Subject :-Submission of Quarterly Returns under Section 25 of the Right to Information Act , 2005 .
Government Circular No. 18 - JK ( GAD ) of 2023

Information is the currency of democracy and the Right to Information Act, 2005 , in addition to fostering citizen - empowerment and eradicating corruption , envisages a robust mechanism for monitoring of all Public Authorities by the Central Information Commission . Section 25 of the Right inter alia provides that :
(2) Each Ministry or Department shall , in relation to the public authorities whithin their jurisdiction , collect and provide such 306 The J & K Official Gazette , 17th August, 2023/ 26th Srav. , 1945. [No. 20
information to the Central Information Commission or State Information Commission , as the case may be , as is required to prepare the report under this section and comply with the requirements concerning the furnishing of that information and keeping of records for the purposes of this section.
(3) Each report shall state in respect of the year to which the report relates , _
a . the number of requests made to each Public Authority
b. the number of decisions where applicants were not entitled to access to the documents pursuant to the requests , the provisions of this Act under which these decisions were made and the number of times such provisions were invoked ;
c. the number of appeals referred to the Central Information Commission or State Information Commission , as the case may be , for review, the nature of the appeals and the outcome of the appleas ;
d. particulars of any disciplinary action taken against any officer in respect of the administration of this Act ;
e . the amount of charges collected by each Public Authority under this Act ;
f. any facts which indicate an effort by the Public Authorities to administer and implement the spirit and intention of this Act;
g. recommendations for reform, including recommendations in respect of the particular public authorities , for the development , improvement , modernization , reform or amendment to this Act or other legislation or common law or any other matter relevant for operationalizing the right to access information .
Under the ambit of the ibid . section , the Central Information Commission prepares an Annual Report on the implementation of the RTI Act and makes necessary recommendations to Public Authorities regarding steps for bringing their practices in conformity with the provisions and spirit No. 20 ] J & K Official Gazette, 17th August, 2023/26th Srav . , 1945. 307 ofthe Right to Information Act. All Public Authorities are required to submit four quarterly returns for yearly perfofrmance - assessment and finalization of the Annual Report . Public Authorities , which fail to submit returns , even for a single quarter , are treated as defaulters .
It has been intimated by the Central Information Commission that Public Authorities in the Union Territory of Jammu and Kashmir are not submitting Annual Returns under Section 25 of the RTI Act , a matter which has been viewed with serious concern by the authorities .
It is accordingly enjoined upon CPIOs of various departments , their subordinate / field offices , Corporations , Boards and PSUs to register themselves and submit quarterly returns on the designated portal https : // cic.gov.in/ , by or before 30-06-2023 . The work flow to be followed for registration/ logging - in and submission of returns has been appended as Annexure to this circular.

As a mark of respect to Shri Parkash Singh Badal , Former Chief Minister of Punjab who has passed away on 25th April , 2023 , the Government of India has decided that there shall be two day ( s ) State Mourning on 26-04-2023 and 27-04-2023 throughout the country. It has been decided that-
(a) The National Flag shall fly at half- mast during the Mourning on all buildings and places where it is flown regularly ; and
(b) There shall be no official entertainment during the Mourning .
These decision are brought into notice of all the concerned for information and necessary action .

