The week starting from 30th October , 2023 to 5th November , 2023 shall be celebrated as Vigilance Awareness Week across the Country, with the theme " Say no to corruption; commit to the Nation " . and increasing public awareness about the perils of corruption inculcating the true spirit of participative vigilance and re - affirming the commitment of everyone to uphold integrity in public governance , with special emphasis on engaging the youth in various activities emphasizing the importance of integrity and ethics and to promote their involvement in the fight against corruption . Vigilance Awareness Week is observed every year to commemorate the birthday of Sardar Vallabhbhai Patel .
In pursuance to the communication No. 023 / VGL/ 035 / 556448 dated 02-08-2023 of Central Vigilance Commission , circular instructions , detailing a three month campaign period ( 16th August , 2023 till 15th November , 2023 ) , were issued vide Circular No. 26 - JK( GAD) of 2023 dated 14-09-2023 , for taking up the following six preventive vigilance measures as focus areas :-
a . Awareness building about Public Interest Disclosure and Protection of Informers (PIDPI ) Resolution .
b . Capacity Building Programmes .
c. Identification and implementation of systemic Improvement Measures .
d. Leveraging of IT for complaint disposal .
e. Updation of Circulars /Guidelines /Manuals .
f. Disposal of complaints received before 30-06-2023 .
The observance of Vigilance Awareness Week , 2023 would commence with the taking of integrity pledge on 30th October , 2023 at 11:00 A.M. by the public servants in the Departments / Organizations/ PSUs etc.
In connection with the celebrations , the Hon'ble Lieutenant Governor , J & K shall administer integrity pledge to all the Administrative Secretaries and officers of various Department at 11:00 AM on 30th October, 2023 , in Civil Secretariat , J& K. The venue shall be Meeting Hall 1st and 2nd Floor , Civil Secretariat , Jammu , for the officers stationed at Civil Secretariat , Jammu and Meeting Hall 3rd and 4th Floor , Civil Secretariat , Srinagar, for the officers stationed at Civil Secretariat , Srinagar . The event shall be coordinated through video conference .

Thereafter , the integrity pledge shall also be administered to all the employees of Civil Secretariat at 11:10 AM in the lawns of Civil Secretariat , Jammu/ Srinagar.
It is , accordingly , enjoined upon all the Administrative Secretaries to participate in the said pledge taking ceremony along with officers of their Departments . Further , Divisional Commissioners , all Deputy Commissioners , Heads of Departments and Managing Directors of PSUs and Autonomous Bodies shall also organize similar pledge taking ceremonies in their offices as per prescribed format of the pledge enclosed .
The other activities within the Departments /Organizations / Districts etc. as well as outreach programmes for public/ citizens , detailed in Circular No. 08-09-23 dated 11-09-2023 of Central Vigilance Commission ( copy enclosed) , shall be conducted during the Vigilance Awareness Week . Bringing transparency and accountability in Governance remains one of the primary means to achieve all round development of the country . The Central Vigilance Commission , as the apex integrity organization of India , adopts different initiatives to strive towards ensuring integrity in public administration. Vigilance Awareness Week is one of the tools 688 The J&K Official Gazette , 29th Feb. , 2024/ 10th Phal . , 1945. [No. 48
of the Commission in increasing public awareness about the perils of corruption . Vigilance Awareness week is observed every year during the week in which the birthday of Sardar Vallabhbhai Patel ( 31st October) falls in . The Commission has decided that this year Vigilance Awareness Week would be observed from 30th October to 5th November, 2023 with the following theme :

2. The observance of Vigilance Awareness Week, 2023 would commence with the taking of the integrity pledge (copy enclosed at the Annexure A) by public servants in the Ministries /Department/ Central Public Sector Enterprises ( CPSEs ) / Public Sector Banks ( PSBs ) and all other organizations on 30th October , 2023 at 1100 hrs .
3. In a move towards inculcating the true spirit of participative vigilance , the Commission had earlier issued instructions detailing a three -month campaign period ( 16th August , 2023 till 15th November , 2023) in which following preventive vigilance measures were to be taken up as focus areas by all the Ministries /Departments and Organizations :
a. Awareness building about Public Interest Disclosure and Protection of Informers ( PIDPI ) Resolution .
b. Capacity Building Programs ,
c. Identification and implementation of Systemic Improvement
measures ,
d.
of IT for complaint disposal ,
Leveraging
e . Updation of Circulars / Guidelines /Manuals ,

4. All organizations are advised to conduct activities relevant to the theme that strives to bring about maximum public participation . It is imperative that all organizations should conduct different outreach programs that aim to sensitize the public about the need for transparency and integrity in public governance . A poster on PIDPI has been Prepared and is available at Annexure C. The poster may be widely circulated and translated to regional languages , wherever feasible . You may prepare your own posters too .

