Whereas , the land specifications whereof is given in " Annexure- A " to this notification is required for public purpose viz . for construction of an approach road ( RHS ) from Bridge over River Tawi at Sangarh to Nagola KM 1st RD - o to 1000 and KM 2nd RD - 460 in Village Nagola , Tehsil Dansal , District Jammu by PW ( R & B ) Department ;
Whereas , on the basis of an indent placed by Executive Engineer , PW ( R & B ) Const . Division II , Jammu vide 6907-10 dated 06-03-2015 , a notification under section 4 ( 1 ) was issued by Collector , Land 960 The J& K Govt . Gazette , 16th Nov. , 2017/25th Kart . , 1939. [ No. 33
Acquisition ( PWD ) , Jammu vide No. LA/ 636-44 dated 16-09-2016 for land measuring 12 Kanals 09 Marlas and 4½ Sirsai , followed by another notification vide No. LA/721-29 dated 29-09-2016 for land measuring 22 Kanals 14 Marlas and 4½ Sirsai thus making the total quantum of land to 34 Kanals and 14 Marlas situated in Village "Nagola " , Tehsil Dansal , District Jammu ;
Whereas , the Collector Land Acquisition ( PWD ) , Jammu vide letter No. LA/ 764-67 dated 28-10-2016 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act by him was served upon the interested persons for filing objections , if any , to the proposed acquisition , but no objection was received from the land owners / interested persons in the prescribed time period as required under sections 5 & 5 - A of Land Acquisition Act ; and
Whereas , the report furnished by Collector, Land Acquisition (PWD) , Jammu vide letter referred to above duly endorsed by Deputy Commissioner, Jammu vide No. DCJ / LA/ PWD /Nagola/ 6 & 7 / 2016-17/ 1185-86 dated 01-12-2016 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Whereas , the Government is satisfied that the land particulars whereof mentioned in " Annexure- A " to this notification is required for public purpose viz . for construction of an approach road ( RHS ) from Bridge over River Tawi at Sangarh to Nagola KM 1st RD - o to 1000 and KM 2nd RD - 460 in Village Nagola , Tehsil Dansal , District Jammu by PW ( R & B ) Department .
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 34 Kanals and 14 Marlas situated in Village "Nagola " , Tehsil Dansal , District Jammu particulars whereof are given in " Annexure - A " to this notification is required for public purposes viz . construction of approach road ( RHS ) from Bridge over River Tawi at Sangarh to Nagola KM 1st RD - o to 1000 and KM 2nd RD - 460 in Village Nagola , Tehsil Dansal , District Jammu by PW( R & B ) Department. Further , the Collector , Land No. 33 ] The J & K Govt . Gazette , 16th Nov. , 2017/ 25th Kart . , 1939. 961
Acquisition ( PWD) , Jammu is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person( s) as required under the Land Acquisition Act/Rules .
However , the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the intersted persons /rightful claimants in accordance with the relevant laws /rules in force , while making the award .

Notification No. 232 - Rev ( LAJ) of 2017
Dated 25-05-2017 .
Whereas , the land , specifications whereof are given in " Annexure- A " to this notification is required for public purpose viz . for construction of Banihal - Mangit road in Village Khari Tehsil Banihal District Ramban ;
Whereas , on the basis of indent prepared by Executive Engineer, PMGSY Div - Ramban vide No. PMGSY / D / R/ 1454-56 dated 29-10-2007 , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (ACR) , Ramban vide No. ACR/ PMGSY / 706-14 dated 08-09-2012 for land measuring 181 Kanals and 12½ Marlas situated at Village Khari , Tehsil Banihal , District Ramban ;
Whereas , declaration under sections 6 & 7 of the Land Acquisition Act was issued vide notification No. 10 RD of 2013 dated 06-03-2013 ;