S.O. - 66 . Whereas , on 23-08-2022 , the Police Station , Dangiwacha , received a docket to the effect that a Joint Naka was eastablished by the Police/ Security Forces at Selo Bridge , and during the checking two suspects while seeing the Naka Party tried to escape but were chased down on the spot and identified as Muzaffar Iqbal Dar S / o Ghulam Nabi Dar R/ o Pazalpora , Malgonipora , Rafiabad and Sofi Ishaq Ahmad S /o Mohs Sultan Sofi R/ o Amberpora , Tarzoo , Sopore. During their personal search , the Police recovered 01 Pistol with magazine , 08 rounds and 02 Hand Grenades from their possession respectively ; and 2 The J& K Official Gazette , 7th Feb. , 2023/ 18th Magha . , 1944. [ No. 44- c
2. Wheras , based on the above , a Case FIR No. 97/2022 U/ S 7/25 Arms Act , 13 , 18 , 23 and 38 of ULA (P) Act , was registered in the Police Station , Dangiwacha , and the invstigation of the case was set into motion ; and
3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquaintee with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation, it was established that the accused viz . Muzaffar Iqbal Dar and Sofi Ishaq Ahmad werer associated with the terrorist organization of LeT banned outfit and under a well knit criminal conspiracy procured arms / ammunition and hand grenades from some unknown terrorists of the said outfit for carrying out the terrorist activities in the area ; and
5. Whereas , the investigation, in respect of unknown terrorists who provided arms/ ammunition and hand grenades to the accused viz . Muzaffar Iqbal Dar and Sofi Ishaq Ahmad , shall continue to ascertain their identity and to bring out their role/involvement in the case and the supplementary chargesheet against them would be filed in the Court of competent jurisdiction ; and
6. Whereas , on the basis of investigation , the statements of witnesses recorded and other evidence collected , the Investigating Officer has established prima facie , involvement of below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act , 1967 , as shown against their names :-

S.O. - 67.- Whereas , on 15-07-2020 , an information was received by the Police Station , Khanyar , to the effect that one Faizan Akhtar Bhat S / o Akhter Hussain Bhat R / o Gousia Colony , Babademb , has been making ISIS /ISJK flags and unfurled the same at the different places in Srinagar city especially within the jurisdiction of Police Station , Khanyar , in order to spread disaffection among the general public against the sovereignty and

Wheras , based on the above , a Case FIR No. 38/2020 under section 13 of ULA ( P) Act , was registered in the Police Station, Khanyar , and the investigation of the case was set into motion ; and
Whereas , during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
Whereas , during the investigation , the accused viz . Faizan Akhtar Bhat was arrested in the case and it was found that the accused prepared ISIS / ISJK flags and handed over the same to other two persons namely Adil Tariq Bhat S / o Tariq Ahmad Bhat R/ o Rangerstop , Gari Masjid , Khanyar and Junaid Nabi Wani S/ o Gh . Nabi Wani R/ o Khawaja Bazar, who unfurled/erected these flages at the different places of Srinagar city. Subsequently , the accused viz . Adil Tariq Bhat and Junaid Nabi wani , were also arrested in the case and during investigation 01 ISJK flag was recovered at the instances of accused viz . Adil Tariq Bhat ; and
Whereas , during the investigation , it was established that the accused viz . Faizan Akhtar Bhat , was making the ISIS /ISJK flags and handed over the same to his associates viz . Adil Tariq Bhat and Junaid Nabi Wani , who unfurled/ erected these flags at the different places of Srinagar city in order to instigate and provoke the general public against the sovereignty and territorial integrity of the Union of India ; and
Whereas , on the basis of investigation , the statement of witnesses recorded and other evidence collected , the Investigating Officer has established a prima facie , involvement of the below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act , 1967 , as shown against their names :-