5. Action taken report regarding the six Preventive Vigilance measures that are to be taken up as focus areas during this three - month campaign period should be sent by all to the Central Vigilance Commission as per the format enclosed at Annexures D ( i ) to D ( vi ) by 8th December , 2023 ( Friday) .
6. During Vigilance Awareness Week - 2023 , special emphasis may be given to engage the youth in various activities emphasizing the importance of integrity and Ethics Organizations should promote activities that involve the youth and foster an environment that re- affirms the importance of their involvement in the fight against corruption.
7. Activities to be conducted within the organizations may include the following :-
a . Employees may be encouraged to take e - pledge by visiting the website , Online " Integrity Pledge " is available at CVC's website ( www.cvc.gov.in) and can be accessed by all ,
b. Conduct workshops/ sensitization programs for employees and other stakeholders on policies/ procedures of the organization and on Preventive Vigilance measures ,
c. Vigilance Study Circles may conduct different outreach and awareness programs ,
d. Conduct various competitions such as debates , quiz , etc. for the employees and their families on issues relating to anti- corruption.
e . Promote the concept of e - Integrity Pledge by persons with whom the organization deals with .
8. Outreach activities for public/ citizens may include the following
a. All Ministries /Departments / Organizations shall publicize integrity Pledge amongst all employees , their families , vendors / suppliers / contractors / stakeholders , students etc. to elicit wider participation , Integrity pledge for citizens and organizations enclosed at Annexures A and B ,
b . Organizations may undertake activities such as walkathons , marathons , street plays etc. which have visibility and mass appeal across all strata of society.

c. Extensive use of social media platforms , bulk SMS/e - mails , WhatsApp etc. for spreading awareness . For different social media relatd initiatives , the social media handles of the Central Vigilance Commission may be tagged . (Twitter : @CVCIndia ; Facebook : CVCof India) .
d. Organize grievance redressal camps for citizens/ customers by organizations having customer - oriented activities . Simi- larly, vendor meets may be organized wherever necessary, through online mode or otherwise , whichever is more feasible .
e . Organize " Awareness Gram Sabhas " for dissemination of information regarding the menace of corruption and the different measures that the public can undertake to redress it , such as complaint portals , etc. As per past practice , Public Sector Banks need to conduct " Aware ness Gram Sabhas " at the Branch level in at least two Gram Panchayats . Other organizations may also organize wherever possible . Indicative list of activities which can be conducted as part of " Awareness Gram Sabhas " is at Annexure - E .
9. Selected Photographs / Media clips may be sent to the Commis- sion by email at the address [email protected] . Photographs and Media clips may be uploaded on departmental/ organizational websites .
10. A report on the observance of Vigilance Awareness Week may be sent by all Ministries / Departments / Organizations to Central Vigilance Commission as per format attached by 8th December, 2023 .

The instant application has been moved by Dy . SP Hqrs . (Now SP) Pulwama ( I.O. of the case) through Ld . APP of this Court seeking therein attachment of property in terms of Section 83 Cr . P.C. belonging to the accused namely Haris Nazir Dar S/ o Nazir Ahmad Dar R/ o Village Kachipora , Tehsil Rajpora , District Pulwama and Ehsan- Ul- Haq Sheikh S / o Abdul Rashid Sheikh R/ o Village Murran , Tehsil and District Pulwama who are involved in the criminal case which is covered by Case FIR No. 65/2023 under Sections 307 IPC , 7/27 Arms Act , 16 , 18 , 20, 23 and 38 UA( P) Act of P/ S Rajpora . It is averred in the application that the above named accused are involved in the commission of crime which is covered by Case FIR No. 65/2023 of P/ S Rajpora and owing to absconding of the said accused , this Court on the request of the applicant investigating agency has issued a proclamation against 1196 The J& K Official Gazette , 29th Feb. , 2024/ 10th Phal. , 1945. [No. 48
the said accused in terms of Section 82 Cr . P.C. but despite the issuance of the said process , the absconding accused failed to appear before the investigating agency and are continously absconding .

Upon the perusal of record it appears that on the request of investigating agency this Court issued non - bailable warrant of arrest in terms of Section 73 Cr . P.C. against the above named accused vide order dated 06-09-2023 and when investigating agency despite employing all efforts could not affect the arrest of accused , a motion was laid before this Court for issuance of proclamation against the said accused in terms of Section 82 Cr . P.C. and this Court vide order dated 13-09-2023 issued the requisite proclamation for the reasons stated therein . It is also evident from the perusal of record that the proclamations issued against the above named accused were publicly read at conspicuous places in the native villages of the accused and said proclamations were also pasted at conspicuous places of the houses of accused and District Court Complex , Pulwama and also published in English Daily " Kashmir Images " and Urdu Daily " Uqab ' in their issue dated 18th of September , 2023 but the above named accused have not shown up before the investigating officer till date and are continuously absconding . The investigating officer of the case present in person before this Court on query of this Court has submitted that he will furnish better particulars /details viz - a - viz the property belongling to the accused which may become liable for attachment in terms of Section 83 Cr.P.C. and will lay a separate motion for attachment of the same and stated that at this stage he is pressing the application to the extent of declaration of the above named accused as proclaimed offender in terms of Section 82 (4) Cr . P.C. only .
Having regard to the peculiar facts and circumstances attending the matter , the application to the extent of declaring the above named accused as proclaimed offender is allowed with the liberty to the Investigating Officer to file a separate motion in terms of Section 83 Cr . P.C. along with details of property if any , belonging to above named accused. Let a declaration for declaring the above named accused as proclaimed offender be issued accordingly and the same may be got published at least in 02 leading Newspapers and Government Gazette .
