Whereas , on the basis of an indent placed by Superintending Engineer , PWD ( R & B ) , Reasi - Udhampur Circle, Hq. Udhampur vide No. SEU/ Camp/ 2017-18 /1386-89 dated 07-06-2017 , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (ACR ) , Udhampur vide No. ACRU/ SQ/4717-27 dated 16-03-2019 for land measuring 13 Marlas , situated at Village Omara, Tehsil and District Udhampur ;

Whereas , the Collector , Land Acquisition ( ACR ) , Udhampur vide No. ACRU/ SQ/ 250 dated 29-04-2019 has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act was served upon the interested persons for filing objections , if any, to the proposed acquisition but no objection was received from the land owners/ interested persons in the prescribed time period as required under sections 5 & 5 - A of the Land Acquisition Act ;

Whereas , the report furnished by Collector, Land Acquisition (ACR) , Udhampur vide number referred to above duly endorsed by Deputy Commissioner, Udhampur vide No. DCU/ SQ/ 338-40 dated 03-05-2019 , Divisional Commissioner , Jammu vide No. 502/3533/Acq/ Omara/Udh/ 19 / 2024-26 dated 08-06-2019 and by the Financial Commissioner , Revenue vide No. FC - LS - LA/4935/ 2019 dated 12-09-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;

Whereas , the Government is satisfied that the land particulars whereof are given above is required for public purpose viz . for construction of 14.50 Mtrs . Span M/ able Bridge Lane over Devika in 1st RD 175-250 of Forest Link Road at Omara , Udhampur situated at Village Omara , Tehsil and District Udhampur by PW ( R & B ) Department .

Now , therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that land measurmg 13 Marlas situated in Village Omara , Tehsil and District Udhampur , particulars whereof are given above is required for public purpose viz . for construction of 14.50 Mtrs . Span M/ able Bridge Lane over Devika in 1st RD 175-250 of Forest Link Road at Omara , Udhampur situated at Village Omara , Tehsil and District Udhampur by PW ( R & B ) Department . Further , the Collector , Land Acquisition ( ACR ) , Udhampur is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .

Whereas , on the basis of indent placed by Chief Engineer , PWD (R& B) , Department , Jammu a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition (SDM ) , Katra vide No. SDM / K/ CLA/ 2019-20/121-27 dated 12-07-2019 for land measuring 07 Kanals , 06 Marlas and 02/½ Sarsai , situated in Village Panthal , Tehsil Katra , District Reasi ;

Whereas , the Collector, Land Acquisition ( SDM ) , Katra vide No. SDM/ K / CLA/2019-20/214-16 dated 02-09-2019 , has reported that the notification issued under section 4 ( 1 ) of the J & K State Land Acquisition Act by him was served upon the interested persons for filing objections , if any , to the proposed acquisition but , no objection was received from the land owners / interested persons within the prescribed period as required under sections 5 & 5 - A of the Land Acquisition Act ; and

Commissioner, Jammu vide No. 502/3593/ PMGSY/Demote/Rbn/ 19 / 2117 dated 03-08-2019 and by the Financial Commissioner , Revenue vide No. FC - LS /LA- 4951 /2019 dated 18-09-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;

Whereas , the Government is satisfied that the land particulars whereof are given above is required for public purpose viz . , for construction of Mehar Neera Ganote Road , situated at Village Demote , Tehsil and District Ramban under PMGSY.

Now, therefore , in pursuance of section 6 of the J& K State Land Acquisition Act , Samvat 1990 , it is declared that land measuring 02 Kanals and 16 Marlas , situated in Village Demote , Tehsil and District Ramban , particulars whereof are given above is required for public purpose viz . for construction of Mehar Neera Ganote Road , situated at Village Demote , Tehsil and District Ramban under PMGSY. Further , the Collector , Land Acquisition (ACR) , Ramban is directed under section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person( s ) as required under the Land Acquisition Act /Rules .

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat 1990 , it is ordered that on expiry of fifteen days from the publication of the notification under section 9 (2) of the said Act , the Collector, will take possession of the aforementioned land in Village Demote , Tehsil and District Ramban which is required for public purpose , subject to fulfillment of the conditions prescribed under section 9 ( 2) and section 17 - A of the Land Acquisition Act and Rules 63 of the Land Acquisition Rules .

