Whereas , one Mr. Bansi Lal (petitioner) had filed a writ petition OWP No. 1694/2013 titled Bansi Lal V/ s State & Ors . in the Hon'ble High Court of Jammu and Kashmir at Jammu and Hon'ble High Court vide order dated 26-04-2019 disposed off the case with the directions :
this petition is allowed and the respondents are directed to complete the acquisition proceedings under the Jammu and Kashmir Land Acquisition Act within a period of two months from the date of receipt of a certified copy of the order and further determine and pay the amount for use and occupation of the said land from the date, the possession of the land was taken from the petitioner till date " .
Whereas , a notification under section 4 (1 ) was issued by Collector, Land Acquisition ( SDM ) , Hiranagar vide No. SDM / H /LHS /233-41 dated 19-10-2019 for land measuring 02 Kanals 12 Marlas situated at Village Ghair ( Chadwal) , Tehsil Hiranagar, District Kathua calling upon the objection from the land owners / interested person, if any ; and Whereas , pursuant to above notification , no objection was received from anyone within the prescribed time period ; and Whereas , District Collector (DC ) , Kathua vide letter No. DCK/ LA/ 2020-21 dated 26-03-2021 submitted the case to Divisional Commissioner, Jammu for issuance of declaration under sections 6 and directive under section 7 of J & K State Land Acquisition Act , Svt . 1990 , who , returned the case vide No. 502/4326/PHE/ Ghair - Chadwal/Kth/ 21 / 69 dated 10-04-2021 for with some observations ; and No. 15 ] The J& K Official Gazette , 14th July, 2022/23rd Asad. , 1944. 133
Whereas , the Collector , Land Acquisition ( SDM ) , Hiranagar vide letter No. SDM/ H / LHS /2021-22/ 382 dated 24-02-2022 re - submitted the case to District Collector (DC ) , Kathua along with copy of indent duly countersigned by Chief Engineer , PHE Department for issuance of declaration under sections 6 and directive under section 7 of J &K State Land Acquisition Act , Svt . 1990 , who , vide No. DCK/ LA/ 2021-22/ 3301- 04 dated 16-03-2022 endorsed to Divisional Commissioner , Jammu ; and
Whereas , Divisional Commissioner , Jammu vide No. 502/ 4326 /PHE/ Chadwal/ Kth/ 22/ 5210 dated 31-03-2022 further endorsed to Financial Commissioner ( Revenue ) , J & K, who vide No. FCR - LAND / 77 / 2022 (171342) dated 27-05-2022 forwarded to this department for the said purpose ; and
Whereas , the report furnished by Collector , Land Acquisition ( SDM) , Hiranagar vide letter referred to above , endorsed by District Collector (DC ) , Kathua , Divisional Commissioner, Jammu and Financial Commissioner (Revenue) , J & K has been examined and it has been found that no one has filed any objection to the proposed acquisition ; and
Whereas , the Government is satisfied that the land particulars are given above is required for public purpose i. e . for establishment/ construction of Tube - Well- cum- Pump Room Building situated at Village Ghair (Chadwal) , Tehsil Hiranagar , District Kathua .
Now, therefore , in pursuance of section 6 of the Jammu and Kashmir Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 02 Kanals , 12 Marlas situated at Village Ghair ( Chadwal ) , Tehsil Hiranagar , District Kathua , is required for public purposes i . e . establishment/ construction of Tube- Well- cum- Pump Room Building . Further, the Collector , Land Acquisition ( SDM) , Hiranagar is directed under section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person ( s ) as required under the Land Acquisition Act/Rule .
Further , the Collector concerned shall be held specifically responsible for identification and proper title verification of all types of lands involved in the case for making apportionment of compensation amongst all the interested persons /rightful claimants , in accordance with the relevant laws/ rules in force , while making the award . The Collector, Land Acquisition shall carry the further acquisition proceedings as per the provisions of the said Act and rules made thereunder .

Whereas , you completed the allotted job of Anti - Termite and Anti- Silverfish Treatment in the whole Press Complex including Administrative Block , Press Factory within stipulated time period.
Whereas , after completion of allotted job you submitted a Guarantee Certificate on stamp paper issued under BL 292253 that your firm is bound to carry out Anti - Termite Treatment free of cost, if the structure is infested with termite within the guarantee period of 5 years i. e . till January , 2023 free of cost.

