Whereas , on the basis of indent placed by the Officer Commanding , 110 RCC ( GREF ) , a notification under section 4( 1 ) was issued by Collector , Land Acquisition ( Defence ) , Rajouri/Poonch , HQ, Rajouri vide No. Coll/Def/273-78 dated 27-07-2013 for land measuring 67 Kanals , 18 Marlas situated at Village Kewal , Tehsil Kotranka , District Rajouri , calling upon the objections from the land owners / interested persons ; and
Whereas , the District Collector ( DC) , Rajouri vide No. Coll/Def/ 980 dated 31-03-2016 has reported that pursuant to the above referred notification , no objection was received from anyone within the stipulated time and accordingly recommended the case for issuance of declaration under section 6 and directive under section 7 of the Land Acquisition Act, Svt . 1990 to Divisional Commissioner , Jammu , who endorsed the same to this department vide No. 502 /LAC / Div. Com/ 21 / 6589 dated 19-03-2021 ; and No. 05 ] The J& K Official Gazette , 5th May, 2022/ 15th Vai . , 1944. 49
Whereas , a fresh report was sought from District Collector ( DC ) , Rajouri vide No. Rev/ LAJ/ 48/2021 dated 05-04-2021 to the effect that whether or not the subject land is still required by the Indenting Department ; and
Whereas , the Deputy Commissioner , concerned vide No. Coll/Def/ 2021/59 dated 07-04-2021 reported that the said land is still required to the Indenting Department and requested to issue declaration under sections 6 and directive under section 7 of the Land Acquisition Act , Svt . 1990 ; and Whereas , the case has been examined in the department and it is found that no objection was received from anyone within the stipulated time to the proposed acquisition and the land is still required by the indenting department ; and
Whereas , the Government is satsfied that the land is required for public purpose i.e. widening of Rajouri- Kandi - Budhal Road by GREF at Village Kewal , Tehsil Kotranka , District Rajouri .
Now, therefore , in pursuance of section 6 of the J & K State Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 67 Kanals and 18 Marlas situated at Village Kewal , Tehsil Kotranka , District Rajouri is required for public purpose i . e . widening of Rajouri - Kandi - Budhal Road double lane specification by GREF. Further , the Collector , Land Acquisition (Defence ) , Rajouri/Poonch , HQ, Rajouri is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person (s ) as required under the Land Acquisition Act/Rules .

Whereas , on the basis of indent placed by the Executive Engineer , PMGSY Division Udhampur - I vide No. CEJ /PMGSY/ 824-45 dated 25-04-2016 , a notification under section 4 ( 1 ) was issued by Collector , Land Acquisition ( ACR) , Udhampur vide No. ACRU / SQ/ 3462-70 dated 28-09-2019 for land measuring 48 Kanals 02 Marlas and 0.5 Sirsai , situated at Village Sunal , Tehsil and District Udhampur , calling upon objections from the land owners/ interested persons ; and
Whereas , the Collector Land Acquisition ( ACR) Udhampur vide No. ACRU / SQ/4076-77 dated 28-10-2019 has reported that pursuant to the above referred notification , one objection was filed regarding variation in area publihed in the notification under section 4 ( 1 ) of Jammu and Kashmir Land Acquisition Act , Svt. , 1990 ; and
Whereas , the objection so raised was got verified through Tehsildar , Udhampur who vide No. TUDR/ OQ / 2019-20/ 2040 dated 28-10-2019 has reported that the objection was found to be baseless ; and

