Subject :-Implementation of Ease of Doing Business (EoDB ) and Ease of Living ( EoL) under Business Reforms Action Plan.

In order to ensure successful implementation of the recommendations under Business Reform Action Plan ( BRAP ) circulated by department for 112 The J& K Official Gazette , 16th June , 2022/26th Jyai . , 1944. [ No. 11

promotion of Industry and Internal Trade (DPIIT ) , Ministry of Commerce and Industry, Government of India and for implementing cumulative action plan through Minimizing Regulatory Compliance Burden ( MRCB ) for Ease of Doing Business (EoDB ) with G2B interface and Ease of Living (EoL) with G2C unterface and with a view to create an investor friendly and labour friendly environment in the UT of Jammu and Kashmir following intructions are hereby notified for compliance by all concerned in the department :-

i . Each draft business regulation will be put online in public domain for a period not less than 30 days to invite public comments /feedback on the same , prior to the enactment of the said regulation .

ii . The legal basis , necessity and business - friendly aspect of each draft regulation shall also be published online for public consultation and feedback .

iii . Suggestions / feedback received and the departmental disposal of the same shall also be published online along with the information as to how the feedback has been addressed in the final regulation .

iv. Any new additional regulation/ service/permission automated through www.jklabour.com & https://singlewindow.jk.gov.in shall be updated in ' Online Wizard System' within 30 days as recommended under BRAP.

V. Live Online MIS dashboard shall be activated for all e - service approvals and grievance/ query applied through www.jklabour.com & https://singlewindow.jk.gov.in for better transparency and monitoring compliance .

vi . Industrial/Investor query received on the www.jklabour.com & https://singlewindow.jk.gov.in shall be addressed/ resolved within 7 working days by concerned authority. In case of any observation , initial respose shall be initiated within 7 days . If the issue pertains to policy matters , the same shall be disposed within 15 days of receipt .

vii . All the inspections shall be carried out as per notified procedure and defined checklist , with prior intimation to the concerned No. 11 ] The J & K Official Gazette , 16th June , 2022/ 26th Jyai . , 1944. 113

establishments . The inspection report shall be uploaded on the portal by the concerned authority within two days from the date of inspection . Facilitation shall be the primary objective of these inspections .

viii . All surprise and complaint based inspections shall be conducted with prior written permission of the concerned head of department in light of the records maintained on the portal .

ix . All the services under BRAP including Registrations , Licenses , Notices , Fines , Penalties , Inspections /Verification Reports , Returns filed by the occupires/ unit holders/ employers , Applications , Payments /Fees etc. uner Labour Laws shall be provided only in Online Mode through www.jklabour.com and no ofline submission /processing of application etc. shall hence forth be entertained .

x . Applicants shall receive stage- wise SMS notification and will be able to download licenses / certificates from the respective login on www.jklabour.com and https://singlewindow.jk.gov.in .

xi . The department will solicit feedback through online mode through the departmental website www.jklabour.com and Industries and Commerce Department Single Window website https : // singlewindow.jk.gov.in .

xii. In order to streamline the process of inspection and related aspects , the department shall implement ' J & K Central Inspection System - JKCIS ' ( integrated risk based shared inspection system) involving different departments as will be coordinated by the Industries and Commerce Department .

xiii . Weekly MIS CSheck and Grievance review meeting will be scheduled under the Chairpersonship of Administrative Secretary of the Department or designated officer in the Department .

Whereas , it appears to the Collector that a total area of land 07 Kanals 19 Marlas 7½ Sirsai (0.998 acre ) is required in Village Tumlhal Tehsil and District Pulwama for public purpose , namely acquisition of land for construction of road from Tumlahal to Chandgam at Village Tumlhal Tehsil and District Pulwama .

Whereas , Social Impact Assessment study was carried out by a team constituted by District Collector vide No. DCP / LA/ 2020/ 610-30 dated 25-08-2020 as laid down under rule 4. A detailed SIA report has been submitted through Tehsildar Pulwama vide his No. TP - OQ/ 1543 dated 16-12-2021 which is reflected herein as under :-

1. That the proposed acquisition of land serves the public purpose , as it connects two villages namely Tumlahal and Chandgam .

2. The land proposed for the acquisition is absolute bare - minimum needed for the project as reported by R& B authorities .