Whereas , on 05-11-2022 , the Police Station , Hajin , received a docket to the effect that a Joint Naka was established by the Police / Security Forces at Checki Chandergeer , Hajin and during the checking a suspect while seeing the Naka Party tried to escape but was chased down on the spot and identified as Mehraj - ud - Din Rather S/ o Manzoor Ahmad Rather R/ o Saderkote Bala , Bandipora . 2. Wheras , based on the above , a Case FIR No. 79/2020 U/ S 4/5 ESA and Sections13 , 18 , 20, 23 and 38 of ULA (P) Act , was registered in the Police Station , Hajin and the investigation of the case was set into motion . Subsequently, during the investigation , the Section 7/25 Arms Act was added in the case ; and
3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation , the accused viz . Mehraj - ud - Din Rather , was found in contact with an unknown terrorist of LeT banned outfit who provided the hand grenade , AK rounds and some incriminatory material to the accused viz.Mehraj - ud- Din Rather, in order to promote terrorist activities in the area . Subsequently, during the investigation , some incriminatory material was also recovered at his instance ; and
5. Whereas , during the investigation, it was found that the accused viz . Mehraj - ud- Din Rather , was member of LeT banned outfit and under a well knit criminal conspiracy procured hand grenade , AK rounds and incriminatory material from an unknown terrorist of the said outfit for carrying out the terrorist activities in the area ; and
6. Whereas , the investigation , in respect of unknown terrorist who provided the hand grenade , AK rounds and incriminatory material to the accused viz . Mehraj - ud- Din Rather, shall continue to ascertain his identity and to bring out his role/ involvement in the case and the supplementary chargesheet against him would be filed in the Court of Competent jurisdiction ; and
7. Subsequently, during the investigation , the Sections 18 , 20 , 23 and 38 of ULA ( P ) Act were added in the case ; and
3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation , the accused viz . Arif Ahmad Mir, alongwith another personrson identified as Kifayat- Ullah Bukhari S / o Mehraj - ud - Din Bukhari R/ o Nowpora Bala , Shopian , were found in contact with a terrorist of Al - Badr banned outfit namely Arjumand Gulzar Dar S/o Gulzar Ahmad Dar R/ o Kharbatpora , Ratnipora , Pulwama A/P Pakistan . The accused viz . Kifayat - Ullah Bukhari was already arrested in case FIR No. 82/2022 of Police Station , Pulwama . Subseqquently, his custody was changed in the instant case and it was found that he procured a magazine and ammunition from the said terrorist and handed over to accused viz . Arif Ahmad Mir in order to promote terrorist activities in the area ;
5. Whereas , during the investigation , it was established that the accused viz . Arif Ahmad Mir and Kifayat - Ullah Bukhari , were working as OverGround Workers ( OGWs ) for the terrorists of Al - Badr banned outfit particularly the terrorist namely Arjumand Gulzar Dar , and under a well knit criminal conspiracy were providing logistic support to him , besides , the accused viz . Arif Ahmad Mir procured a magazine and ammunition from the acused for carrying out the terrorist activities in the area ; and
6. Whereas , on the basis of the investigation, the statements of witnesses recorded and other evidence collected , the Investigating Officer No. 45 - a] The J & K Official Gazette , 9th Feb. , 2023 /20th Magha, 1944. 3

Whereas , based on the above , a Case FIR No. 14/2020 under section 13 , 18 , 38 and 39 of ULA (P ) Act , was registered in the Police Station , Devsar and the investigation of the case was set into motion . Subsequently, during the investigation , the Sections 18, 38 and 39 of ULA ( P) Act were dropped from the case ; and
Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
Whereas , during the investigation , three persons identified as Zubair Ahmad Sofi S /o Ghulam Hassan Sofi R /o Tazipora , Abid Hussain Itoo S / o Muhammad Ishaq Itoo R / o Nai Basti , Damjan and Aqib Majeed Mir S / o Abdul Majeed Mir R / o Baihama , were found involved in the commission of crime . Whereas , the accused terrorist viz . Zubair Ahmad Sofi , has been killed in an encounter with the Security Forces at Mishipora , Qaimoh on 16-06-2022 , and the proceedings under the law would abate against him ; and

