Dated 02-12-2021.

The UT of Jammu and Kashmir is exposed to natural hazards like

floods, droughts, gale winds and earthquakes which are not rare or unusual 602 The J&K Official Gazette, 6th Jan., 2022/16th Pausa, 1943. [No. 41 ––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––

phenomenon in the UT. The vulnerability varies from region to region,

which often turn into disasters causing significant disruption of socio

economic life of communities leading to loss of life and property.

The India Disaster Resource Network (IDRN) is a web-based

platform for managing the following :—

(a) Inventory of equipment ;

(b) Skilled human resources ; and

(c) Critical supplies for emergency response.

It was initiated by Ministry of Home Affairs (MHA) under the

GoI-UNDP Disaster Risk Management (DRM) Programme with the aim

to build up a systematic inventory of equipment and skilled human resources,

so that disaster managers can find the location and details of the resources

for immediate response.

National Institute of Disaster Management (NIDM), Ministry of Home

Affairs, Government of India, is managing the IDRN portal since June,

2008. The online inventory of resources i. e., IDRN, is hosted in the National

Informatic Centre (NIC), New Delhi. IDRM is responsible for maintaining

and monitoring the data and the portal. Authorized Government officers

have access to the portal and the District Authorities are authorized for

uploading and updating the data time to time after collecting it from various

line departments of their respective districts. The Updation of the information

on IDRN portal is the responsibility of the District Authorities.

As such through the medium of this circular, it is enjoined upon all the

Deputy Commissioners of the UT of J&K (Chairman, DDMA), to ensure

uploading and up-date of the data on India Disaster Resource Network

(IDRN) portal so that such proactive mechanism may help in containing

the effects of any future disaster.

Note :—Each Chairman of DDMA shall designate an officer in their

respective Districts by entrusting responsibility to him/her to

regularly upload data on IRDN under intimation to DoDMRRR.

Whereas, on the basis of indent placed by Executive Engineer, PWD

Whereas, the Collector, Land Acquisition (ACR), Doda, vide No. 1595-

1600/Acq dated 21-10-2019, has reported that the notification issued under

section 4 (1) of the J&K State Land Acquisition Act by him was served

upon the interested persons for filing objections, if any, to the proposed

acquisition, but no objection was received from the land owners/interested

persons within the prescribed period as required under sections 5 & 5-A of

the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Doda, vide letter referred to above duly endorsed by District Collector (DC),

Doda vide No. 491/LAC/D/19 dated 21-10-2019, Divisional Commissioner,

Jammu vide No. 502/3883/PWD/Beoli/D/19/2931 dated 27-11-2019 and by

Financial Commissioner, Revenue vide No. FC-LS/LA/4962/2019 dated 29-

07-2020 has been examined and it has been found that the land owners did

not file any objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars whereof

are given above is required for public purpose viz. for construction of Bheli

Lal Draman road under PWD (R&B) Department.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring

44 Kanals and 17 Marlas, situated in Village Beoli, Tehsil and District Doda

is required for public purposes viz. for construction of Bheli Lal Draman

under PWD (R&B), situated at Village Beoli, Tehsil and District Doda.

Further, the Collector, Land Acquisition (ACR), Doda is directed under section

7 of the said Act to take orders for acquisition of the land after giving

prescribed notice to the interested person(s) as required under the Land

Acquisition Act/rules.

Howeveer, the Collector concerned shall be personally responsible

for identification and proper title verification of all types of lands involved in

the case for making apportionment of compensation amongst all the interested

porsons/rightful claimants in accordance with the relevent laws/rules in force,

while making the award.

5. Reservation :

(i) A candidate seeking his/her consideration under reserved categories must ensure that he/she possesses a valid Category Certificate on the cut-off-date.

(ii) The candidature of the candidates will be provisional till the genuineness of the reserved category certificate is verified by the Appointing Authority.

(iii) Candidates may note that in case a claim for reservation is made on the basis of false/fake/fraudulent certificate, he/she shall be debarred from the examination(s) conducted by the J&K Public Service Commission, in addition to any other penal action as may be deemed appropriate.

6. Horizontal Reservation :

7. Domicile :

The candidate should be a Domicile of the Union Territory of Jammu and Kashmir. The candidate must possess the Domicile Certificate issued by the Competent Authority in the prescribed format as on the last date prescribed for submission of online application form.

