Dated 21-10-2019 .
Whereas , the land specifications whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of alternate accommodation for CAPF situated at Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar by CAPF ;
Whereas , on the basis of an indent placed by Sr. Superintendent of Police , District Kishtwar , vide No. GB /Land/ 18 / 1962-65 dated 07-02-2018 , 524 The J& K Govt . Gazette, 9th Jan. , 2020/ 19th Pausa , 1941. [ No. 41
a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (ACR) , Kishtwar vide No. ACR/ LA/ 3267-72 dated 28-06-2018 for land measuring 68 Kanals and 19 Marlas situated at Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar ;
Whereas , the Collector, Land Acquisition ( ACR ) , Kishtwar vide No. ACR/ LA/ 2019/ 166 dated 28-05-2019 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any, to the proposed acquisition and some land owners /interested persons filed objections within the stipulated time and were verified by the Collector with no merits and recommended for rejection which are deemed to be baseless as reported by the concerned Collector ;
Whereas , the report furnished by Collector , Land Acquisition (ACR ) , Kishtwar vide number referred to above duly endorsed by District Collector (DC) , Kishtwar vide No. DCK/LA/ 2019/ 95-99 dated 03-06-2019 , Divisional Commissioner, Jammu vide No. 502/ 3551 / Acq/ Lachdayaram and Pochhal/ Kishtwar/ 19/2046/48 dated 16-08-2019 and by the Financial Commissioner , Revenue vide No. FC - LS /LA- 4928 / 2019 dated 12-09-2019 has been examined and it has been found that some land owners filed objections and after examination these have been disposed off under norms / rules ;
Whereas , the Government is satified that the land particulars whereof are given in Annexure " A" to this notification is required for public purpose viz . for construction of alternate accommodation for CAPF situated at Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar by CAPF.
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 68 Kanals and 19 Marlas , situated at Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar , particulars whereof are given in Annexure " A " to this notification is required for public purposes viz . for construction of alternate accommodation for CAPF situated in Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar by CAPF. Further, the Collector , Land Acquisition (ACR ) , Kishtwar is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .

Now, in pursuance of section 17 of the Land Acquisition Act , Samvat 1990 , it is ordered that on expiry of fifteen days from the publication of the notification under section 9 (2 ) of the said Act , the Collector will take the possession of the aforementioned land at Villages Lachdayaram and Pochhal , Tehsil and District Kishtwar required for public purpose subject to fulfillment of the conditions prescribed under section 9 (2 ) and section 17 -A of the Land Acquisition Act and Rule 63 of the Land Acquisition Rules .
However , the Collector concerned shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/ rightful claimants in accordance with the relevant laws / rules in force , while making the award.

Whereas , the Collector , Land Acquisition (ADC) , Reasi vide No. CLA/ NR / ADC / Rsi / 19-20/ 145-147 dated 15-06-2019 has reported that the notification issued under section 4( 1 ) of the J & K State Land Acquisition Actwas served upon the interested persons for filing objections , if any , to the proposed acquisition but no objection was received from the land owners / interested persons in the prescribed time period as required under sections 5 & 5 - A of the Land Acquisition Act ;
Whereas , the report furnished by Collector, Land Acquisition ( ADC ) , Reasi vide number referred to above duly endorsed by Deputy Commissioner, Reasi vide No. DC / Rsi/ 19-20/473-77 / SQ dated 02-07- 2019 , Divisional Commissioner , Jammu vide No. 502/3584/ Sawlakote/Reasi/ 19/ 1104-06 dated 24-07-2019 and by the Financial Commissioner , Revenue vide No. FC - LS /LA - 4923 /2019 dated 06-09-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Whereas , the Government is satified that the land particulars whereof are given in Annexure " A" to this notification is required for public purpose viz . for dumping yard No. 1 of T- 14 situated at Village Sawlakote , Tehsil Arnas , District Reasi by Northern Railway.

Whereas , the Collector , Land Acquisition ( SDM ) , Padder vide No. SDMP / LA/2019/ 01 dated 01-04-2019 has reported that the notification issued under section 4( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any , to the proposed acquisition but some land owner/ interested persons filed objections which after verification were found without merits as reported by the Collector, Land Acquisition ( SDM ) , Padder ;