Whereas , vide this office letter No. RGPJ /PC/ 3918-23 dated 17-01-2022 , you were requested to depute your team to re - execute the Anti- Termite Treatment as the symptoms of termite (White Ant ) re - appeared and rapidly increased in the different Stores of Press Factory , but you have taken the matter in casual manner and not taken any further step for re - execution of Anti - Termite Treatment .
Whereas , even after lapse of more than 04 months nothing has been done from your side , resulting to which lots of paper and paper products costing in lacs of rupees , have been destroyed by the termite .
Whereas , vide this office letter No. RGPJ/ PC/ 774-78 dated 06-06-2022 , you were once again requested to re - execute the Anti- Termite Treatment within a weeks time , otherwise the department is left with no other option but to forward the case to higher authorities for strict action under rule besides , to black- list your firm and legal action under rule shall be initiated against your firm .
Whereas , the said reminder letter send through Speed Post vide No. EEB : 44103731N dated 09-06-2022 , the post office returned the letter as your registered office address was not found .
In view of above a SHOW CAUSE NOTICE is served to you through print media in order to report to this office within 07 days from the date of publication of this show cause notice , otherwise the department will take strict action under rule besides , to black - list your firm and legal action under rule shall be initiated against your firm without any further notice .

S.O. - 133 . In exercise of the powers conferred by Article 309 of the Constitution of India , the Lieutenant Governor of the Union Territory of Jammu and Kashmir is pleased to direct that :

S.O. - 136 . Whereas , on 07-10-2021 , Police Station , Zakoora received a docket to the effect that during Naka checking at Zakoora crossing , a person coming from Batpora towards Zakoora was noticed in suspicious circumstances , who while seeing Naka party tried to escape but was chased down on spot and identified as Adil Ahmad Khan S / o Abdul Aziz Khan R/ o Sozeith Narbal . During his personal search , Police recovered 02 Posters of banned LeT outfit from his possession ; and 2 The J&K Official Gazette , 29th March, 2022/8th Chai . , 1944. [ No. 52 - aa
2. Whereas , upon the information , a case FIR No. 105/2021 under
section 13 ULA(P) Act , came to be registered in Police Station , Zakoora
and investigation of the case was taken up . Subsequently, during
investigation section 39 ULA(P) Act , was added in the case ; and
3. Whereas , during investigation , site plan ofplace of occurrence
and seizure memos were prepared and statements of witnesses acquainted
with the facts and circumstances of the case were recorded under the
relevant provisions of law ; and
4. Whereas , during investigation, some incriminating material was also retrieved from the cell phone of accused Adil Ahmad Khan and it was established that the accused was working as Over Ground Worker (OGW) for the terrorists of LeT banned outfit and was providing logistic support to them for carrying out the terrorist activities in the area ; and
5. Whereas , on the basis of investigation , statements of witnesses recorded and other evidence collected , the Investigating Officer has established prima facie involvement of below mentioned accused for the commission of offences punishable under section as shown against his name of the Unlawful Activities (Prevention) Act , 1967 :-

(Prevention) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the accused for his prosecution under the provisions of Law.
Now, therefore , in the exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government hereby accord sanction for launching prosecution against the accused viz . Adil Ahmad Khan for the commission of offences punishable under Sections 13 , 39 of the Unlawful Activities (Prevention) Act , 1967 , arising out of FIR No. 105/2021 of Police Station , Zakoora .

as Rafiq Ahmad Dar S / o Gh . Hassan R/ o Ghat Tokuna , Awantipora. During search of the bag carried by the said person , Police recovered one Chinese hand grenade from the said bag ; and
2. Whereas , upon the information , a case FIR No. 50/2018 under sections 18 , 20 , 21 of the Unlawful Activities ( Prevntion) Act , 1967 , came to be registered in Police Station , Awantipora and investigation , of the case was set into motion . Subsequently, during investigation , section 23 ULA( P) Act was added in the case ; and
3. Whereas , during investigation, one more accused namely, Abid Majeed Sheikh S/ o Ab . Majeed Sheikh R/o Dadsura Tral was arested in connection with the case and on his discloser, Police recovered an amount of Rs . 5,37,000/- from his instances which were provided to him by terrorist of Ansar - Gazwatul - Hind outfit Zakir Rashid Bhat @ Zakir Musa S/ o Ab . Rashid Bhat R/ o Noorpora , Tral for purchase of arms/ ammunition ; and
4. Whereas , during investigation, site plan of place of occurrence and seizure memos were prepared and statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
5. Whereas , during investigation , it was established that both the accused Rafiq Ahmad Dar and Abid Majeed Sheikh in a well knit criminal conspiracy with terrorist Zakir Rashid Bhat @ Zakir Musa procured arms/ammunition with the intention to commit terror act ; and
6. Whereas , accused terrorist Zakir Rashid Bhat has been killed in an encounter with the security forces and proceeding under law shall abate against him; and

