Notification No. 262-Rev (LAJ) of 2019
Dated 25-10-2019.
Whereas, the land specifications whereof are given in "Annexure-A"
to this notification, is required for public purpose viz., for construction of road
from Ritti to Kuperla situated in Village Bassan, Tehsil and District Udhampur
under PMGSY, Phase-X ;

PMGSY Division, Udhampur vide No. CEJ/PMGSY/824-45 dated
25-04-2016, a notification under section 4 (1) was issued by Collector,
Land Acquisition (ACR), Udhampur vide No. ACRU/SQ/5705-13 dated
22-12-2017 read with corrigendum No. ACRU/SQ/841-49 dated 22-06-2019
for land measuring 42 Kanals, 01 Marla and 04 Sirsai, situated in Village
Bassan, Tehsil and District Udhampur ;
Whereas, the Collector, Land Acquisition (ACR), Udhampur vide
No. ACRU/SQ/3332-34 dated 24-09-2019, has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act was served upon the interested persons for filing objections, if any, to
the proposed acquisition, but no objection was received from the land
owners/ interested persons in the prescribed time period as required under
sections 5 and 5-A of the Land Acquisition Act ;
Whereas, the report furnished by the Collector, Land Acquisition (ACR),
Udhampur vide No. referred above duly endorsed by Deputy Commissioner,
Udhampur vide No. DCU/SQ/3532-34 dated 01-10-2019, Divisional
Commissioner, Jammu vide No. 502/3742/PMGSY/Bassan/Udr/19/2550
dated 19-10-2019 and by Financial Commissioner, Revenue vide No. FC-LS/
LA-5085/19 dated 23-10-2019 has been examined and it has been found that
the land owners did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof
are given in "Annexure-A" to this notification is required for public purpose
viz. for construction of road from Ritti to Kuperla situated in Village Bassan,
Tehsil and District Udhampur under PMGSY, Phase-X.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that land measuring
42 Kanals, 01 Marla and 04 Sirsai, situated in Village Bassan, Tehsil
and District Udhampur, particulars whereof are given in ''Annexure-A" to
this notification is required for public purposes viz. for construction of road
from Ritti to Kuperla situated in Village Bassan, Tehsil and District Udhampur No. 26] The J&K Govt. Gazette, 24th Sept., 2020/2nd Asv., 1942. 187 –––––––––––––––––––––––––––––––––––––––––––––––––––––– under PMGSY, Phase-X. Further, the Collector, Land Acquisition (ACR),
Udhampur is directed under section 7 of the said Act to take orders for
acquisition of the said land after giving prescribed notice to the interested
person (s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for
identification and proper title verification of all types of land involved in the
case and apportionment of compensation amongst all the interested persons/
rightful claimants, in accordance with the relevant laws/rules in force, while
making the award.

Jammu, FTR, BSF vide No. BSF/Fence/135 feet/FTR(J)/Engg/13/9274- No. 26] The J&K Govt. Gazette, 24th Sept., 2020/2nd Asv., 1942. 191 –––––––––––––––––––––––––––––––––––––––––––––––––––––– 76 dated 04-11-2013, a notification under section 4 (1) was issued by
Collector, Land Acquisition (SDM), R. S. Pura vide No. SDMR/LA/135
Feet-Sangral/2014-15/2535-42 dated 23-02-2015 read with corrigendum
No. SDMR/LA/BF/135 Feet/2018-19/2336-43 dated 30-01-2019 for land
measuring 151 Kanals, 1½ Marlas situated in Village Sangral, Tehsil
Suchetgarh, District Jammu ;
Whereas, the Collector, Land Acquisition (SDM), R. S. Pura vide
No. SDMR/LA/BF/135 Feet/Sangral/2018-19/2420 dated 15-02-2019, has
reported that the notification issued under section 4 (1) of the J&K State
Land Acquisition Act was served upon the interested persons for filing
objections, if any, to the proposed acquisition, but no objection was received
from the land owners/interested persons in the prescribed time period as
required under sections 5 and 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (SDM),
R. S. Pura vide No. referred to above duly endorsed by Deputy

02-09-2019 has been examined and it has been found that the land owners

Whereas, the Government is satisfied that the land particulars whereof

Whereas, indent was placed by the AE(Civ) Second in Command for Officer Commanding, Vide No. 229/LA/MITALGARH BR/14 Dated 30-01-2019 for construction of 60 M Span Steel Girder Bridge over Mitalgarh Nallah at KM 0.022 on Galhar-Sansari Road ; and
Whereas, Tehsildar, Nagseni was directed to prepare the Land Acquisition Papers of the above said scheme under rules. Accordingly Tehsildar Nagseni submitted the same papers to this office Vide No. TN/ Gen/PMT Bridge/2019-20/131-32 dated 13-05-2019.

