PMGSY (JKRRDA), Jammu, vide No. CEJ/PMGSY/19190-92 dated 20–11–2017, a notification under section 4(1) was issued by Collector, Land Acquisition (ACR), Kishtwar vide No. ACR/LA/2017/397-403 dated 29–11–2017, for land measuring 70 Kanals and 04½ Marlas situated in Village Tatani, Tehsil Drabshalla, District Kishtwar ;

[No. 26 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Whereas, the Collector, Land Acquisition (ACR), Kishtwar vide No. ACR/LA/2017/2846-50 dated 04–01–2018 has reported that the notification issued under section 4(1) of the J&K State Land Acquisition Act was served upon the interested persons for filing objections, if any, to the proposed acquisition, but no objection was received from the land owners/interested persons within the prescribed period as required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (ACR), Kishtwar vide above referred letter duly endorsed by District Collector (DC), Kishtwar, vide No. DCK/LA/2017/872-75 dated 07–02–2018 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof are given above is required for public purpose viz. construction/widening of link road from Chalasoo to Tatani situated in Village Tatani, Tehsil Drabshalla, District Kishtwar.
Now, therefore, in pursuance of section 6 of the J&K State Land Acquisition Act, Samvat 1990, it is declared that land measuring 70 Kanals and 04½ Marlas situated in Village Tatani, Tehsil Drabshalla, District Kishtwar, particulars whereof are given above, is required for public purpose viz. for construction/widening of link road from Chalasoo to Tatani situated in Village Tatani, Tehsil Drabshalla, District Kishtwar. Further, the Collector, Land Acquisition (ACR), Kishtwar is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person(s) as required under the Land Acquisition Act/Rules.
Further, in pursuance of section 17 of the Land Acquisition Act, Samvat 1990, it is also ordered that on expiry of fifteen days from the publication of the notification under Section 9 (2) of the said Act, the Collector will take possession of the aforementioned land in Village Tatani, Tehsil Drabshalla, District Kishtwar, required for public purposes, subject the fulfillment of the conditions prescribed under Section 9(2) and Section 17–A of the Land Acquisition Act and Rule 63 of the Land Acquisition Rules.

material within seven days from the date of the acceptance of the

paid.
6. GST as applicable under rules shall be charged on the auction

SRO-339.––In exercise of the powers conferred by proviso to section 124 of the Constitution of Jammu and Kashmir, the Government hereby makes the following amendments in the Jammu and Kashmir Economics and Statistical Training Rules, 1975, namely :––
1. sub-rule (e) of rule 2 shall be substituted by the
following :––
"Controller of Examination" means Controller of
Examination of Jammu and Kashmir Public Service
Commission ;

workers registered under Building and Other Construction Workers
(Regulation of Employment and Conditions of Service) Act, 1996,

Act, 2008.

