Subject :-Promotions /Regularization of employees apportioned to the Union Territory of Ladakh - Advisory thereof.
Government Circular No. 12 - JK (GAD) of 2024
Dated : 04-06-2024 .
In terms of Circular No. 20 -JK( GAD ) of 2021 dated 19-06-2021 , all the Administrative Departments were advised to consider the employees continuing their services in the UT of Ladakh , for grant of promotions against combined cadre strength and seniority , till final allocation of the employees of erstwhile State of Jammu and Kashmir is made by the 186 The J& K Official Gazette, 4th July, 2024 /13th Asad . , 1946. [No. 14
Competent Authority in terms of the Jammu and Kashmir Reorganisation Act , 2019. The promotions made , if any, by exclusion of employees who were provisionally continuing to serve on the corresponding posts , in the Union Territory of Ladakh were to be reviewed immediately, being in contravention to the provisions of the Jammu & Kashmir Reorganisation Act, 2019 .
SubsequentJy , clarifications were sought by the Administrative Departments with regard to promotlon/ inclusion of the employees apportioned to the Union Territory of Ladakh against cadre strength of Union Territory of Jammu and Kashmir , after the apportionment of employees among the two successor Union Territories .
Accordingly, the matter was examined in the General Administration Department and vide Circular No. 09 - JK(GAD ) of 2022 dated 08-03-2022 , following clarifications were notified for the information of all Administrative Departments :
i. Consequent upon the apportionment of manpower between Union Territory of Jammu and Kashmir and Union Territory of Ladakh , the promotions / appointments in Jammu and Kashmir shall be considered against the posts allocated to Union Territory of Jammu and Kashmir only. The posts allocated to Union Territory of Ladakh shall be excluded while considering any such exercise except for the services failing under the ambit of S.O. 428 dated 21-12-2021 .
ii . The employees apportioned to Union Territory of ladakh vide Government Order No. 1212 -JK( GAD) of 2021 dated 15-11-2021 shall be excluded from ' Seniority List/ Eligibility Ilst' and such employees shall not be considered for promotions in the Union Territory of Jammu and Kashmir w.e.f. 15-11-2021.
Despite the earlier instructions , it has come to notice that the Departmental Promotion Committees , including the J & K Public Service Commission, are not considering the employees apportioned to the Union Territory of Ladakh for promotion/regularization to the post ( s ) on which they have been placed in the In - charge capacity against vacancies in the cadre prior to 15-11-2021 . However , some Administrative Departments have sought clarification in the matter . Besides , the Administration of the Union Territory of Ladakh has also requested to resolve the issue at an earliest , so that the Administration can place their matter before the Union Public Service Commission/ concerned DPCs for further promotions .

Accordingly , the matter has been reviewed in the General Administration Department and the following instructions are hereby notified for the information of J & K Public Service Commission/ all Administrative Departments and concerned Head of Departments :
i . The cases for regularization/ promotion of employees apportioned to the Union Territory of Ladakh, who have been placed in the In- charge capacity on higher post ( s ) prior to their apportionment against the combined cadre strength , shall be placed before the J& K Public Service Commission/ Departmental Promotion Committee (s ) , for consideration on case to case basis after observing all the rules and vacancy position in the combined cadre strength at the relevant period .
ii . Thereafter , the recommendations of the Departmental Promotion Committee ( s ) / J & K PSC shall be sent to the concerned Administrative Department in the Administration of Union Territory ofLadakh along with all relevant records/ documents for issuance of regularization order ( s ) and subsequent entry in the Service Book.

It shall be subject to the following conditions : -
i. The land shall be used only for the purpose for which the sanction of transfer has been accorded .
ii . The sanction has nothing to do with the process of allotment or regularization of the land for Industrial Units or entrepreneur for which Industries and Commerce Department has to fulfill the criteria as required under the laid down rules .
iii. The land shall put to use after obtaining all other permissions as may be required for its construction from the Competent Authority.

vii . litigation , if any to be contested by the indenting department .
viii . The indenting department to take possession of the land within 30 days from the transfer order , and land to be put to use within 03 years failing which the land shall revert back to the Government .
ix. The Revenue Department shall not earmark or develop any approach road for setting up of Industrial Estates .
x . The Government reserves the right to retrieve any unutilized portion of the land from the department , if the same is required for any other public purpose .
xi . This shall be without prejudice to the outcome of the writ petition (s ) , if any pending before the competent courts .

Whereas , it appears to the appropriate Authority that land measuring 11 Kanals at village Sonamarg is required for public purpose with the nomenclature " KM 1.3 Lashpathri Bridge on Sonamarg Bypass Road , Tehsil Gund, District Ganderbal ' through indenting Department namely Boarder Roads Organization .
Whereas , vide SO 237 Dated 23-07-2020 issued by Revenue Department J & K Government the Collector Land Acquisition ( Sub divisional Magistrate Kangan) has been designated as Collector Land Acquisition to perform duties under the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act, 2013.
Whereas , a team was constituted vide this office Letter No. 574/ SDM/ KGN/LAS Dated : 29-02-2024 .

