Whereas , on the basis of indent placed by the Inspector General , BSF, Jammu vide No.BF/Land/BOPs/Ftr/Engg/2011/0619-20 , notification 292

under section 4 ( 1 ) of Land Acquisition Act , Samvat , 1990 was issued by Collector Land Acquisition ( SDM ) , Vijaypur , vide Notification No. 6 of 2019 dated 12-06-2019 under endorsement No. SDM/V/2019-20/ 32-37 dated 12-06-2019 for land measuring 340 Kanal 18½ Marlas situated in village Nanga, Tehsil Ramgarh, District Samba for acquisition of land for construction of 135 feet wide strip composite bundh, calling upon the objections from the land owners / interested persons ; and
Whereas , pursuant to above notification , no objection was received from anyone , however , evacuee land measuring 161 Kanals 17 Marlas is also involved in the said acquisition which matter was taken up by Divisional Comrntssioner ; Jammu with Custodian Department vide No.502/ Border Fencing/ Gen/23 / 1088 dated 08-09-2023 for Issuance of NOC for acquisition of the said land ; and
Whereas , Custodian General , J & K vide Order No.49 of 2023 dated 25-09-2023 issued under endorsement No.CG ( EP ) 1386-89/Acq dated 25-09-2023 has granted necessary " NOC " to the acquisition of the evacuee land ; and
Whereas , Deputy Commissioner , Samba vide No. DCS /LAS / ACR/ 2023-24/468-471 dated 31-10-2023 recommended the case to Divisional Commissioner , Jammu for issuance of declaration under Sections 6 & 7 of Land Acquisition Smvt . Act 1990 for acquisition of land measuring 340 Kanals 1812 Marlas situated village Nanga , Tehsil Ramgarh being acquired for public i.e. construction of 135' vide strip composite bundh by BSF . Divisional Commissioner , Jammu vide No.502/4735 / Acq/ 135 ft./ Nanga/ Smb/ 23 /1541 (7309103 ) dated 02-12-2023 endorsed the same to this department for the said purpose ; and
Whereas , the report furnished by District Collector ( DC ) , Samba vide letter referred to above , duly endorsed by Divisional Commissioner , Jammu has been examined and it has been found that no one has filed any objection to the proposed acquisition ; and
Whereas , the Government is satisfied that the land particulars whereof are given in Annexure ' A' to this notification is required for public purpose i.e. construction of 135 ′ wide strip composite bundh by BSF.
Now , therefore , in pursuance of Section 6 of the J & K Land Acquisition Act , Samvat 1990 , it is declared that the land measuring 340 Kanals 1812 Marlas situated in village Nanga , Tehsil Ramgarh, District Samba is required for public purposes i.e. construction of 135 ' wide No. 24] The J& K Official Gazette, 12th Sept. , 2024/21st Bhad. , 1946. 293
strip composite bundh by Border Security Force (BSF ) . Further , the Collector Land Acquisition ( SDM ) Vijaypur is directed under Section 7 of the said Act to take orders for acquisition of the said land after giving prescribed notice to the interested person (s ) as required under the Land Acquisition Act/rules .
However, the Collector concerned shall be held specifically responsible for identification and proper title verification of all types of lands involved in the case for making apportionment of compensation amongst all the interested persons/ rightful claimants , in accordance with the relevant laws / rules in force , while making the award . The Collector/indenting department shall also ensure that no compensation shall be made for the portion of land which has already been acquired for the road in question .

SO - 452 . Whereas , on 09th August , 2019 , the Jammu & Kashmir Reorganisation Act , 2019 was enacted through which the then State of Jammu & Kashmir was bifurcated into two Union Territories i.e. ( i ) Union Territory ofJammu & Kashmir ( ii) Union Territory of Ladakh ; and Whereas , Section 14 (2 ) of the Jammu & Kashmir Reorganisation Act, 2019 provides that there shall be a Legislative Assembly for the Union Territory of Jammu and Kashmir ; and Whereas , a Delimitation Commission was set up under Delimitation Commission Act , 2002 vide notification dated 6th March 2020 , to inter - alia carry out delimitation of constituency of the Union Territory of Jammu and 2 The J & K Official Gazette , 5th Sept. , 2024 / 14th Bhadra , 1946. Kashmir which has been completed vide notification dated on 05th May , 2022; and
Whereas , in terms of Sub - Section ( 1 ) of Section 15 of the Representation of the People Act , 1951 (43 of 1951 ) a general election has to be held for the purpose of constituting the first Legislative Assembly of the newly carved Union Territory of Jammu & Kashmir ; and Now , therefore , as recommended by the Election Commission of India in pursuance of Sub- Section ( 2) of Section 15 of the said Act , the Lieutenant Governor of the Union Territory of Jammu and Kashmir is hereby pleased to call upon each of the Assembly Constituencies of the Union Territory of Jammu and Kashmir , specified in the TABLE below , to elect members to the Legislative Assembly of the Union Territory of Jammu and Kashmir , in accordance with the provisions of the said Act and of the rules and orders made thereunder .

