Resettlement Act, 2013 for calling upon the objections, if any, from

the interested persons/land owners within stipulated time period from

the date of issuance/publication of the said notice ; and

Whereas, in response to said notification, no objection was received

within stipulated time period from the land owners/interested person in

the Collectorate of Sub-Divisional Magistrate, Mahore ; and

Whereas, as per S. O. No. 17 dated 14-01-2022 issued by

Government of Jammu and Kashmir, Revenue Department,

the appropriate Government as defined under Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 shall be Deputy Commissioner up to 400 Kanals (50 acre) ; and

SO-474.––Whereas, on 04-04-2022, the Police Station, Maisuma received a reliable information to the effect that some unknown terrorists fired indiscriminately upon the CRPF nafri deployed at Barrow Mandir, Maisuma, with their illegal arms/ammunition, with the intention to kill them. resulting in injuries to two CRPF personnel, who were shifted to hospital for treatment. Whereas, based on the above, a Case FIR No. 05/2022 under Sections 307 IPC, 7/27 Arms Act, 13 and 16 of ULA (P) Act, was registered in the Police Station, Maisuma and the investigation of the case was set into motion. Subsequently, one of the injured CRPF personnel namely HC/GD Vishal Kumar, succumbed to his injuries and Section 302 IPC was added in the case. During the investigation, Sections 120-B, 201, 468 IPC r/w 37 Aadhaar Act, Sections 18, 19, 20, 38, 39 of ULA (P) Act, were also added in the case ; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, three accused identified as Irfan Rashid Bhat @ Usman S/o Ab. Rashid Bhat R/o Padashahi Bagh, Srinagar, Ashiq Bashir Najar @ Nasir S/o Bashir Ahmad Najar R/o Syed Abad, Soiteng, Srinagar and Bilal Ahmad Daga @ Umer S/o Mohd Shafi Daga R/o Banday Kocha, M. R. Gunj, Srinagar, were found involved in the commission of offence. Subsequently, the accused were arrested in the case and during investigation some incriminatory material was recovered at the instances of accused viz. Ashiq Bashir Najar @ Nasir ; and

5. Whereas, during the investigation, the accused viz. Irfan Rashid Bhat @ Usman, Ashiq Bashir Najar @ Nasir and Bilal Ahmad Daga @ Umer, were found in contact with three terrorists of JeM/LeT banned outfit namely, Mubashir Ahmad Dar S/o Gh. Nabi Dar R/o Pastuna, Tral A/P PoK, Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib Rs/o Pakistan and were working for them in order to promote terrorist activities in the area. The accused terrorists viz. Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib, attacked upon the CRPF nafri deployed at Barrow Mandir, Maisuma on 04-04-2022 ; and

6. Whereas, during the further investigation, two more persons namely Kaleem Zaffar Khan @ Khawar S/o Zaffar-ul-Khan R/o Firdous Abad, Batamaloo and Raja Junaid Bhat S/o Hafazul1ah Bhat R/o Mandir Bagh, were round involved in the case. The accused viz. Kaleem Zaffar Khan @ Khawar, on the directions of accused viz. Bilal Ahmad Daga, No. 27-f] The J&K Official Gazette, 6th Oct., 2022/14th Asv., 1944. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— prepared two fake Aadhaar Cards in the name of terrorists viz. Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib and the other accused viz. Raja Junaid Bhat, also procured a SIM card on fake documents and provided to accused Bilal Ahmad Daga. Subsequently, the accused viz. Kaleem Zaffar Khan @ Khawar, was arrested in the case and accused Raja Junaid Bhat, is evading his arrest ; and

7. Whereas, during the investigation, it was established that the accused viz. Irfan Rashid Bhat @ Usman, Ashiq Bashir Najar @ Nasir and Bilal Ahmad Daga @ Umer, were working as Over Ground Workers (OGWs) for the terrorists namely, Mubashir Ahmad Dar, Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib and were providing shelter/logistic support to them, besides, under a well knit criminal conspiracy faclitated the terrorists viz. Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib, on the date of occurrence for carrying out the attack upon the CRPF party deployed at Barrow Mandir, Maisuma which resulted in the death of a CRPF personnel ; and

8. Whereas, the accused terrorists namely Adil Hussain @ Abu Arsalan @ Khalid and Mubashir Bhai @ Mohd Bhai @ Abu Kasim @ Mir Shoaib, have been killed in an encounter with the Security Forces and the proceedings under the law would abate against them ; and