3. That reportedly the acquisition at an alternate place has not been considered by the Indenting Department.

4. That there is no utilized land which has been previously acquired in the area for this purpose .

5. There is no unutilized acquired land to be utilized for such public purpose in the said village .

Therefore , it is notified that a piece of land 7 Kanals 19 marlas 7½ Sirsai of standard measurement , whose detailed description is as under needs to be acquired for public purpose namely for construction of road from Tumlahal to Chandgam at Village Tumlahal Tehsil and District Pulwama ;

(vi) Experience Certificate (Ten years ) and five years administration experience for the post of Dy . Medical Superintendent.

( i ) Valid Category Certificate-01 leaf ;

(ii) For Physically Challenged Candidates Disability Certificate on the prescribed format , if required - 01 leaf ;

10. Scheme of selection :

Selection shall be made in accordance with the provisions laid down in the Jammu and Kashmir Public Service Commission's (Business and Procedure) Rules , 2021 as amended from time to time .

Candidates are especially advised to apprise themselves with the provisions of Rule 44 ( ii ) of the Jammu and Kashmir Public Service Commission's ( Business and Procedure) Rules , 2021 .

11. Important instructions regarding filling up of online applications are given herein below :-

i. Candidates are required to apply online through the website of the Commission i.e. http://www.jkpsc.nic.in No. other means /mode of application shall be accepted .

ii. Candidates are first required to go to the JKPSC website http://www.jkpsc.nic.in and click on the link " One Time Registration " or click on Login menu if you have already created your profile with the JK PSC.

iii . After logging into your account , candidates are required to fill all the requisite fields of One Time Registration ( OTR) i. e . personal information , contact information and educational qualification , service details etc.

iv . The candidate shall also be required to upload the image of date stamped recent passport size color photograph and signature . The photograph should not be taken earlier than 01-01-2021 .

v . Size of the photograph ( passport size ) and signature must be between 10kB to 20kB in * .jpeg or * .jpg only .

vi . After successful submission of all the details in your OTR account , check the eligibility conditions as mentioned in the advertisement notification before applying for the post .

vii . Click on the " show examination " as shown against the respective post/ examination you want to apply .

viii . On clicking on the " show examination " a window will appear on your computer screen . Select the month of the advertisement notification for which you want to apply, a link (s ) for the post (s ) will appear on the computer screen .

ix. An " APPLY" button is shown against the respective post and the candidates will click on the APPLY button against the post he/she is eligible.

x. On clicking " APPLY " button , an instruction window will appear. Candidates should read instructions carefully before clicking on " APPLY " button at the bottom of the webpage.

xi . On clicking " APPLY " button , the system will display all facts/ particulars that a candidate may have mentioned while filling up the necessary fields of his /her OTR account . Candidate shall fill up the remaining required fields in the application form and accept the declaration thereof.

xii . Once the candidate is satisfied about the correctness of the filled in details , then , he or she may click on " SUBMIT " button to finally push the data into server with successful submission report .

xiii . On successful submission of the basic details , the candidates will be required to pay the online fee and uploading of the documents , for final submission of the online application form.

xiv. Candidates can pay the requisite fee through online mode in the " SUBMITTED APPLICATIONS " menu in your account .

xv. After successful payment of the fee, the fee status will get reflected on the Online Application Form. Candidates can check the fee status by clicking on the Print Application Button in the submitted Applications menu in your JKPSC account . In case the payment status shows either " not submitted or under processing or status has not been reflected on your submitted application form " , candidate( s ) are advised to contact the JKPSC office at Solina , Srinagar/ Resham Ghar Colony, Jammu immediately for clarification . Further where the online fee is paid through other service providers the candidate must ensure that not only the amount of fee is debited from his/ service provider's Account but also credited into the official account of JKPSC .

xvi . The candidate would be able to get the printout of his / her submitted application only after the payment of the requisite fee and uploading of mandatory prescribed/ requisite documents .

xvii . The JKPSC will not undertake detailed scrutiny of applications for the eligibility and other aspects at the time of filling up of online and, therefore , candidature will be accepted only provisionally . The candidates are advised to go through the requirements of educational qualification , age , etc. and satisfy themselves that they are eligible for the post(s) . Copies of supporting documents will be sought at the time of document verification . When scrutiny is under taken, if any , claim if made in the application is not found/ substantiated by proof, the candidature will be cancelled and the Commission's decision shall be final and binding .

xviii . Please note that the above procedure is the only valid procedure for applying . No other mode of application or incomplete steps would be accepted and such applications would be rejected .

12. Editing of the online application form :

Candidates who have successfully submitted the online application form along with requisite fee will be allowed to edit some of the fields in their submitted online application form w. e . f. 07.02.2022 to 09.02.2022 . Detailed instruction in this regard will be made available on the website of the Commission .