Whereas , the Authority appointed by the Government under sub- section (2 ) of section 45 of the Unlawful Activities (Prevention) Act , 1967 has independently examined the Case Diary File and all the other relevent documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused ; and

Whereas , after perusing the Case Diary File , the relevant documents and also taking into consideration views of the Authority appointed under sub - section (2 ) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government is ofthe view that there is sufficient material and evidence available against the accused for their prosecution under the aforesaid provisions of Law .
Now, therefore, in the exercise of powers conferred by sub - section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government hereby accord sanction for launching prosecution against the above accused viz . Rafiq Ahmad Dar and Abid Majeed Sheikh for the commission of offence punishable under relevant sections the Unlawful Activities ( Prevention) Act , 1967 as indicated against each accused at Para (7) , arising out of FIR No. 50/2018 of Police Station, Awantipora .

SO - 151 . In exercise of the powers conferred by Article 309 of the Constitution of India , the Lieutenant Governor of the Union , Territory of Jammu and Kashmir hereby directs that :-
" In the Subordinate Services Recruitment Rules or any other rules governing the service in the departments and the posts indicated in Annexure - A to this notification, the Class - IV posts having Pay 2 The J& K Official Gazette , 4th April , 2022/ 14th Chai . , 1944. [ No. 53 -k
Level SL - 2 are placed in Pay Level SL- 1 . The existing employees working in these departments having Pay Level SL- 2 shall continue in Pay Level SL - 2 till vacation of these posts on account of promotion, death , retirement etc.
Further , all departments shall amend their respective Subordinate Services Recruitment Rules in such a way that all future referrals shall be made for direct recruitment to Class - IV posts at Pay Level SL - 1 only, besides , the provision for uniform carrier progression of all Class - IV employees across all Departments shall also be incorporated" .
These rules shall come into force from the date of the publication in the official Gazette .

Notification
Where as , in exercise of powers conferred under section 66 of J & K Municipal Act , 2000, Municipal Committee , Charar - i - Sharief notifies to impose and recover municipal tax for the items classified under clause 1 of section 66 of the Act , as per the schedule annexed to the notification ;
Whereas , under section 70 (02) , the Committee/ Council is supposed to publish a notice for the information of the inhabitants of the Charar - i- Sharief Town ; and 2 The J&K Official Gazette , 27th May, 2022/ 6th Jyai . , 1944. [No. 8-1
Whereas , the inhabitants of Charar - i - Sharief Town have a right to file objections , if any , in writing in 30 days from date of publication of this notice under section 70 (3 ) of J& K Municipal Act , 2000 .
Now , this notification is issued under the seal and signature of undersigned along with proposed schedule of tax inviting objections from the inhabitants of the town to be filed in writing in the office of the Municipal Committee , Charar - i - Sharief within the period of 30 days from date of publication of this notification .
In case no such objection is received within above specified period , the schedule of taxes shall be affected after one weak from the date of expiry of time limit .

In exercise of the powers conferred under section 66 read with section 70 of J & K Municipal Act , 2000 A. D. the Municipal Council , Kupwara hereby propose to revise the tax schedule as contained in Annexure " A" to this notification within the limits of Municipal Council , Kupwara.