8. Centre of Examination :

i. The examination will be held at Srinagar and Jammu centres. All the candidates shall indicate the option for examination centre as indicated above.

ii. The allotment of centres shall be at sole discretion of the Commission and once a centre is allotted to a candidate, request for a change of centre will not be entertained.

iii. Information about the examination indicating the time table and Centre of Examination for the candidates will be uploaded on the websites of the Commission about two weeks before the date of examination. If any candidate does not find his/her Roll Number on the website of the Commission, one week before the date of examination, he/ she must immediately contact the Commission's Office at Srinagar/Jammu, with proof of having submitted his/her application. Failure to do so will deprive him/her of any claim for consideration.

iv. Candidate must submit his/her online application form, Email ID and Mobile Number along with his/her Name, Date of Birth and Name of the Examination, while addressing any communication to the Commission. Communication from the candidates not furnishing these particulars shall not be entertained.

v. Admit Cards will be available for downloading about two weeks before the date of examination on the official website of the Commission i. e. jkpsc.nic.in. Candidate must bring printout of the Admit Card/Roll Number Slip to the Examination Hall.

vi. For securing entry into the centre of examination, in addition to the Admit Card/Roll Number Slip, it is mandatory to carry at least two passport size recent color photographs (not taken earlier than 01-01-2021) and any of the original valid Photo-Id proof such as—

i. Aadhar Card/E-Aadhar ;

ii. Voter's ID Card ;

iii. Driving License ;

9. Requisite Fee :

After successful submission of the online application form, candidate will be required to deposit requisite fee through online mode. The amount of fee to be paid is given below :—

General Category = Rs. 1000.00

Reserved Categories = Rs. 500.00

PHC Candidates = Nil.

Note :—i. The application form submitted without deposition of the fee, which gets substantiated through reflection of the same on the application form, shall be treated as incomplete and candidature shall be deemed to have been rejected without any notice. No representation against such rejection shall be entertained.

ii. Submission of multiple applications by way of prefixing Mr./Ms. or through generation of multiple User ID's or any other mode, followed by either non-payment of fee particulars or fee particulars (TID) of one application (RID) being mentioned against another application with a different RID would lead to rejection of the online application. The applicants who are submitting multiple applications should note that only the applications with higher Registration ID (RID) number shall be entertained by the Commission and fee paid against one RID shall not be adjusted against any other RID number. Besides a strict disciplinary action shall be taken including the cancellation of candidature and debarment for future examinations of J&K PSC will be taken against such applicants.

10. Scheme of Selection :

(i) In pursuance of SRO No. 325 dated 12-07-2013 read with amendment made vide SRO No. 388 dated l0-09-2018, the candidate(s) will be selected on the basis of a written test comprising of Multiple Choice Question (MCQ).

(ii) As far as possible the Multiple Choice Question(s) will be of the standards as have been prescribed for the National Entrance Eligible Test (NEET) for admission to PG courses.

(iii) The written examination (MCQ type) will be of two hours

duration (120 minutes) having 100 questions.

(iv) There will be negative marking for incorrect answers

(as detailed below) for all questions—

(a) There are four alternative for the answers to every question. For each question for which a wrong answer has been given by the candidate, one fourth (0.25) of the marks assigned to that question will be deducted as penalty.

(b) If a candidate gives more than one answer, it will be treated as a wrong answer even if one of the given answer happen to be correct and there will be same penalty as above for that question.

(c) If a question is left blank i. e. no answer is given by the

candidate, there will be no penalty for that question.

(v) The candidate(s) who crosses the bench mark as has been laid down in Rule-50 of J&K PSC (Business and Procedure Rules), 2021 shall be recommended for appointment.

11. Provision of Compensatory Time and Assistance of Scribe :

(i) On request of a visually impaired (Blind) or any other candidate with Locomotor Disability and Cerebral Palsy where dominant (writing) extremity is affected to the extent of slowing the performance or function (minimum of 40% impairment), the candidate shall be provided assistance of an amanuensis (Scribe) on production of a Disability Certificate issued by the Standing Medical Board or Medical Board constituted by the Government. The scribe should have at least one qualification below than the requirement for the post applied for by the candidate(s) and further should be from an academic stream different from that stipulated for the post. The scribe shall be paid remuneration charges by the Commission equivalent to the honorarium paid to the Invigilator :

Provided the concerned Supervisor shall ensure that the scribe provided to the candidate on the day of examination shall not extend any type of help to the candidate in solving the questions.