SO - 116.- Whereas , on 05-04-2020 , an information was received by the Police Station , Bijbehara , to the effect that during the funeral prayers of a killed terrorist namely Mohammad Ashraf Malik @ Sadam Malik S / o Bashir Ahmad Malik R/ o Arwani , Bijbehara , who got killed during an encounter at Village Khur Batapora , Kulgam, some unknown miscreants violated the restrictions imposed under Section 144 Cr. PC . imposed in view of apprehension of spread of Covid- 19 pandemic and raised anti - national slogans against the sovereignty and integrity of the Union of India ; and 2 The J& K Official Gazette , 3rd March, 2023/ 12th Phal . , 1944. 2 . Whereas , based on the above , a Case FIR No.33/ 2020 under section 188 , 269 , 505 IPC , 13 of ULA ( P) Act was registered in the Police Station , Bijbehara , and the investigation of the case was set into motion ; and
3. Whereas , during the investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recored under the relevant provisions of law ; and
4. Whereas , during the course of investigation , four persons identified as Mohammad Yousaf Wani S/ o Gh . Mohammad Wani , Shahid- ul- Islam Wani S/ o Gh . Mohammad Wani , Ruhul Amin War S / o Mohammad Amin War and Javaid Ahmad Bhat S / o Sonaullah Bhat R's / o Arwani , Bijbehara, were found involved in the comission of crime . Subsequently, the accused were arrested in the case ; and
5. Whereas , during investigation , it was established that on the date of occurrence the accused viz . Mohmmad Yousaf Wani , Shahid - ul - Islam Wani , Ruhul Amin War and Javaid Ahmad Bhat , raised anti - national slogans during the funeral prayers of a killed terrorist and instigated the general public against the sovereignty and territorial integrity of the Union ofIndia ; and
6. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected , the Investigating Officer has established prima facie , involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their names : -

SO- 119.- Whereas , on 27-07-2020 , during the search of a missing person namely Shahbaz Ahmad Shah S/ o Gh . Hassan Shah R/ o Katrasoo , Kulgam , who got missing from his home on 11-07-2020 , a reliable information was received by the Police Station , Kulgam, that the said missing person has joined the terrorist ranks of JeM banned outfit with the help of some OGWs , for carrying out the terrorist activities in the area ; and 2 The J&K Official Gazette , 3rd March , 2023 / 12th Phal . , 1944. 2. Whereas , based on the above , a case FIR No. 138/2020 under Sections 13 , 19 and 20 of ULA (P ) Act was registered in the Police Station , Kulgam, and the investigation of the case was set into motion . Subsequently, during the investigation , the offences under Section 18 -B , 38 and 39 of ULA ( P) Act were added in the case ; and
3. Whereas , during the investigation, the seizure memos were prepared and the statement of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation , one Nadeem Ahmad Dar S/ o Ab . Khaliq Dar R / o Zazripora , Kulgam, was found involved in the commission of crime . Subsequently, the said accused was arrested in the case and was found in contact with a terrorist of JeM banned outfit namely Tariq Ahmad Mir S / o Ab . Rehman Mir R/ o Zangalpora , who along with the accused viz . Nadeem Ahmad Dar, lured/ motivated the accused viz . Shahbaz Ahmad Shah, to join the terrorist ranks in order to promote terrorist activities in the area ; and
5. Whereas , during the investigation , it was established that the accused viz . Shahbaz Ahmad Shah , was member of JeM banned outfit and the other accused viz . Nadeem Ahmad Dar , was working as Over Ground Worker ( OGW) for the terrorists of the said outfit particularly the terrorist namely Tariq Ahmad Mir , and was voluntarily harbouring the terrorists , besides the accused viz . Nadeem Ahmad Dar and Tariq Ahmad Mir , motivated and facilitated the joining of accused Shahbaz Ahmad Shah , with the terrorist ranks for carrying out the terrorist activities in the area ; and
6. Whereas , the accused terrorists namely Shahbaz Ahmad Shah and Tariq Ahmad Mir , have been killed in the different encounters with the Security Forces and the proceedings under the law would abate against them ; and

