Whereas, on the basis of an indent placed by Executive Engineer, PWD (R&B) Constt. Div.–II, Jammu, a notification under section 4(1) was issued by Collector, Land Acquisition (PWD), Jammu vide No. LA/ 1035-43 dated 23–12–2016 for land measuring 12 Marlas and 08 Sirsai situated in Village Top Sherkhanian, Tehsil and District Jammu ;
Whereas, the Collector, Land Acquisition (PWD), Jammu vide No. LA/1184-85 dated 27-01-2017 has reported that the notification issued under section 4(1) of the J&K State Land Acquisition Act was served upon the interested persons for filing objections, if any, to the proposed acquisition, No. 19] The J&K Govt. Gazette, the 9th Aug., 2018/18th Srav., 1940. 417 –––––––––––––––––––––––––––––––––––––––––––––––––––––––– but no objection was received from the land owners/interested persons in the prescribed time period as required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (PWD), Jammu vide number referred to above duly endorsed by Deputy Commissioner, Jammu vide No. DCJ/LA/Top Sherkhanian Road /2017-18/ 1366 dated 30–12–2017, Divisional Commissioner, Jammu vide No. 502/ 3009/Acq/PWD/Top Sherkhanian/Jammu/18/4418-20 dated 06–02–2018 and by Financial Commissioner, Revenue vide No. FC-LS/LA-4612/2018 dated 21–02–2018 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof are given above is required for public purpose viz. for construction of Upper Shiv Nagar road in Village Top Sherkhanian, Tehsil and District Jammu by PW (R&B) Department.
Now, therefore, in pursuance of section 6 of the J&K State Land Acquisition Act, Samvat 1990, it is declared that land measuring 12 Marlas and 08 Sirsai situated in Village Top Sherkhanian, Tehsil and District Jammu, particulars whereof are given above is required for public purpose viz. for construction of Upper Shiv Nagar Road inVillage Top Sherkhanian, Tehsil and District Jammu by PW (R&B) Department. Further, the Collector, Land Acquisition (PWD), Jammu is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the intersted person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/ rightful claimants in accordance with the relevant laws/rules in force, while making the award.

Whereas, Administrative Department vide Notification No. 330-Rev (LAK) of 2017 dated 27-07-2017 has issued declaration under sections 6&7 of the Land Acquisition Act for land measuring 48 Kanals, 05 Marlas and 90 Sft. situated in Village Gundi Khalil, Tehsil Narbal, District Budgam for construction of Semi Ring Road by NHAI ;
Whereas, Divisional Commissioner, Kashmir vide No. Div. Com/LAS- Acq/3827/3686 dated 02-01-2018 has reported that Project Director, NHAI has expressed urgency for completion of land acquisition process for the project.
Now, therefore, in pursuance of section 17 of the Land Acquisition Act, Samvat 1990, it is ordered that on expiry of fifteen days from the publication of the notification under section 9(2) of the said Act, the Collector will take possession of the aforementioned land in Village Gundi Khalil, Tehsil Narbal, District Budgam required for public purpose, subject to fulfillment of the conditions prescribed under section 9(2) and section 17-A of the Land Acquisition Act and Rules 63 of the Land Acquisition Rules.
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/ rightful claimants in accordance with the relevant laws/rules in force, while making the award.

Marketing Companies, and in supersession of previous notifications
issued on the subject by this Directorate and in exercise of the powers
vested in me under clause 2 (B) of Kerosene (Fixation of Ceiling Price)
Order, 1970, I, Nisar Ahmad Wani, Director, Food, Civil Supplies and
Consumer Affairs, Kashmir, hereby revise and refix the sale rate of PDS
SKO at Rs. 28.69 per litre applicable within the Municipal Limits of
Srinagar District for the month of June, 2018. The rate so arrived has been
determined in the manner as indicated in the table below :–

SRO-290.––1n pursuance of section 2 of the Jammu and Kashmir
Delegation of Powers Act, 2018 (Governor's Act No.1 of 2018), the
Governor is pleased to direct that––
(i) in respect of the Departments allocated to Advisors vide
notification SRO-282 of 2018 dated 23rd June, 2018, all the
cases which are required to be submitted to the Cabinet in
terms of Schedule-II of the Jammu and Kashmir Government 2 The J&K Govt. Gazette, 27th June, 2018/6th Asad., 1940. [No. 12-k –––––––––––––––––––––––––––––––––––––––––––––—–––—————
Business Rules shall be submitted by the Administrative
Departments with the approval of the concerned Advisor to
the State Administrative Council through the Chief Secretary ;
(ii) in respect of the Departments allocated to Advisors vide
notification SRO-282 of 2018 dated 23-06-2018, all cases
which are required to be submitted to the Chief Minister in
co-ordination or the Governor in terms of Schedule-III and
Schedule-IV of the Jammu and Kashmir Government Business
Rules shall be submitted by the Administrative Department
concerned with the prior approval of the concerned Advisor to
the Governor through Chief Secretary ;
(iii) cases involving major policy decisions or having substantial
financial implications shall be submitted by the Administrative
Secretary concerned to the Advisor through the Chief
Secretary ;
(iv) the Business relating to the Departments of General
Administration, Civil Aviation, Hospitality and Protocol,
Estates and Information shall be submitted by the concerned
Administrative Secretaries to the Advisors through Chief
Secretary till further orders ; and
(v) the powers already delegated to the Administrative
Secretaries as notified vide notification SRO-281 of 2018
dated 23-06-2018, shall continue to be exercised by them.