Whereas , the tentative award so issued was submitted to the Divisional Commissioner , Jammu for approval of rates in 2014. The acquisition proceeding could not be completed within the statutory period of two years for want of approval of rates and the proceesings thus lapsed under section 11 - B of the Act ;
Whereas , a fresh notification was issued by the Collector , Land Acquisition ( ACR ) , Ramban under section 4 ( 1 ) of the Land Acquisition Act vide No. Acq/PMGSY/ 16/ 337-47 dated 16-09-2016 for the land in question on the advice of the Financial Commissioners Revenue conveyed vide No. FC - LS - LA/4285 / 2012 dated 12-08-2015 ;
Whereas , the Collector Land Acquisition (ACR ) , Ramban vide his No. Acq / PMGSY/ 16/ 337-47 dated 16-09-2016 has issued fresh notification under section 4 ( 1 ) of the Land Acquisition Act . The acquisition proceeding initiated earlier could not be completed within the statutory period of two years which lapsed in terms of section 11 - B of the said Act ;
Whereas , the Collector , Land Acquisition ( ACR ) , Ramban vide No. Acq/PMGSY/ 2016-17 / 601-04 dated 16-01-2017 has reported that the fresh notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act by him was served upon the interested persons for filing objections , if any, to the proposed acquisition , but no objection was received from the land owners / interested persons in the prescribed time period as required under sections 5 & 5 - A of Land Acquisition Act ;
Whereas , the report furnished by Collector, Land Acquisition ( ACR) , Ramban vide above referred letter duly endorsed by DC , Ramban vide DC/ LA/ Rbn/291-20 dated 30-01-2016 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ; and
Whereas , the acquisition proceedings already initiated lapsed , having not been completed during the stipulated period of two years as required under section 11 - B of the Land Acquisition Act , thereby necessitating conducting of denovo proceedings ;

Whereas , the Government is satisfied that the land particulars whereof are given in " Annexure- A" is required for public purpose viz . for construction of Banihal - Mangit Road in Village Khari , Tehsil , Banihal , District Ramban .
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 181 Kanals and 12½ Marlas situated at Village Khari , Tehsil Banihal , District Ramban , particulars whereof are given in " Annexure - A " is required for public purposes viz . for construction of Banihal- Mangit Road under PMGSY. Further , the Collector, Land Acquisition (ACR ) , Ramban is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person (s ) as required under the Land Acquisition Act/Rules .
Further, in pursuance of section 17 of the Land Acquisition Act , Samvat 1990 , it is also ordered that on expiry of fifteen days from the publication of the notification under section 9 ( 2 ) of the said Act , the Collector will take possession of the aforementioned land in Village Khari , Tehsil Banihal , District Ramban required for public purposes subject to fulfillment of the conditions prescribed under section 9 (2 ) and section 17 - A of the Land Acquisition Act and rule 63 of the Land Acquisition Rules .

SRO - 340.-Whereas , on 18-02-2006 one Muhammad Abdullah Deka S/ o Ab . Rahim Deka R/ o Daksum , Kokernag lodged a written report in Police Station , Kothibagh to the effect that his younger brother , namely, Nazir Ahmad Deka , who was selling skull caps/perfumes near Biscoe School , Lal Chowk , Srinagar is missing since 16-02-2006 .

On 22-06-2006 , another report was received from said Muhammad Abdullah Deka stating therein that his brother Nazir Ahmad Deka has been abducted by some unknown persons who were boarded in a white colour Gypsy , near Biscoe School , Srinagar with the intention to kill him ; and
Whereas , in this connection , case FIR No. 62/2006 , under sections 302 , 364, 201 , 120 - B RPC was registered in Police Station , Kothi Bagh , Srinagar and investigation initiated ; and
Whereas , during the course of investigation , in a similar nature case , bearing No. 06/2007 of P/ S Batamaloo , it came to surface that Police Personnel of SOG, Ganderbal boarded in a white colour Gypsy had lifted the Nazir Ahmed Deka from Lal Chowk near Biscoe School and after hatching criminal conspiracy, killed him in a planned fake encounter at Yachnar Badergund , Ganderbal , which was dramatized on 16/ 17-02-2006 , jointly by SOG, Ganderbal and 5 RR ; and
Whereas , on 17-02-2006 , accused namely Mukhand Raj Guru, Capt./ Adjutant 05 RR Army Unit lodged a complaint in Police Station, Ganderbal , stating therein that an unidentified militant has been killed during an encounter . Accordingly, a case FIR No. 17/2006, under section 307 RPC and section 7/25 Arms Act, 1959 was registered in Police Station , Ganderbal regarding the said incident reported by said accused . However , the said FIR was investigated upon by SIT ( Special Investigation Team) and the claim of accused was found false and a fabricated one . The investigation was closed as "Not Admitted " on merits ; and
Whereas , during the course of investigation , on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused persons under sections 302, 364, 201 , 120 - B of Ranbir Penal Code against the accused persons ; and Whereas , the appointing authority of Bahadur Ram Keth ( Dy . SP ) and Hansraj Parihar ( SSP) is the Government in the Home Department and the offence has been committed by the accused persons in connivance
with other accused, while acting or purporting to act in discharge of their No. 20 - c ] The J& K Govt . Gazette , 21st Aug. , 2017/30th Srav. , 1939. 3 duties and to prosecute them , sanction under section 197 ( 1 ) of the Code of Criminal Procedure , Samvat 1989 is mandatory ; and
Now, therefore , in exercise of powers conferred by sub - section ( 1 ) of section 197 of the Code of Criminal Procedure , Samvat 1989 , the State Government hereby accord sanction for launching prosecution against the below mentioned accused persons for the commission of offence punishable under sections 302 , 364 , 201 , 120 - B of Ranbir Penal Code , arising out of FIR No. 62/2006 of Police Station, Kothi Bagh , Srinagar :-
1. Bahadur Ram Keth then ( Dy . SP) S/ o Milky Ram R/ o Bishna , Jammu .
2. Hansraj Parihar S/ o Bao Chand R/ o Pamlaur , Kishtwar the then SSP, Ganderbal .