Subject :— Acquisition of land measuring 03 Kanals 04 Marlas situated in Village Kheralaid, Tehsil Pouni acquired for construction of PMGSY road from Kheralaid to Gajore (1.93 Km) in Village Kherlaid, Tehsil Pouni, District Reasi, Phase-VII. ———
District Collector (Deputy Commissioner), Reasi was requested by the Superintending Engineer, PMGSY Circle, Reasi/Udhampur, Reasi in a letter of formal indent bearing No. SE/PMGSY/R/2762-64 dated 7-12-2009, for the acquisition of land for public purpose namely "Construction of PMGSY 204 The J&K Govt. Gazette, 24th Sept., 2020/2nd Asv., 1942. [No. 26
road from Kheraliad to Gajore in Village Kherlaid", Tehsil Pouni, District Reasi, Phase-VII. The case was referred to this Collectorate for initiating land acquisition proceedings under the provisions of Land Acquisition Act, 1990 BK and rule made thereunder. The revenue papers were got prepared through Tehsildar, Pouni and also got authenticated by the indenting department.
Accordingly, a notification under section 4(1) of Land Acquisition Act No. X SMVT, 1990 was issued by this Collectorate vide No. Col/LA/ACR/ 14/66-69 dated 1-2-2014 and was served upon the land owners/interested persons and indenting department, who were asked to file their objections, if any, within 15 days from the date of issuance of said notification. No objection was received by this Collectorate in response to said notification. The case was submitted to the District Collector (Deputy Commissioner) Reasi vide No. Col/LA/ACR/Reasi/15/49-52 dated 17-4-2015 for declaration under sections 6 and 7 of the Land Acquisition Act, 1990 BK from the competent authority. Thereafter, declaration under sections 6 & 7 was issued by the then District Collector, Reasi vide No. DC/Rsi/15-16/312-15 dated 6-5-2015 in the light of SRO-235 dated 11-8-2009 and notification under section 9 and 9A of the Act was also issued by then collector Land Acquisition (Assistant Commissioner, Revenue) Reasi vide No. Col/LA/ACR/Reasi/ 15/119-123 dated 11-5-2015 for the above mentioned quantum of land.
But before the issuance of final award for the instant land acquisition case, the above mentioned SRO-235 dated 11-8-2009 was rescinded vide notification SRO-25 dated 28-1-2016 and it is ordered that all cases of land acquisition seeking issuance of declaration under sections 6 & 7 of the Land Acquisition Act, 1990 BK, shall, invariably be submitted to the Administrative (Revenue) Department, irrespective of the quantum of land viz-a-viz valuation involved thereof.
Thereafter, the District Collector (Deputy Commissioner), Reasi requested Commissioner/Secretary to Government, Revenue Department, Civil Secretariat, Srinagar vide No. DC/Rsi/18-19/589-94/SQ dated 7-8-2018, for the issuance of declaration under sections 6 & 7 of the Land Acquisition Act. Thereafter, Commissioner/Secretary to Government, Revenue Department, Civil Secretariat, Srinagar vide notification No. 402- Rev(LAJ) of 2018 dated16-10-2018 issued declaration under sections 6 and 7 for the land measuring 03 Kanals 04 Marlas for the subject public purpose, with the direction to the Collector Land Acquisition (Assistant Commissioner Revenue), Reasi that he shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/ rightful claimants in accordance with the relevant laws/rules in force, while making the award and directed this Collectorate under section 7 of the said No. 26] The J&K Govt. Gazette, 24th Sept., 2020/2nd Asv., 1942. 205
Act to take order for acquisition of the said land after giving prescribed notice to the interested person(s) as required under the Land Acquisition Act/Rules.
Then a notification under sections 9 and 9A of the Land Acquisition Act was issued by this Collectorate vide No. CLA/ACR/Rsi/18-19/332- 340 dated 06-12-2018, served upon the land owners/interested persons and indenting department asking them to file their objections regarding measurement, title and quantum of compensation within a stipulated period. In response to said notification no objection was received from anyone concerned.
Principle of Compensation :
This land is located in Village, Kheralaid, located out of Municipal limits and is being acquired for PMGSY road. The land coming under the acquisition is non-agriculture in nature. The stamp duty rates for the year 2018-19 notified by the District Collector Reasi, vide No. DC/Rsi/17-18/ 1643-70/SQ dated 30-03-2018 of Village Kheralaid, Tehsil Pouni, District Reasi are Rs. 2.00 (in lacs) for irrigated, Rs.1.70 (in Lacs) for unirrigated and Rs.3.00 (in lacs) for small plots, per local kanal.
Therefore, keeping in view, the report of field staff, location of land under acquisition, notified Stamp duty rates for the year of 2018-19 and other factors, this Collectorate proposed a rate of Rs. 2.00 lacs for uncultivable land per local kanal for the land under instant acquisition, and based on the proposed rate of land compensation submitted a draft award to the District Collector (Deputy Commissioner) Reasi for determination of the rate in the Collectors meeting.
The instant case of the land acquisition was placed in the Collectors meeting held on 01-10-2019 headed by District Collector, Reasi and rate of land compensation proposed by this Collectorate was discussed threadbare. The committee of Collectors observed that the rate of land compensation proposed by this Collectorate was on the lower side and finally unanimously approved a rate of Rs. 2.50 lacs (Rupees two lacs and fifty thousand only) per local kanal, for un-cultivable land (GM and BQ) under instant acquisition. The minutes of the said Collectors meeting have been communicated to this Collectorate vide No. DC/Rsi/2019-20/1199-1207/SQ dated 11-10-2019. Thereafter, a revised draft award bearing No. Col/ACR/Rsi/19-20/279 dated 28-10-2019 was submitted to the District Collector, Reasi for the approval of rate of land compensation and sanction of awarded amount in the light of SRO-132 of 2019 dated 25-02-2019. The District Collector (Deputy Commissioner), Reasi vide No. DC/Rsi/19-20/1509-12/SQ dated 28-10-2019 accorded the approval of rate of land compensation and sanction of awarded amount.
Further, no structure, fruit bearing and non-fruit bearing trees are
reported to be involved in the acquisition.

