Dated 11-03-2019 .

Whereas , the land specifications whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of road from Salal to Bangteer in Village Salal , Tehsil and District Reasi , Phase- X, Pkg . No. JK14-457 , under PMGSY ;

Whereas , on the basis of an indent placed by Executive Engineer , PMGSY Division , Reasi vide No. PMGSY/Udh - II/R/ 2018-19/ 523-28 dated 25-05-2018 , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition ( ACR ) , Reasi vide No. CLA/ ACR/ Rsi/ 18- 19/240-248 dated 13-09-2018 for land measuring 52 Kanals and 06 Marlas , situated in Village Salal , Tehsil and District Reasi ;

Whereas , the Collector , Land Acquisition ( ACR ) , Reasi vide No. CLA/ ARC /Rsi/ 18-19/288 dated 06-11-2018 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any , to the proposed acquisition but no objection was received from the land owners / interested persons in the prescribed time period as required under sections 5 & 5 -A of the Land Acquisition Act ;

Whereas , the report furnished by Collector, Land Acquisition (ACR) , Reasi vide No. referred to above , duly endorsed by the District Collector (DC) , Reasi vide No. DC / Rsi/ 18-19 / 1224-28 / SQ dated 09-11-2018 , Divisional Commissioner , Jammu vide No. 502/3381 /Acq/ PMGSY/ Salal / Rsi/ 18 / 3974-75 dated 21-12-2018 and by Financial Commissioner , Revenue vide No. FC - LS/LA- 4797/2018 dated 17-01-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;

Whereas , the Government is satified that the land particulars whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of road from Salal to Bangteer in Village Salal , Tehsil and District Reasi , Phase - X , Pkg . No. JK14-457 , under PMGSY.

Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 52 Kanals and 06 Marlas situated in Village Salal , Tehsil and District Reasi , particulars whereof are given in Annexure " A " to this notification is required for public purpose viz . for construction of road from Salal to Bangteer in Village Salal , Tehsil and District Reasi , Phase - X, Pkg . No. JK14-457 , under PMGSY. Further , the Collector, Land Acquisition ( ACR) , Reasi is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person( s ) as required under the Land Acquisition Act/Rules .

This is for information of all shortlisted candidates that during the scrutiny of the application forms submitted by them certain deficiencies / discrepancies have been notice which may render the concerned candidates ineligible for appearing in the written examination .

The candidates listed in Annexure " A " to this notice are advised to produce the requisite documents within a period of 07 days i. e . on or before 24-05-2019 after which no request/claim on this account shall be entertained on whatsoever grounds . The candidate ( s ) who are required to submit the Medical Certificate are also advised to submit said certificate on the prescribed format appended with the notice .

The candidates listed in Annexure " B " to this notice are advised to submit hard copy of application form along with all requisite documents within a period of 07 days , failing which their candidature will be rejected without further notice .

Note :-

Final Award

On placement of indent by the Inspector General , Head Quarter , Jammu FTR BSF vide his No. AXXV/ BWS/ STC/Engg/ 2009 / 3625-26 dated 26-05-2009 , the proceedings were initiated for acquisition of land measuring 4 Kanals 03 Marlas situated in Village Roun , Tehsil and District Udhampur of Jammu and Kashmir , State Land Acquisition Act , 1934 AD for exacavation trial pits near bank of river Tawi .

" No Objection " to the acquisition of land measuring 4 Kanals 03 Marlas bearing Khasra No. 587 min situated in Village Roun , Tehsil 184 The J& K Govt . Gazette , 18th July , 2019/27th Asad. , 1941. [ No. 16

and District Udhampur for excavation trial pits at STC , BSF, Udhampur conveyed by the Home Department , Government of Jammu and Kashmir vide No. Home/Land - Acq/47 / 2017 dated 25-10-2017 and same endorsed by the Divisional Commissioner Office , Jammu vide endorsement No. 502/ 2840/ Roun/T / Udh / NOC / 17/ 3026 dated 27-10-2017 , The land under acquisition is the State Land.