13. Action against candidates found guilty of misconduct :

Candidates are advised that they should not furnish any particulars that are false or suppress any material information. A candidate who is , or has been , declared by the Commission, to be guilty of-

i. obtaining by wrongful support of his/ her candidature by any means ; or

impersonating ; or ii.

procuring impersonation by any person ; or

iv. submitting fabricated documents or documents which have been tampered with ; or

V. making statements which are incorrect , or false or suppressing material information ; or

vi . resorting to any other irregular or improper means in connection with his/ her candidature for the selection ; or

vii. attempting to commit or , as the case may be , abetting the Commission of all or any of the acts specified in the foregoing clauses may , in addition to rendering himself /herself liable to criminal prosecution.

(a) to be disqualified by the Commission from selection for which he/ she is a candidate ; and/ or

(b) to be debarred either permanently or for a specified period-

(i) By the Commission from any selection held by them.

WHEREAS , in pursuance of Sections 8 and 4 of the Delimitation Act , 2002 ( 33 of 2002 ) , as amended by the Delimitation ( Amendment ) Act , 2003 ( 3 of 2004 ) , and Part -V of the Jammu & Kashmir Reorganisation Act , 2019 , the Delimitation Commission has , by its Order No.1 dated 14th March , 2022 published in the extraordinary issue of the Gazette of India and the Union Territory of Jammu & Kashmir Gazette on 14th March , 2022 , determined- ( i ) the total number of seats in the House of the People to be allocated to the Union Territory of Jammu & Kashmir as five ( 5 ) of which Zero ( 0 ) seat shall be reserved for Scheduled Castes and Zero ( 0 ) seat shall be reserved for the Scheduled Tribes , and ( ii ) the total number of seats to be assigned to the Legislative Assembly of the Union Territory as Ninty ( 90 ) of which , Seven ( 7 ) seats shall be reserved for the Scheduled Castes and Nine ( 9 ) seats for the Scheduled Tribes ; and

WHEREAS , in pursuance of sub- section ( 1 ) of Section 5 , read with sub - section ( 1 ) of Section 9 of the Delimitation Act , 2002 and Part- V of the Jammu & Kashmir Reorganisation Act , 2019 , the Delimitation Commission associated with itself the Associate Members from the Union Territory with the proceedings for the delimitation of Parliamentary and Assembly Constituencies in the Union Territory; and

WHEREAS , in pursuance of sub - section ( 2) of Section 9 of the Delimitation Act , 2002 and Part-V of the Jammu & Kashmir Reorganisation Act , 2019 , the Delimitation Commission published its draft proposals , for the delimitation of Parliamentary and Assembly Constituencies in the Union Territory on the basis of the relevant published figures of 2011 Census , in the extraordinary issue of the Gazette of India and in the Jammu & Kashmir Union Territory Gazette on 14th March , 2022 , inviting objections and suggestions in relation to the aforesaid proposals by 21st March , 2022 ; and

WHEREAS , in pursuance of the said sub - section ( 2 ) of Section 9 of the Delimitation Act , 2002 and Part -V of the Jammu & Kashmir No. 5-2 ] The J & K Official Gazette , 5th May , 2022/ 15th Vai . , 1944. 3

Reorganisation Act , 2019 , the Commission's Order No. 1 mentioned above and the above referred draft proposals of the Commission was published in the local newspapers on 14th March , 2022 and given further publicity through radio and television and other media of mass communication ; and

WHEREAS , in pursuance of the said sub - section ( 2 ) of Section ( 9 ) of the Delimitation Act , 2002 and Part - V of the Jammu & Kashmir Reorganisation Act , 2019 , the Commission also issued a public notice on 25th March , 2022 specifying the places and dates of its public sittings to consider all objections and suggestions ; and WHEREAS , in pursuance of the said sub- section ( 2) of Section 9 of the Delimitation Act , 2002 and Part -V of the Jammu & Kashmir Reorganisation Act , 2019 , the Commission held public sittings on 4th April , 2022 at Jammu and on 5th April , 2022 at Srinagar and heard the members of the public and afforded them full opportunity of making oral and written submissions , in addition to the written representations already sent , if any , to the Commission ; and

WHEREAS , the Commission has considered all objections and suggestions made at the aforesaid public sittings and / or received by it otherwise , in relation to its said proposals , in the light of the relevant provisions of the Constitution and the said Acts .