Whereas , the report furnished by Collector, Land Acquisition ( SDM ) , Padder vide No. SDMP/LA/2019 /01 dated 01-04-2019 referred to above duly endorsed by Deputy Commissioner, Kishtwar vide No. DCK / LA/ 2019/433-38 dated 03-09-2019 , Divisional Commissioner , Jammu vide No. 502/3527 /Degree/ College /Padder /Kishtwar/ 19 /2158-59 dated 14-09-2019 and by the Financial Commissioner, Revenue vide No. FC - LS/LA - 4898/ 2019 dated 30-09-2019 has been examined and it has been found that the objection filed by few land owners / interesed persons have been found to be baseless and without any merits ;
Whereas , the Government is satified that the land particulars whereof are given in Annexure "A " to this notification is required for public purpose viz . for construction of Government Degree College , Padder situated at Village Atholi , Tehsil Padder, District Kishtwar by the Higher Education Department .
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 58 Kanals and 04 Marlas , situated at Village Atholi , Tehsil Padder , District Kishtwar , particulars whereof are given in Annexure " A " to this notification required for public purpose viz . for construction of Government Degree College , Padder situated at Village Atholi , Tehsil Padder , District Kishtwar by the Higher Education Department . Further , the Collector , Land Acquisition (SDM) , Padder is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person (s ) as required under the Land Acquisition Act/Rules .

Whereas , the Collector , Land Acquisition (ADC ) , Billawar vide No. ADC/Blr/ 2018-19/ 1530 dated 14-09-2018 has reported that the notification issued under section 4 ( 1) of the J & K State Land Acquisition Act by him was served upon the interested persons for filing objections , if any, to the proposed acquisition but , no objection was received from the land owners / interested persons within the prescribed period as required under sctions 5 & 5 -A of the Land Acquisition Act ; and
Whereas , the report furnished by Collector , Land Acquisition, vide number referred above duly endorsed by District Collector (Deputy Commissioner ) , Kathua vide No. DCK / LA/ 2019-20/846-49 dated 05-09-2019 , Divisional Commissioner , Jammu vide No. 502/ 3228/ PMGSY / Lahri / Kathua/ 19 / 2424 dated 05-10-2019 and by the Financial Commissioner , Revenue vide No. FC - LS/LA- 5029/ 19 dated 18-10-2019 has been examined and it has been found that the land owners did not file any abjection to the proposed acquisition ; and
Whereas , the Government is satified that the land particulars whereof are given above , is required for public purpose viz . construction of road from L028 - Kohag to Lahri , under Pkg No. JK07129 , Phase X by PMGSY situated in Village Lahri , Tehsil Lohai Malhar, District Kathua.
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990, it is declared that the land measuring 53 Kanals and 18 Marlas , situated in Village Lahri , Tehsil Lohai Malhar, District Kathua , particulars whereof are given in Annexure " A " is required for public purpose viz . for construction of road from L028 - Kohag to Lehri under Pkg No. JK07129 , Phase X by PMGSY situated in Village Lahri , Tehsil Lohai Malhar , District Kathua . Further , the Collector , Land Acquisition (ADC) , Billawar is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person(s ) as required under the Land Acquisition Act/Rules .

Financial Bid :
The " Financial Bid " is required to be uploaded online as per the Bill of Quantities (BoQs ) of e- NIT .
Other Terms & Conditions of Tender :
(1) In case of any breach of the agreement at any time on the part of the tenderer , the agreement shall be terminated summarily by the Department and a penality of 2 % of the total cost of ordered item( s ) shall be imposed on the supplier and CDR/ FDR shall be forfeited .
(2) All tenderers shall submit their samples of Derby Shoes before date of opening of Technical bid viz . 6-1-2020.
(3) Disputes , if any , shall be settled by the Courts within the jurisdiction of Union Territory (Srinagar /Jammu ) .
(4) No tender will be considered unless and until all the documents are properly signed.
(5) During the period of contract if the price of the ordered model decreases during the period of delivery the decreased price shall be considered as final .
(6) Delivery of item (s ) is further subject to the inspection by the inspecting authority to be nominated by the Director , State Motor Garages Department , J & K Government and no payment shall be released without the inspection certificate by the nominated team in token of that the supplies are as per approved samples by the State Level Purchase Committee .