Accordingly Notification u/ s 4( 1 ) of J & K , State Land Acquisition Act, 1934 AD was issued vide this Collectorate No. CLAD /Udh/ 77-84 dated 15-01-2018 , wherein objections were invited from the land owners regarding acquisition of land . Copies of the said notices were served upon to the land owner through Tehsildar , Udhampur as well as by publication in the local leading newspaper and Government Gazette . No objection was received in the prescribed time period . The specification of the land under acquisition is given below

Thereafter , District Collector , Udhampur was requested vide this Collectorate No. CLAD /Udh/ 906-07 dated 05-04-2018 for taking up the matter with competent authority for according declaration under sections 6 and 7 of the Land Acquisition Act . The District Collector , Udhampur has taken up the matter of according declaration u/ s 6 and 7 in light of SRO - 25 dated 28-01-2016 with Commissioner Secretary to Government , Revenue Department , J & K Government , Srinagar vide his letter No. DCU/ SQ/802-04 Dated 22-06-2018 . The Governement of Jammu and Kashmir Revenue Department , Civil Secretariat vide notification No. 363 - Rev ( LAJ ) of2018 dated 08-08-2018 has issued notification u/s 6 and 7 of J & K State Land Acquisition Act in the instant case and has directed the Collector to proceed further in the acquisition , which is communicated to this Collectorate vide endorsement No. Rev /LAJ/363 /2018 dated 08-08-2018 with the direction to follow all provisions of Land Acquisition Act/ in the instant case and has directed the Collector to proceed further in the Rules No. 16 ] The J & K Govt . Gazette , 18th July , 2019/ 27th Asad . , 1941. 185

and any other law governing the subject matter , while making apportionment of compensation in favour of rightful claimants .

Consequent upon this notification under sections 9 and 9A of the J& K State Land Acquisition Act , 1934 AD was isssued vide this Collectorate No. SCDU /LA/ BSF/ 1177-85 dated 20-08-2018 and the copies of the same were served upon the land owner ( Revenue Department ) as well as indenting department to state their interests in the land , amount and particulars of their claims to compensation for such interests and their objections , if any, to measurement of land within the period of fifteen days .

Neither the indenting department nor the land owner has filed any objection within the stipulated period.

Principle of compensation :

Tehsildar , Udhampur vide his No. TUDR / OQ/ 2016-17 Dated 10-11-2016 at the time of preparation of Revenue documents has intimated the three year average sale deed rate as Rs . 2,796 Lakhs per Kanal , Stamp duty rates for the year 2018-19 have been notified for village Roun Rs . 3.70 Lakhs for irrigated land and Rs . 3.05 Lakhs for Un - irrigated land per Kanal . Due to the increase in developmental activities , the values of land has increased . Instant acquisition land is situated near the river Tawi . The Village of Roun is situated at a distance of 9 Kms . from District Hq . Udhampur. Undersigned visited the spot found that subject land is physically situated nearby river Tawi . The land is also recorded in Revenue record as Gair Mumkin Daryie Tawi . In view of this , I propose the rate of Rs . 3.05 Lakhs for Gair Mumkin land per kanal in the instant case as per the rate of land for un- irrigated land in Stamp Duty of the village for the year 2018-19 notified by the District Collector. This rate will be effective only for the Khasra No. indicated in the notification u/ s 9 and 9A issued by this Collectorate . Keeping in view the above factors into consideration , the rate of Rs . 3.05 Lakhs for Gair Mumkin was proposed which was considered the genuine rate in the opinion of the undersigned.

A meeting of Collectors under the chairmanship of District Collector was held on 27-01-2019 in the office chamber of the District Collector, Udhampur. The rate proposed by the undersigned was deliberated threadbare and committee approved the rates @ Rs . 3.05 lakhs per kanal ofUn- cultivable land (Gair Mumkin) and conveyed to this office in minutes of meeting issued by the district Collector, Udhampur vide endorsement No. DCU / SQ /LA/ 1757-69 dated 27-01-2019 .

The total amount involved in the instant acquisition came to Rs.14,61,942/ - ( Rupees Fourteen Lakh Sixty One Thousand Nine Hundred Forty Two only ) including 15 % Jabrana . The amount involved falls within pecuniary jurisdiction of the Deputy Commissioner , Udhampur . A request was submitted to the undersigned vide No. SCDU /LA/ BSF / 1545-46 dated 31-01-2019 to get the sanction and approval of awarded amount from the competent authority so that the Final Award is prepared.