Hassan Mir , Ashaq Hussain Baba S/ o Gh . Mohammad Baba and Akhter Mohi - ud- Din Rather S/ o Gh . Mohi - ud- Din Rather Rs /o Saloora , Ganderbal , are carrying out unlawful activities in the area on behalf of the terrorist organization Ansar Gazwat- ul -Hind (Rebal group of HM banned outfit) , besides , making flags of the said outfit and are hoisting the same in the area , in order to spread terror among the general public ; and 2 The J& K Official Gazette, 17th Feb. , 2023/28th Magha, 1944. 2. Whereas , based on the above a Case FIR No. 139/2018 under Section 13 of ULA( P) Act , was registered in the Police Station , Ganderbal , and the investigation of the case was set into motion ; and
3. Whereas , during the course of investigation , the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation , the accused viz . Irfan Ahmad Mir , Ashaq Hussain Baba and Akhter Mohi - ud - Din Rather, were arrested in the case and during investigation some flags of the Ansar- Gazwat-ul -Hind ( Rebel group of HM banned outfit) were recovered at their instances . The accused viz . Ashaq Hussain Baba , being deaf and dumb having 93 % disability was dropped from the case giving benefit of Section 169 Cr. PC ; and
5. Whereas , during the investigation , it was established that the accused viz . Irfan Ahmad Mir and Akhter Mohi- ud - Din Rather, were making the flags of the above outfit and hoisting the same in the area , thereby challenged the sovereignty and territorial integrity of the Union of India ; and
6. Whereas , on the basis of the investigation , the statement of witnesses recorded and other evidence collected, the Investigating Officer , has established prima facie involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of the Unlawful Activities (Prevention) Act , 1967 , as shown against their name :-

SO- 81.- Whereas , on 30-08-2022 , a reliable information was received by the Police Station, Zainapora , regarding the hiding of some unknown terrorists of LeT banned outfit in the residential house of one Usman Gulzar Wani S / o Gulzar Ahmad Wani R/ o Hushangpora , Nagbal . Subsequently , a Joint Cordon and Search Operation was launched by the Police/ Security Forces and during the Search the hiding terrorists fired indiscriminately upon the Search Party , with their illegal arms/ 2 The J& K Official Gazette , 20th Feb. , 2023 / 1st Phal . , 1944. ammunition , with the intention to kill them. The fire was retaliated, triggering an encounter ; and
2. Whereas , based on the above a Case FIR No. 104/2022 under Sections 307 IPC , 7/27 Arms Act , and Section 16, 19 and 20 of ULA (P) Act , was registered in the Police Station , Zainapora , and the investigation of the case was set into motion . Subsequently , during the investigation , the offences under Sections 7/25 Arms Act and 18 , 23 , 38 & 39 of ULA ( P) Act , were added in the case and

Whereas , during the investigation , the dead bodies of three terrorists of LeT banned outfit were recovered from the encounter site , who were later on identified as Danish Khursheed Bhat S / o Khursheed Ahmad Bhat R/ o Laddi , Zainapora , Tanvir Ahmad Wani S / o Bashir Ahmad Wani R/ o Amerbugh , Imamsahib and Towseef Ahmad Bhat S/ o Gh . Nabi Bhat R/ o Cheerimarg , Zainapora . During search , arms / ammunition viz . 03 AK - 47 rifles , 08 AK magazines , 271 rounds and 01 Chinese hand grenade were also recovered from the place of encounter ; and .
4. Whereas , during the course of investigation , the site plan of place of the occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provision of law ; and
5. Whereas , during the investigation , the accused house owner viz . Usman Gulzar Wani , was arrested in the case and was found working for the terrorists of the outfit and during the investigation , 01 SLR rifle , 02 magazines and 14 rounds were recovered at his instances ; and
6. Whereas , during the investigation , it was established that the accused viz . Usman Gulzar Wani , was working as Over Ground Worker (OGW) for the terrorists of LeT banned outfit particularly the killed terrorists namely Danish Khursheed Bhat , Tanveer Ahmad Wani and Towseef Ahmad Bhat , and under a well knit criminal conspiracy procured arms /ammunition from them, besides , on the date of occurrence voluntarily hardboured the killed terrorists in his residential house for carrying out the terrorists activities in the area ; and 3