The requisite certificates are recorded as under :—

2. That The adequate funds on account of land compensation are available
with this Collectorate.
3. That no compensation has been paid in respect of the land under
acquisition earlier.
4. That the Shajra Khasra of the land has been authenticated by the
indenting department as token of its correctness.
5. That the land compensation will be paid in accordance with the provisions
of Agrarian Reforms Act, 1976.
6. The Shajra Khasra/Aks prepared in the instant case is in accordance
with the spot position and field book.
7. That no evacuee property/Auqaf property/Dharmarth/Forest land is
involved in the instant case of land acquisition.
8. It is also certified that the land compensation payable to the owners/ interested persons as shown in the apportionment statement shall be tendered in accordance with the provisions of Agrarian Reforms Act, 1976 and guidelines given in the Circular issued by the Revenue Department under No. (LB)-10/80 dated 23-03-1980.

e-Tenders are invited from reputed vendors/firms/entities for Survey, preparation, Customization, Installation, Testing, Commissioning and Maintenance of Inventory Management System as per terms of reference detailed out in Annexure-A of this e-NIT. The e-NIT consisting of qualifying information, eligibility criteria, Bill of quantities, (B.O.Q.), Set of terms and conditions of contract and other details can be seen/downloaded from the J&K e-Procurement Portal www.jktenders.gov.in from 07-07-2020 (1400 hours) to 28-07-2020 up to 1800 hours. Bidders submitting their bids online shall be accepted and no document other than those mentioned in the e-NIT shall be accepted manually.
The tenders (technical bids only) will be opened online on 30-07-2020 at 1100 hours at Police Headquarters, J&K Gulshan Ground, Jammu/Peerbagh, Srinagar. In case of unforeseen circumstances, the date of opening will be next working day or as notified separately.
A pre-bid meeting shall be held on 18-07-2020 at 1500 hours for clarification of queries of the prospective bidders. The intending bidders shall attend the meeting well in time at Conference Hall, PHQ, Gulshan Ground, Jammu. Alternatively the intending bidders shall email their queries pertaining to this e-NIT for clarification at [email protected]. The same shall be mailed within 15 days from the date of floating this e-NIT beyond which no query shall be entertained.