12. Documents to be mandatorily uploaded :

While filling the online application form, the applicant(s) are required to mandatorily upload the following documents along with the online application form :—

(i) Date of Birth Certificate (Secondary School/Matric

Certificate)-1 leaf.

(ii) Domicile Certificate-1 leaf.

(iii) Category Certificate (if claiming benefit under that

category)-1 leaf.

iv) MBBS Degree Certificate along with the consolidated

Marks Cards-up to 5 leaves.

(v) Internship Certificate-01 leaf.

(vi) Registration Certificate-0l leaf.

NOTE :

It may be noted that the requisite documents uploaded by the candidates must be issued before the prescribed cut-of-date of advertisement notification and that no further opportunity shall be provided to upload any document and action under rules including rejection of application form/candidature etc. will be taken without any further notice.

13. Important instructions regarding filling up of online

applications are given herein below :—

(a) Candidates are required to apply online through the website of the Commission i. e. http://www.jkpsc.nic.in. No other means/mode of application shall be accepted.

(b) Candidates are first required to go to the JKPSC website www.jkpsc.nic.in and click on the link "One Time Registration" or click on Login menu if you have already created your profile with the JKPSC.

(d) The candidate shall also be required to upload the image of date stamped recent passport size color photograph and signature. The photograph should not be taken earlier than 01-01-2021.

(e) Size of the photograph (passport size) and signature must

be between 10kB to 20kB in *.jpeg or *jpg only.

(f) After successful submission of all the details in your OTR account, check the eligibility conditions as mentioned in the advertisement notification before applying for the post.

(g) Click on the "show examination" as shown against the

respective post/examination you want to apply.

(h) On clicking on the "show examination" a window will appear on your computer screen, select the month of the advertisement notification for which you want to apply, a link(s) for the post(s) will appear on the computer screen.

(i) An "APPLY" button is shown against the respective post and the candidates will click on the "APPLY" button against the post he/she is eligible.

(j) On clicking "APPLY" button, an instruction window will appear. Candidates should read instructions carefully before clicking on "APPLY" button at the bottom of the webpage.

(k) On clicking "APPLY" button, the system will display all facts/particulars that a candidate may have mentioned while filling up the necessary fields of his/her OTR account. Candidate shall fill up the remaining required fields in the application form and accept the declaration thereof.

(l) Once the candidate is satisfied about the correctness of the filled in details, then, he or she may click on "SUBMIT" button to finally push the data into server with successful submission report.

(m) On successful submission of the basic details, the candidates will be required to pay the online fee and uploading of the documents, for final submission of the online application form.

(n) Candidates can pay the requisite fee through online mode in the "SUBMITTED APPLICATIONS" menu in your account.

(o) After successful payment of the fee, the fee status will get reflected on the Online Application Form. Candidates can check the fee status by clicking on the Print Application Button in the submitted applications menu in your JKPSC account. In case the payment status shows either "not submitted or under processing or status has not been reflected on your submitted application form", candidates(s) are advised to contact the JKPSC Office at Solina, Srinagar/Resham Ghar Colony, Jammu immediately for clarification. Further where the online fee is paid through other service providers the candidate must ensure that not only the amount of fee is debited from his/Service Provider's Account but also credited into the official account of JKPSC.

(p) The candidate would be able to get the printout of his/her submitted application only after the payment of the requisite fee and uploading of requisite documents viz. Date of Birth Certificate, Degree Certificate, Category Certificate and Domicile Certificate.

(q) The JKPSC will not undertake detailed scrutiny of applications for the eligibility and other aspects at the time of written examination and therefore, candidature will be accepted only provisionally. The candidates are advised to go through the requirements of educational qualification, age, etc. and satisfy themselves that they are eligible for the post(s). Copies of supporting documents will be sought at the time of document verification. When scrutiny is undertaken, if any, claim if made in the application is not found/substantiated by proof, the candidature will be cancelled and the Commission's decision shall be final and binding.

(r) Please note that the above procedure is the only valid procedure for applying. No other mode of application or incomplete steps would be accepted and such applications would be rejected.

14. Editing of the online application form :

Candidates who have successfully submitted the online application

form along with requisite fee will be allowed to edit some of the fields

in their submitted online application form within three days after the

cut-of-date i. e. from 22-01-2022 to 24-01-2022 (11.59 P. M.). Detailed

instruction in this regard will be made available on the website.