Whereas on the basis of indent placed by Inspector General , STC , BSF, Udhampur vide No. 4086/Engg/ STC /Land Acq/ 17/ 10173-76 dated 14- 06-2017 , for acquisition of land measuring 70 Kanals for extension of amenities and training infrastructure to STC , BSF situated at Village Thill , Tehsil and District Udhampur , Revenue field staff prepared revenue papers . The case was submitted to Home department , who issued NOC vide No. Home/Land Acq/66/2018 dated 09-05-2019 and a notification under section 4 ( 1) was issued by Collector, Land Acquisition , Defence , Udhampur vide No. SCDU / LA/BSF/ 161-70 dated 06-06-2019 , calling upon the objections from the land owners / interested persons ; and
Whereas , pursuant to the above notification , objections were received from the land owners on 29-06-2019 . Special Collector, Defence , Udhampur issued notification under section 5 (A) of the said Act vide No. SCDU/LA/ 509-10 dated 25-09-2019 read with No. SCDU/ LA/ 575 dated 21-10-2019 , No. SCDU /LA/261-63 dated 21-12-2020 and No. SCDU/LA/529-31 dated 30-03-2021 for hearing objections . The objectors appeared before Special Collector, Defence , Udhampur on 03-09-2019 . One of the objector namely Mr. Devi Saran stated that all his land has already been acquired in construction of Dhar Road , Railway Line , Irrigation Department works and BSF. He refused to provide the said land for acquisition as he would become landless . Another objector Mr. Hans Raj stated that he has no objection for acquisition of his land , but compensation of land should be paid @ Rs . 35 lakh per Kanal . Third objector Mr. Dev Raj appeared before the special Collector , Defence , Udhampur on 16-02-2021 and stated that his fake signatures ere made on representation , filed before the Collector on 29-06-2019 by someone and he has no objection regarding acquisition of his land. However , Mr. Hans Raj again appeared before the Collector on No. 05 ] The J& K Official Gazette , 5th May, 2022/ 15th Vai . , 1944. 53
08-04-2021 and refused to provide his land for acquisition . Accordingly, Collector , Defence letter No. SCDU/ LA/ 544-45 dated 10-10-2019 sought report from Tehsildar , Udhampur who vide No. TUDR/ OQ/2019-20 /2273 dated 03-12-2019 intimated that objectors / land owners do not become landless and houseless due to acquisition of said land ; and
Whereas , Collector, Land Acquisition , ( Defence ) , Udhampur vide No SDCU/ LA/ 183-84 dated 05-08-2021 read with No. CLAD/Udh/409-10 dated 02-02-2022 recommended the case to District Collector ( DC ) , Udhampur, who vide No. DCU /LA/ 171-73 dated 14-01-2022 read with No. DCU/ CLAD/Udh/ 411-13 dated 03-02-2022 endorsed to Divisional Commissioner, Jammu for issuance of declaration/ notification under sections 6 and 7 and 17 of the Land Acquisition Act , Samvat 1990. Divisional Commissioner , Jammu , vide No. 502 /3137/Acq/ STC.BSF/Thill/Udh/ 18/3009 dated 10-02-2022 and Financial Commissioner (Revenue ) , J & K vide No. FCR - LAND /33 /2022-06 ( 138748 ) endorsed to this department for the said purpose ; and
Whereas , the report furnished by Collector , Land Acquisition , Defence , Udhampur vide letter referred to above duly endorsed by District Collector (DC) , Udhampur has been examined and it has been found that due opportunity has been provided to the objectors and further enquiry has been conducted and found that the objections are not based on merits . land is required for defence purposes which is an important public purpose and therefore the objections doesn't merit any consideration , hence rejected ; and The
Whereas , the Government is satisfied that the aforesaid land is required for public purpose i . e . for extension of amenities and training infrstructure to STC , BSF situated at Village Thill , Tehsil and District Udhampur .
Now, in pursuance of section 6 of the Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 70 Kanals situated at Village Thill , Tehsil and District Udhampur as per Annexure ' A' is required for public purpose i . e. extension of amenities and training infrastructure to STC , BSF. Further, the Collector , Land Acquisition, Defence , Udhampur is directed under section 7 of the said Act to take orders for acqiuisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rules .
Further , the Collector concerned shall be held specifically responsible for identification and proper title verification of all types of lands involved in the case for making apportionment of compensation amongst all the [No. 05

interested persons /rightful claimants , in accordance with the relevant laws/ rules in force , while making the award . The Collector /Indenting Department shall also ensure that no compensation shall be made for the portion of land which has already been acquired for extension of amenities and training infrastructure in question .

