Whereas , the report furnished by Collector, Land Acquisition ( SDM ) , Katra , vide number referred to above duly endorsed by the District Collector (DC) , Reasi vide No. DC /Rsi/ 19-20/ 882-86/ SQ dated 09-09- 2019 Divisional Commissioner , Jammu vide No. 502/ 3630/PWD/ Kakrayal/ Rsi / 19 / 2433 dated 05-10-2019 and by the Financial Commissioner , Revenue vide No. FC - LS /LA- 5012/ 19 dated 18-10-2019 has been examined and it has been found that the land owners did not file any objection to the proposed acquisition ;
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 35 Kanals 06 Marals situated in Village Kotla , Tehsil Katra and District Reasi particulars whereof are given in " Annexure- A " is required for widening / upgradation of Panthal - Jhagger PWD road from 1st to Km . 13th (under CRPF ) situated in Village Kotla , Tehsil Katra and District Reasi . Further, the Collector , Land Acquisition ( SDM) , Katra is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .

Whereas , Tehsildar , Kishtwar was directed to prepare the Land Acquisition Papers of the above said scheme under rules . Accordingly, Tehsildar , Kishtwar submitted the requisite papers to this office vide No. 868 /OQ/Gen dated 24-12-2018 ; and
Whereas , the Divisional Forest Officer , Kishtwar , vide No. 716- 17/DFK dated 22-07-2019 , has re - verified and ascertained the correctness of assessment already made in favour of each land owner with regard to the No. of Non- Fruit Bearing Trees involved , indicating that the area is covered by thick Oak crop . inter alia reveal the incriminating contents scripted on the said question paper and name of the paper setter as Professor Noor Mohammad Bhat ; and
4. Whereas , the investigation conducted , prima facie , established the commission of offence punishable under section 13 of the ULA (P) Act 1967 , against the accused person namely ; Professor Noor Mohammad Bhat S/ o Haji Ali Mohammad Bhat R/ o Malikyar, Fateh Kadal , Srinagar
5. Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused person ; and
6. Whereas , after perusing the Case Diary, the relevant documents and also taking into consideration the observations /views of the Authority appointed under sub - section ( 2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law .
Now, therefore , in exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities ( Prevention) Act , 1967 , the State Government hereby accords sanction for launching prosecution against the accused person namely Professor Noor Mohammad Bhat S/ o Haji Ali Mohammad Bhat R/ o Malikyar , Fateh Kadal , Srinagar for the commission of offences punishable under section 13 of Unlawful Activities (Prevention) Act , 1967 , in case FIR No. 85/2010 of Police Station , Nigeen.

SRO - 618.-Whereas , on 17-05-2018 , Police Station , R.M. Bagh received an information from reliable sources to the effect that some unknown gunmen barged in the premises of Hotel Hill Skirt , Buchwara , Dalgate and snatched service weapons (02 INSAS Rifles and 01 SLR Rifle with magazines and ammunition) from the guard personnel of IRP 4th Bn . deployed there . The guard personnel have not shown any resistance to counter the incident of weapon snatching and have shown sheer cowardice and negligence towards duty ; and
2. Whereas , a case FIR No. 39/2018 under section 392 RPC 7/25 A.Act , 30 Police Act read with 3 PEPO was registered at Police Station , R. M. Bagh and investigation was taken up ; and 2

