Notification No. 44 Rev ( LAJ) of 2019
Dated 19-03-2019 .
Whereas , the land specifications whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of composite band/border fencing ( 135 ft . wide strip) in Village Galar and Chak Harkha, Tehsil and District Samba by Border Security Force ;
Whereas , on the basis of an indent placed by Inspector General , BSF vide No. BF /Land/BOPs / Ftr /Engg / 2011 / 10619-20 dated 08-09-2011 , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (ACR) , Samba vide No. DCS / ACR / LAS / 18-19 /240-45 dated 30-08-2018 for land measuring 188 Kanals and 18 Marlas , situated in Village Galar and Chak Harkha, Tehsil and District Samba ;

Whereas , the District Collector ( DC) , Samba vide No. DCS/ ACR/ LAS/18-19/452-455 dated 28-11-2018 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any, to the proposed acquisition , and one Satya Devi W/ o Gopal Singh has filed the objections stating therein that her name has not been incorporated in the field book of Village Chak Harkha . Accordingly, Tehsildar Samba was requested to look into the matter and submit compliance report . Tehsildar Samba vide his letter dated 30-10-2018 has reported that there is dispute with respect to Khasra No. 75 of Village Chack Harkha between co - sharer. He has further stated that entry in the field book has been incorporated as per revenue record . It is pertinent to mention here that objections of the application Satya Devi is regarding apportionment of land, which can be settled/resolved while making the payment to the land owners ;
Whereas , the report furnished by District Collector ( DC ) , Samba vide No. referred to above , duly endorsed by the Divisional Commissioner , Jammu vide No. 502/2057/135 ft/ Galar/ Samba/ 18 /3826-28 dated 15-12-2018 and by Financial Commissioner , Revenue vide No. FC - LS /LA- 4786/ 2018 dated 03-01-2019 has been examined and it has been found that one owner namely Satya Devi has filed objections and after examination which has been disposed of in accordance with the rule /norms ;
Whereas , the Government is satified that the land particulars whereof are given in Annexure " A" to this notification is required for public purpose viz . for construction of composite band/border fencing ( 135 ft. wide strip) in Village Galar and Chak Harkha , Tehsil and District Samba by Border Security Force .
Now, therefore , in pursuance of section 6 of the J& K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 188 Kanals and 18 Marlas situated in Village Galar and Chak Harkha, Tehsil and District Samba , particulars whereof are given in Annexure " A " to this notification is required for public purpose viz . for construction of composite band/border No. 17 ] The J & K Govt . Gazette , 25th July, 2019/3rd Srav. , 1941. 221
fencing ( 135ft . wide strip ) in Village Galar and Chak Harkha , Tehsil and District Samba by Border Security Force . Further , the Collector , Land Acquisition (ACR ) , Samba is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .
However, the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/ rightful claimants in accordance with the relevant laws /rules in force , while making the award .

Whereas , the land specifications whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of road from KM 3rd of TO2 to Bhera Upper in Village Ari , Tehsil Mendhar , District Poonch , PKG No. JK11-81 under PMGSY ;
Whereas , on the basis of an indent placed by Chief Engineer , PMGSY (JKRRDA) , Jammu vide No. CEJ /PMGSY/ 497-99 dated 10-04-2017 , a notification under section 4( 1 ) was issued by Collector , Land Acquisition (SDM) , Mendhar vide No. SDM/ LA/ PMGSY/ 485-92 dated 13-06-2018 for land measuring 44 Kanals , situated in Village Ari , Tehsil Mendhar , District Poonch ;
Whereas , the Collector , Land Acquisition ( SDM ) , Mendhar vide No. SDM / LA - PMGSY/ 558 dated 17-09-2018 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any , to the proposed acquisition , but no objection was received from the land owners / interested persons within the prescribed time period as required under sections 5 & 5 -A of the Land Acquisition Act ;
Whereas , the report furnished by Collector , Land Acquisition ( SDM) , Mendhar vide No. referred to above duly endorsed by District Collector (DC ) , Poonch vide No. DCP/LA/ 1295 dated 10-11-2018 , Divisional Commissioner, Jammu vide No. 502/3398 /Acq/PMGSY/Ari/P/ 18 /4159-60 dated 29-12-2018 and by Financial Commissioner , Revenue vide No. FC - LS /LA- 4801/ 2019 dated 22-01-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;