9. Whereas, on the basis of the investigation, the statement of witnesses recorded and other evidence collected, the Investigatmg Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their name :—

SO-475.––Whereas, on 18-05-2022, the Police Station, CIK, Kashmir, received a reliable information that one Zulafkar Ali Khatana S/o Mohammad Altaf Khatana R/o Kachawan, Kathnadi, Laroo, Kokernag, serving as Constable in 171/Bn of Central Reserve Police Force (CRPF), 2 The J&K Official Gazette, 6th Oct., 2022/14th Asv., 1944. [No. 27-g –––––––––––––––––––––––––––––––––––––––––—–––—————––– has been working for the PaK based terrorists of JeM/LeT banned outfits and providing vital information to them in order to carry out the terrorist activities on these vital installations, besides, aiding the Enemy Country (Pakistan) to target security personnel in order to wage war against the Union of India ; and

2. Whereas, based on the above, a Case FIR No. 11/2022 under Sections 18, 38, 39 of ULA (P) Act, 121, 121-A IPC, 3 Official Secrets Act, 3 Enemy Agent Ordinance and Sections 7(a) 7(b) of Prevention of Corruption Act, was registered in Police Station, CIK (SIA), Kashmir and the investigation of the case was set into motion. Subsequently, during the investigation, the Section 13 of ULA (P) Act was added and Sections 7(a) 7(b) of PC Act, was dropped from the case ; and

3. Whereas, during the investigation, the accused viz. Zulafkar Ali Khatana, was arrested in the case and it was found that the accused was in contact with PoK based ISI agents/terrorists of JeM/LeT banned outfit namely @ Yousuf Bloach @ Zarar @ Qari Maviah @ Hafiz and @ Aziz Bhai, through the social media, who motivated the accused to work for them. The accused on the directions of these PoK based terrorists shared photographs of vital installation, IAF base Pathankot, Chhabua, Dibrugarh, Grid references of some Army Camps in Valley, video of convoy movement, restricted/confidential documents, sketches, Artillery positions in Gulmarg, names/pictures of J&K/Security personnel, Photos of Baltal and Zojila passes and copies of intelligence inputs which he had received by virtue of his duties as intelligence official, with the above terrorists ; and

4. Whereas, during the course of investigation, the seizure memos were prepared and statement of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

5. Whereas, during investigation, it was established that the accused Zulafkar Ali Khatana, was associated with the terrorists of JeM/LeT banned outfit namely Yousuf Bloach @ Zarar, Aziz Bhai and Qari Maviah @ Hafiz, and was providing logistic support to them, besides, under a well knit criminal conspiracy shared vital information with the above terrorists/ISI agents, for carrying out the terrorist activities and to wage war against the Union of India ; and No. 27-g] The J&K Official Gazette, 6th Oct., 2022/14th Asv., 1944. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— 6. 3. Whereas, during the course of the investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statement of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the author of the article namely, Abdul Aala Fazili S/o Late Mohd Rafi Fazili R/o Humhama Chowk, Airport Road, Budgam and the Director and editor of the online portal "The Kashmir Walla" namely Peerzaada Fahad Shah S/o Peerzaada Nisar Shah, R/o Samboora, Pulwama A/P Dawood Colony, Aanchar, Soura Srinagar, were found part of an ongoing operation to build and propagate the false narrative to sustain the secessionist-cum-terrorist campaign within J&K and to disrupt the territorial integrity of Union of India, by seceding J&K with Pakistan and subsequently, the accused were arrested in the case ; and

5. Whereas, during the investigation, it was found that the accused viz. Abdul Aala Fazili and Peerzaada Fahad Shah, under an active conspiracy and Pakistan's support, have resurrected a platform for reviving the narrative in support of the terrorists and separatist ecosystem. The said accused have been spreading the anti-India narrative by exploiting the digital platforms under a concealed and camouflaged set- up, with the help of illicit funding received from hostile foreign agencies and prescribed terrorist organizations ; and

6. Whereas, during the investigation, it has been established that the accused viz. Abdul Aala Fazili and Peerzaada Fahad Shah, under a well knit criminal conspiracy, were involved in unlawful activities and advocacy of the commission of the terrorist act, abetting the waging of war against the Government of India ; and

7. Whereas, during investigation it was also established that the accused viz. Peerzaada Fahad Shah, is the Director and editor of the No. 27-s] The J&K Official Gazette, 8th Oct., 2022/16th Asv., 1944. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— online portal "The Kashmir Walla" and through the corresponding bank account of the portal has received "foreign contributions" in contravention of the Foreign Contribution (Regulation) Act, 2010 ; and