NOW , THEREFORE , in pursuance of clause ( d ) of sub - section ( 2) of Section 9 read with sub - section ( 2 ) of Section 4 of the Delimitation Act , 2002 , as amended and Part- V of the Jammu & Kashmir Reorganisation Act , 2019 , the Delimitation Commission hereby determines as follows:-

1. Ninety territorial Assembly Constituencies into which the Union Territory of Jammu & Kashmir shall be divided for the purpose of elections to the Legislative Assembly of the Union Territory and the extent of each such Constituency shall be as shown in Table -A [No. 5-2 4 The J& K Official Gazette , 5th May , 2022/ 15th Vai . , 1944.

[As envisaged in Section 14 (4) of The Jammu and Kashmir Reorganisation Act , 2019 (34 of 2019 ) , 24 seats have not been taken up for the purpose of delimitation ] .

2. The territorial Parliamentary Constituencies into which the Union Territory of Jammu & Kashmir shall be divided for the purpose of elections to the House of the People and the extent of each such Constituency shall be as shown in Table-B .

3. Where the name of a Constituency as shown in Table-A or Table- B is distinguished by the brackets and letters " ( SC ) " the seat in that Constituency is reserved for the Scheduled Castes .

4. Where the name of a Constituency as shown in Table-A or Table- B is distinguished by the brackets and letters " ( ST) " the seat in that Constituency is reserved for the Scheduled Tribes .

परिसीमन अधिनियम , 2002 ( 2002) की धारा 10 की उप - धारा ( 1 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , जम्मू- कश्मीर संघ राज्य क्षेत्र में संसदीय और विधान सभा निर्वाचन क्षेत्रों के परिसीमन के संबंध में परिसीमन अधिनियम, 2002 की धारा 4 की उप - धारा (2) के साथ पठित धारा 9 की उप- धारा (2) और जम्मू- कश्मीर पुनर्गठन अधिनियम , 2019 के भाग- V के अंतर्गत परिसीमन आयोग द्वारा किया गया निम्नलिखित आदेश एतदद्वारा प्रकाशित किया जाता है।

यतः , परिसीमन ( संशोधन) अधिनियम , 2003 (2004 का 3) द्वारा यथा- संशोधित परिसीमन अधिनियम, 2002 (2002 का 33) की धारा 8 और 4 और जम्मू- कश्मीर पुनर्गठन अधिनियम , 2019 के भाग के अनुसरण में , परिसीमन आयोग ने 14 मार्च , 2022 को भारत के राजपत्र और जम्मू- कश्मीर संघ राज्य क्षेत्र के राजपत्र के असाधारण अंक में प्रकाशित अपने आदेश सं. 1 दिनांक 14 मार्च , 2022 के द्वारा यह निर्धारित किया है - ( i ) जम्मू- कश्मीर संघ राज्य क्षेत्र को लोक सभा में आवंटित की जाने वाली सीटों की कुल संख्या पांच (5) होगी, जिसमें से शून्य (0) सीट अनुसूचित जातियों के लिए आरक्षित होगी और शून्य ( 0) सीट अनुसूचित जनजातियों के लिए आरक्षित होगी , और ( ii) संघ राज्य क्षेत्र की विधान सभा को आवंटित की जाने वाली सीटों की कुल संख्या नब्बे (90) होगी, जिनमें से सात (7 ) सीटें अनुसूचित जातियों के लिए और नौ (9) सीटें अनुसूचित जनजातियों के लिए आरक्षित होंगी; और

यतः , परिसीमन अधिनियम, 2002 की धारा 9 की उप - धारा ( 1 ) के साथ पठित धारा 5 की उप - धारा ( 1 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम , 2019 के भाग- V के अनुसरण में, परिसीमन आयोग ने संघ राज्य क्षेत्र के संसदीय और विधानसभा निर्वाचन क्षेत्रों के परिसीमन की कार्यवाहियों के लिए संघ राज्य क्षेत्र के सह सदस्यों को अपने साथ संबद्ध किया है; और

यतः , परिसीमन अधिनियम, 2002 की धारा 9 की उप- धारा ( 2 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , परिसीमन आयोग ने 2011 की जनगणना में प्रकाशित संगत आंकड़ों के आधार पर संघ राज्य क्षेत्र में संसदीय और विधानसभा क्षेत्रों के परिसीमन के लिए अपने प्रारूप प्रस्तावों को भारत के राजपत्र और जम्मू-कश्मीर संघ राज्य-क्षेत्र के राजपत्र के असाधारण अंकों में 14 मार्च, 2022 को प्रकाशित किया ताकि पूर्वोक्त प्रस्तावों के संबंध में 21 मार्च, 2022 तक आपत्तियां और सुझाव आमंत्रित किए जा सकें; और