(7) Financial bid of only those tenderers shall be opened who will qualify the technical bid .
(8 ) The Department shall be at liberty to procure the Derby Shoes in minimum quantity are as per requirement within 12 days ( including holidays) . In case of exigency the item shall be supplied within the shortest possible time failing which the Department shall approach L -2 bidder after obtaining non- availability certificate from L- 1 bidder .
(9) Guarantee/Warranty period of item ( s ) wherever applicable be specified and for such item, in case of detection of any defect during the said period the items shall have to be replaced free of cost by the successful tenderer .
(10) Rates shall be quoted FOR destination i. e . Jammu/ Srinagar and should be inclusive of all taxes .
(11) No interest shall be paid on CDR/FDR and the FDR / CDR of the successful tenderer shall be converted into security deposit and those of unsuccesful tenderer the same shall be returned immediately after completion of the tendering process .
(12) Any postal delay shall not be responsibility of the department.
(13) No terms and conditions of the tenderer shall be entertained by the Department .
( 14) The Chairman State Level Purchase Committee can stop the process at any time and can exercise options whatsoever , in the interest of the administration of the State Motor Garages Department.
( 15) Chairman, State Level Purchase Committee reserves the right to accept or reject any tender at any time without assigning any reason thereof .
(16) The successful tenderer has to sign the contract on terms and conditions of this notice .
( 17) Successful supplier should have available stocks of assorted sizes both at Jammu and Srinagar to meet out the requirement of Shoes .

SRO - 561 . In exercise of the powers conferred by the proviso to section 124 of the Constitution of Jammu and Kashmir the Governor is pleased to direct that the following amendments shall be made in the Jammu and Kashmir Civil Service Regulations , namely :-
After Rule 6 of JK Civil Services ( Defined Contribution Pension Scheme) Rules , 2010 under schedule XXIII , the following shall be added as rule 7 :-
" 7. Partial withdrawal.-( 1 ) A partial withdrawal of accumulated pension wealth of the subscriber , not exceeding twenty five per 2

cent of the contributions made by the subscriber and excluding contributions made by employer , if any, at any time before exit from National Pension System subject to the terms and conditions , purpose , frequency and limits specified below :-
(A) Purpose. A subscriber on the date of submission of the withdrawal form , shall be permitted to withdraw not exceeding twenty five per cent of the contribution made by such subscriber to his individual pension account , for any of the following purposes only :-
(a) for Higher education of his or her children including a legally adopted child ;
(b) for the marriage of his or her children , including a legally adopted child ;
(c) for the purchase or construction of a residential house or flat in his or her own name or in a joint name with his or her legally wedded spouse. In case , the subscriber already owns either individually or in the joint name a residential house or flat , other than ancestral property, no withdrawal under these regulations shall be permitted ;
(d) for treatment of specified illness of the subscriber, his legally wedded spouse , children including a legally adopted child or dependant parents suffer from any specified illness , which shall comprise of hospitalization and treatment in respect of the following diseases :-
I. Cancer ;
II . Kidney Failure (End Stage Renal Failure) ;
III . Primary Pulmonary Arterial Hypertension ;
IV. Multiple Sclerosis ;
V. Major Organ Transplant ;
VI . Coronary Artery Bypass Graft ;
VII . Aorta Graft Surgery ;
VIII . Heart Valve Surgery ;

X. Myocardial infarction ;

XV. Any other critical illness of a life threatening nature as stipulated in the circulars , guidelines or notifications issued by the Authority from time to time.
(B) Limits . The permitted withdrawal shall be allowed only if the following eligibility criteria and limit for availing the benefit are complied with by the subscriber :-
a . The subscriber shall have been in the National Pension System at least for a period of three years from the date of his or her joining ;
b . The subscriber shall be permitted to withdraw accumulation not exceeding twenty five per cent of the contributions made by him or her and standing to his or her credit in his or her individual pension account, as on the date of application for withdrawal ;
(C) Frequency . The subscriber shall be allowed to withdraw only a maximum of three times during the entire tenure of subscription under the National Pension System. The request for withdrawal shall be submitted by the subscriber , along with relevant documents to the Central Record Keeping Agency or the National Pension System Trust , as may be specified, for processing of such withdrawal claim through their nodal office . Provided that where a subscriber is suffering from any illness , specified in sub- clause (d) , the request for withdrawal may be submitted through any family member of such subscriber.

2. Partial withdrawal process/documents . Partial withdrawal request is required to be submitted by subscriber to Central Record Keeping Agency through his /her Nodal Office/ Points of Presence/ Aggregator , as may be applicable. The Nodal Office/Points of Presence/ Aggregator should satisfy itself about the genuineness of the requirement for partial withdrawal by subscriber and after satisfying itself forward the withdrawal application for release of funds by Central Record Keeping Agency. On receipt of partial withdrawal request , Central Record Keeping Agency will process the withdrawal request in the Central Record Keeping Agency System. "

