No. 2539 of 2023/RG Dated 23-10-2023.

Acting in compliance to the directions of the Hon'ble Supreme Court of India in its order dated 31-07-2023 in the case titled Md. Asfak Alam Vs State of Jharkhand Cr. Appeal No. 2207 of 2023, the High Court of Jammu and Kashmir and Ladakh hereby notifies the directions contained in the said judgment as Guidelines on Arrest, Detention and Bail of accused, for the Guidance of the Magistrates and the Criminal Courts subordinate to the High Court of Jammu and Kashmir and Ladakh. The said Guidelines are enumerated as under :—

1. Both the Governments of Union Territory of Jammu and Kashmir and Union Territory of Ladakh to instruct its police officers not to automatically arrest accused when a case under Section 498-A Indian Penal Code 1860, is registered but to satisfy themselves about the necessity for arrest under parameters laid down and flowing from Section 41 Cr.PC.

2. All the police officers be provided with the check list containing

specified sub-clauses under Section 41(1)(b)(ii).

3. The police officers shall forward the check list duly filled and furnish the reasons and materials which necessitated the arrest, while forwarding/producing the accused before the Magistrate for further detention.

4. The Magistrate while authorizing detention of the accused shall peruse the report furnished by the police officer in terms aforesaid and only after recording its satisfaction, the Magistrate will authorize detention.

5. The decision not to arrest an accused, be forwarded to the Magistrate within two weeks from the date of the institution of the case with a copy to the Magistrate which may be extended by the Superintendent of Police of the district for the reasons to be recorded in writing.

Notice of appearance in terms of Section 41-A Cr.PC be served on the accused within two weeks from the date of institution of the case, which may be extended by the Superintendent of Police of the District for the reasons to be recorded in writing.

7. Failure to comply with the directions aforesaid shall apart from rendering the police officers concerned for departmental action, they shall also be liable to be punished for contempt to be instituted before High Court.

8. Authorizing detention without recording reasons as aforesaid by the Judicial Magistrate concerned shall be liable for departmental action by the High Court.

9. Tha aforesaid directions shall not only apply to case under Section 498-A IPC or Section-4 of the Dowry Prohibition Act, but also to such other cases where offence is punishable with imprisonment for a term which may be less than seven years or which may extend to seven years, whether with or without fine.

This notification is made under the provisions of Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No. 30/2013), to all whom it may concern.

A plan of the land may be inspected in the office of the Collector on any working day during the working hours. The Government authorizes Collector and his Revenue field staff to enter upon and survey land take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the Act.

Under Sub-Section (4) of Section 11 of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, etc., or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector. Objections to the acquisition, if any, may be filed by the person interested within 60 (sixty days) from the date of publication of this notification as provided under Section 15 of the Act before Collector.

Subject :— Preliminary Notification under Section 11(1) of ''Right to Fair Compensation and Transparency in Land Acquisition, Reha bilita tion a nd Resettlement Act, 2013'' for acquisition of land measuring 18 Marlas situated in estate Lalpora Tehsil Tral District Pulwama for public purpose namely acquisition of land for construction of School building P/S Pahelcheck Khalil. ———–

Whereas, the formal indent of the land has been placed by the Director School Education Kashmir vide No. DSEK/Plg/LC/Pul/425, Dated 30-07-2022 for construction of school building P/S Pahelcheck Khalil at Village Lalpora Tehsil Tral District Pulwama.

On the basis of said indent, the revenue extracts for land measuring 18 Marlas were submitted by Tehsildar Tral which were accordingly forwarded to the Director School Education Kashmir vide this office communication No. ADC/Tral/LA/2022-23/112-16 dated 21- 07-2022 for authentication in token of their correctness on spot which were received through Chief education Officer Pulwama vide his No. CEO/Pul/Plg/22/606-08, dated 10-08-2022.

Whereas, Social Impact Assessment was carried out by Social Impact Assessment (SIA) unit and a report submitted/preliminary investigation was conducted by a team constituted by Collector as laid down under Rule-4 of ''Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013''. The summary of the Social Impact Assessment Report/preliminary investigation is as follows :

1. That the proposed acquisition of land for the porject namely ''construction of school building P/S Pahelcheck'' at revenue Village Lalpora serves the public purpose.