Whereas , based upon the indent placed by the Industries and Commerce Department for acquisition of land measuring 137 Kanals and 12 Marlas , acquisition proceedings were initiated and notification under section 4 ( 1 ) of the J & K State Land Acquisition Act , ( Svt ) 1990 was issued vide Notification Number 13 of 2004 dated 26-06-2004 ;

Whereas , land acquisition proceedings in respect of the subject land could not be concluded as the same were challenged before the Hon'ble High Court by one Mr. Kuldeep Singh Salaria S/ o Chamel Singh Salaria R/ o Village Kalana , Tehsil and District Kathua in OWP 1315/2009 in case titled Col. Kuldeep Singh Salaria V/s . State of J&K 362 The J& K Govt. Gazette , 16th Jan. , 2020/26th Pausa, 1941. [No. 42 and ors. which vide its order dated 23-03-2018 , disposed off the writ petition and passed following directions :-

" in view of the aforesaid submissions and in the facts of the case the writ petition is disposed off with the direction to the Collector , Land Acquisition concerned to take a decision with regard to the continuation or otherwise of the land acquisition proceedings , after a lapse of more than 8 years , by a speaking order in accordance with law . Let the aforesaid exercise be carried out within a period of six weeks from the date of receipt of a certified copy of the order passed today" .

Whereas , the petitioner has also filed contempt petition before the Hon'ble High Court in Contempt Petition Number 304 of 2019 titled Kuldeep Singh Salaria V/ s . Vikas Kundal and ors . and which vide its order dated 03-07-2019 issued notice to the State Respondents for appearance . And the contempt petition has been listed on 13-09-2019 before the Single Bench of Hon'ble High Court at Jammu ;

Whereas , the matter was taken up with the Indenting Department i. e . Industries and Commerce Department which , after taking into consideration the pendency of the litigation before the Hon'ble High Court over the aforesaid land acquisition proceedings and delay in conclusion of acquisition proceedings conveyed vide their communication Number DP & C/M &P / J/45 / 525-28 dated 11-09-2019 , " That they had placed indent for acquisition of land measuring 137 Kanals and 12 Marlas at Village Nanan Chak, but after lapse of 9 years due to the pendency of the litigation before the Hon'ble High Court in case titled Kuldeep Singh Salaria and ors . in which acquisition of land measuring 16 Kanals and 18 Marlas has been challanged in the same village being part of the total chunk of 137 Kanals and 12 Marlas . Since the department is in the urgent need of the land bank and accordingly, placed revised indent for acquisition of the land measuring about 120 Kanals 14 Marlas only after deducation of the land which is subject matter of the litigation in the first instance " .

Accordingly , in exercise of the powers conferred upon me under section 4 ( 1 ) of the J & K State Land Acquisition Act , 1990 ( Svt . ) , I, Ghansham Singh , KAS , Collector , Land Acquisition ( Additional Deputy Commissioner) , Kathua , do hereby notify that the land particulars of which are given below is likely to be needed for public purpose , namely , for establishment of Industrial Estate at Village Nanan , Tehsil and District Kathua calling objections from the land owners / interested persons for acquisition of the aforesaid land .

As recommended by the technical committee following amendment is issued in PHQ NIT No. 84 of 2019 dated 13-12-2019 floated to procure Anti - Riot Gas Mask with canister : -

(i) Equivalent CE/NIOSH certification is acceptable . Valid certificate in this regard must be provided through NABL accreditation laboratory.

(ii ) The material should be light weight , sturdy and comfortable to wear . Polyster /Lycra is just for examply .

(iii) The mask should form a complete seal with the face so as not to allow escape of adulterated gases . No of straps should not be more than six and it should be easy to wear and take - off .

SRO - 605.- Whereas , on 31-01-2011 , Police Station , Pattan received a Docket on behalf of Dy. Supt . of Police (OPS ) , Pattan to the effect that Police Component , Pattan received an information through reliable sources that some terrorists were roaming in Pattan area upon which he along with nafri established a naka at Babatang NHW, Pattan . During checking , the naka party saw a suspected person coming from Palhallan towards Pattan Town , the said person on seeing the naka party tried to flee from the spot but was apprehended . On search , one letter pad of banned outfit Hizbul Mujahidin was recovered from his possession . During preliminary questioning the accused disclosed his name as Fayaz Ahmad Wani S / o Gh . Mohi - u - Din Wani R/ o Lolipora , Pattan and also narrated his affiliation with HM outfit as

2. Whereas , a case FIR No. 25/2011 under sections 13 & 17 UA( P) Act , was registered in Police Station , Pattan and investigation was set into motion ; and

3. Whereas , during the course of investigation , on the basis of statements of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused person namely , Fayaz Ahmad Wani S/ o Ghulam Mohi - u - Din Wani R/ o Lolapora for commission of offences under sections 13 & 17 of the Unlawful Activities ( Prevention) Act , 1967 ; and

4. Whereas , the Authority appointed by the State Government under sub - section ( 2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused person ; and

5. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law.