NOTIFICATION
No. 480/2022 . Whereas , the term of office of Shri M. Venkaiah Naidu , Vice - President of India , is upto 10th day of August , 2022 , in terms ofArticle 67 of the Constitution ; and
Whereas , an election is due to be held , in terms of clause ( 1 ) of Article 68 of the Constitution , to fill the vacancy to be caused by the expiration of the term of office of the incumbent Vice- President before the expiration of term of his office ; and 2 The J& K Official Gazette , 5th July, 2022/14th Asad. , 1944. [No. 13-4
Whereas , under sub - section (3 ) of Section 4 of the Presidential and Vice-Presidential Elections Act , 1952 (31 of 1952) , the. Election Commission of India is required to so appoint the dates for the election to fill the office of the Vice- President of India that the election will be completed at such time as will enable the Vice- President thereby elected to enter upon his office on the 11th day of August , 2022 .
Now, therefore , the Election Commission of India hereby-
(A) calls upon the Electoral College , referred to in Article 66 of the Constitution, to elect a person to fill the above vacancy in the Office of Vice- President of India before the expiration of the term of the incumbent Vice- President , in accordance with the provisions of the Constitution , the Presidential and Vice- Presidential Elections Act , 1952 (31 of 1952) , and the Rules and Orders made thereunder ; and
(B) in pursuance of sub- section ( 1 ) of Section 4 of the said Act , appoints-
(a) the 19th July, 2022 ( Tuesday) , as the last date for making nominations ;
(b) the 20th July, 2022 (Wednesday) , as the date for scrutiny of the nominations ;
(c) the 22nd July, 2022 (Friday) , as the last date for the withdrawal of candidatures ; and
(d) the 6th August , 2022 (Saturday) , as the date on which a poll shall , if necessary, be taken .

सं . 480 / 2022.- यतः , श्री एम . वेंकैया नायडु , भारत के उपराष्ट्रपति की पदावधि , संविधान के अनुच्छेद 67 की शर्तों पर , 10 अगस्त , 2022 को समाप्त हो रही है ; और
यतः पदधारित उपराष्ट्रपति की पदावधि समाप्त होने के पूर्व , इस प्रकार उत्पन्न हुई रिक्ति को भरने के प्रयोजन से , संविधान के अनुच्छेद 68 के खण्ड ( 1 ) की शर्तों पर , निर्वाचन कराया जाना है ; और 2 जम्मू और कश्मीर अधिकारिक राजपत्र , 5 जुलाई , 2022 /14 आषाढ़ , 1944. [सं . 13-4
यतः राष्ट्रपतीय और उपराष्ट्रपतीय निर्वाचन अधिनियम , 1952 ( 1952 का 31 ) की धारा 4 की उपधारा (3 ) के अधीन भारत निर्वाचन आयोग द्वारा भारत के उपराष्ट्रपति के पद को भरने के लिए निर्वाचन हेतु तारीख इस प्रकार नियत की जानी अपेक्षित है कि निर्वाचन ऐसे समय तक पूर्ण हो जाए और निर्वाचित उपराष्ट्रपति अपना पद 11 अगस्त , 2022 को ग्रहण करने में समर्थ हो सकें ।
अतः अब , भारत निर्वाचन आयोग एतदद्वारा :-
अ) संविधान के अनुच्छेद 66 में निर्दिष्ट निर्वाचक मंडल से यह अपेक्षा करता है कि वे संविधान के प्रावधानों के अनुसार , राष्ट्रपतीय और उपराष्ट्रपतीय निर्वाचन अधिनियम , 1952 ( 1952 का 31 ) और तदाधीन बनाए गए नियमों और उनके तहत जारी किए गए आदेशों के उपबन्धों के अनुसार , वर्तमान उपराष्ट्रपति की अवधि खत्म होने से पूर्व भारत के उपराष्ट्रपति के पद को भरने के लिए एक व्यक्ति निर्वाचित कर दें; और
आ) उक्त अधिनियम की धारा 4 की उपधारा ( 1 ) के अनुसरण में निम्नलिखित निर्धारित करता है: -
(क) नामनिर्देशन की अन्तिम तारीख
: 19 जुलाई , 2022 (मंगलवार)
(ख) नामनिर्देशन की संवीक्षा की तारीख : 20 जुलाई , 2022 ( बुधवार )
(ग ) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख: 22 जुलाई , 2022 (शुक्रवार )
(घ ) वह तारीख जिसको , यदि आवश्यक हुआ ,
तो मतदान होगा
: 6 अगस्त , 2022 (शनिवार )

No. 480/2022 ( 1) . In pursuance of Rule 8 of the Presidential and Vice- Presidential Elections Rules , 1974, the Election Commission of India hereby ;
(a) fixes Room No. 63 , Parliament House , New Delhi as the place of polling for the Vice - Presidential Election to be held in accordance with its Notification No. 480/2022 , dated the 5th July, 2022 ; and 2 The J& K Official Gazette , 5th July, 2022/14th Asad. , 1944. [No. 13-5
(b) specifies the hours from 10.00 a . m. to 5.00 p. m. both inclusive to be the hours during which the poll , if necessary, will be taken at the said place of polling .