8. Whereas, the investigation with respect to the other accused shall remain to continue to bring their role in the case who are the part of the conspiracy ; and

9. Whereas, on the basis of investigation, and other evidence collected, the Investigating Officer has established, prima facie, involvement of the below mentioned accused in the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, Indian Penal Code and the Foreign Contribution (Regulation) Act, 2010, as shown against each :—

SO-488.––Whereas, on 23-04-2022, information was received by Police Station, Rajbagh to the effect that a person namely Mohd Ishfaq S/o Mohd Shafi R/o Malsoo, Doda, is associated with one terrorist namely Mohd Amin @ Khubib R/o Thatri, Doda A/P in Pakistan and the duo, in association of some other persons/inhabitants of Border villages of Tehsil Merheen and Hiranagar areas of District Kathua, are indulging in anti-national and terror activities aimed against the integrity and 2 The J&K Official Gazette, 8th Oct., 2022/16th Asv., 1944. hatched for the purpose, were facilitating the transportation of arms/

ammunition to promote terrorist activities in the area ; and

2. Whereas, based on the above, case FIR No. 86/2022 under

Sections 120-B, 121, 121-A, IPC and 13, 16, 18, 38 & 39 of ULA

(P) Act, 1967 was registered in Police Station, Rajbagh and investigation

was taken up. Subsequently, during the investigation Section 23 of ULA

(P) Act was added, whileas Section 16 of ULA(P) Act was dropped

from the case ; and

3. Whereas, during course of investigation, site plan of place of

occurrence and seizure memos were prepared and statement of witnesses

acquainted with the facts and circumstances of the case were recorded

under the relevant provisions of law ; and

4. Whereas, during the investigatton, it was established that the

accused viz. Mohd Ishfaq, was arrested in the case and it was found

that he was in contact with the terrorist viz. Mohd Amin @ Khubib,

and presently based in PaK, through virtual mode ; and

5. Whereas, during further investigation, it was found that one more

person namely Makhan Din @ Shah Hussain S/o Late Bika R/o Merheen,

who was in constant touch with the accused viz. Mohd Ishfaq in

furtherance of the criminal conspiracy for procurement of arms/

ammunition. The accused managed to procure some ammunition and

other incriminate material. The accused viz. Makhan Din @ Shah

Hussain, was already in custody in case FIR No. 08/2021 of Police

Station, Rajbagh wherefrom, the custody of the accused has been

changed to the instant case under the order of the Competent Court

of Law ; and

6. Whereas, during the investigation, it was established that accused

viz. Mohd Ishfaq and Makhan Din @ Shah Hussain, were working as

OGWs for the terrorists of LeT banned outfit particularly Mohd Amin

@ Khubib, and under a well knit conspiracy were providing logistic/

other support including transportation of arms/ammunition to facilitate

and promote terrorist activities in the area and to wage war against the

SO-490.––Whereas, on 09-04-2022, the Police Station, Srigufwara received a docket to the effect that a reliable information was received regarding the presence of some unknown terrorists in Village Sirhama. Subsequently, a Joint Cordon and Search Operation was launched and during the search the terrorists hiding in the residential house of one Javaid Ahmad Rather S/o Ab. Khaliq Rather R/o Apple Colony, Sirhama, fired indiscriminately upon the search party with their illegal arms/ 2 The J&K Official Gazette, 10th Oct., 2022/18th Asv., 1944. [No. 27-v –––––––––––––––––––––––––––––––––––––––––—–––—————––– ammunition, with the intention to kill them. The fire was retaliated by the Police/Security forces, which triggering an encounter ; and

2. Whereas, based on the above, a Case FIR No. 18/2022 under Sections 307 IPC, 7/25 Arms Act, 16, 18, 19 of ULA Act, was registered in the Police Station, Srigufwara and the investigation of the case was set into motion. Subsequently, during the investigation, Sections 20, 23 and 39 of ULA (P) Act, were added in the case ; and

3. Whereas, during the investigation, one dead body was recovered from the place of encouter, who was later on identified as the terrorist of LeT banned outfit namely, Nisar Ahmad Dar S/o Gh. Hassan Dar R/o Redwani, Qaimoh. During the search operation, arms/ammunition viz. 01 AK-47 Rifle with Magazine and 20 Rounds were also recovered from the encounter site ; and

4. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

5. Whereas, during the investigation, five other accused identified as Omar Nabi Rather S/o Gh. Nabi Rather R/o Sirhama, Mudasir Ahmad Najar S/o Gull Mohd Najar R/o Herpora, Sirhama, Sartaj Ahmad Rather S/o Mukhtar Ahmad Rather R/o Sirhama, Idress Ahmad Mir S/o Bashir Ahmad Mir R/o Buchroo, Kulgam and Mehraj Ahmad Lone S/o Bashir Ahmad Lone R/o Awoora, Mishpora, Kulgam, were found involved in the case and were in found in contact with the terrorist viz. Nisar Ahmad Dar. Subsequently, four accused viz. Omar Nabi Rather, Mudasir Ahmad Najar, Sartaj Ahmad Rather and Idress Ahmad Mir, were arrested in the case and the accused viz. Mehraj Ahmad Lone, is evading his arrest ; and

6. Whereas, during the investigation, it was found that the accused namely, Idress Ahmad Mir and Mehraj Ahmad Lone, handed over the accused terrorist viz. Nisar Ahmad Dar, to accused Mudasir Ahmad Najar for providing of shelter, who further handed over the said terrorist to accused viz. Sartaj Ahmad Rather. The, accused viz. Sartaj Ahmad Rather, concealed the said terrorist in the orchards for two days and provided food/logistic support to him. Later on all, the accused decided No. 27-v] The J&K Official Gazette, 10th Oct., 2022/18th Asv., 1944. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— to conceal the said terrorist in Village Sirhama and subsequently, on the date of occurrence, the accused viz. Omar Nabi Rather and Mudasir Ahmad Najar, brought the said terrorist in the house of Javaid Ahmad Rather, when he was not available in his house and concealed the said terrorist in the said house without the knowledge of the house owner ; and

7. Whereas, during the investigation, it was established that the accused namely Omar Nabi Rather, Mudasir Ahmad Najar, Sartaj Ahamd Rather, Idress Ahmad Mir and Mehraj Ahmad Lone, were working as Over Ground Workers (OGWs) for the terrorists of LeT banned outfit particularly the killed terrorist namely Nisar Ahmad Dar and under a well knit criminal conspiracy were providing shelter/logistic support to him, besides, the accused viz. Omar Nabi Rather and Mudasir Ahmad Najar, voluntarily harboured/concealed the said terrorist in the residential house of Javaid Ahmad Rather without his knowledge, for carrying out the terrorist activities in the area ; and

8. Whereas, the accused terrorist viz. Nisar Ahmad Dar, has been killed in the said encounter with the Security Forces and the proceedings under the law would abate against him. The house owner namely Javaid Ahmad Rather, was not found involved in the case ; and

9. Whereas, on the basis of the investigation, the statement of witnesses recorded and other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their name :—

Kareem Mir R/o Nowgam, Verinag and fired upon him with their illegal arms/ ammunition, with the intention to kill him, resulting in serious injuries 2 The J&K Official Gazette, 10th Oct., 2022/18th Asv., 1944. Later on the injured person succumbed to his injuries and subsequently, during the investigation, Section 302 RPC was added in the case ; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

Whereas, during the investigation, 04 terrorists of HM/JeM banned outfit identified as Zubair Ahmad Wani S/o Mohd Afzal Wani R/o Dehruna, Hilal Ahmad Naikoo S/o Ali Mohd Naikoo R/o Panzoo, Verinag, Mohd Iqbal Ganie S/o Mohd Abdullah Ganie R/o Nowpora, Dooru and Umer Pathan R/o Multan, Pakistan, were found involved in the commission of crime. Subsequently, during the investigation the accused namely Hilal Ahmad Naikoo, was arrested in the case ; and

5. Whereas, during the investigation, it was established that the accused viz. Zubair Ahmad Wani, Hilal Ahmad Naikoo, Mohd Iqbal Ganie and Umer Pathan, were members of HM/JeM banned outfit and on 04-05-2019, under a well knit criminal conspiracy barged in the residential house of deceased Gull Mohd Mir and fired upon him, which resulting in the death of the said deceased person ; and

Whereas, after perusing the Case Diary File, the relevant documents and also taking into consideration the views of the Authorlty appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. SO-492.––Whereas, on 13-05-2019, the Police Station, Gool received a docket to the effect that a reliable information was received about the movement of some LeT banned terrorists in Hara, Kalimasta, Gool area. Mohi-ud-Din Dar S/o Gh. Mohi-ud-Din Dar R/o Malipora, Kulgam and