2. That the land proposed for the acquisition is an absolute bare-

minimum needed for the porject.

3. That no owner became landless by the said acquisition.

4. That the acquisition at an alternate place has not been found

feasible by the Indenting Department.

5. That no unutilized land has previously been acquired in the

said Village/area for the said purpose.

6. Recommendations.

The establishment/construction of the said school at Lalpora, Tehsil Tral will surely benefit a huge population of the area especially the student community.

Moreover, the land identified for the construction of Government Primary School building at Lalpora Tehsil Tral does not have any adverse Social Impact on local public.

Whereas, the Social Impact Assessment Report was forwarded to District Collector (Deputy Commissioner) Pulwama vide this office No. : ADC/Tral/LA/2023-24/143-44, dated 03-11-2024 and the same got approved for issuance of Notification under Section 11(1) of the ''Right to Fair Compensation and Transparency in Land Acquisition, No. 10 ] The J&K Official Gazette, 6th June, 2024/16th Jyai., 1946. 287

Advertisement Rates through Hoardings :

The committee has decided that the rate of advertisement may

be fixed as Rs. 5 Per sq. ft. Rs. 3 Per Sq. ft. (for flexes/banners),

per day for prime locations and Rs. 3 Per Sq. ft. Rs. 1 Per sq. ft.

(for flexes/banners)per day for non prime locations within the Town.

Proposal for enhancement of fee with regard to Pilgrimage :

The committee has decided that the rent from ground and fields

i.e. Permission for holding religious events may be fixed as Rs.700

per day for Municipal Committees.

However for holding events other than religious the rate may

be Rs. 1400 per day for Municipal Committees.

Proposal for revision of fee for permission to install Crackers :

The committee has decided that the application fee for permis-

sion to install cracker stall may be fixed as Rs. 1000 per stall for

Municipal Committees. There may be an annual increase of 50% in

the above rates after year of notification.

Management Rules, 2016 notified by the Ministry of Environment,

Forest and Climate Change, GoI vide notification No. G.S.R 1357 (E) 2 The J&K Official Gazette, 19th March, 2024/29th Phal., 1945. [No. 50-24

dated 08/04/2016 and Solid Waste Management Bye-Laws, 2019 subsequently notified by Jammu and Kashmir Government in respect of Municipal Committee, Nowsheraon 4th September, 2019, the committeehas revised the user charges which will come into force w.e.f.01/04/2024. The person having any objection may submit the same to the undersigned in writing within 30 days from the date of publication of this noticethrough official email i.e. [email protected] in person during the official working hours on any working day. NOTIFICATION

No. 464/EPS/2024(5). — WHEREAS, the President of India has,

by notification issued under sub-section (2) of Section 14 of the

Representation of People Act, 1951 (43 of 1951) and published in the

Gazette of India on the 26th April, 2024 (Friday), been pleased to call

upon each of the parliamentary constituencies, specified in column (2) of

the Schedule below, in the States or Union Territories mentioned in

column (1), of the Schedule to elect members to the House of the People, 2 The J&K Official Gazette, 26th April, 2024/6th Vai., 1946. [No. 4-7

in accordance with the provisions of the said Act and of the rules and

orders made thereunder.

2. Now, therefore, in pursuance of Sections 30 and 56 of the said Act,

the Election Commission of India hereby-

(A) Appoints, with respect to the said election, from each of the

parliamentary constituencies specified in the said Schedule,—

(a) the 03rd May, 2024 (Friday), as the last date for making

nominations;

(b) the 04th May, 2024 (Saturday), as the date for scrutiny of

nominations;

of candidatures;

(d) the date specified in column (3) of the SCHEDULE below,

as the date on which a poll shall, if necessary, be taken in the

parliamentary constituencies, specified in the corresponding

entry in column (2) of the said Schedule; and

(e) the 06th June, 2024 (Thursday), as the date before which the

election shall be completed in all the above mentioned

parliamentary constituencies; and

(B) Fixes the hours specified in column (4) of the said Schedule, as

the hours during which the poll shall, if necessary, be taken in the

constituencies, specified in the corresponding entry in column (2)

of the said Schedule, on the date specified against such

constituency in column (3) thereof, for the above election.