Whereas , the Chief Engineer Kashmir Public Health Engineering department Srinagar ( Kashmir) through Executive Engineer PHE Division Pulwama submitted an indent for acquisition of 01 - Kanal of [ No. 5

land for public purpose , namely construction of Tube Well and Service Reservoir for WSS Khandaypora -Nowgam project at estate Khandaypora Teshil Awantipora .
Whereas , it appears to the Collector that a total area of 01 - Kanal of land is required in Village Khandaypora Tehsil Awantipora District Pulwama for public purpose viz . construction of Tube Well and Service Reservoir for WSS Khandaypora - Nowgam project at estate Khandaypora Tehsil Awantipora . The Social Impact Assessment Study was carried out by SIA Unit and a report submitted/preliminary investigation was conducted by a team constituted by District Collector as laid down under rule 4. The Summary of the Social Impact Assessment Report/ preliminary investigation is as follows ( Copy enclosed) ;
1. That the proposed acquisition of land serves a public purpose , because there is no other water supply scheme which can be used by the general public and the proposed scheme is exclusively for the public purpose as verified.
2. The extent of the land proposed for the acquisition is absolute bare- minimum needed for the project as discussed with the representative of Indenting Department .
3. Selection of alternate land at this stage shall not be feasible as work has already been started by the department at this site and the project is said to be half way completed .
4. No utilized land which has been previously acquired exists in the area is being kept un- utilized .
5. No such land has been earlier acquired/ still unutilized in the village.
The said team strongly recommended the acquisition of land in question measuring 01 Kanal as per the indent placed for construction of Tube Well and Service Reservoir for WSS Khandaypora - Nowgam project at estate Khandaypora Tehsil Awantipora.
No commercial /residential/ agricultural structure is coming under the alingnment as such no family is likely to be displaced due to land acquisition.
Therefore , it is notified that for the above said project in the Village Shala Tokna Tehsil Awantipora District Pulwama , a piece of land measuring 01 Kanal of standard measurement , whose detail description is as following , is under acquisition.

The notification is made under the provisions of Section- 11 ( 1 ) of the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act , 2013 (Act No. 30/2013 ) , to all whom it may concern .
A plan of the land may be inspected in the office of Collector Land Acquisition/Additional Deputy Commissioner Awantipora on any working day during the working hours .
The Government is pleased to authorize Tehsildar /Revenue staff, Indenting Department , their consultant and their staff to enter upon and survey and take levels of any land , dig or bore into the sub - soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act .
Under Section 11 (4) of the Act , no person shall make any transaction or cause any transaction of land i. e . sale/purchase , etc , or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector .

SO - 11.- In exercise of the powers conferred by Section 23 of the Jammu and Kashmir Reservation Act , 2004 , the Government of Jammu and Kashmir hereby makes the following amendment in the Jammu and Kashmir Reservation Rules , 2005 ; namely :-
' In rule 24 , for the words and sign " the certificates shall be renewable after following the procedure prescribed for issuance of 2

SO - 14 . In exercise of the powers conferred by Section 16 of the Jammu and Kashmir Public Men and Public Servants Declaration of Assets and Other Provisions Act , 1983 , the Government hereby makes 2 The J&K Official Gazette , 11th Jan. , 2022/ 21st Pausa , 1943. [No. 41 -d
following amendments in the Jammu and Kashmir Public Servants Declaration of Assets and Other Provisions Rules , 1998 :-
1. In Rule 3 of the Rules :-
i . sub - rule ( 1 ) shall be substituted as under ,-
" ( 1 ) Every Public Servant shall submit annual return through online mode using the portal https://prs.jk.gov.in for the calendar year between 1st and 31st January , of the next calendar year , in respect of all the assets possessed by him and his family members which shall include the assets in respect of movable property, the value of which exceeds his two months basic salary in each case , giving full particulars regarding ,-
(a) Cash balance , saving bank deposits , shares , cash certificates , fixed deposits , debentures , security bond ;
(b) Jewellary/ ornaments ; and
(c) Households items ( electric and electronic items only) . "
ii . sub - rule (2 ) shall be omitted.
2. Rule 4 of the Rules shall be substituted as under, -
"4. Restriction to acquire and transfer of movable property.- Every public servant shall bring to the notice of the prescribed authority the acquisition or transfer of movable property where the value of such property exceeds his two months basic salary in each case . "

SO- 27.- In exercise of the powers conferred by proviso to Article 309 of the Constitution , the Lieutenant Governor hereby directs that after clause (v) to rule 5 of the Jammu and Kashmir Civil Services (Defined Contribution Pension Scheme ) Rules , 2010 as contained under Schedule XXIII of the Jammu and Kashmir Civil Services Regulations Vol . ( II ) , the following shall be added as clause ( w) ; namely :-
"(w) . In all cases , where the NPS contributions are deducted from the salary of the government employee but the amount is not remitted to CRA system or is remitted late , the amount may be credited to the NPS account of the employee along with interest for the period from the date on which the deductions are made till the date the amount is credited to the NPS account of the employee , as per rates applicable to GPF from time to time, compounded annually.
The above rule shall come into force from the date of issuance of this notification . "