वैधानिक आदेश -452 .- यतः , 09 अगस्त , 2019 को , जम्मू- कश्मीर पुनर्गठन अधिनियम , 2019 अधिनियमित किया गया था , जिसके माध्यम से तत्कालीन जम्मू- कश्मीर राज्य को दो संघ राज्य क्षेत्रों अर्थात (i ) जम्मू- कश्मीर संघ राज्य क्षेत्र (ii ) लद्दाख संघ राज्य क्षेत्र में द्विभाजित किया गया था; और 2 जम्मू और कश्मीर अधिकारिक राजपत्र , 05 सितम्बर , 2024 / 14 भाद्र , 1946. [ सं . 23-2
यतः , जम्मू- कश्मीर पुनर्गठन अधिनियम , 2019 की धारा 14 ( 2 ) में उपबंध किया गया है कि जम्मू- कश्मीर संघ राज्य क्षेत्र के लिए एक विधान सभा होगी; और
यतः , अन्य बातों के साथ - साथ , जम्मू- कश्मीर संघ राज्य क्षेत्र के निर्वाचन क्षेत्रों का परिसीमन करने के लिए अधिसूचना दिनांक 06 मार्च 2020 के जरिए परिसीमन आयोग अधिनियम , 2002 के तहत एक परिसीमन आयोग गठित किया गया था जिसे अधिसूचना दिनांक 05 मई , 2022 के जरिए पूरा कर लिया गया है ; और
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 (1951 का 43 ) की धारा 15 की उप - धारा ( 1 ) के निबंधनों के अनुसार नवसृजित जम्मू- कश्मीर संघ राज्य- क्षेत्र की पहली विधान सभा का गठन करने के प्रयोजनार्थ साधारण निर्वाचन आयोजित किया जाना है ; और
अब , इसलिए , उक्त अधिनियम की धारा 15 की उप - धारा (2 ) के अनुसरण में जैसा कि भारत निर्वाचन आयोग द्वारा संस्तुति की गई है , जम्मू- कश्मीर संघ राज्य क्षेत्र के उप - राज्यपाल एतद्वारा उक्त अधिनियम के उपबंधों और तदधीन बनाए गए नियमों और आदेशों के अनुसार नीचे दी गई तालिका में विनिर्दिष्ट जम्मू- कश्मीर संघ राज्य क्षेत्र के प्रत्येक विधान सभा निर्वाचन क्षेत्र से अपेक्षा करते हैं कि वे जम्मू- कश्मीर संघ राज्य क्षेत्र की विधान सभा के लिए सदस्य निर्वाचित कर दें ।

WHEREAS , the Lieutenant Governor of the Union Territory of Jammu and Kashmir has , by notification issued under sub - section ( 2) of section 15 of the Representation of the People Act , 1951 (43 of 1951 ) and published in the official Gazette of the Union Territory on the 05th September , 2024 ( Thursday ) , been pleased to call upon each of the Assembly constituencies in the Union Territory , specified in the TABLE below , to elect members to the Legislative Assembly of the Union Territory of Jammu and Kashmir , in accordance with the provisions of the said Act and of the rules and orders made thereunder .