In response to the request sent by the undersigned , the Deputy Commissioner, Udhampur accorded the approval of the amount involved in the acquisition vide his letter No. DCU /LA/ SQ/ 1835-36 dated 12-02- 2019 , the total compensation amount has been worked out to the tune of Rs.14,61,942/- ( Rupees Fourteen Lakh Sixty One Thousand Nine Hundred Forty Two only ) for acquisition of land measuring 4 Kanals 03 Marlas situated in Village Roun , Tehsil and District Udhampur for excavation trial pits near bank of river Tawi .

Therefore , I , Tinna Mahajan, KAS , special Collector Defence , Udhampur hereby issue the Final Award for an amount of Rs.14,61,942/ - (Rupees Fourteen Lakh Sixty One Thousand Nine Hundred Forty Two only) for acquisition of land measuring 4 Kanals 03 Marlas situated in Village Roun , Tehsil and District Udhampur for excavation trial pits near bank of river Tawi .

The requisite certificates are recorded as under :-

1. The land needed for public purpose i.e. for excavation trial pits near bank of river Tawi .

2. Adequate funds are available with indenting department .

3. No compensation has been paid in respect of land earlier.

4. Titma Shajra of land has been authenticated by the indenting department as token of correctness .

5. Compensation will be paid in accordance with the provisions of the Agrarian Reforms Act , 1976 .

6. It is also certified that the compensation payable to the owners/ interested persons as shown in the apportionment statement in accordance with the provisions of the Agrarian Reforms Act , 1976 and guidelines given in the circular issued by the Revenue Department vide No. LB - 10/ 80 dated 23-02-1980 .

SRO - 286 . Whereas , on 10/11/2018 Police Station , Nowgam , Srinagar received an information through reliable sources to the effect that one Suhail Ahmad Dar S/ o Gh . Hassan Dar R/ o Safnagri , Shopian has provided food and shelter to some unknown HM terrorists in his rented room located near Candid School , Nowgam . These unknown militants were hiding there and were eager to carry terrorist attack on security forces ; and 2. Whereas , a case FIR No. 109/2018 u/ s 18,19 ULA (P) Act ; 1967 was registered at Police Station , Nowgam , Srinagar and investigation was taken up ; and 2 The J & K Govt. Gazette , 15th April , 2019/ 25th Chai . , 1941. [No. 2 - f

3. Whereas , during the course of investigation , search was conducted and during search , two terrorists , who were hiding in the rented accommodation of accused Suhail Ahmad Dar took advantage of darkness , and managed to escape from the spot . However accused Suhail Ahmad Dar S/ o Gh. Hassan Dar R/ o Safnagri , Shopian (Accused No. 01 ) was apprehended from his rented accommodation and during search , one mobile phone J7 NXT - SAMSUNG was recovered from his possession and seizure memo was prepared on questioning disclosed that he was in touch with one active terrorist , namely, Aadil Bilal Bhat @ Aadil Hizbi S/ o Bilal Ahmad Bhat R/ o Malangpora , Pulwama (Accused No. 03 ) through BBM Mobile Application and on 10-11-2018 , he provided food and shelter to Shahid Ahmad Baba S / o Mushtaq Ahmad Baba R/ o Drubgam, Pulwama (Accused No. 02 ) and Aadil Bhat @ Aadil Hizbi S / o Bilal Ahmad Bhat R/ o Malangpora , Pulwama (Accused No. 03 ) in his rented accommodation situated at Nowgam . He further disclosed that after taking meals these terrorists came to know that security forces had cordoned the area and both the terrorists fled away along with their illegal arms / ammunition by taking advantage of darkness . However, they left two pair of shoes (Black colour) , a cricket bag and one cell phone Galaxy J3 ( 6) which was formatted by Accused No. 1 on the direction of Accused No. 03 while the cordon was being laid by security forces . Accordingly, the disclosure memo was prepared and placed on record , and on the disclosure of accused , Suhail Ahmad two pairs of shoes (Black colour) , One Cricket Kit Bag and One Cell Phone was recovered and seizure memo was prepared . During investigation site plan was prepared . Statement of witnesses acquainted with the facts and circumstances were recorded under section 161 Cr. PC besides statement of witnesses were recorded under section 164 - A Cr. PC . The recovered cell phones ( belonging to Accused No. 01 and 03 ) were sent to CFSL , Chandigarh for analysis and opinion thereof is awaited. During the course of investigation statement of house owner was recorded who deposed that he had provided one room to Accused No. 01 as well as his room partner namely Mohammad Ismail Ganie S / o Late Wali Mohammad Ganie R/ o Binner , Baramulla on rent basis . The statement of Mohammad Ismail (room partner of Accused No. 01 ) has also been recorded who has also corroborated that accused No. 01 had provided food and shelter to two terrorists in his rented room . been conducted before the Executive Magistrate , Pantha Chowk, Srinagar, where, Mohammad Ismail (Room Partner ofAccused No. 01) has identified two terrorists (Accused No. 02 and 03 ) who had visited the rented room of Accused No. 01 on the day of occurrence . During further course of investigation , it surfaced that Aadil Ahmad Bhat @ Aadil Hizbi S / o Bilal Ahmad Bhat R/ o Malangpora, Pulwama ( Accused No. 03) was killed in an encounter in Sharshali Khrew, Pampore on 29-11-2018 and death certificate ofsaid militant has been obtained from Police Station , Pulwama . Besides , it has also surfaced that Accused No. (02) was also killed during the intervening night of 31 / 01-02-2019 in an encounter at his native Village Drubgam , Rajpora , Pulwama the FIR copy of the said encounter has been obtained from Police Station , Rajpora , Pulwama ; and