15. Action against candidates found guilty of misconduct :

Candidates are advised that they should not furnish any particulars

that are false or suppress any material information.

A candidate who is, or has been, declared by the Commission,

to be guilty of—

i. obtaining by wrongful support of his/her candidature by any

means ; or

ii. impersonating ; or

iii. procuring impersonation by any person ; or

iv. submitting fabricated documents or documents which have

been tampered with ; or

v. making statements which are incorrect, or false or

suppressing material information ; or

vi. resorting to any other irregular or improper means in

connection with his/her candidature for the selection ; or

vii. using unfairmeans during the test ; or

viii. writing irrelevant matter including obscene language or

pornographic matter, in the script(s) ; or

ix. misbehaving in any other manner in the examination

hall ; or

x. harassing or doing bodily harm to the staff employed by

the Commission for the conduct of their test ; or

xi. attempting to commit or, as the case may be, abetting the

foregoing clauses may, in addition to rendering himself/

herself liable to criminal prosecution shall be liable—

(a) to be disqualified by the Commission from selection

(b) to be debarred either permanently or for a specified

period—

(i) By the Commission from any examination or

selection held by them ;

(ii) By the Union Territory Government from any

employment under them ; and

(c) if he/she is already in-service under Government, disciplinary action can be taken against him/her under the appropriate rules.

SO-284.—In exercise of the powers conferred by proviso to Article 309 of Constitution of the India, the Lieutenant Governor is pleased to make the following rules, namely :—

1. Short title and commencement.—(1) These rules may be called the Government Medical College, Anantnag (Gazetted) Service Recruitment Rules, 202l.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Administrative Department" means the Department of the Government in the Civil Secretariat holding the administrative charge of the Service;

(b) "Cadre" means the cadre of the service;

(c) "Commission" means the Jammu & Kashmir Public Service Commission;

(d) "Government" means the Government of Jammu and Kashmir;

(e) "Head of the Department" means the Major Head of the Department holding the administrative control of the organization;

(f) "Member of the Service" means a person appointed to a post in the service under the provisions of these rules;

(g) "Post" means a permanent and temporary post, carrying a definite time scale of pay sanctioned by the competent authority;

(h) "Rules" mean the Government Medical College, Anantnag (Gazetted) Service Recruitment Rules, 2021;

(i) "Schedules" mean the schedules annexed to these rules;

(j) "Service" means Government Medical College, Anantnag Gazetted Service; and

(k) "UT" means the Union Territory of Jammu and Kashmir.

(2) Words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956/ the Jammu and Kashmir Civil Services Regulations.

3. Constitution of service.—(1) From the date of commencement of these rules, there shall be constituted the Government Medical College, Anantnag, Gazetted Service.

(2) The Government may, at the commencement of these rules, appoint to the service any person who is eligible for appointment to that service at the commencement of these rules and is holding in substantive capacity any post included in the cadre of the service :

Provided that for the purposes of initial constitution of the service, the person holding any post in substantive capacity to which he/she was appointed by the competent authority under rules included in the cadre of the service in its sanctioned scale of pay shall be deemed to have been appointed to the service under these rules if he/she is fully qualified to hold the post under these rules, unless he/she opts otherwise within 15 days from the commencement of these rules.

Explanation :—The word "holding" means a person holding a post included in the cadre of Government Medical College, Anantnag (Gazetted) Service, in its sanctioned scale of pay on regular basis under orders of competent authority and will not cover the persons holding a post on ex-cadre/deputation basis or on ad hoc basis or in a stop gap arrangement.

4. Strength and composition of the service.—(1) The authorized permanent and temporary strength of the cadre and the nature of the posts included therein shall be determined by the Government from time to time and shall, at the initial constitution of the service under rules, be such as specified in Schedule-I annexed to these rules :

Provided that the Government may create temporary posts in the cadre of the service for specified period as may be considered necessary from time to time.

(2) The Government shall, at the interval of every five years or at such other intervals as may be necessary, re-examine the strength and composition of the cadre of the service and make such alterations therein as it deems fit.

