Whereas, Superintending Engineer (Civil) Director (Contracts and EPC) Project SAMPARK has furnished letter to this Collectorate vide No. 80000/Policy/103/EPC Cell dated 31-12-2022, regarding the Exemption of Social Impact Assessment for widening of Rajouri-Bazar to Darhali Bridge road by GREF situated at Village Rampur Tehsil and District Rajouri.

Whereas, Tehsildar Rajouri has furnished the Revenue papers and Officer Commanding 58 RCC (GREF) C/o 56 APO vide letter No. 2004/F.A. Mir/F-216/17/E2LA dated 20-10-2018 has authenticated the subject revenue papers and submitted to this Collectorate along with Indent/fund availability certificate.

Whereas, the appropriate authority, Deputy Commissioner Rajouri vide Order No. DCR/CALA/NH-144A/2023-24/233-38 dated 15-01-2024 has exempted undertaking of Social Impact Assessment Study under Section 9 read with Section 40 of the Act, for the subject acquisition.

In view of the above, I Saleem Ahmed (JKAS) Collector Land Acquisition Defence Rajouri-Poonch HQ. Whereas, in accordance with S.O.-17 dated 14-01-2022, the Declaration/Notification under Section 19 of the aforesaid Act stands issued by District Collector/Appropriate Government vide Notification No. 05 of Rev/LA of 2023 dated 04-11-2023.

Now, therefore, in terms of Section 21 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, notice is hereby issued/given to all the interested persons/land owners to state the particulars of the land so needed, and to state the nature of their respective interests in the land and particulars of their claims to compensation for such interests, their claims to rehabilitation and resettlement along with their objections, if any, to the measurement made under Section 20, to appear personally or by agent or advocate before the Collector Land Acquisition (Assistant Commissioner Revenue) Pulwama in the office within 30 days from the date of publication of this notice.

SO-545.—In exercise of the powers conferred by Section 148 of the

Jammu and Kashmir Goods and Services Tax Act, 2017 (Act No. V of

recommendations of the Council, hereby notifies the following special

procedure to be followed by a registered person or an officer referred to in

Sub-Section (2) of Section 107 of the said Act who intends to file an appeal

against the order passed by the proper officer under Section 73 or 74 of the

said Act in accordance with Circular No. 182/14/2022-GST, dated 10th of

November, 2022 pursuant to the directions of the Hon'ble Supreme Court

in the case of Union of India v/s Filco Trade Centre Pvt. Ltd., SLP(C)

No. 32709-32710/2018.

2. An appeal against the order shall be made in duplicate in the

Form appended to this notification at ANNEXURE-1 and shall be

presented manually before the Appellate Authority within the time specified

in Sub-Section (1) of Section 107 or Sub-Section (2) of Section 107 of the

said Act, as the case may be, and such time shall be computed from the

date of issuance of this notification or the date of the said order, whichever

is later :

Provided that any appeal against the order filed in accordance with

the provisions of section 107 of the said Act with the Appellate Authority

before the issuance of this notification, shall be deemed to have been filed

in accordance with this notification.

3. The appellant shall not be required to deposit any amount as

referred to in Sub-Section (6) of Section 107 of the said Act as a pre-

condition for filing an appeal against the said order.

4. An appeal filed under this notification shall be accompanied by

relevant documents including a self-certified copy of the order and such

appeal and relevant documents shall be signed by the person specified in

sub-rule (2) of rule 26 of the J&K Goods and Services Tax Rules. 2017.

5. Upon receipt of the appeal which fulfills all the requirements as

provided in this notification, an acknowledgement, indicating the appeal

number, shall be issued manually in FORM GST APL-02 by the Appellate

Authority or an officer authorised by him in this behalf and the appeal shall

be treated as filed only when the aforesaid acknowledgement is issued.

6. The Appellate Authority shall, along with its order, issue a summary

of the order in the Form appended to this notification as ANNEXURE-2.

2. Any person intending to manufacture goods as mentioned in Schedule to this notification, and who has been granted registration after the issuance of this notification, shall furnish the details of packing machines being used for filling and packing of pouches or containers in FORM SRM-I on the common portal, within fifteen days of grant of such registration.