SRO - 592.- Whereas , on 16-07-2018 Police Component , Sopore along with nafri of 197 Bn . 177 Bn CRPF and 52 RR were deployed on Naka checking at Haritar Bridge , Tarzoo . During Naka checking it was found that one person who was coming from Gund Jahangir to Haritar, tried to flee in suspicious conditions from the spot on seeing Naka party , but he was apprehended by Naka party During questioning , he disclosed his The J& K Govt . 2 identity as Bilal Ahmad Kaloo S / o Ab . Rehman Kaloo R/ o Takiyabal Sopore . During his personal search one page of matrix sheet of banned outfit JeM and two hand grenades were recovered and he could not provide any justification regarding the incriminating material ; and
2. Whereas , a case FIR No. 65/2018 u/ s 13 ULA ( P) Act , 7/25 IA. Act , was registered in P / S Tarzoo and investigation taken up ; and
3. Whereas , during investigation it has been found that the alleged accused person is an active OGW of banned outfit JeM . The said person was roaming to throw grenade on police/ security forces with intention to kill. The accused has been an active OGW of JeM outfit and was involved in pasting the posters of banned outfit JeM in Sopore area . The activities of said accused person have been found a threat to the security and sovereignty of the country and State . During the course of investigation section 13 of the ULA (P) Act , 1967 has been deleted and section 18 ULA( P) Act has been added in the case ; and
4. Whereas , during the course of investigation, on the basis of statement of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused person namely Bilal Ahmad Kaloo S /o Gh . Nabi Kaloo R/ o Takiyabal , Sopore under section 18 of the Unlawful Activities (Prevention ) Act , 1967 ; and
5. Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused person ; and
6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967 , the State Government is of the view that there No. 28 -x] The J& K Govt . is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law.

Whereas , during the course of investigation, it surfaced that in the ensuing firing 01 terrorist namely Shafat Hussain Wani S/ o Mohammad Akber Wani R/ o Wagoora , Baramulla got killed on spot and another terrorist namely ; Mukthar Ahmad Khan S/ o Ab . Ahad Khan R/ o Brass , Tehsil Khansahib fled from the spot. During search huge quantity of arms and ammunition was recovered from incident site. Also during investigating it came to fore that the house owner namely Maqsood Ahamd Khan @ Jignu S / o Mohammad Maqbol Khan R/ o Checkmerg , Arizal has provided shelter to the above named militants voluntarily . Pertinent to mention that accused Mukhtar Ahmad Khan and Shafat Hussain Wani are now dead and sanction for launching prosecution is not required against them ; and
4. Whereas , during the course of investigation, on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused person namely Waqsood Ahmad Khan @ Jignu S / o Mohammad Maqbool Khan R/ o Checkmerg , Arizal under section 19 of the Unlawful Activities (Prevention) Act, 1967 ; and
5. Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities ( Prevention) Act, 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused person ; and
6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section (2) of section 45 of the Unlawful Activities No. 28 - b ] The J& K Govt . Gazette , 10th Oct. , 2019 / 18th Asv . , 1941. 3
(Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law.
Now, therefore , in exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused person namely Maqsood Ahmad Khan @ Jignu S/ o Mohammad Maqbool Khan R/ o Checkmarg , Arizal for the commission of offences punishable U/ S 19 of Unlawful Activities (Prevention) Act , 1967 arising out of FIR No. 37/2018 of P/ S , Beerwah .

Mohammad Ashraf Baba ( all residents of Hajin) . Consequently personal search of two suspects was conducted and during the search some objectionable material in the shape of letter pads of banned outfit of Hizbul Mujahideen , printed poster and matrix sheet were recovered from their possession ; and
2 Whereas , a case FIR No. 01/2012 u/ s 120 - B RPC and 13 & 20 ULA (P) Act , 1967 was registered at Police Station, Hajin and investigation initiated ; and
3. Whereas , during the course of investigation , on the basis of statement of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima- facie case against the accused persons namely 1. Fayaz Ahmad Mir S/ o Gh . Mohammad Mir 2. Zubair Ahmad Parray S/ o Ab . Rashid Parray 3. Ishfaq Ahmad Baba S/ o Mohammad Ashraf Baba (All residents of Hajin) under sections 120 - B RPC , 13 & 20 of the Unlawful Activities (Prevention) Act, 1967. The accused have been arrested and later on released on bail under the orders ofHon'ble Court ; and
4. Whereas , the Authority appointed by the State Government under sub- section ( 2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused persons ; and
5. They have also slit the throat of the deceased with some sharp edged weapon and threw his dead body at Sesman near grid station adjacent to National Highway ; and

SRO - 951 . In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor is pleased to direct that the cadre of the Jammu and Kashmir Forensic Science Laboratory ( Gazetted) Service for the Union Territory of Jammu and Kashmir upon exclusion of the posts of Union Territory of Ladakh , shall comprise the posts as indicated in Schedule - I to this notification , subject to any modifications as may be necessary.
This shall come into force with immediate effect .