4. Whereas , evidence collected during investigation prima facie establishes a case u/ ss 18 , 19 UAP Act , against accused 1. Suhail Ahmad Dar S /o Gh . Hassan Dar R/ o Safnagri , Shopian 2. Shahid Ahmad Baba S/ o Mushtaq Ahmad Baba R/ o Drubgam , Pulwama and 3. Adil Bilal Bhat @Aadil Hizbi S/ o Bilal Ahmad Bhat R/ o Malangpora , Pulwama and investigation concluded as proved . However, Accused No. 02 & 03 have been neutralized and no sanction is required against them ; and

5. Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused persons for commission of offences punishable under sections 18 & 19 of the Unlawful Activities ( Prevention) Act , 1967 ; and

6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observation/ views of the Authority appointed under sub - section ( 2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for his prosecution under the aforesaid provisions of law.

SRO - 287 . Whereas , Police Station , Kulgam on 11-07-2018 reliably came to know that some persons namely Masood Ahmad Bhat S / o Abdul Rehman Bhat R/ o Chadder, Shabir Ahmad Bhat S / o Gh . Mohammad Bhat R/ o Bhan , Shabir Ahmad Dar S/ o Ab . Ahad Dar R/ o Chadder were working as OGW's for banned outfit LeT and were giving every kind of help to the militants i . e . transport , shelter , food etc. The said accused persons were facilitating , aiding active terrorists of the area in committing subversive activities , which is threat to the security forces as well as integrity and sovereignty of India.

2. Whereas , a case FIR No. 116/2018 u/ ss 13 (2) , 18 , 19, 38 , 39 ULA (P) Act of Police Station , Kulgam was registered and investigation was taken up ; and

3. Whereas , during the course of investigation , statements of witnesses were recorded under section 161 , 164- A Cr. P. C. Investigation conducted has revealed that accused 1. Masood Ahmad Bhat S / o Abdul Rehman Bhat R/ o Chadder 2. Shabir Ahmad Bhat S/ o Gh . Mohammad Bhat R/ o Bhan . 3. Shabir Ahmad Dar S/o Ab . Ahad Dar R/ o Chadder were the OGW of the banned outfit LeT and were providing all kind of support to the militants for subversive activities , even carrying of arms and ammunition from one place to another. The evidence brought on record during the course of investigation prima facie establishes commission of offences u/ ss 13 ( 2) , 18 , 19 , 38 , 39 ULA (P) Act ; and