3. The details of any additional filling and packing machine being installed in the registererd place of business shall be furnished, electronically on the common portal by

the said registered person within 24 hours of such installation in FORM SRM-IIA.

4. Upon furnishing of such details in FORM SRM-I or FORM

SRM-IIA, a unique ID shall be generated for each machine, whose details have been furnished by the registered person, on the common portal.

5. In case, the said registered person has submitted or declared the production capacity of his manufacturing unit or his machines, to any other government department or any other agency or organization, the same shall be furnished by the said registered person in FORM SRM-IA on the common portal,

within fifteen days of filing said declaration or submission :

Provided that where the said registered person has submitted or declared the production capacity of his manufacturing unit

or his machines, to any other government department or any other agency or organization, before the issuance of this notification, the same shall be furnished by the said registered person in FORM SRM-IA on the common portal, within thirty days of issuance of this notification.

Explanation :—

1. In this Schedule, ''tariff item'', ''heading'', ''sub-heading'' and ''Chapter'' shall mean respectively a tariff item heading, sub-heading and Chapter as specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975).

2. The rules of the interpretation of the First Schedule to the said Customs Tariff Act, 1975, including the Section and Chapter Notes and the General Explanatory Notes of the First Schedule shall, so far as may be apply to the iterrpretation of this notification.

3. For the purposes of this notification, the phrase ''brand name''means brand name or trade name, whether registered or not, that is to say, a name or a mark, such as symbol, monogram, label, signature or invented word or writing which is used in relation to such specified goods for the purpose of indicating, or so as to indicate a connection in the course of trade between such specified goods and some person using such name or mark with or without any indication of the identity of that person.

This notification shall be deemed to have come into force with effect

from 31st of July, 2023.

SO-548.—-Whereas, on 17-08-2016, the Police Station, Yaripora, received a docket to the effect that one person namely Mohammad Shaban Dar S/o Mohammad Ramzan Dar R/o Wanpora, delivered a

2. Whereas, based on the above, a Case FIR No. 102/2016 under

Section 13 of ULA (P) Act was registered in the Police Station, Yaripora,

and the investigation of the case was set into motion ; and

3. Whereas, during the investigation, the site plan of the place

of occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, eleven other persons namely

Sarjan Ahmad Wagay @ Barkati S/o Ab. Razaq Wagay R/o Reban,

Shopian, Farooq Ahmad Khan S/o Gull Mohd Khan R/o H. S. Bugh,

Ajaz Ahmad Bhat S/o Hafizullah Bhat R/o Chanigam, Suhail Ahmad

Ganie S/o Gh. Mohd Ganie R/o Mohammadpora, Kulgam, Asif Amin

Bhat S/o Mohd Amin Bhat R/o Tungdanoo, Muzamil Ahmad Itoo

S/o Mohd Abdullah Itoo, Ab. Rashid Malik S/o Ab. Rehman Malik,

Adil Gulzar S/o Gulzar Ahmad Malik, Liyaqat Hussain Malik

S/o Gh. Hassan Malik R's/o Yaripora, Mohd Ashraf Rather S/o Gull

Mohd Rather R/o Kanjikulla and Ab. Rashid Qureshi S/o Ali Mohd

Qureshi R/o Yamrach, were arrested in the case and later on were

not found involved and accordingly, were dropped from the case and

were given benefit under Section 169 Cr. PC ; and

5. Whereas, during the investigation, it was established that on

the date of occurrence the accused viz. Mohammad Shaban Dar,

delivered a provocative speech and instigated the general public against

the sovereignty and territorial integrity of the Union of India ; and

6. Whereas, on the basis of investigation, and other evidence

collected the Investigating Officer has established prima facie,

involvement of below mentioned accused in the commission of the

offences punishable under section of the Unlawful Activities (Prevention)

Act, 1967, as shown against his name :—

7. Whereas, the Authority, appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all

the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused ; and

8. Whereas, after perusing the Case Diary File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for his prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching

prosecution against the accused viz. Mohammad Shaban Dar, for the commission of offence punishable under Section 13 of ULA (P) Act, arising out of FIR No. 102/2016 of Police Station, Yaripora.
