Whereas , the Collector, Land Acquisition (ACR ) , Pulwama vide No. DCP / LA / 2017/ 1109-13 dated 23-11-2017 has reported that the notification issued under section 4( 1 ) of the J & K State Land Acquisition Actby him was served upon the interested persons for filing objections , if any, to the proposed acquisition , but no objection was received from the land owners/ interested persons within the prescribed period as required under sections 5 & 5 - A of the Land Acquisition Act ;
Whereas , the report furnished by Collector , Land Acquisition (ACR) , Pulwama vide No. referred above duly endorsed by Deputy Commissioner , Pulwama vide No. DCP/LA/ 2017/ 1157-60 dated 13-12- 2017 , Divisional Commissioner , Kashmir vide No. Div. Com/LAS - Acq/ 3064/3772 dated 15-01-2018 and by Financial Commissioner, Revenue vide No. FC - LS /LA - 4608/2018 dated 30-01-2018 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Whereas , the Government is satisfied that the land particulars whereof are given in " Annexure - A" to this notification is required for public purpose viz . for construction of Corridor to Islamic University of Science and Technology in Village and Tehsil Awantipora , District Pulwama.
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990, it is declared that land measuring 13 Kanals , 19 Marlas & 07 Sirsai , situated in Village and Tehsil Awantipora , District Pulwama, particulars whereof are given in " Annexure A " to this notification is required for public purposes viz . for construction of Corridor to Islamic University of Science and Technology in Village and Tehsil Awantipora , District Pulwama . Further , the Collector, Land Acquisition (ACR ) , Pulwama is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the intersted person( s ) as required under the Land Acquisition Act/Rules .

An Act to amend the Jammu and Kashmir Panchayati Raj Act , 1989 .

In exercise of the powers vested under Proclamation No. P - 1 / 18 of 2018 dated 20th June , 2018 , the Governor is pleased to enact as follows : -
1. Short title and commencement.- ( 1 ) This Act may be called the Jammu and Kashmir Panchayati Raj (Second Amendment) Act , 2018 .
(2) It shall come into force from the date of its publication in the Government Gazette .
2. Amendment of section 4 , Act No. IX of 1989. In section 4 of the Jammu and Kashmir Panchayati Raj Act , 1989 , ( hereinafter referred as ' the principal Act ' ) , in sub - section (3 ) , for the words " including the Sarpanch " , the words " excluding the Sarpanch " shall be substituted .
3. Amendment of section 12, Act No. IX of 1989. In section 12 of the 'principal Act ' in sub - section ( 1 ) , in clause (i) , for the words ' Halqa ' , the words , "Halqa in consultation with Halqa Majlis " shall be substituted .
4. Amendment of section 15, Act No. IX of 1989. In section 15 of the 'principal Act ' , after proviso thereto , the following proviso shall be inserted : -
"Provided further that in the absence of Halqa Panchayat , the concerned Block Development Officer shall be empowered to collect the fees / taxes already imposed by the Halqa Panchayat" .
5. Amendment of section 52, Act No. IX of 1989. In section 52 of the ' principal Act ' , in sub - sections ( 1 ) and (2) , for the word ' Government' , the words ' Government or any other officer specially empowered or authorized in this behalf ' shall be substituted .

(AMENDMENT) ACT, 2018 .

An Act to amend the Jammu and Kashmir Municipal Corporation Act, 2000 .
In exercise of the powers vested under Proclamation No. P- 1 / 18 of 2018 dated 20th June, 2018 , the Governor is pleased to enact as follows :-
1. Short title and commencement . ( 1 ) This Act may be called the Jammu and Kashmir Municipal Corporation (Amendment) Act, 2018 .
(2) It shall come into force with effect from 3rd April , 2018 .
2. Amendment in section 31 , Act No. XXI of 2000. In section 31 of the Jammu and Kashmir Municipal Corporation Act , 2000 , in sub- section ( 1 ) , —
I. after clause ( vi ) , the following clause shall be inserted , namely:-
" (vi - a) the manner of giving and recording of votes by means ofvoting machines and the procedure as to voting to be followed at polling stations where such machines are used " ;
II . after clause ( viii ) , the following clause shall be added , namely :-
" ( viii - a) the procedure as to counting of votes recorded by means of voting machines " ;
III. for clause ( ix) the following clause shall be substituted , namely:-
" ( ix) the custody of voting machines and disposal of papers relating to elections " ;
IV. for clause ( xi) the following clause shall be substituted , namely:-
"( xi ) the holding of fresh poll in case of destruction of, or tampering with ballot boxes or voting machines , or mechanical failure of voting machines , before the count . "
3. Repeal and Savings . ( 1 ) The Jammu and Kashmir Municipal Corporation (Amendment ) Act , 2016 (Governor's Act No. IV of 2016) stands repealed.

(2) Notwithstanding any such repeal , anything done or any action taken under the provisions of the aforesaid repealed Act shall be deemed to have taken under the provisions of this Act.

It is reiterated that all unrecognized political parties registered with the Election Commission of India shall be treated as registered parties for the purpose ofMunicipal Elections . It is further clarified that candidates sponsored by all those political parties which have been recognized by the Election Commission of India as State Parties in States other than J & K would be treated as candidates sponsored by unrecognized political parties for the purpose of allotment of symbols .