5. Qualification and method of recruitment.—(1) No person shall be eligible for appointment to any post in any class, category or grade in the service unless he/she possesses the qualifications as laid down in Schedule-II annexed to these rules and fulfils other requirements 4 The J&K Official Gazette, 18th Aug., 2021/27th Srav., 1943. of recruitment as provided in the rules and orders of the Government for the time being in force.

(2) Appointment to the service shall be made—

(a) by direct recruitment; or

(b) by promotion.

6. Probation.—(1) Probation of persons appointed to the service by direct recruitment shall be regularized in terms of the Jammu and Kashmir Probationer (Condition of Service, Pay and Allowances) and Fixation of Tenure Rules, 2020 and in all other cases under the provisions of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956.

(2) The pay of person appointed to the service under these rules through direct recruitment shall be regulated as per the provisions of Jammu and Kashmir Probationer (Condition of Service, Pay and Allowances) and Fixation of Tenure Rules, 2020 and in all other cases, as per the provisions of Jammu and Kashmir Civil Service Regulations, 1956 or general rules as issued from time to time.

7. Reservation in appointments.—While making appointments either by direct recruitment or by promotion, reservation shall be made in accordance with the rules and orders issued from time to time for members of Scheduled Castes/Scheduled Tribes/Backward Classes or any other category or class of persons under the provisions of the Jammu and Kashmir Reservation Act, 2004 and the rules made thereunder.

8. Training and Departmental Examinations.—Persons appointed to the service by direct recruitment shall be required to undergo such training from time to time during the course of probation and to pass during the period of probation or trial such departmental examination as the Government may prescribe :

Provided that the Government may exempt persons from such training or departmental examination either wholly or partly, who have passed a departmental examination or undergone training declared by Government to be equivalent to a departmental examination or training prescribed under these rules.

9. Eligibility of Government servants for direct recruitment.— A person already in the Government service may apply through proper channel for direct recruitment against a vacant post in any particular class or category in the service if he/she possesses the educational and other qualifications prescribed for recruitment to such class or category of posts. The upper age limit for direct recruitment in respect of such Government servant shall be as provided in the general rules :

Provided that in case of a post which requires a higher degree specialization or experience, the Government may prescribe higher age limit.

10. Maintenance of seniority lists.—Seniority of the members of the service shall be regulated under the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956. The Administrative Department shall maintain final seniority lists of the service members and shall update the same on annual basis on first January every year.

11. Residuary matters.—In regard to matters not specifically covered by these rules, the members of the service shall be governed by the rules/regulations and orders applicable to the UT Civil Service in general.

12. Interpretation.—If any question arises relating to the interpretation of these rules, the matter shall be referred to the Administrative Department whose decision thereon shall be final and binding.