SRO - 343 . In exercise of the powers conferred by clause ( b ) of sub - section ( 2) of section 65 of the Motor Vehicles Act , 1988 (Central Act No. 59 of 1988 ) , the Government of Jammu and Kashmir intends to make the following amendments in Rule 41 of the Jammu and Kashmir Motor Vehicles Rules , 1991 , namely :-
( i) sub - rule appended to Rule 41 shall be numbered as ( 1 ) ;

(ii) after sub- rule ( 1) , the following shall be added as sub- rule ( 2 ) :-
" (2) For the purpose of registration of non - transport vehicles on first sale under sub - sections (3) , (5) and ( 6) of section 41 of the Motor Vehicles Act , 1988 from a dealer holding valid trade certificates , the Government may empower any dealer or his authorized person having sufficient experience and administrative knowledge as Registering Authority, subject to the terms and conditions that may be specified from time to time" .
Now , therefore , the aforesaid proposed amendment is hereby published as required under sub - section ( 1 ) of section 212 of the Motor Vehicles Act , 1988 , for information of all persons likely to be effected thereby.
Any person who desires to object to the aforesaid proposal / amendment may submit his /her objections / suggestions for consideration in writing to the Commissioner/ Secretary to Government , Transport Department , Civil Secretariat , Srinagar within a period of one month from the date of issuance of this notification .
Any objection /suggestion received after the expiry of the prescribed date shall not be entertained .

SRO - 344.-Whereas , on 16-01-2015 , Police Station , Tarzoo received a written report from Inspector , Dilraj Singh of Police Component , Sopore , to the effect that Police Component , Sopore , received an information through reliable sources that one Farooq Ahmad Bhat ( Sarpanch , Choora) S/o Late Abdul Jabbar Bhat R/ o Choora is providing logistic support/ shelter to the militants of LeT outfit . On receiving this information, the house of said Farooq Ahmad Bhat was cordoned off by Police of Sopore , 2 The J& K Govt . Gazette , 23rd Aug. , 2017/ 1st Bhad. , 1939. [No. 20- g
along with 52 RR and 177 Bn. CRPF. During search , one foreign militant identified as Zubair Ahmad Mughal @ Ameer Maviya S / o Abdul Rashid R/ o Gulshan Iqbal , Karachi , Pakistan , was apprehended in the said house along with arms and ammunition and Farooq Ahmad Bhat was also nabbed for being abettor of the foreigner militant ; and
Whereas , with regard to the aforementioned incident , a case FIR No. 14/2015 under section 7/25 Arms Act, 14 Foreigners Act and sections 13 , 19 , 20 of Unlawful Activities (Prevention) Act , 1967 was registered in Police Station , Tarzoo and the investigation was initiated ; and
Whereas , during the course of investigation , on the basis of statements recorded under section 161 and 164- A of Cr. P. C. and based on the circumstantial and documentary evidence , the Investigating Officer has established a prima facie case for offences under section 7/25 Arms Act , section 14 Foreigners Act and sections 13 and 20 of Unlawful Activities (Prevention) Act , 1967 against Zubair Ahmad Mughal @ Ameer Maviya S/ o Abdul Rashid Mughal R/ o Gulshan Iqbal , Karachi , Pakistan , being a foreigner militant and member of LeT outfit for offences under sections 13 and 19 of Unlawful Activities ( Prevention) Act , 1967 against Farooq Ahmad Bhat S/ o Abdul Jabbar Bhat R/ o Choora ; and for offences under section 13 of Unlawful Activities ( Prevention) Act, 1967 against Mohammad Ashraf Mir S/ o Ghulam Ahmad Mir R/ o Chanpora , Athoora and Mohammad Yousuf Najar S /o Mohammad Munawar Najar R/ o Chanpora , Athoora ; and
Whereas , the "Authorities " appointed by the State Government under sub - section ( 2 ) of section 45 of the Unlawful Activities (Prevention) Act, 1967 have independently scrutinized the Case Diary file and all other relevant documents relating to the case and have come to a conclusion that a prima facie case is made out against the accused persons namely Zubair Ahmad Mughal @ Ameer Maviya, PAK militant , 2. Whereas , after perusing the Case Diary , the relevant documents
and also taking into consideration the observations/ views of the Authorities
appointed under sub - section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967 , the State Government is of the view that there
is sufficient material and evidence available against the accused persons
for their prosecution under the aforesaid provisions of law ; and Now , therefore , in exercise of powers conferred by sub - section ( 1) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government hereby accord sanction for launching prosecution against the below mentioned accused :-
1. Zubair Ahmad Mughal @ Ameer Maviya S / o Abdul Rashid Mughal R/ o Gulshan Iqbal , Karachi , Pakistan ( LeT ) PAK militant for the commission of offences punishable under sections 13 and 20 of Unlawful Activities ( Prevention ) Act , 1967.