4 Whereas , accordingly the investigation of the case has been closed as proved against accused persons namely 1. Masood Ahmad Bhat S/ o Abdul Rehman Bhat R/ o Chadder 2. Shabir Ahmad Bhat S / o Gh.Mohammad Bhat R/ o Bhan , 3. Shabir Ahmad Dar S/o Ab . Ahad Dar R/ o Chadder 4. Saleel Ahmad Ganie @ Shakoor Ganie S / o G.h. Qadir Ganie R/ o Chidder 5. Shakoor Ahmad Dar @ Abu Baker S/ o Mohd Munawar DarR/ o Sopat ( killed) . This may be mentioned here that accused No. 04 was arrested during an encounter in which accused No. 05 was killed on 24-06-2018 at Chidder , Kulgam and for which FIR No. 107/2018 was registered in Police Station, Kulgam ; and

5. Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities (Prevention ) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused persons for commission of offences punishable under sections 13 (2) , 18 , 19 , 38 , 39 of the Unlawful Activities (Prevention) Act, 1967 ; and

(Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law.

7. Now, therefore , in exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act, 1967, the State Government hereby accords sanction for launching prosecution against the accused persons namely 1. Masood Ahmad Bhat S / o abdul Rehman Bhat R/ o Chidder 2. Shabir Ahmad Bhat S/ o Gh . Mohammad Bhat R/ o Bhan , 3 . Shabir Ahmad Dar S/o Ab . Ahad Dar R/ o Chidder 4. SRO - 320 .--In exercise of the powers conferred by section 492 read with section 493 of the Jammu and Kashmir Code of Criminal Procedure , Samvat 1989 , the Government hereby accords concurrence to the engagement of Shri Kuljeet Singh Pathania as Public Prosecutor ( Special Counsel ) for CBI ( having been engaged by Central Government , Ministry of Personnel , PG and Pensions ( Department of Personnel and Training) , New Delhi vide Letter No. 225 / 15/ 2018- AVD - II dated 28-11-2018) for conducting cases instituted by the Delhi Special Police Establishment in Trial Courts and Appeals / Revisions or other matters arising out of these cases in Revision or Appellate Courts .

SRO- 321 . In exercise of the powers conferred by section 23 of the Jammu and Kashmir Reservation Act , 2004 and all other relevant provisions of law in this behalf , the Government of Jammu and Kashmir hereby directs that clause ( iii) of Rule 21 of the Jammu and Kashmir Reservation Rules , 2005 shall be substituted by the following , namely :-

" ( III) A person claiming the benefit on the grounds that he/she belongs to an identified backward area or an area near the Line of Actual Control/International Border , must establish that he/ she 2

has resided in the area for a period of not less than 15 years prior to the date of application and is actually residing in the said area :

Provided that a person shall not be disentitled from claiming this benefit only on the ground that his/ her father or the person on whom he/she is dependent is living in a place which is not identified as backward or area near the Line of Actual Control or International Border on account of his ( a) employment ; or (b) business ; or ( c ) other professional or vocational reasons ; or (d) migration from one place to another place within the respective division due to security reasons :

Provided further that a person who has migrated from Kashmir Division for security reasons will not be disentitled from claiming this benefit even if he/ she has migrated outside the Division/ State subject to the condition that he/she should have been registered as a migrant with the office of Relief and Rehabilitation Commissioner (Migrants ) , Jammu . "

Whereas , on 01-06-2017 during Naka checking one White Colour WagonR Vehicle bearing registration No. JK 156569 was intercepted at Khusarpura , Shahgund in which 05 persons were boarding including driverwho were questioned and they disclosed their names 1. Bashir Ahmad Mir (Driver ) S /o Ab . Ahmad Mir R/ o Parabal , Hajin 2. Mohd Younis Bhat S/ o Sonullah Bhat R/ o Gundjhangeer 3. Shabir Ahmad Dar S / o Ab . Majeed Dar R/ o Gundjhangeer 4. Hilal Ahmad Parray S/ o Gh . Ahmad Parray R/ o Kochak Mohalla, Hajin 5. Sonuallah Dar S /o Gh. Ahmad R/ o Gundjhangeer, 2 The J&K Govt. Gazette, 15th April , 2019 /25th Chai . , 1941. [No. 2 -h