SRO-292.––In exercise of the powers conferred by section 29 of the
Jammu and Kashmir School Education Act, 2002, the Government hereby
makes the following amendments in the Jammu and Kashmir School
Education Rules, 2010, namely :––
1. In rule 4.––
I. In sub-rule (2), clauses (c) and (d) shall be omitted ;

II. After sub-rule (2), the following shall be added as
sub-rule 2-A :––
"2A. The application shall be accompanied by the following
Safety Certificates, namely :––
(a) School building safety certificate to be issued by
PWD ;
(b) Fire Safety Certificate to be issued by J&K Fire
and Emergency Department ;
(c) Chemical Lab Safety Certificate from concerned
SDM".
III. In sub-rule (3), for clauses (a) and (b), the following clauses
shall be substituted :––
(a) After receipt of the application, the competent authority
or any official/s authorized by him for the purpose shall,
within 15 days from the receipt of the application refer
the matter for spot inspection of the said institution, or
for examination of the project/proposal (as the case may
be) vis-a-vis the norms of infrastructure, equipment, staff
and other requirements, as laid down under rules 5, 6
and 11 of these rules, to the committees comprising
following officers/officials, namely :––

(b) Inspection procedure.––The following procedure shall be followed for inspection of the institutes, namely :––
(a) Application for affiliation/recognition as per devised proforma, complete in all respects shall be submitted online on JKBOSE, website.
(b) JKBOSE shall constitute an inspection committee
within 10 days of receipt of application.
(c) In case of any deficiency, JKBOSE shall communicate the same to the applicant within 7 days, otherwise it shall be presumed fit for inspection.
(d) As and when, applicant informs the fulfillment of deficiency, the inspection team shall be constituted within 10 days for conduct of inspection.
(e) The inspection committee shall submit its report within a period of 15 days from the date of appointment.
(f) The competent authority shall examine the report so received and take final decision thereon within 30 days and convey the same to the educational agency.

(g) The total time involved would be a maximum of 75
days.
(h) Affiliation/Recognition Committee shall meet
every 3rd Monday of the month. In case the
earmarked day is a holiday, the meeting shall be
held on next working day.
(i) All cases for affiliation/recognition shall be submitted
in respect of both Kashmir/Jammu province three
months prior to the commencement of session.
(j) No provisional approvals shall be granted.
(k) Minutes of affiliation committee meeting shall be
framed by JKBOSE and shall be submitted to
Administrative Department along with Draft
Affiliation/Recognition order for approval and the
same shall be returned to JKBOSE for issuing
affiliation/recognition order.
(l) Affiliation/Recognition orders shall be for a
period of five years in view of Govt. Order
No. 385-Edu of 2016 dated 05-10-2016.
(m) The entire revised procedure shall be made available
online.
(n) The concerned Committee shall submit the
report to "Competent Authority" within a period of
30 days from the date of his appointment.
IV. After rule (4), the following shall be added as rule 4-A,
namely :––
"(4-A) Monitoring of ETT Institutes.––(1) The inspection
of ETT Institutes shall be undertaken as per the said rules at
the beginning of each session.

(2) For regular monitoring of ETT/NTT Institutes, there
shall be due involvement of the District Administration for
which a committee of following officers shall be made :––
(a) Officer not less than the rank of SDM to be deputed
by District Magistrate concerned ;
(b) Principal of a Higher Secondary School ;
(c) Deputy Secretary/Assistant Secretary, JKBOSE.
(3) The committee shall undertake quarterly inspections from
the date of onset of session and besides looking into the
infrastructural issues shall also monitor the admission process,
residential status/physical presence of candidates, regular
attendance of students and teaching-learning process.
(4) In order to streamline the affiliation/recognition process,
application for upgradation/extension in affiliation/recognition
from class 9th to 12th be submitted in the office of JKBOSE
and fee deposited there only. The JKBOSE shall organize
inspections by the respective committees constituted for the
purpose. Joint inspection report shall be placed before the
affiliation/recognition committee for perusal and approval,
wherever deemed proper. Further affiliation/recognition
process shall be co-terminus with each other. However, mere
filing of an application before the competent authority shall
not confer any right in itself to run a school."
2. In rule 5, the following shall be added as sub-rule (2),
namely :––
"The power to approve the composition of Managing Committee
shall rest with the concerned Director, School Education with
respect to all schools running up to class 12th. However, any
change in the management body shall be done by the concerned