SRO-343.––Whereas, on 25-02-2018, Police Station, Chari-e-Sharief
received an information through reliable sources that some
unknown gunman fired upon Selection Grade Constable, Kultar Singh
No. 441/AP-13th Bn, deployed for guard duty at the Shrine of Sheikh
Noor-ud-Din Noorani (RA) at Chari-e-Sharief, with the intension to kill 2 The J&K Govt. Gazette, 11th Aug., 2018/20th Srav., 1940. [No. 19-e –––––––––––––––––––––––––––––––––––––––––––––—–––————— him and snatch his service rifle and in the incident the said constable got
injured seriously ; and
2. Whereas, in this connection, a case FIR No. 06/2018 under
section 392, 7/27, Arms Act, 1959 came to be registered in the Police
Station, Chari-e-Sharief ; and
3. Whereas, during the course of investigation, Investigating Agency
visited the spot and took the injured constable to hospital for treatment.
The Investigating Officer (I. O.) prepared injury memo/site plan and
recorded the statements of witnesses. The injured SG Constable after
being given the first aid at SDH, Chari-e-Sharief, was referred to 92-Base
Army Hospital, Badamibagh, Srinagar for specialized treatment. However,
he succumbed to his injuries and, accordingly, section 302 RPC was added
in the case ; and
4. Whereas, during further investigation, empty cartridges recovered
on the spot and the clothes of the deceased were sent to FSL, Jammu/
Srinagar for expert analysis and opinion. Besides, a Maruti Eco Van
bearing Registration No. JK13C-5191 was found unattended and parked
at Talab-e-Kalan, Chari-e-Sharief opposite to Yatri Nivas in a suspicious
manner without number plate in the front and a moulded number plate at
the rear of the vehicle which was accordingly seized. On ascertaining the
particulars of the owner of the said vehicle, the driver namely Umar
Farooq Mir S/o Farooq Ahmad Mir R/o Kawoosaibagh, Kakapora was
arrested who revealed that on the day of occurrence, he along with other
five accused persons namely 1. Tawheed Basheer Rather S/o Bashir
Ahmad Rather R/o Laterbal, Pampore, 2. Mudasir Ahmad Wani S/o
Gulzar Ahmad Wani R/o Laterbal, Pampore, 3. Imran Feroz Khan S/o
Feroz Ahmad Khan R/o Hassan Wani, Pulwama, 4. Shahid Khursheed
Rather S/o Khursheed Ahmad Rather R/o Zagigam, Rajpora, Pulwama
and 5. Shahid Mushtaq Baba S/o Mushtaq Ahmad Baba R/o Drabgam,
Pulwama hatched conspiracy near Government Degree College, Pulwama
and boarded the same vehicle. They also removed the front number plate
of the vehicle and moulded the rear number plate near Eidgah, Gadoora,
whileas, the accused No. 4 was driving his own motor cycle (Hero Honda) No. 19-e] The J&K Govt. Gazette, 11th Aug., 2018/20th Srav., 1940. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— Splender without registration number and left for Chari-e-Sharief to execute
their plan. On reaching Chari-e-Sharief, the accused persons parked the
vehicle and Motor Cycle alongside the road and entered into the premises of Shrine from the main gate and executed the plan by firing on the sentry Sgct. Kultar Singh at rear bunker by a pistol, snatched his SLR rifle and fled from the spot ; and
5. Whereas, in the course of investigation, it was also found that the
accused persons were affiliated with Terrorist Organization namely JeM outfit as such sections 16, 18 and 20 ULA (P) Act, 1967 were also added in the case ; and
6. Whereas, during further course of investigation, the CDR of the accused persons were obtained, which indicated that on the day of occurance
all the accused persons had come to Chari-e-Sharief together for execution of their plan. The CCTV footage from Petrol Pump, Zaloosa, Chari-e-Sharief, where the accused persons have filled fuel in their vehicles, was also obtained which has been preserved in a pen drive and sealed in presence of Executive Magistrate. Both the vehicles were seized. Statements of some witnesses were recorded before the Magistrate under
section 164-A Cr. P. C. and proceedings for forfeiture of vehicle Maruti Eco van bearing No. JK13C-5191 were initiated and the matter in this regard is pending with the Competent Authority ; and
7. Whereas, the identification parade of the accused persons was also conducted in presence of the Executive Magistrate, 1st Class,
Chari-e-Sharief. All the accused persons except one accused namely Shahid Mushtaq Baba S/o Mushtaq Ahmad Baba R/o Drabgam, Pulwama (who is still active militant of JeM outfit and is absconding with snatched SLR rifle) have been arrested. Further, on the basis of the birth certificate, one of the accused namely, Shahid Khursheed Rather S/o Khursheed Ahmad Rather R/o Zagigam, Rajpora, Pulwama was found to be a Juvenile as
such, was lodged in Juvenile Home, Harwan, Srinagar. However, he stands bailed out by the Hon'ble Court ; and
8. Whereas, during the course of investigation, 08 mobile phones were recovered from the accused and have been sent to CFSL, Chandigarh
for expert analysis and the report in this regard is awaited ; and 4 The J&K Govt. Gazette, 11th Aug., 2018/20th Srav., 1940. [No. 19-e –––––––––––––––––––––––––––––––––––––––––––––—–––————— 9. Whereas, the investigation of the case has finally been concluded
as challan under sections 302, 392, 120-B RPC, 7/27 A. Act and sections
16, 18, 20 ULA (P) Act against accused persons ; and
10. Whereas, the authority appointed by the State Government under
sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,
1967, has independently scrutinized the Case Diary (CD) file and all the
other relevant documents relating to the case and has come to a definite
conclusion that this is a fit case for accord of sanction for launching
prosecution against the accused persons in terms of the relevant provisions
of the Unlawful Activities (Prevention) Act, 1967 ; and
11. Whereas, after perusing the Case Diary, the relevant documents
and also taking into consideration the observations/views of the Authority
appointed under sub-section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967, the State Government is of the view that there
is sufficient material and evidence available against the accused persons for
their prosecution under the aforesaid provisions of law.
12. Now, therefore, in exercise of powers conferred by
sub-section (2) of section 45 of the Unlawful Activities (Prevention)
Act, 1967, the State Government hereby accords sanction for launching
prosecution against the below mentioned accused for the commission of
offences punishable under sections 16, 18 and 20 of the Unlawful Activities
(Prevention) Act, arising out of FIR No. 06/2018 in Police Station,
Chari-e-Sharief :––

of 1936), the Government of Jammu and Kashmir hereby intends to make
following amendments, namely :––
1. The returns to be filed by unit holders/owners/employers/
occupiers, wherever, required under the rules framed in
pursuance to aforesaid Acts, shall be substituted by the Single
Combined, Consolidated Annual Return Form, forming
Annexure "A" to this notification.
2. Consequent upon this, the rules and related forms forming
Annexure "B" to this notification shall stand omitted from the
respective rules.
Now, it is hereby notified that any person(s) who desire(s) to object
to the aforementioned amendments, may submit his/her objections/
suggestions, in writing for consideration to the Principal Secretary to the
Government, Labour and Employment Department within a period of 30
days from the date of issuance of this notification.

and Specified Wakaf Properties (Management and Regulation) Act, 2004.
In exercise of the powers vested under Proclamation No. P-1/18 of 2018
dated 20th June, 2018, the Governor is pleased to enact as follows :––
1. Short title and commencement.––(1) This Act may be called the
Jammu and Kashmir Muslim Specified Wakafs and Specified Wakaf Properties
(Management and Regulation) (Amendment) Act, 2018.
(2) It shall come into force from the date of its publication in the
Government Gazette.
2. Amendment in section 6, Act No. VIII of 2004.––In section 6
of the Jammu and Kashmir Muslim Specified Wakafs and Specified Wakaf
Properties (Management and Regulation) Act, 2004, after sub-section (2), the
following proviso shall be added, namely :–––
"Provided that during the continuation of Proclamation issued under
section 92 of the Constitution of Jammu and Kashmir or Article 356
of the Constitution of India as applicable to the State, the Board shall
be headed by the Governor who shall be its ex-officio Chairman and
if he happens to be a Non-Muslim, he may appoint any eminent
Muslim, including from amongst his Advisors in the State, to be the
Chairman."