Hajin. The extensive search of the vehicle/ personal search of these persons were conducted and it was found that each person possessed 02 grenades in a concealed manner besides 02 AK - 47 Magazine and 27 Rds . of AK - 47 rifle recovered from beneath driver's seat . All the accused persons and the vehicle were immediately taken into the custody. During preliminary interrogation accused persons revealed that they along with Inayat Ahmad Parray S / o Mohammad Akber Parray R/ o Hajin were working with the terrorist group of LeT as OGW's . They came in a contact with Anayat at Hajin town who had given them this consignment for distribution among LeT operative in areas of Shahgund and Gundjhangeer . The accused persons were apprehended with illegal Arms/ Ammunition and during the course of investigation the accused disclosed that they were working with militants of banned LeT outfit and no plausible explanation was provided by them for the recovery effected from their possessions ; and

2. Whereas , a case FIR No. 34/2017 u/ s 7/25 I. A Act and section 18 of ULAP Act was registered in Police Station , Hajin and investigation taken up ; and

3. Whereas , the recovery of Arms /Ammunition from the possession of the accused persons and the statement of witnesses prima facie , a case is made out against the accused persons u/ ss 18, 20 and 39 UAPA ; and

4. Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967, has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of sanction for launching prosecution against the accused person ; and

5. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration , the observations / views of the Authority appointed under sub - section ( 2) of section 45 of the Unlawful Activities (Prevention) Act , 1967, the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law.

6. Now, therefore , in exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State No. 2-h] The J&KGovt. Gazette , 15th April , 2019/ 25th Chai . , 1941. 3

SRO - 289 . Whereas , Police Post Qaimoh on 09-10-2013 , received a reliable information to the effect that one militant namely Mubarak Ahmad Wani @ Major Saqib , equipped with illegal arms and ammunition is hiding in the house of one Sartaj Ahmad Dar S/ o Gh . Ahmad R/ o Hawoora , Mishipora . Acordingly, a joint search operation was launched by Police and Army 1st RR. The said militant however , took advantages of darkness and managed to escape from the spot . It was learnt that one more person Bashir Ahmad Allie S/ o Late Abdul Hamid R/ o Howoora assisted and provided shelter to the said militant in giving slip to the search party ; and 2 The J& K Govt . 2. Whereas , a case FIR No. 277/2013 u/s 13 , 19,20 ULAP Act , 1967 was registered at Police Station , Kulgam and investigation was taken up ; and

3. Whereas , during the course of investigation , a site plan of place of occurrence was prepared and statement of witnesses acquainted with the fact and circumstances of the case were recorded under relevant provision of law. Investigation conducted revealed that accused Mubarak Ahmad wani @ Major Saqib is an active militant of HM outfit and has been found involved in various militant activities in Valley especially in district Anantnag. Investigation has further revealed that on the day of occurrence the accused person namely Gh . Ahmad Dar had provided shelter to hide the active militant in his house and also assisted him to escape from the cordon and search launched by Security forces . Investigation also revealed that after fleeing from the place of occurrence the accused namely Bashir Ahmad Allie further guided the accused Saqib in his escape to save him from facing the law of land . During initial investigation , suspected Sartaj Ahmad Dar was apprehended in the case who had been given benefit u/s 169 Cr. P C. owing to no active role played by him in providing shelter to the accused Saqib ; and

4. Whereas , based on the facts and circumstances that enumerated during investigation , section 20 of ULAP Act was added and Sec . 7/25 A. Act was dropped from the case . Cogent evidence collected has , primafacia, disclosed the commission of offences punishable u/s 13 , 20 ULA ( P) Act , 1967 against accused Mubark Ahmad Wani @ Major Saqib S / o Mohammad Ramzan Wani R/ o Bangdar, Anantnag and offence punishable u/ s 19 ULAP Act , 1967 against the accused 2. Ghulam Ahmad Dar S/ o Mohammad Ramazan Dar R/ o Vidow, Mishipora and 3. Bashir Ahmad Allie S/ o Ab . Hamid R/ o Hawoora , Mishipora and investigation concluded as proved ; and

conclusion that this is a fit case for accord of prosecution sanction against the said accused persons .

6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations / views of the Authority appointed under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law.

7.
