Order

1. The instant application has been filed by the SHO P/S Kralgund seeking initiation of proceedings under Section 87 JK Cr. P.C. It has been submitted that the charge-sheet against accused person was produced before this Hon'ble Court and 51 accused persons during investigation absconded and proceedings under Section 512 JK Cr. P.C. were initiated against them. Despite issuance of repeated warrants, the absconders knowingly absconded so that warrant could not be executed. The detailed report in the warrant stands submited by the executive agency. Therefore, prayed that coercive major be taken against the absconders and they may be declared as proclaimed offenders.

2. Heard Ld. Public Prosecutor.

3. From the perusal of the file as well as report from executive agency, it is evident that the accused persons against whom warrants have been issued by the Hon'ble Court of CJM Handwara have crossed over the LOC from time to time with regard to same have been named in the absconders register of register No. 4 have been entered by the Police Station Kralgund. Copy of the registry and absconders report of Numberdar, Chowkidar of the Villages and report of beat officer and beat books and petrol book is placed on r ecord that makes satisfaction that the accused person named in the enclosed list are absconding or concealing themselves so that warrant could not be executed against them and or who have crossed over the LOC and cannot be found within the limits of UT of J&K. Therefore the issuance of this process under Section 87 Cr. PC. is made hereby.

4. This Court is satisfied that the accused persons named in the enclosed list and there is no immediate prospect of arrest them. Accordingly, proceeding U/S 299 Cr. PC. (Old 512 Cr. PC) are hereby initiated against the accused persons enclosed in the list. By virtue of this warrant U/S 82 of Cr. PC. (87/Cr. PC Old) read with Section 299 Cr. PC (512 Cr. PC. Old) the police in the state/UT is hereby directed and authorised to arrest the accused persons named in the enclosed list within the state now UT and within the limits of Union of India and produce them before the Court as and when arrested.

5. The copy of the proclamation be published as follows :

The explanation and show cause notices were served to you but nothing has been heard from you despite oral inquiry conducted by the undersigned regarding absence w.e.f. from 30-08-2023 to 17-09-2023 FN, although you assured submission of leave papers with the medical certificate but all in vain. Now, you are hereby chargesheeted for remaining continuously absent from your duty as under.

I. Whereas, there are sufficient proof of your absence as per the records of this office. As per explanation/show cause notices served from time to time, you failed to explain the reasons of your absence w.e.f. 30-08-2023 to 17-09-2023.

are not obedient and loyal towards your duty and your attitude of tactics adopted leads you for strict disciplinary

action.

Before, any action under service rules is initiated against you under article CSR 128 Volume 1 for remaining absent from duty unauthorisedly

Notification

In exercise of the powers conferred under Section (66) of the

Jammu and Kashmir Municipal Act, 2000, the Municipal Committee,

Pahalgam hereby notifies to impose and recover Trade Tax for the items

classified under clause (i) to clause (xvi) of Sub-Section (1) of Section

(66) of the Act, as per the schedule Annexed with the notification.

Whereas, under Section 70(2) of Municipal Act, 2000, the

Committee is supposed to publish a notice for the information of the

inhabitants Business establishments/Hoteliers/service providers/Pony

wallas, of the Pahalgam Town ;

Whereas, the inhabitants of the Pahalgam Town have right to file

objections,if any, in writing within (30) days from the date of publication

of this notice under Section 70(3) of Municipal Act 2000.

Now, this notification is issued today on 08th day of September,

2023 under the seal and signature of the under signed along with the

proposed schedule of Tax inviting objections from the inhabitants

Business establishments/Hoteliers/service providers/Pony Wallas, of the

Pahalgam Town to be filled in writing in the Office of the Municipal

Committe, Pahalgam within (30) Days from the publication of this

notification. In case no such objection is received within the above

specified period, the schedule of Taxes shall be effective after one week

from the date of expiry of time limit for filing of objections.

It is hereby published for the information of general public that under Sections 65, 66 and 68 of the Jammu and Kashmir Municipal Act, 2000, Solid Waste Management Rules, 2016 notified by the Ministry of Environment, Forest and Climate Change, GOI vide Notification No. G.S.R 1357(E) dated 08-04-2016 and Solid Waste Management 2 The J&K Official Gazette, 9th March., 2024/19th Phal., 1945. [No. 49-4

Bye-Laws 2019 subsequently notified by Jammu and Kashmir Government in respect of Municipal Committee, R.S.Pura on 3rd of October 2019, the Committee has revised the User Charges which will come into force w.e.f 01-04-2024. The person having any objections may submit the same to the undersigned in writing within 30 days from the date of publication of this notification through official email id i.e [email protected] or in person during the official working hours on any working day. The objection/objections, if any received after the prescribed period shall not be entertained. The detail of the revised User Charges is as under:-