SRO - 346.- Whereas , on 07-04-2014 , Police Station , Kralpora received an information through a reliable source to the effect that some unknown militants are hiding in the residential house of one Mohammad Sadiq Mir S/ o Ab . Gaffar R/ o Gund Zonireshi , Kralpora ; and
Whereas , on receipt of this information , a party of security forces and police cordoned off the area and search operation was launched .

During search operation , militants opened fire upon security forces and in the ensuing cross firing , Subidar Kanganwari Verand JCO No. 460478P of 19 Maratha Regiment Camp , Chokibal , Police Head Constable , Mohamad Shafi No. 100/H , Police Constable Reyaz Ahmad No. 307 /H of SOG, Handwara were killed , besides two foreign terrorists also got killed on the spot . Besides , ASI Reyaz Ahmad No. 286/ S , SPO Reyaz Ahmad No. 523/ SPO , Ct . Shehal No. 365 / KP, SPO Fayaz Ahmad No. 398 / SPO of SOG, Handwara and a civilian Mst . Shamali W/ o Ab . Gaffar Mir R/ o Zonireshi sustained injuries ; and
Whereas , in this connection , case FIR No. 22/2014 under section 307 Ranbir Penal Code , 7/25 Arms Act , was registered in Police Station , Kralpora, and investigation initiated and during investigation offences under section 302 RPC and 19 Unlawful Activities ( Prevention) Act, 1967 were added ; and
Whereas , during the course of investigation, on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused persons under section 19 of Unlawful Activities (Prevention) Act, 1967 ; and
Whereas , the authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 has independently scrutinized the Case Diary file and all other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for sanctioning prosecution against the accused person ; and
Whereas , after perusing the Case Diary , the relevant documents and also taking into consideration the observations /views of the Authority appointed under sub - section ( 2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law .
Now , therefore , in exercise of powers conferred by sub - section ( 2 ) of section 45 of the Unlawful Activities ( Prevention) Act, 1967 , the State No. 21 - a] The J & K Govt . Gazette , 24th Aug. , 2017/2nd Bhad . , 1939 . Government hereby accord sanction for launching prosecution against the accused person namely Mohammad Sadiq Mir S/ o Abdul Gaffar Mir R/ o Gund Zonireshi , Kralpora , for the commission of offence punishable under section 19 of the Unlawful Activities (Prevention) Act , 1967 , arising out of FIR No. 22/2014 of Police Station , Kralpora . 3

In exercise of the powers conferred by sub - section (3 ) of section 70 of the Food Safety and Standards Act, 2006 read with the Rule 3.2.1 of Food Safety and Standards Rules , 2011 and in partial modification of Notification SRO - 371 dated 18th of November , 2016 , The J & K Govt . Gazette , 24th Aug. , 2017 / 2nd Bhad . , 1939. [No. 21 - d
2 State Government hereby appoint Shri Ashok Kumar Koul as Presiding Officer for Food Safety Appellate Tribunal , Jammu .
The Presiding Officer shall assume the charge of the Tribunal within a period of 21 days from the date of issuance of this notification . The term of Presiding Officer shall be five years from the date of joining the assignment or till he attains the age of 65 years whichever is earlier .