Jammu, the 17th January, 2020.
S.O.-30.–Whereas, on 18-05-2019, Police Station, Qazigund
apprehended a person in suspicious circumstances during naka checking
who disclosed his name as Musadiq Bashir Dar S/o Bashir Ahmad Dar
R/o Waripora, Handwara and from his possession two cell phones were
recovered which contain incriminating material ; and 2 The J&K Govt. Gazette, 17th Jan., 2020/27th Pausa, 1941. [No. 42-f –––––––––––––––––––––––––––––––––––––––––––––—–––—————–– 2. Whereas, a case FIR No. 94/2019 under section 13 ULA(P) Act
was registered in Police Station, Qazigund and investigation of the case
was taken up ; and
3. Whereas, during the course of investigation, accused Musadiq
Bashir Dar disclosed that he is in contact with active terrorist namely, Ishaq
Sher Gujri @ Hyder and provides shelter/logistic support to him and other
terrorists. The recovered cell phones from his possession were subjected
to examination in presence of Executive Magistrate and BBM chat data
was recovered and stored on a CD ; and recovered data revealed his
contracts with the active terrorists of the area especially Ishaq Sher Gujri
@ Hyder ; and
4. Whereas, based on the circumstantial and documentary evidence,
and the statement of witnesses recorded under relevant sections of law,
the Investigating Officer has established a prima facie case under section
13 against the above mentioned accused person ; and
5. Whereas, the Authority appointed by the Government of Jammu
and Kashmir under sub-section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967, has independently scrutinized the Case Diary file
and all the other relevant documents relating to the case and has come to a
definite conclusion that this is a fit case for accord of prosecution sanction
against the said accused person ; and
6. Whereas, after perusing the Case Diary, the relevant documents
and also taking into consideration the observations/views of the Authority
appointed under sub-section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government of Jammu and Kashmir is of the
view that there is sufficient material and evidence available against the
accused person for his prosecution under the aforesaid provisions
of law.
Now, therefore, in exercise of powers conferred by sub-section (2)
of section 45 of the Unlawful Activities (Prevention) Act, 1967, the
Government of Jammu and Kashmir hereby accords sanction for launching
prosecution against the accused person namely, Musadiq Bashir Dar S/o

S.O.-48––Whereas, on 01-03-2019, Police Station, Tarzoo received information through reliable source that the activists of Jammat-e-Islami (JeI) were carrying out anti-national activities in the jurisdiction of Police 2 The J&K Govt. The activists of the said organization include procuring money from various illegal sources for use of the same in the militancy related activities ; and
2. Whereas, Jammat-e-Islami Jammu and Kashmir has been declared as an unlawful association under Notification S.O.-1069 (E) dated February 28, 2019 issued by the Central Government, under section 3 (1) of the Unlawful Activities (Prevention) Act, 1967 ; and
3. Whereas, a case FIR No. 07/2019 under sections 10 and 13 of Unlawful activities (Prevention) Act, 1967, was registered in Police Station, Tarzoo and investigation taken up ; and
4. Whereas, during the course of investigation, I/O visited site, prepared site plan, recorded the statement of witnesses and accused person namely, Mohammad Maqbool Malla S/o Abdul Subhan Malla R/o Amberpora, Tarzoo an active member of banned outfit of JeI has been arrested in the case ; and
5. Whereas, on the basis of statements of witnesses, and other evidence, the Investigation Officer established a prima facie case against the accused person namely, Muhamad Maqbool Malla S/o Abdul Subhan Malla R/o Amberpora, Tarzoo for commission of offences under sections 10 and 13 of the Unlawful Activities (Prevention) Act, 1967 ; and
6. S.O.-52.––Whereas, on 25-08-2018, Police Station, Handwara received missing reports from the parents of (1) Umar Bashir Sheikh S/o Bashir Ahmad Sheikh, (2) Umar Khazir Sheikh @ Danish S/o Khazir Mohammad Sheikh R's/o Chotipora, (3) Wasim Ahmad Khan S/o Furtaz Ahmad R/o Kargam and (4) Tahir Abdullah Bhat S/o Mohammad Abdullah Bhat R/o Kohroo stating therein that their wards are missing since 24-08-2018 ; and 2 The J&K Govt. Gazette, 10th Feb., 2020/21st Magha, 1941. [No. 45-b –––––––––––––––––––––––––––––––––––––––––—–––—————––– 2. Whereas, during investigation, Police Handwara came to know that the missing youth have joined Unlawful Organization (Al Badar outfit) with the intention to indulge in subversive activities in the area ; and
3. Whereas, a case FIR No. 337/2018 under sections 13, 18-B, 39 of Unlawful Activities (Prevention) Act, 1967 was registered in Police Station, Handwara and investigation set into motion ; and
4. Whereas, during investigation of the case, it surfaced that all the aforementioned accused persons have joined militant ranks on being motivated and instigated by one Ajaz Ahamd Mir (OGW) S/o Gh. Ahmad Mir R/o Langate, Kupwara ; and
5. Whereas, during further investigation it came to fore that one Ishaq Ahmad Sheikh S/o Gh. Mohammad Sheikh R/o Chotipora had transported the above mentioned accused persons in vehicle bearing Reg. No. 0720-JK09B and facilitated their stay in Kupwara, however in the meantime the accused persons were arrested by the Police ; and
6. Whereas, statement of witnesses under sections 161 and 164-A Cr. P. C. were re-recorded and other evidence collected by the Investigating Officer and on conclusion of the investigation by the I/O, a prima facie case against the below mentioned accused persons has been proved under various provisions of Unlawful Activities (Prevention) Act, 1967 as shown against each :—