Whereas , vide Notification No. PSC/Exam/08 /2019 dated 25-01-2019 application forms for appearing in Assistant Engineer (Accounts ) Departmental Examination were invited from eligible candidates . In response of 63 application forms were received ; and
Whereas , on scrutiny of the application forms , it has been found that out of 63 candidates , 01 candidate has not submitted his fee receipt along with his Application Form and 29 candidates have not submitted hard copies of their application forms up to the last date i . e . 26-02-2019 .
Now, therefore , the following candidates are advised to submit the requisite documents shown against each within seven days from the date of publication of the notice , failing which their candidature will be rejected :-

Except the cases of forest leases and sale of forest produce including minor forest produce , the cases relating to ( i ) transfer/ lease of State / Departmental land to the State Government Department ( s ) exceeding 500 Kanals and transfer of any quantum of land to Central Government ( ii ) transfer / lease of State Departmental Land to Government Owned Corporations , Autonomous Bodies , Agencies , PSUs etc. for public purpose/developmental programmes , irrespective of the quantum of land involved and ( iii ) transfer of land in terms ofArticle 256 ( 2) of the Constitution of India as applicable to the State of Jammu and Kashmir shall be submitted to the State Cabinet/ State Administrative Council for consideration/ approval .
(b) Cases involving transfer / lease of land to any State/ Central Government Department/ Agency , Autonomous Body, Government Owned Corporation , Board , PSU etc. involving relaxation of norms/ rules , if any, or waiver of premium or in circumstances where the concerned department ( under whose possession the land is recorded) does not consent to part with land due to any reason , shall also be submitted to the State Cabinet/ State Administrative Council for consideration/ approval .

SRO - 316.- Whereas , on 11-12-2009 , Police Station , Khanyar , received a written docket from SHO , Police Station , Khanyar to the effect that a procession led by Mohammad Shafi Lone , Peer Saifullah , Mohammad Shafi Reshi under the command of Syed Ali Shah Geelani Chairman, J & K Hurriyat Conference came out from Zeyarat Naqeshband Sahib and raised Anti National slogans and violated section 144 Cr. PC as the notification for the same was issued on 9th of December , 2009 by District Magistrate , Srinagar ; and 2 The J& K Govt . Gazette , 20th May, 2019/30th Vai . , 1941. [No. 7 -b
2. Whereas , a case FIR No. 84/2009 u/ ss 188 , RPC , 13 ULA Act, was registered at Police Station , Khanyar and investigation was taken up ; and
3. Whereas , during the course of investigation , site plan was prepared and statement of witnesses were recorded under relevant provisions of Law. During investigation , press cuttings having bearing on the case were obtained as piece of evidence and placed on file . Evidence oral and documentary collected during investigation substantiated the involvement of accused persons namely 1. Syed Ali Shah Geelani S /o Peer Syed Mohammad Shah R/ o Duroo , Sopore A/ P Hyderpore , Srinagar , 2. Irshad Ahmad @ Irshad Majeed Sofi S/ o Ab . Majeed Sofi R/ o Zahidpora , Hawal , 3. Avid Showkat Mir S/ o Showkat Mir R/ o Zandar Mohalla , 4. Mudasir Ahmad Teli S/o Nazir Ahmad R/ o Guzar Masjid, Srinagar 5. Manzoor Ahmad Khan S / o Ghulam Hassan R / o Aqlimar , Khanyar A/P Elahibagh 6. Bilal Ahmad Badyari S /o Abdul Majeed R/ o Batwara , Srinagar 7. Ghulam Nabi Malik @ Sadam S / o Abdul Ahad Malik R/ o Shahlal , Handwara A/P Brathna Qamerwari 8. Mushtaq Ahmad Sheikh S/o Ghulam Mohiddin R/ o Syedpora , Nowhatta 9. Peer Saif- ul- ah @ Bashir Ahmad R/ o Zadoora , Pulwama 10. Mohammad Shafi Lone S/ o Abdul Aziz R/ o Bishambernagar , Khanyar 11. Mohammad Shafi Reshi S/ o Ali Mohammad Reshi R / o Nesbal , Sumbal A/P Dalgate in the commission of crime punishable u / s 13 of Unlawful ( Prevention) Act , 1967, 188 RPC and accordingly the investigation concluded as proved against them . Accused 2-8 have been arrested in the case , while as , accused 1 , 9 to 11 have not been arrested being extreme elderly and it has been proposed that they shall be presented before the competent Court of Law at the time of presenting charge sheet ; and
4. Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of No. 7-b ] The J & K Govt. Gazette , 20th May, 2019/30th Vai . , 1941. 3
prosecution sanction against the said accused persons for commission of offences punishable under section 13 of the Unlawful Activities (Prevention) Act , 1967 ; and
5. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section ( 2 ) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provision of law.
6. Now, therefore , in exercise of powers conferred by sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused persons namely 1.