information that terrorist Zaheen Javid Dar S/o Javid Ahmad R/o Ashkuroo,

Baramulla along with his OGWs Muzaffar Ahamd Banday S/o Mohammad

Sideeq R/o Motujan, Shopian, Umar Yousuf Bhat S/o Mohammad Yousuf

and Zahid Nazir Mantoo S/o Nazir Ahmad Mantoo R's/o Feeripora, Shopian

carrying illegal arms/ammunition, boarded in a vehicle with intention to carry

Chogalpora, Kulgam on a motorcycle ; and

2. Whereas, upon this information, Case FIR No. 53/2021 under

sections 16, 18 Unlawful Activities (Prevention) Act, 1967, 7/25 Arms Act,

came to be registered in Police Station, Kulgam and investigation of the

case was set into motion. During naka checking all the accused persons

were arrested in connection with the case and 01 hand grenade, 01 AK-47

Magazine, 77 AK rounds and 08 Pistol rounds were recovered from their

possession. Subsequently, during investigation, section 16 ULA (P) Act

was dropped and section 13 (1), 20, 23, 39 of ULA (P) Act were added in

the case ; and

3. Whereas, during the course of investigation, site plan of place of

occurrence and seizure memo were prepared and statement of witnesses

acquainted with the facts and circumstances of the case were recorded

under the relevant provisions of law ; and

4. Whereas, during investigation, accused terrorist Zaheen Javid Dar

of Ashkuroo, Baramulla disclosed that after joining the banned terrorist

outfit JeM, he was deputed to District Shopian for carrying out the terrorist

activities in the area and accused Muzaffar Ahmad, Umar Yousuf, Zahid

Hussain and Majid Nisar disclosed that they were working for the above

terrorists and were providing logistic support to him for carrying out the

terrorist activities in the District ; and

5. Whereas, during further investigation, it was established that the

accused Zaheen Javid Dar was member of JeM terrorist banned outfit and

other accused persons Muzaffar Ahmad, Umar Yousuf, Zahid Hussain and

Majid Nisar were working as Over Ground Workers (OGWs) for the above

terrorist and under well knit criminal conspiracy were providing logistic

support/transportation of arms/ammunition to the terrorists from one place

to another in order to carry out the unlawful activities in the area ; and

6. Whereas, on the basis of investigation, statements of witnesses

recorded and other evidence collected, the Investigating Officer has

Whereas, accused namely Zahid Hussain Mantoo has been found juvenile, during the investigation and in view of section 1(4) of The Juvenile Justice (Care and Protection of Children) Act, 2015, the apprehension, detention, prosecution, penalty or imprisonment shall be governed by the said Act ; and

9. Whereas, the Authority appointed by the Government under sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967 has independently examined the case diary file and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the accused persons ; and

10. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the views of the Authority appointed under sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the accused for their prosecution under the aforesaid provisions of law.

Now, therefore, in exercise of powers conferred by

1. Preamble is replaced as under :

In exercise of the powers conferred by Article 225 of the Constitution of India and Sections 75 and 77 of the Jammu and Kashmir Reorganization Act, 2019 (Central Act 34 of 2019) read with Sections 122 and 129 of the Code of Civil Procedure, 1908, Section 8 of the Jammu and Kashmir State Civil Courts Act, Samvat 1977 and Clause 26 of the Letters Patent (Jammu and Kashmir) and all other powers enabling it in this behalf, the High Court of Jammu & Kashmir and Ladakh with the previous approval of the Lieutenant Governor, promulgates and issues, with respect to practice and procedure to be followed at the High Court, the following rules, namely :

2. In Rule 1(3), the following sentence is added at the end of

the rule :

If any doubt or difficulty arises in the application of any of these Rules to pending causes or matters, the matters shall be placed before the Chief Justice, who may pass such order as he considers just and proper in the circumstances of the case, and a compliance with such order shall be sufficient compliance with the provisions of these Rules.

3. Rule 3(m) is reframed as under :

'Registrar means Registrar General of the High Court and

includes Registrar, Additional Registrar, Joint Registrar,

Deputy Registrar or an Assistant Registrar of the High Court,

in relation to the powers, duties or functions exercised or

performed by the Registrar, Additional Registrar, Joint

Registrar, Deputy Registrar or the Assistant Registrar as the

case may be under these Rules'.

4. In rule 3(c), the words 'Jammu and Kashmir Evidence Act, 1977 (XII of 1977)' are substituted with the words 'Indian Evidence Act, 1872'.

5. In rule 3(e), the figures '1977 (X of 1977)' are substituted by the figure '1908' and the figures '1989 (XIII of 1989)' are substituted by the figure '1973'.

SO-286.—In exercise of the powers conferred by the proviso to

Article 309 of Constitution of the India, the Lieutenant Governor is pleased

to make the following rules, namely :—

1. Short title and commencement.—(1) These rules may be

called the Government Medical College, Doda (Gazetted) Service

Recruitment Rules, 202l.

(2) They shall come into force from the date of their publication in

the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise

requires,—

(a) "Administrative Department" means the Department of

the Government in the Civil Secretariat holding the administrative charge of the Service ;

(b) "Cadre" means the cadre of the service ;

(c) "Commission" means the Jammu and Kashmir Public Service

Commission ;

(d) "Government" means the Government of Jammu and

Kashmir ;

(e) "Head of the Department" means the Major Head of the

Department holding the administrative control of the organization ;

(f) "Member of the Service" means a person appointed to a post in the service under the provisions of these rules ;

(g) "Post" means a permanent and temporary post, carrying

a definite time scale of pay sanctioned by the competent authority ;

(h) "Rules" mean the Government Medical College, Doda

(Gazetted) Service Recruitment Rules, 2021 ;

(i) "Schedules" mean the schedules annexed to these rules ;

(j) "Service" means Government Medical College, Doda Gazetted

Service ; and

(k) "UT" means the Union Territory of Jammu and Kashmir.

(2) Words and expressions used in these rules but not defined shall

have the same meaning as assigned to them in the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956/the Jammu

and Kashmir Civil Services Regulations.