SO - 09 .-- Whereas , the Government vide SRO - 268 dated 12-08-2003 , appointed the Principal District and Sessions Judge , Rajouri , as an Arbitrator for making the award in respect of the land measuring 48 Kanals 10 Marlas , situated at Village Rampur, District Rajouri ; and 2 The J& K Official Gazette , 5th Jan. , 2022/ 15th Pausa , 1943. [ No. 40- i
Whereas , a representation for extension in time for completion of arbitration proceedings was received on 21-02-2018 , which was forwarded to the Deputy Commissioner, Rajouri for a detailed report ; and
Whereas , pending report from the Deputy Commissioner , Rajouri , the owner of the aforementioned land filed a writ petition bearing No. 947/2018 , before the Hon'ble High Court , Jammu , praying therein for the following reliefs :-
"Writ of Mandamus , commanding the respondent Nos . 2. and 3 to take decision qua the extension of time to the arbitrator appointed under Section 8 of Jammu and Kashmir Requisition and Acquisition of Immovable Property Act, 1968 to complete the arbitration proceeding in the case titled , Uma Rani and others Vs. State and others . "
Whereas , the Hon'ble High Court , J & K, Jammu vide its order dated 02-07-2018 disposed of the writ petition with the following directions ; and
"In view of the aforesaid submission made by the petitioner himself and in the facts of the case , the instant writ petition is disposed of with a direction to respondent No. 1 to dispose ofthe letter/ communication sent by the Principal District Judge, Rajouri for extension of time in deciding the matter. The same shall be done expeditiously, preferably within a period of four weeks from today. "
Whereas , the petitioner filed a contempt petition No. 290 of 2018 in OWP 947/2018 titled Sanjay Sharma V/S . Abdul Majeed Bhat before the Hon'ble Court , J & K, Jammu , for alleged non - compliance of the aforesaid order dated 02-07-2018 of the Hon'ble High Court ; and
Whereas , the Principal District and Sessions Judge , Rajouri , vide letter dated 23-01-2020 requested for grant or extension in time for making the award in respect of the subject land ; and
Whereas , the Government after considering all aspects relating to the matter , has decided to extend the time for completion of arbitration proceedings .

Now, therefore , in compliance of the directions dated 02-07-2018 passed by the Hon'ble High Court , Jammu , in OWP 947/2018 titled Sanjay Sharma V/ s . Abdul Majeed Bhat , the Government in exercise of the powers conferred under sub - rule ( l ) of rule 10 of the Jammu and Kashmir Requisitioning and Acquisition of Immovable Property Rules , 1969 , hereby directs that the time for completion of the arbitration proceedings and for making the award in respect of the subject land shall and shall always be deemed to have been extended by a further period of four months from the date of issuance of this notification .

Whereas , in exercise of the powers conferred under Section ( 66) of the Jammu and Kashmir Municipal Act , 2000 , the Municipal Committee , Pampore hereby notifies to impose and recover Trade Tax for the items classified under clause ( i) of Sub - Section ( 1 ) of Section ( 66) of the 2 The J & K Official Gazette , 19th March , 2022 / 28th Phal . , 1943. Jammu and Kashmir Municipal Act , 2000 as per the schedule annexed with this Notification ; and
Whereas under section 70 ( 2 ) the committee is required to publish a notice for the information of the General Public .
The draft Tax Schedule of Municipal Committee , Pampore is hereby put in public domain to invite objections if, any , regarding revised rates as shown in the draft schedule in writing within thirty days from the date of publication of this notice under section 70 ( 3 ) of Jammu and Kashmir Municipal Act , 2000 .
Now , this Notification is issued today the 19th of March , 2022 , under the seal and signature of the undersigned along with the proposed Tax Schedule of Municipal Committee , Pampore inviting objections , if any , from the Inhabitants / Traders of the town to be filed in writing and submitted in the office of Municipal Committee within thirty days from the date of publication of this notification .