Whereas , the revenue team headed by Tehsildar Gund conducted preliminary enquiry and furnished detailed report vide Letter No. 78/ OQ/TG/4 . Dated 07-03-2024 citing therein that the Indenting Department on spot has already acquired land measuring 09 K- 11 M out of the total land measuring 20K- 11M under Survey No. 33 min in estate Sonamarg .
Whereas , the Team referred headed by Tehsildar Gund conducted preliminary enquiry vide No. 21 / TG /2024 Dated 15-03-2024 and reported that land measuring 11 Kanals out of the total land measuring 20K- 11M under Survey No. 33 min in estate Sonamarg is required for the public purposes with the nomenclautre " KM 1.3 Lashpathri Bridge on Sonamarg Bypass Road , Tehsil Gund , District Ganderbal and has further reported that no social Impact assessment is required in the instant case .
Whereas , in accordance with the Sub- Sections 1 and 2 of Section- 4 of the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act 2013 , Tehsildar Gund vide his office order No. 22 /TG/ 2024 Dated 15-03-24 conducted inquiry with regard to the Social Impact Assessment and other issues with the following findings in general :-
1. That the proposed acquisition of land serves the public purpose.
2. That the extent of the land proposed for the Acquisition is in the absolute bare - minimum needed for the project .
3. That no other alternate and feasible land has been found available .
4. That no unutilized land which has been previously acquired exists in the area is available .
Whereas , the Deputy Commissioner Ganderbal vide his office No. DCG / LAS / 24 / 1898-1901 Dated 04-03-2024 accorded approval and authorized the Collector Land Acquisition ( Sub Divisional Magistrate Kangan) for issuance of Notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act 2013 .
In view of above , I Nuzhat , K. Qurashi , Collector Land Acquisition Kangan ( Sub Divisional Magistrate Kangan) in terms of powers vested in me vide Section - 11 ( 1 ) of the RFCTARR Act , 2013 , hereby notify No. 14] The J& K Official Gazette , 4th July, 2024/ 13th Asad . , 1946.

No. 464 / EPS /2024 (3 ) .- WHEREAS , the President of India has , by notification issued under Sub - Section ( 2) of Section 14 of the 2

The J& K Official Gazette , 12th April , 2024/23rd Chai . , 1946.
Representation of People Act , 1951 ( 43 of 1951 ) and published in the Gazette of India on the 12th April , 2024 ( Friday) , been pleased to call upon each of the parliamentary constituencies , specified in column ( 2) of the Schedule below, in the States or Union Territories mentioned in column ( 1 ) , of the Schedule to elect memmbers to the House of the People , in accordance with the provisions of the said Act and of the rules and orders made thereunder .
2. Now, therefore , in pursuance of Sections 30 and 56 of the said Act, the Election Commission of India hereby-
(A) Appoints , with respect to the said election , from each of the parliamentary constituencies specified in the said Schedule ,-
(a) the 19th April , 2024 ( Friday) , as the last date for making nominations ;
(b) the 20th April , 2024 ( Saturday) , as the date for scrutiny of nominations ;
(c) the 22nd April, 2024 ( Monday) , as the last date for withdrawal of candidatures ;
(d) the date specified in column ( 3 ) of the SCHEDULE below, as the date on which a poll shall , if necessary, be taken in the parliamentary constituencies , specified in the corresponding entry in column (2) of the said Schedule ; and
(e) the 06th June, 2024 (Thursday) , as the date before which the election shall be completed in all the above mentioned parliamentary constituencies ; and
(B) Fixes hours specified in column (4) of the said Schedule , as the hours during which the poll shall , if necessary, be taken in the constituencies , specified in the corresponding entry in column (2) of the said Schedule , on the date specified against such constituency in column ( 3) thereof, for the above election .

सं . 464/ईपीएस /2024 ( 3 ) . - यतः, भारत के राष्ट्रपति ने लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 14 की उप - धारा ( 2 ) के अंतर्गत निर्गत और भारत के राजपत्र में 12 अप्रैल , 2024 ( शुक्रवार) को प्रकाशित अधिसूचना के द्वारा नीचे दी गई अनुसूची के स्तंभ ( 1 ) में उल्लिखित राज्यों या संघ राज्य क्षेत्रों में , इसके स्तंभ ( 2 ) में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में से प्रत्येक संसदीय निर्वाचन क्षेत्र से अपेक्षा की है कि उक्त अधिनियम के उपबंधों और तदधीन बनाए गए नियमों और किए गए आदेशों के अनुसार लोक सभा के लिए सदस्य निर्वाचित कर दें ।