Showket Ahmad Sheikh S/o Ghulam Nabi Sheikh R/o Charsoo,

Awantipora. During their personal search, the Police recovered

01 AK-47 Rifle with Magazine, 30 Rounds and an amount of Rs. 8770/-

(Indian Currency) from their possession respectively ; and

2. Whereas, based on the above, a Case FIR No. 40/2019

under Sections 7/27 Arms Act, 13, 17, 19 of ULA (P) Act, and

Sections 120-B, 121 and 122 RPC, was registered in the Police Station,

Gool and the investigation of the case was set into motion. Subsequently,

during the investigation Section 19 of ULA (P) Act was dropped and

Section 18 of ULA (P) Act was added in the case ; and

3. Whereas, during the course of investigation, the site plan of the

place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances of

the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the accused viz. Tawheel

Mohi-ud-Din Dar and Showket Ahmad Sheikh, along with two other

accused identified as Abid Gulzar S/o Gulzar Ahmad Reshi R/o Chursoo,

Awantipora and Ghulam Nabi Chandail S/o Abdul Rehman Chandail

R/o Bhimdasa, Gool, were found in contact with a terrorist of LeT

banned outfit namely, Naveed Ahmad Bhat @ Abu Talha S/o Ali Mohd

Bhat R/o Qaimoh, Kulgam. The accused viz. Tahweel Mohi-ud-Din Dar

and Showket Ahmad Sheikh, received an amount of Rs. 2.5 lacs from

the terrorist viz. Naveed Ahmad Bhat @ Abu Talha and procured the

arms/ammunition from the accused viz. Ghulam Nabi Chandail, after

handing over an amount of Rs. 2,40,000/- to him. Subsequently, the

accused viz. Abid Gulzar and Ghulam Nabi Chandail, were also arrested

in the case ; and

5. Whereas, during the investigation, it was established that the

accused viz. Naveed Ahmad Bhat @ Abu Talha, is member of LeT

banned outfit and the accused namely Tahweel Mohi-ud-Din Dar,

Showket Ahmad Sheikh, Abid Gulzar and Ghulam Nabi Chandail, were

working for the said terrorist and under a well knit criminal conspiracy

Whereas, on the basis of the investigation, the statement of witnesses recorded and other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, and Ranbir Penal Code as shown against their name :—

11. Whereas, the Government has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused under the aforementioned provision of the Ranbir Penal Code (RPC).

Now, therefore, in exercise of the powers conferred by Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, and Section 196 of the Code of Criminal Procedure, the Government hereby accord sanction for launching prosecution against the accused viz. 4. Whereas, during the investigation, three persons identified as Zeenat-ul-Islam S/o Ab. Waheed Magray R/o Watoo, Imtiyaz Ahmad Parray S/o Gh. Mohi-ud-Din Parray R/o KB Pora and Mohammad Sikander Lone S/o Ab. Gani Lone R/o Mirwani, were found involved in the case. Subsequently, the accused were arrested in the case ; and

6. Whereas, the accused viz Shareef-ud-Din Shah, has expired and

the proceedings under the law would abate against him ; and

3. Whereas, during the investigation, the site plan of place of occurrence and the seizure memos of recovered arms/ammunition were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the accused viz. Rahid Mushtaq Ganie, Amir Shafat Mir and Tahir Nisar Sheikh, were found in contact with two PaK based terrorists of LeT banned outfit namely @ Zarar and @ Haroon, through the virtual mode, who arranged and provided the arms/ammunition to the accused in order to promote terrorist activities in the area ; and

5. Whereas, during the further investigation, it was established that the accused viz. Rahid Mushtaq Ganie, Amir Shafat Mir and Tahir Nisar Sheikh, were associated with the terrorist organization of LeT banned outfit and under a well knit criminal conspiracy procured the arms/ ammunition from the terrorists for carrying out the terrorist activities in the area and to wage war against the Government of India ; and

6. Whereas, the investigation, in respect of PaK based terrorists of LeT banned outfit namely @ Zarar and @ Haroon, shall continue to ascertain their actual identity and to bring out their role/involvement in the case ; and

7. Whereas, on the basis of investigation, and other evidence collected, the Investigating Officer has established, prima facie, involvement of below mentioned accused in the commission of the offence punishable No. 29-l] The J&K Official Gazette, 20th Oct., 2022/28th Asv., 1944. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––——— under sections of the Unlawful Activities (Prevention) Act, 1967, and IPC as shown against their name :—

9. Whereas, the Government has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the accused under Sections 121 and 121-A of the Indian Penal Code, 1860 ; and

Whereas, on further perusal of the Case Diary File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for his prosecution under the provisions of the Unlawful Activities (Prevention) Act, 1967.