यतः , परिसीमन अधिनियम, 2002 की धारा 9 की उप- धारा (2 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , आयोग के ऊपर उल्लिखित आदेश सं . 1 और आयोग के ऊपर संदर्भित प्रारूप प्रस्ताव 14 मार्च , 2022 को स्थानीय समाचार पत्रों में प्रकाशित किए गए थे और उन्हें रेडियो एवं टेलीविजन तथा जन संचार के अन्य साधनों के माध्यम से आगे और प्रचारित - प्रसारित किया गया था; और

यतः , परिसीमन अधिनियम, 2002 की धारा (9) की उक्त उप -धारा (2 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , आयोग ने 25 मार्च, 2022 को एक सार्वजनिक सूचना भी जारी की जिसमें सभी आपत्तियों और सुझावों पर सं. 5-1] जम्मूऔर कश्मीर आधिकारिक राजपत्र, 05 मई, 2022/15 वैशाख , 1944. 3

विचार करने के लिए इसकी सार्वजनिक बैठकों के स्थानों और तिथियों को निर्दिष्ट किया गया था; और

यतः , परिसीमन अधिनियम, 2002 की धारा 9 की उक्त उप - धारा ( 2 ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , आयोग ने 4 अप्रैल, 2022 को जम्मू में और 5 अप्रैल , 2022 को श्रीनगर में सार्वजनिक बैठकों का आयोजन किया और जनता के सदस्यों को सुना और उन्हें आयोग को पहले से भेजे गए लिखित अभ्यावेदनों , यदि कोई हों, के अलावा मौखिक और लिखित निवेदन प्रस्तुत करने का पूरा अवसर दिया; और

यतः, आयोग ने संविधान और उक्त अधिनियमों के प्रासंगिक प्रावधानों के आलोक में अपने उक्त प्रस्तावों के संबंध में पूर्वोक्त सार्वजनिक बैठकों में की गई और/ या इसके द्वारा अन्यथा प्राप्त सभी आपत्तियों और सुझावों पर विचार किया है;

अब , इसलिए यथा संशोधित परिसीमन अधिनियम , 2002 की धारा 4 की उप- धारा (2 ) के साथ पठित धारा 9 की उप- धारा ( 2) के खंड ( घ) और जम्मू- कश्मीर पुनर्गठन अधिनियम, 2019 के भाग- V के अनुसरण में , परिसीमन आयोग एतद्वारा निम्नानुसार निर्धारित करता है:

1. नब्बे राज्य-क्षेत्रीय विधान सभा निर्वाचन क्षेत्र जिनमें संघ राज्य क्षेत्र की विधान सभा के निर्वाचनों के प्रयोजनार्थ जम्मू- कश्मीर संघ राज्य क्षेत्र को विभाजित किया जाएगा, और ऐसे प्रत्येक निर्वाचन क्षेत्र का विस्तार तालिका- क में दर्शाए अनुसार होगा; [ जैसा कि जम्मू-कश्मीर पुनर्गठन अधिनियम , 2019 (2019 का 34) की धारा 14(4) में परिकल्पित है, परिसीमन के प्रयोजनार्थ 24 सीटों को नहीं लिया गया है] ।

2. वे राज्य-क्षेत्रीय संसदीय निर्वाचन क्षेत्र जिनमें लोकसभा के निर्वाचनों के प्रयोजनार्थ जम्मू- कश्मीर संघ राज्य क्षेत्र को विभाजित किया जाएगा, और ऐसे प्रत्येक निर्वाचन क्षेत्र का विस्तार तालिका- ख में दर्शाए अनुसार होगा;

3. जहां तालिका-क अथवा तालिका - ख में यथा -दर्शित निर्वाचन क्षेत्र के नाम कोष्ठकों और अक्षरों ( अ.जा. ) द्वारा सुभिन्न किए गए हैं, वहां उस निर्वाचन क्षेत्र में वह सीट अनुसूचित जातियों के लिए आरक्षित है।

4. जहां तालिका-क अथवा तालिका - ख में यथा- दर्शित निर्वाचन क्षेत्र के नाम कोष्ठकों और अक्षरों (अ.ज.जा. ) द्वारा सुभिन्न किए गए हैं, वहां उस निर्वाचन क्षेत्र में वह सीट अनुसूचित जनजातियों के लिए आरक्षित है ।