2. अतः , अब , उक्त अधिनियम की धारा 30 और 56 के अनुसरण में , भारत निर्वाचन आयोग एतद्द्वारा-
(अ) उक्त अनुसूची में विनिर्दिष्ट प्रत्येक संसदीय निर्वाचन क्षेत्र से, उक्त निर्वाचन के संबंध में -
(क) नामनिर्देशन करने की अंतिम तारीख के रूप में 19 अप्रैल , 2024 (शुक्रवार) को;
(ख) नामनिर्देशनों की संवीक्षा की तारीख के रूप में 20 अप्रैल , 2024 (शनिवार) को;
(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख के रूप में 22 अप्रैल , 2024 ( सोमवार) को;
(घ) नीचे दी गई अनुसूची के स्तंभ (3 ) में विनिर्दिष्ट तारीख को उस तारीख के रूप में, जिसको यदि आवश्यक हुआ तो उक्त अनुसूची के स्तंभ ( 2 ) में तदनुरूप प्रविष्टि में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में मतदान होगा ; और
(ङ) 6 जून , 2024 ( गुरुवार) को उस तारीख के रूप में , जिससे पहले ऊपर उल्लिखित सभी संसदीय निर्वाचन क्षेत्रों में निर्वाचन संपन्न करा लिया जाएगा;
नियत करता है; और
(आ) उक्त अनुसूची के स्तंभ (4 ) में विनिर्दिष्ट समय को ऐसे समय के रूप में निर्धारित करता है जिसके दौरान, यदि आवश्यक हुआ तो उपर्युक्त निर्वाचन के लिए उक्त अनुसूची के स्तंभ (2 ) में तदनुरूप प्रविष्टि में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में इसके स्तंभ (3 ) में ऐसे निर्वाचन क्षेत्र के सम्मुख विनिर्दिष्ट तारीख को मतदान कराया जाएगा ।

अधिसूचना
का०आ० ( अ) - सत्रहवीं लोक सभा के कार्यकाल की समाप्ति पर, नई लोक सभा गठित किए जाने के प्रयोजन के लिए साधारण निर्वाचन कराए जाने का विनिश्चय किया गया है ।

सं . 464/ईपीएस /2024 ( 3 ) . - यतः, भारत के राष्ट्रपति ने लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 14 की उप - धारा ( 2 ) के अंतर्गत निर्गत और भारत के राजपत्र में 12 अप्रैल , 2024 (शुक्रवार) को प्रकाशित अधिसूचना के द्वारा नीचे दी गई अनुसूची के स्तंभ ( 1 ) में उल्लिखित राज्यों या संघ राज्य क्षेत्रों में , इसके स्तंभ ( 2 ) में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में से प्रत्येक संसदीय निर्वाचन क्षेत्र से अपेक्षा की है कि उक्त अधिनियम के उपबंधों और तदधीन बनाए गए नियमों और किए गए आदेशों के अनुसार लोक सभा के लिए सदस्य निर्वाचित कर दें ।

2. अतः , अब , उक्त अधिनियम की धारा 30 और 56 के अनुसरण में , भारत निर्वाचन आयोग एतद्द्वारा-
(अ) उक्त अनुसूची में विनिर्दिष्ट प्रत्येक संसदीय निर्वाचन क्षेत्र से, उक्त निर्वाचन के संबंध में -
(क) नामनिर्देशन करने की अंतिम तारीख के रूप में 19 अप्रैल , 2024 (शुक्रवार) को;
(ख) नामनिर्देशनों की संवीक्षा की तारीख के रूप में 20 अप्रैल , 2024 (शनिवार) को;
(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख के रूप में 22 अप्रैल , 2024 ( सोमवार) को;
(घ) नीचे दी गई अनुसूची के स्तंभ (3 ) में विनिर्दिष्ट तारीख को उस तारीख के रूप में, जिसको यदि आवश्यक हुआ तो उक्त अनुसूची के स्तंभ ( 2 ) में तदनुरूप प्रविष्टि में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में मतदान होगा ; और
(ङ) 6 जून , 2024 ( गुरुवार) को उस तारीख के रूप में , जिससे पहले ऊपर उल्लिखित सभी संसदीय निर्वाचन क्षेत्रों में निर्वाचन संपन्न करा लिया जाएगा;
नियत करता है; और
(आ) उक्त अनुसूची के स्तंभ (4 ) में विनिर्दिष्ट समय को ऐसे समय के रूप में निर्धारित करता है जिसके दौरान, यदि आवश्यक हुआ तो उपर्युक्त निर्वाचन के लिए उक्त अनुसूची के स्तंभ (2 ) में तदनुरूप प्रविष्टि में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्रों में इसके स्तंभ (3 ) में ऐसे निर्वाचन क्षेत्र के सम्मुख विनिर्दिष्ट तारीख को मतदान कराया जाएगा ।