SRO-541.––Whereas, on 05-05-2018, Police Station, Hajin received a written report from one Ab. Rehman Dar S/o Ab. Jabbar Dar R/o Gulshan Mohalla, Hajin to the effect that during the intervening night of 04/05-05-2018, some unknown terrorist barged into his residential house and kidnapped his son and brother namely, Bashir Ahmad Dar 2 The J&K Govt. Gazette, 25th Sept., 2019/3rd Asv., 1941. [No. 25-c –––––––––––––––––––––––––––––––––––––––––––––—–––—————
and Gh. Hassan Dar @ Rassa and later both of them were killed and their dead bodies were left near local Mosque Gulshan Mohalla, Shahgund etc. ; and
2. Whereas, a case FIR No. 26/2018 under sections 302, 364, 458 RPC, 7/27 A. Act was registered at Police Station, Hajin and investigation was taken up ; and
3. Whereas, during the course of investigation, site plan was prepared and dead bodies of both the kidnapped persons namely, Bashir Ahmad Dar and Gh. Hassan Dar were recovered and taken into possession. Necessary memos viz. recovery memo, injury memo and identification memo, were also prepared. After conducting medico legal formalities the dead bodies were handed over to their legal heirs for last rites. During investigation, statement of witnesses were recorded under section 161 Cr. P. C. and placed on record. During further investigation statement of material witness was recorded under section 164 Cr. P. C. who identified the accused persons as 01. Mohammad Saleem Parray S/o Gh. Mohammad R/o Kan Mohalla, Hajin a local militant and three foreign terrorist viz. 2. Ali @ Maaz, 3. Rizwan @ Jindal and 4. Fehdullah @ Abdullah @ Zoong and revealed further that they are involved in kidnapping and lateron killing of the two local persons. Based on the facts and circumstances that enumerated during investigation sections 16, 18, 20, 38 of UAP Act were added in the case ; and
4. Whereas, cogent evidence prima facie establishes the involvement of accused militants namely, 01. Mohammad Saleem Parray S/o Gh. Mohammad R/o Khan Mohalla, Hajin and three foreign terrorist viz. 2. Ali @ Maaz, 3. Rizwan @ Jindal and 4. Fehdullah @ Abdullah @ Zoong in the commission of crime punishable under sections 302, 364, 458 R. P. C., 16, 18, 20, 38 of ULA(P) Act and investigation concluded as proved against them. Among the four involved accused persons three foreign terrorists viz. Ali @ Maaz, Rizwan @ Jindal and Fehdullah @ Abdullah @ Zoong have been killed during encounter at Par Mohalla, Hajin on 30-08-2018 as per copy of FIR No. 46/2018 under sections 307 RPC r/w, 7/27 A. Act of Police Station, Hajin, which is placed on record. While accused 1. Mohammad Saleem Parray No. 25-c] The J&K Govt. S/o Gh. Mohammad R/o Kan Mahalla, Hajin is an active militant and against whom proceedings under section 512 Cr. P. C. have been proposed ; and
5. Whereas, the Authority appointed by the State Government under sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the said accused person ; and
6. Whereas, after perusing the Case Diary, the relevant documents and also taking into consideration the observations/views of the Authority appointed under sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, the State Government is of the view that there is sufficient material and evidence available against the accused person for his prosecution under the aforesaid provisions of law.
7. Now, therefore, in exercise of powers conferred by sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, the State Government hereby accords sanction for launching prosecution against the accused person namely, Mohammad Saleem Parray S/o Ghulam Mohammad R/o Kan Mohalla, Hajin for the commission of offences punishable under sections 16, 18, 20 and 38 of Unlawful Activities (Prevention) Act, 1967 arising out of FIR No. 26/2018 of Police Station, Hajin.