SO- 96.- Whereas , on 16-10-2022 , the Police Station , Bandipora , received a docket to the effect that while performing patrolling duty in the area , a reliable information was received about organizing of meeting by some unknown terrorists at Zalwan Nursery . area was cordoned off by the Police / Security Forces and during the search , the terrorists hiding in the area managed their escape , but a person identified as Shahid Hassan Bhat S / o Ghulam Hassan Bhat R/ o Ward No. 03 Plan , Bandipora , was arrested from the spot ; and
2. Whereas , based on the above , a case FIR No. 168/2022 under Sections 18 and 20 of ULA ( P ) Act , was registered in the Police Station , Bandipora , and the investigation of the case was set into motion . Subsequently , during the investigation , the offences under Sections 4 (b ) ESA and 23 , 38 and 39 of ULA ( P ) Act were added in the case ; and
3. Whereas , during the course of investigation , the site plan of the place of occurence and the seizure memos were prepared and the statements of the witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation the accused viz . Shahid Hassan Bhat , was found in contact with two terrorists of LeT banned outfit namely Hasher Rafiq Parray S/ o Mohammad Rafiq Parray R / o Putashay , Bandipora and Abu Muslim @ Khubaib @ Huraira R/ o Pakistan , through the virtual mode , who provided some hand grenades to the accused viz . Shahid Hassan Bhat , in order to promote terrorists activities in the area . Subsequently , during the investigation , 02 hand grenades were recovered at his instances ; and
5. Whereas , during the investigation , it was established that the accused viz . Shahid Hassan Bhat , was working as Over Ground Worker (OGW) for the terrorists of LeT banned outfit particularly the terrorists namely Hasher Rafiq Parray and Abu Muslim @ Khubaib @ Huraira , and was providing logistic support to them , besides under a well knit criminal conspiracy procured hand grenades from the said terrorists for carrying out the terrorists activities in the area ; and
6. Whereas , the investigation in respect of the accused terrorist namely Hasher Rafiq Parray and Abu Muslim @ Khubaib @ Huraira , shall continue to bring out their role/ involvement in the area and supplementary charge sheet against them would be filed in the court of competent jurisdiction ; and No. 46 - w] The J & K Official Gazette , the 22nd Feb. , 2023 / 3rd Phal . , 1944. 3

4. Whereas , during the investigation , the accused viz . Mohammad Lone , were working as Over Ground Workers ( OGWs ) for the terrorists and under a well knit criminal conspiracy were providing logistic support to them, besides , werre facilitating the transportation of arms /ammunition for the terrorists from one place to another for carrying out the terrorist activities in the area ; and

to direct that after Sub - Rule ( 1 ) of Rule 41 of the Jammu and Kashmir Civil Services ( Leave) Rules , 1979 , the following shall be inserted as Sub- Rule ( 1 - a ) ; namely :-
" ( 1 - a) Special Maternity Leave of 60 days may be granted to a woman employee in case of death of a child soon after birth/ stillbirth on the following conditions :-
i. In case a Maternity Leave has already been availed by a woman employee and her leave continues till the date of expiry of child soon after birth/ stillbirth , the maternity leave already availed till death of the child may be converted into any other kind of leave available in her leave account without insisting for a medical certificate and a Special Maternity Leave of 60 days may be granted from the date of expiry of child soon after birth/ stillbirth ;
ii. In case the maternity leave has not been availed by a woman employee , 60 days of Special Maternity Leave may be granted from the date of expiry of child soon after birth/ stillbirth;
iii . The condition for death of a child soon after birth may be defined as up to 28 days afterbirth ;
iv. A baby born with no signs of life at or after 28 weeks of gestation may be defined as still birth ;
v . The benefit of Special Maternity Leave shall be admissible only to a woman employee with less than 2 surviving children ;

5. Whereas , during the investigation , it was established that the accused viz . Junaid Ahmad Parray, was associated with the terrorist organization of Ansar - Gazwat- Ul- Hind and procured arms / ammunition from terrorists of the outfit for carrying out terrorist activities in the area ; and
6. Whereas , on the basis of the investigation , the statement of witnesses recorded and other evidence collected , the Investigating Officer , has established a prima facie involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of Unlawful Activities ( Prevention) Act, 1967 , as shown against his name