3. Constitution of service.—(1) From the date of commencement

of these rules, there shall be constituted the Government Medical College,

Doda, Gazetted Service.

(2) The Government may, at the commencement of these rules,

appoint to the service any person who is eligible for appointment to that

service at the commencement of these rules and is holding in substantive

capacity any post included in the cadre of the service :

Provided that for the purposes of initial constitution of the service,

the person holding any post in substantive capacity to which he/she was

appointed by the competent authority under rules included in the cadre

of the service in its sanctioned scale of pay shall be deemed to have been

appointed to the service under these rules if he/she is fully qualified to

hold the post under these rules, unless he/she opts otherwise within 15

days from the commencement of these rules.

Explanation :— The word "holding" means a person holding a post

included in the cadre of Government Medical College,

Doda (Gazetted) Service, in its sanctioned scale of pay

on regular basis under orders of competent authority

and will not cover the persons holding a post on

ex-cadre/deputation basis or on ad hoc basis or in a

stop-gap arrangement.

4. Strength and composition of the service.—(1) The

authorized permanent and temporary strength of the cadre and the nature

of the posts included therein shall be determined by the Government from

time to time and shall, at the initial constitution of the service under rules,

be such as specified in Schedule-I annexed to these rules :

Provided that the Government may create temporary posts in the

cadre of the service for specified period as may be considered necessary

from time to time.

(2) The Government shall, at the interval of every five years or at

such other intervals as may be necessary, re-examine the strength and

composition of the cadre of the service and make such alterations therein

as it deems fit.

5. Qualification and method of recruitment.—(1) No person

shall be eligible for appointment to any post in any class, category or

down in Schedule-II annexed to these rules and fulfils other requirements

of recruitment as provided in the rules and orders of the Government for

the time being in force.

(2) Appointment to the service shall be made—

(a) by direct recruitment ; or

(b) by promotion.

6. Probation.—(1) Probation of persons appointed to the service

by direct recruitment shall be regulated in terms of the Jammu and

Kashmir Probationer (Condition of Service, Pay and Allowances) and

Fixation of Tenure Rules, 2020 and in all other cases under the provisions

of the Jammu and Kashmir Civil Services (Classification, Control and

Appeal) Rules, 1956.

(2) The pay of person appointed to the service under these rules

through direct recruitment shall be regularized as per the provisions of

Jammu and Kashmir Probationer (Condition of Service, Pay and

Allowances) and Fixation of Tenure Rules, 2020 and in all other cases,

as per the provisions of Jammu and Kashmir Civil Service Regulations,

1956 or general rules as issued from time to time.

7. Reservation in appointments.—While making appointments

either by direct recruitment or by promotion, reservation shall be made

in accordance with the rules and orders issued from time to time for

members of Scheduled Castes/Scheduled Tribes/Backward Classes or

any other category or class of persons under the provisions of the Jammu

and Kashmir Reservation Act, 2004 and the rules made thereunder.

8. Training and Departmental Examinations.—Per sons

appointed to the service by direct recruitment shall be required to undergo

such training from time to time during the course of probation and to pass

during the period of probation or trial such departmental examination as

the Government may prescribe :

Provided that the Government may exempt persons from such

training or departmental examination either wholly or partly, who have

by Government to be equivalent to a departmental examination or training

prescribed under these rules.

9. Eligibility of Government servants for direct recruitment.—

A person already in the Government service may apply through proper

channel for direct recruitment against a vacant post in any particular

class or category in the service if he/she possess the educational and

other qualifications prescribed for recruitment to such class or category

of posts. The upper age limit for direct recruitment in respect of such

Government servant shall be as provided in the general rules :

Provided that in case of a post which requires a higher degree of

specialization and or experience, the Government may prescribe higher

age limit.

10. Maintenance of seniority lists.—Seniority of the members

of the service shall be regulated under the Jammu and Kashmir Civil

Services (Classification, Control and Appeal) Rules, 1956. The

Administrative Department shall maintain final seniority lists of the service

members and shall update the same on annual basis on first January

every year.

11. Residuary matters.—In regard to matters not specifically

covered by these rules, the members of the service shall be governed by

the rules/regulations and orders applicable to the UT Civil Service in

general.

12. Interpretation.—If any question arises relating to the

interpretation of these rules, the matter shall be referred to the

Administrative Department whose decision thereon shall be final and

binding.