3. Whereas , during the course of investigation site plan of place of occurrence was prepared , and arms ammunition viz . AK 47 Rifle No. 18068461 and other ammunition and articles were seized as piece of evidence . The guard personnel namely Sgct . Parvaiz Ahmad No. 641 /IR 4th Bn. ( F - Coy) , Ct . Hilal Ahmad Sheikh No. 856 /IR 4th Bn . ( E- Coy) , Ct . Zameer Ahmad No. 820/ IR 4th Bn . (A- Coy) , and Ct . Nazir Ahmad No. 817 /IR 4th Bn . (E- Coy ) were taken into custody and questioned and it transpired that the accused have shown sheer cowardice and didn't resist the snatching of weapons and thereby shown negligence towards duty. During the course of investigation it transpired that during an encounter one snatched INSAS Rifle bearing Regd . No. 16372309 has been recovered from two killed terrorists namely 1. Mohammad Altaf Dar @ Altaf Kachroo S/ o Gh .. Mohammad Dar R/ o Hawoora , Mishpora District Kulgam. Accordingly the said INSAS Rifle was collected from concerned Police Station under Court Orders and later on seized in the instant case ; and
4. Whereas , during further course of investigation, it transpired that accused terrorists namely Aqib Nazir Chopan , Umer Rashid Wani , Umer Majeed Ganie , Mohd . Tahseen Batloo , Mohd . Altaf Dar and Mohd . Abass Sheikh along with accused OGWs namely Mohd . Shafeeq Bhat, Waseem Ahmad Khan and Gulzar Ahmad Rah had conducted a meeting in the house of Mohd. Shafeeq Bhat @ Shafeeq Molvi S/ o Gh . Qadir R / o Diyarwani , Batmaloo and conspired that they will snatch the weapons from the guard deployed at Hotel Hill Skirt and accordingly the allied documents viz . disclosure statements of accused 1. Mohd . Shafeeq Bhat @ Shafeeq Molvi S / o Gh . Qadir R/ o Diyarwani Batmaloo (OGW) 2. Waseem Khan S/ o Gh. Mohd. R/ o Diyarwani , Batmaloo recorded in case FIR No. 173/2018 under section 307 , 302 , 120 -B , 34 RPC 7/27 A. Act , 16 , 18 , 19 , 20 , 39 ULA ( P) of Police Station , Batmaloo were obtained and placed on file . The disclosure statement would reveal that on 16-05-2018 , terrorists namely Abass Sheikh , Tahseen @ Junaid conducted meeting with Umer Rashid , Aqib Nazir and Umer Majeed Ganie who hatched a criminal conspiracy for snatching the weapon from Police Guard posted at Hotel Hill Skrit , Buchwara , Dalgate . After snatching the weapon from the above said Hotel , one INSAS bearing No. 16372309 was given to Umer Rashid Wani who was arm less at that moment , while as remaining snatched arms/ ammunition were handed over to an unknown person , sent by Mohammad Altaf Dar @ Altaf Kachroo S / o Gh .. Mohammad Dar R/ o Hawoora Mishpora , who took the arms / ammunition to South Kashmir .

Based on the disclosure statement , six ( 06) accused persons were identified and out of six , four have been eliminated in different encounters with security forces and accused Tahseen Ahmad Batloo @Junaid S / o Ali Mohammad R/ o Zaindar Mohalla, Habba Kadal , has been arrested while as accused Mohd . Abass Shiekh S/ o Gh . Hassan Sheikh R/ o Rampora Qaimoh is absconding . During further course of investigation one more suspected person namely Gulzar Ahmad Rah S / o Habibullah R/ o Zaindar Mohalla , Habbakadal was found involved in the instant case who too was arrested ; and

Whereas , during the course of investigation , on the basis of statement of witnesses , the seizure memos and other evidence , the Investigating Officer established a prima facie case for the commission of offences punishable under section 30 Police Act read with 3 PEPO against accused police officials namely :-

It is pertinent to mention that accused 8 , 9 , 10 and 12 have been killed in different encounters with security forces against whom proceedings would be abated , while as accused No. 13 is absconding against whom proceedings under section 512 Cr . PC have been proposed ;

Whereas , the Authority appointed by the State Government under sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused persons ; and

SRO - 648.- Whereas , on 26-02-2018 accused Mushtaq Ahmad Chopan and other accused who were lodged at Police Lock up of Police Station , Tral came out of the Lock up for taking lunch . Accused Mushtaq Ahmad Chopan instead of taking lunch stated that he has to attend nature's call and went inside a bathroom and after some time , a Burka clad person came out from toilet block and crossed the Main Gate of Police Station , Tral . As no lady wearing Burka has visited Police Station , Tral on 26-02-2018 , the Incharge Guard/ Sentry of the Main Gate asked the person to stop but he managed to cross the Gate . One Sg . Ct . coming towards Police Station , Tral from outside Camps managed to hold the escapee and in the meantime , explosion 2