Now, therefore , in exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused person namely , Fayaz Ahmad Wani S / o Ghulam Mohi - u - Din Wani R/ o Lolapora for the commission of offences punishable under sections 13 & 17 of Unlawful Activities (Prevention) Act , 1967 , in case FIR No. 25/2011 of Police Station , Pattan .

2. Whereas , a case FIR No.10/2019 u/ s 7/25 Arms Act , 1959 , 38 ULA (P) Act of 1967 was registered at Police Station, Zainapora and investigation taken up ; and

3. Whereas , investigation conducted revealed that accused persons provided logistic as well as other support viz . carrying of arms ammunition for militants and worked as OGWs for HM terrorists ; and

4. SRO - 597.- Whereas on 17-04-2019 Police Station, Tarzoo received an information to the effect that some persons namely 01. Sajad Ahmad Rather S/ o Khazir Muhamamd Rather R/ o Takiybal , Sopore , 02 . Javaid Ahmad Bhat S/ o Ghulam Rasool Bhat RIO Dag Mohalla , Tarzoo , 03. Imtiyaz Ahmad Sheikh S/ o Bashir Ahmad Sheikh R/ o Khushal Colony Sopore , 4. Nasir Farooq Marazi S / o Farooq Ahmad Marazi R/ o Khushal Colony, Tulibal , Sopore affiliated with Al - Badder , LeT & JeM outfit as 2 The J& K Govt . Gazette , 17th Oct. , 2019/25th Asv . , 1941. [ No. 29 - a

OGWs were luring youth towards militancy and provide all logistic support/ information regarding movement of Security Forces to the active terrorists in the areas ; and

2. Whereas a case FIR No. 29/2019 U/S 13,16,18,20 ULA ( P) Act was registered in P/ S Tarzoo and investigation of the case was taken up ; and

3. Whereas , during the course of investigation, the four accused persons were apprehended and from their possession , two matrix sheets each were recovered . On further investigation, based on their disclosure , arms and ammunition which includes 13 live cartridges of AK series , 04 UBGL grenades and 17 live cartridges were recovered ; and

4. Whereas , based on the circumstantial and documentary evidence , and the statements recorded U/ S 161 and 164 -A Cr. PC , seizures and recoveries , the investigating officer has established a prima facie case under sections is , 18,20 ULA(P ) besides other offences against the above four accused persons . Being a juvenile one of the accused person namely Javaid Ahmad Bhat S/ o Ghulam Rasool Bhat R/ o Dag Mohalla, Tarzoo was bailed by Juvenile Justice Board Baramulla on 04.05.2019 , while the rest of the accused are on Judicial remand ; and

5. Whereas , the Authority appointed by the State Government under sub- section (2 ) of section 45 of the Unlawful Activities (Prevention) Act, 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused persons ; and

6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations/ views of the Authority appointed under sub - section (2 ) of section 45 of the Unlawful Activities (Prevention) Act, 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused persons for their prosecution under the aforesaid provisions of law.

Now, therefore , in exercise of the powers conferred by sub - section (2) of section 45 of the Unlawful Activities ( Prevention ) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused persons namely Sajad Ahmad Rather S / o Khazir Muhamamd Rather R/ o Takiybal , Sopore , 02. Javaid Ahmad Bhat S / o Ghulam Rasool Bhat R / o Dag Mohalla , Tarzoo , 03. Imtiyaz Ahmad Sheikh S / o Bashir Ahmad Sheikh R/ o Khushal Colony, Sopore , 4. Nasir Farooq Marazi S/ o Farooq Ahmad Marazi R/ o Khushal Colony Tulibal , Sopore for the commission of offences punishable u /s 13,18 & 20 of Unlawful Activities (Prevention) Act , 1967 , in case FIR No. 29/2019 of Police Station , Tarzoo .

SRO - 698.- In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor is pleased to direct that the cadre of the [ Jammu and Kashmir Health and Family Welfare ( Subordinate/Non- Gazetted) Service ] for the Union Territory of Ladakh , shall comprise the posts as indicated in Schedule- I to this notification , subject to any modifications as may be necessary .

This shall come into force with immediate effect .

SRO- 759.- In exercise of the powers conferred by proviso to Article 309 of the Constitution of India , the Governor is pleased to direct that the cadre of the Jammu and Kashmir Legal Metrology 2 The J & K Govt . Gazette , 25th Oct. , 2019/3rd Kart . , 1941. [ No. 30 - aag

( Subordinate ) Service for the Union Territory of Jammu and Kashmir upon exclusion of the posts of Union Territory of Ladakh , shall comprise the posts as indicated in Schedule - I to this notification , subject to any modifications as may be necessary.