Now, therefore, in exercise of the powers conferred by Sub- Section (2) of Section 45 of Unlawful Activities (Prevention) Act, 1967, and Section 196 of Code of Criminal Procedure, 1973, the Government hereby accord sanction for launching prosecution against the accused viz. S.O.-539—.Whereas, on 27-04-2010, the Police Station, Pulwama received a docket to the effcct that party workers of Hurriyat (G), identified as Manzoor Ahmad Pandith S/o Ali Rehman Pandith, Aijaz Ahmad Tramboo S/o Ab. Razak Tramboo, Sajid Ahmad Wani S/o Late Ghulam Nabi Wani

R's/o Kakapora and Ghulam Ahmad Dar S/o Ab.Rehman Dar R/o Samboora, Pamporo, delivered anti national speech at Main Market, Kakapora, and instigated the general public against the sovereignty and territorial integrity of the Union of India and Hurriyat Chairman, Syed Ali Shah Geelani joined the mob and also raised anti-national slogans ; and 2 The J&K Official Gazette, 20th Oct., 2022/28th Asvi., 1944. 2. Whereas, based on the above, a Case FIR No. 181/2010 under

Sections 147,341 RPC, and Section 13 of ULA (P) Act, was registered in

the Police Station, Pulwama and the investigation of the case was taken up

; and

3. Whereas, during the course of investigation, the site plan of place

of the occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the accused viz. Manzoor Ahmad

Pandith, Aijaz Ahmad Tramboo, Sajid Ahmad Wani and Ghulam Ahmad

Dar, were arrested in the case. During investigation, one more person namely

Mohd Ayoub Lone S/o Ab. Majeed Lone R/o Lelhar, was found involved in

the commission of offence. Subsequently, the said accused was also arrested

in the case, who after his release joined the terrorist ranks of LeT banned

outfit ; and

5. Whereas, during the investigation, it was established that on the

date of occurrence the accused viz. Syed Ali Shah Geelani, Manzoor

Ahmad Pandith, Ajaz Ahmad Tramboo, Sajid Ahmad Wani, Ghulam Ahmad

Dar and Mohd Ayoub Lone delivered anti-national speech at Main Market,

Kakapora and instigated the general public against the sovereignty and

territorial integrity of the Union of India ; and

6. Whereas, the accused viz. Syed Ali Shah Geelani has expired and

the accused viz. Mohd Ayoub Lone, has been killed in an ancounter with

the Security Forces and the proceedings under the law would against

them ; and

7. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating Officer,

has established prima facie involvement of the below mentioned accused

for the commission of offences punishable under sections of the Unlawful

Activities (Prevention) Act, 1967, as shown against their names :—

Whereas, during the investigation, it was found that accused Nayeem Ahmad Khan S/o Ghulam Mohd Khan R/o Baghat Barzulla, Srinagar on the directions of accused Syed Ali Shah Geelani S/o Syed Mohammad Shah R/o Sopore had raised the anti-national slogans challenging the integrity and sovereignty of the nation besides instigating the people to support the Pulwama Bandh call ; and

5. Whereas, during the investigation, it was established that on the date of occurrence, the accused viz. Nayeem Ahmad Khan, on the directions of accused viz. Syed Ali Shah Geelani raised anti-national slogans and instigating the mob to raise against the sovereignty and territorial integrity of India ; and

6. Whereas, the accused viz. Nayeem Ahmad Khan, is presently lodged in Tihar Jail, New Delhi in connection with some other offences, while as accused viz. Syed Ali Shah Geelani, has expired and the proceedings under the law would abate against him ; and

7. Whereas, on the basis of the investigation, the statement of witnesses recorded and other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967 as shown against his name :—

4. Whereas, during the investigation, one Aamir Rasheed Sheikh S/o Abdul Rasheed Sheikh R/o Khud Hajipora, Manzgam, was found involved in the commission of crime. Subsequently, the accused was arrested in the case ; and

5. Whereas, during the investigation, it was found that on the date of occurrence the accused viz. Aamir Rasheed Sheikh, pasted the posters of Afgan Taliban, a terrorist organization, in the Manzgam area, thereby threatened the sovereignty and territorial integrity of the Union of India ; and

Whereas, on the basis of investigation, and other evidence collected, the Investigating Offlcer has established, prima facie, involvement of below mentioned accused in the commission of the offences punishable under section of the Unlawful Activities (Prevention) Act, 1967, as shown against his name :—