Director, School Education within a period of 90 days, it shall be
deemed as confirmed."
3. In sub-rule (1) of rule 6 under the heading Physical
Facilities.––
(I) In clause (a).––
(i) in sub-clause (i), for the numbers and words "1-2 Sq. Mt.", the number and words "1 Sq. Mt." shall be substituted.
(ii) sub-clause (v) shall be substituted by the following :––
"One staff room a minimum of 300 Sq. ft."
(II) In clause (b).––
(i) in sub-clause (i) for the numbers and words "1 -2 Sq. Mt.", the number and words "1 Sq. Mt." shall be substituted.
(ii) sub-clause (v) shall be substituted by the following :––
"One Principals room and one staff room with a minimum of 300 Sq ft. each".
(III) In clause (c).––

4. In clause (e) of sub-rule (II) of rule 6.––
i. In sub-clause (i), for the word "Graduate" the words

iii. In sub-clause (iii), for the word "Graduate", the word
"Post Graduate" shall be substituted.
iv. Sub-clause (iv) shall be re-casted as under :––
"One Post Graduate in English literature or in Functional

Parents Coordination Committee members as and when Managing
Committee convenes any meeting w.r.t. change in Fee structure,
infrastructure, upgradation and any other matter of concern for
parents."
6. after rule 11, the following rules shall be added as rules, 12,
13 and 14.––
12. De-Recognition.––(1) The Government may de-recognize
any school, if in its opinion ; the functioning of such a
school is not in accordance with the provisions of these
rules :
Provided that no such order shall be passed by the
Government unless reasonable opportunity is provided to
the educational agency in this regard.

13. Website.––Every school is required to maintain a website
and ensure disclosure of information to general public under
the provisions of Jammu and Kashmir Right to Information
Act, 2009.
14. Appeal.––(1) Any person aggrieved of any decision taken
under these rules shall file an appeal before the Minister
Incharge, whose decision thereon shall be final and binding.
(2) Such appeal shall be filed within a period of 60 days
from the date of passing of the order to be challenged.

SRO-303.––In exercise of the powers conferred by section 164
of the Jammu and Kashmir Goods and Services Tax Act, 2017
(Act No. V of 2017), the State Government, on the recommendations of
the Council hereby make the following rules further to amend the Jammu
and Kashmir Goods and Services Tax Rules, 2017, namely :––
(i) in rule 58, after sub-rule (1), the following sub-rule shall be
inserted, namely :––
"(1A) For the purposes of Chapter XVI of these rules, a
transporter who is registered in more than one State or Union 2 The J&K Govt. Gazette, 10th July, 2018/19th Asad., 1940. [No. 14-g –––––––––––––––––––––––––––––––––––––––––––––—–––—————
Territory having the same Permanent Account Number, may
apply for a unique common enrollment number by submitting
the details in FORM GST ENR-02 using any one of his Goods
and Services Tax Identification Numbers, and upon validation
of the details furnished, a unique common enrolment number
shall be generated and communicated to the said transporter :
Provided that where the said transporter has obtained a unique
common enrollment number, he shall not be eligible to use any
of the Goods and Services Tax Identification Numbers for the
purposes of the said Chapter XVI." ;
(ii) in rule 138C, after sub-rule (1), the following proviso shall be
inserted, namely :––
"Provided that where the circumstances so warrant, the
Commissioner, or any other officer authorised by him, may,
on sufficient cause being shown, extend the time for recording
of the final report in Part B of FORM EWB-03, for a further
period not exceeding three days.
Explanation :––The period of twenty four hours or, as the
case may be, three days shall be counted from
the midnight of the date on which the vehicle
was intercepted." ;
(iii) in rule 142, in sub-rule (5), after the words and figures
"of section 76", the words and figures "or section 129 or
section 130" shall be inserted ;

recommendations of the J&K Services Selection
Board.
II (E) :
"Every transfer proposal shall be processed in
accordance with the provisions of the Jammu and
Kashmir Government Business Rules and Transfer
Policy notified vide Government Order No. 861-GAD
of 2010 dated 28-07-2010.
Further all proposals relating to powers of transfer,
which are presently delegated in the Transfer Policy
at item No. I, II, III, IV and V, shall be submitted to
Administrative Department for decision."