S O- 121.-Whereas , on 01-03-2019 , an information was received by the Police Station , Ganderbal , to the effect that some unknown Jel activists are concucting meetings , processions within the jurisdiction of Police Station , notwithstanding the fact that the said association has been banned by the Government of India , besides , are instigating the The J& K Official Gazette , 3rd March , 2023/ 12th Phal . , 1944. Whereas , based on the above , a case FIR No. 32/2019 under Sections 10 , 13 of ULA (P) Act was registered in the Police Station , Ganderbal , and the investigation of the case was set into motion . Subsequently , during the investigation , the offences under Section 13 of ULA (P) Act was dropped from the case ; and
3. Whereas , during the course of investigation , the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and
4. Whereas , during the investigation , nine persons identified as Gh . Mohammad War @ Gul Mohammad War S/ o Ab . Rahim War R/ o Manigam , Ab . Majeed Dar S / o Gh . Nabi Dar R/ o Kurhama , Nazir Ahmad Wani S/ o Gh . Mohammad Wani R/ o Kangan , Javaid Ahmad Lone S / o Nazir Ahmad Lone , Arshed Ali Sheikh S / o Ali Mohammad Sheikh R's / o Shalabugh , Gh . Mohammad Bhat S / o Gh. Ahmad Bhat R / o Tullamulla , Ali Mohammad Bhat S / o Khazir Mohammad Bhat R/ o Lar , Wani Rouf Khaliq S / o Ab . Khaliq R/ o Tullamulla and Ab . Hameed Bhat S/ o Gh . Ahmad Bhat R/ o Batwina , were found involved in the commission of crime . Subsequently , the accused were arrested in the case ; and
5. Whereas , during the investigation , it was established that the accused viz . Gh . Mohammad War @ Gul Mohammad War , Ab . Majeed Dar , Nazir Ahmad Wani , Javaid Ahmad Lone , Arshed Ali Sheikh , Gh . Mohammad Bhat , Ali Mohammad Bhat , Wani Rouf Khaliq and Ab . Hameed Bhat , were affiliated with banned association Jammat - e - Islami (Jel ) , J & K , and were members of the said association, and were carrying out activities of the association banned by the central Government ; and

SO- 133 - Whereas , on 27-09-2022 , a reliable information was received by the Police Station , Nowshera , to the effect that a person identified as Mohd Azam Bakerwal S/ o Kalu Cast Bakerwal R/ o Thathyali Keri , Rajouri A/ P Anas , Bandhar , Sarya , is in contact with the Pakistani based terrorists of JeM banned outfit and has been facilitating the transportation of arms / ammunition for the terrorists from across the border , in order to carry out the terrorist activities in the area and to wage war against the Government of India ; and
2. Whereas , based on the above , a case FIR No. 224/2022 under section 121 IPC , 10 and 13 of ULA (P) Act , was registered in the Police Station , Nowshera , and the investigation of the case was set into motion . Sections 121 IPC and 10 of ULA ( P) Act were dropped and the offences under Sections 18 , 20 , 23 , 38 and 39 of ULA ( P) Act and 4/5 ESA were added in the case ; and
3. Whereas , during the investigation, the accused viz . Mohd Azam Bakerwal, was arrested in the case and during investigation, 02 pressure mines with plates were recovered at his instance . The accused was found in contact with a terrorist of JeM banned outfit namely Shamsheer Nai @ Zafar Iqbal S / o Altaf Din R/ o Gonthal , Surankote , Poonch A/P PoK/Pak, who provided the explosive material to the accused in order to promote terrorist activities in the area ; and
4. Whereas , during the investigation, the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law and
5. Whereas , during the investigation, it was established that the accused viz . Mohd Azam Bakerwal , was working as Over Ground Worker ( OGW) for the terrorists of JeM banned outfit particularly the Pakistan based terrorist namely Shamsher Nai @ Zafar Iqbal , and under a well knit criminal conspiracy was providing logistic support to him, besides , procured explosive material from the said terrorist for carrying out the terrorist activities in the area ; and
6. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected , the Investigating Officer , has established a prima facie involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of the Unlawful Activities (Prevention) Act , 1967 , as shown against their names :-