Judgement
This petition under Section 15 of the Payment of Wages Act is filed by the applicant Masooda Amin who was allegedly came to be appointed as Junior Executive on 1st March, 2008 at ' Karan Nagar ' Srinagar Branch who performed her duties excellently and was promoted as " Executive Operations " . According to her , during floods in September , 2014 , she was urged to open an emergency counter at Nallahamar Road Srinagar for rendering claims of the insured and on the verbal directions of respondent No. 2 (Branch Manager ) Bajaj Allianz General Insurance Company Ltd. , the applicant entertained strenuously claimants / customers while receiving the claim intimations . It is a further case of the applicants that instead of appreciating the work of the applicant , the respondent No. 2 put her on notice seeking disciplinary action against her on overreaching of job portfolio which was ultimately yielded into termination of the applicant's services .
According to the applicant on finding termination arbitrary and irrational a civil suit came to be filed against them (Management ) by the applicant which is pending adjudication in the Court of 1st Additional Munsiff Srinagar and in pursuit of the appropriate remedy for recovery of the genuine wages this application under the Payment of Wages Act is preferred under Section 15 of Payment of Wages Act.
It is further stated that even a criminal complaint was filed against respondent No. 2 wherein cognizance was taken and process was issued by Court of Judicial Magistrate Ist Class hence petitioner may be paid salary due from January 2014 - May 2015 upto Rs . 5,95,000/ - alongwith gross salary at the time of her termination as Executive Operations is equal to Rs . 3,50,000/ - alongwith emulation wages payable to the applicant .
Respondents in their demurrer denied all contents of petitioner being frivolous and concocted one , besides Respondents No. 2 is not No. 48-2 ] The J & K Official Gazette, the 24th Feb. , 2022/ 5th Phal . , 1943. 3
a necessary party and has wrongly been impleaded as party respondent . Therefore petition is liable to be dismissed for mis - joinder of parties .
Heard .Perused objections taken by respondents as well as written submissions . Respondents have argued that the present petition is hit by Limitation Act as the same is not filed withen a period of twelve months from the date of cause of action . Respondents have categorically stated in their written reply that no amounnt was ever deducted by the company as the same was not allowed to be decucted hence all the deducted and recoveries made from out of full and final settlement upon termination of services . The petitioner are in line with the Payment of Wages Act and absolutely there is no occasion for filing any petition against the respondents . According to the respondents the petitioner vide her written letter admitted that petitioner has accepted 32 claim intimations and handed over to Mr. Adil , surveyor who is working with G.N- Teli Surveyor on the panel of respondent no . 1 Hence all these illegal acts/ commission and omissions done by the petitioner were not part of the duties of the petitioner who was not authorized to do so without any authority . Cosequently she was put under suspension in contemplation of a formal enquiry into the matter vide letter dated 30-12-2014 and ultimately she was terminated from services vide order dated 03-03-2015 on having and over all view of the matter by the competent authority .
Considered arguments put forth herein and entire material on record . LC for petitioner has in his petition stated that a civil suit seeking mandatory injunction came to be filed by her and an ex -parte injunction was granted by Ld . Munsiff Srinagar vide its order dated 06-04-2015 which was subsequently vacated by the aforesaid Court .
I have carefully perused the record and evidence affidavit of the petitioner Masooda Amin as well as of her witnesses namly Mohammad Amin Baba and Nazir Ahmad Bhat wherein both the witnesses have corroborated the statement of Masooda Amin .
Keenly perused provisions of the Payment of Wages Act ( Section 15) and also of Limitation Act it appears that nowhere the petitioner has denied the assertions put forth by respondents that she has not overreached her job and handled 32 claims without instructions/ orders passed by respondents even keen perusal of evidence affidavit filed by the petitioner reveals that there is no mention of any deduction part from the petitioner .

It has also came to notice of this Tribunal from record borne out here that present petition is not tenable under Section 15 read with other provisions of Payment of Wages Act as O.P has not deducted any amount and all recoveries/deductions from petitioner are done only on termination of the petitioner.
Record transpires that there is no negation of contentions put forth by the respondents in their reply hence this Tribunal has arrived at the conclusion that the petitioner has miserably failed to prove his petition beyond any shadow of doubt hence the same is dismissed being devoid of any legal force . Resultantly petitioner is held entitled to no relief as sought for through this claim petition. The reference is answered accordingly. File be consigned to records after its due compilation.