took place , as a result of which , said Sg . Ct . namely Mehraj - ud - Din No. 405 /Awt and escapee got seriously injured and later escapee succumbed to his injuries ; and
2. Whereas , a case FIR No. 20/2018 , under sections 221 , 224 RPC 18 , 20 ULA (P ) Act and 7/27 A. Act was registered at Police Station , Tral and investigation was taken up ; and
3. Whereas , during investigation, it came to fore that in pursuance of a well - knit criminal conspiracy hatched by some active terrorists of banned terrorist organisation Hizb - ul - Mujahedeen ( HM) with deceased and some other persons , to effect the escape of accused Mushtaq Ahmad Chopan from Police custody , a Burka, Ladies Dress , Pistol and Grenade was managed in premises of Police Station , Tral , through Zaina Begum taking advantage of the fact that ladies were not being subjected to body search or scan by gadgets at the Main Gate of said Police Station . The garments which were worne by deceased before changing them with the ladies dress were recovered from the said bathroom and one Pistol and two Magazines and 13 live cartridges were recovered/ seized from escapee's dead body which were hidden in the wrist belt worne by him ; and
4. Whereas , during further investigation , it came to fore that active terrorists of banned terrorist organization Hizb - ul - Mujahedeen (HM) namely, Umar Fayaz Lone alias Hammad Khan , Mohammad Irfan Rather , Mohammad Qasim and Shakoor Ahmad Parray have provided the recovered Arms /Ammunition to Mohammad Shafi Khan and Zaina Begum who managed the same inside the premises of Police Station , Tral to be used by Mushtaq Ahmad Chopan (Deceased) for managing his escape from the Police Custody. Mohammad Shafi Khan and Mst . Zaina Begum succeeded in handing over the illegally obtained Arms/ Ammunition together with lady wearing clothes to Mushtaq Ahmad Chopan ( Deceased) . Also during investigation , carelessness /dereliction and negligence towards their duties has been found on part of Head Constable Abdul Rehman Malik and Head Constable Ghulam Mohammad Itoo ; and
Whereas , during the course of investigation , on the basis of statements of witnesses the seizure memos and other evidence , the Investigating Officer established a prima facie case against the accused person namely 1. SRO - 804.-In exercise of the powers conferred by proviso to Article 309 of the Constitution of India , the Governor is pleased to direct that the cadre of the [Government Medical College , Doda ( Subordinate/ Non-Gazetted ) Service ] , Union Territory of Jammu and Kashmir, shall comprise the posts as indicated in Schedule - I to this notification , subject to any modifications as may be necessary.
This shall come into force with immediate effect .

SRO - 620.- In exercise of the powers conferred by sub - section (1) of section 9 read with sub- section ( 5) of section 15 of the Jammu and Kashmir Goods and Services Tax Act , 2017 ( Act No. V of 2017) , the State Government , on the recommendations of the Council , hereby makes the following amendments in Notification SRO No. GST - 1 dated 08-07-2017 , namely :-
In the said notification, -
in Schedule 1-2.5 % ,--
( i) S. No. 33A and the entries relating thereto shall be omitted ;

(a) Petrol , Liquefied Petroleum Gases ( LPG ) or Compressed Natural Gas ( CNG ) driven vehicles of engine capacity not exceeding 1200cc ; and
(b) Diesel driven vehicles of engine capacity not exceeding 1500cc for persons with orthopedic physical disability, subject to the condition that an officer not below the rank of Deputy Secretary to the Government of India in the Department of Heavy Industries certifies that the said goods shall be used by the persons with orthopedic physical disability in accordance with the guidelines issued by the said Department " , shall be substituted ;
(iv) S. No. 446 and the entries relating thereto shall be omitted .
C. in Schedule IV- 14 % ,-
(i ) after S. No. 12 and the entries relating thereto , the following S. No. and the entries shall be inserted , namely : -

SUDA) ( Non - Gazetted/Inferior Services) for the Union Territory of Jammu and Kashmir upon exclusion of the posts of Union Territory of Ladakh , shall comprise the posts as indicated in Schedule- I to this notification , subject to any modifications as may be necessary .
This shall come into force with immediate effect .