Now, therefore , in pursuance of sections 30 and 56 of the said Act , the Election Commission of India hereby -
(A) Appoints , with respect to the said election in each of the constituencies specified in the said table , -
(a) the 12th September , 2024 ( Thursday ) , as the last date for making nominations ;
(b ) the 13th September , 2024 (Friday ) , as the date for the scrutiny of nominations ;
(c ) the 17th September , 2024 ( Tuesday ) , as the last date for the withdrawal of candidatures ;
(d) the 01st October , 2024 ( Tuesday) , specified in the TABLE below as the date on which a poll shall , if necessary , be taken ; and
(e ) the 10th October , 2024 ( Thursday ) , as the date before which the election shall be completed ; and

अधिनियम के उपबंधों और तदधीन बनाए गए नियमों और आदेशों के अनुसार नीचे दी गई तालिका में विनिर्दिष्ट संघ राज्य क्षेत्र के विधान सभा निर्वाचन क्षेत्रों में से प्रत्येक विधान सभा निर्वाचन क्षेत्रों से अपेक्षा की है कि वे जम्मू- कश्मीर संघ राज्य क्षेत्र की विधान सभा के सदस्यों को निर्वाचित कर दें ।
अब , इसलिए , उक्त अधिनियम की धारा 30 और 56 के अनुसरण में , भारत निर्वाचन आयोग एतद्दद्वारा-
(अ) उक्त तालिका में विनिर्दिष्ट प्रत्येक निर्वाचन क्षेत्र में उक्त निर्वाचन के संबंध में , निम्नलिखित नियत करता है-

NOTIFICATION
Whereas , the schedule for the current General Elections to the Legislative Assemblies of Haryana and Jammu & Kashmir, has been announced by the Election Commission vide Press Note No. ECI/ PN/ 128/2024 dated 16th August , 2024 read with Press Note No. ECI / PN / 132 / 2024 dated 31st August , 2024 ; and 2. Whereas , Section 126A of The Representation of the People Act , 1951 (in short R.P. exit poll and publish or publicise by means , of the print or electronic media or disseminate in any other manner , whatsoever , the result of any exit poll during such period, as may be notified by the Election Commission in this regard .
(2) For the purposes of sub- section ( I) , the Election Commission shall , by a general order , notify the date and time having due regard to the following , namely : -
( a ) In case of a general election , the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the poll in all the States and Union Territories ;
(b) In case of a bye - election or a number of bye - elections held together , the period may commence from the beginning of the hours fixed for poll on and from the first day of poll and continue till half an hour after closing of the poll : Provided that in case of a number of bye- elections held together on different days , the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the last poll .
(3) Any person who contravenes the provisions of this section shall be punishable with imprisonment for a term which may extend to two years or with fine or with both . "

result of any exit poll in connection with the aforesaid general election , shall be prohibited .
4. It is further clarified that under Section 126 ( 1 ) (b ) of the R.P. Act , 1951 , displaying any election matter including results of any opinion poll or any other poll survey , in any electronic media , would be prohibited during the period of 48 hours ending with the hours fixed for the conclusion of the poll in connection with the aforesaid general elections .

यतः निर्वाचन आयोग के प्रेस नोट संख्या ईसीआई / पीएन / 128 / 2024 दिनांक 16 अगस्त, 2024 के साथ पठित प्रेस नोट संख्या ईसीआई / पीएन / 132 / 2024 दिनांक 31 अगस्त , 2024 , के द्वारा घोषित किए 2 जम्मू और कश्मीर अधिकारिक राजपत्र , 03 सितम्बर , 2024 / 12 भाद्र , 1946. [ सं . 22-6 गए हरियाणा और केंद्रशासित प्रदेश जम्मू और कश्मीर विधान सभा निर्वाचन क्षेत्रों के वर्तमान साधारण निर्वाचनों के लिए कार्यक्रम की घोषणा कर दी गई है; और
2. यतः , लोक प्रतिनिधित्व अधिनियम , 1951 ( संक्षेप में लो.प्र . अधिनियम , 1951 ) की धारा 126 क में यह विनिर्दिष्ट किया गया है कि " (1 ) कोई भी व्यक्ति कोई निर्गम मत सर्वेक्षण नहीं करेगा और किसी निर्गम मत सर्वेक्षण के परिणाम का , ऐसी अवधि के दौरान जो निर्वाचन आयोग द्वारा इस संबंध में अधिसूचित की जाए , प्रिंट या इलेक्ट्रॉनिक मीडिया के माध्यम से प्रकाशन या प्रचार या किसी भी प्रकार की अन्य रीति में प्रसार नहीं करेगा ।
(2) निर्वाचन आयोग , उपधारा ( 1 ) के प्रयोजन के लिए , निम्नलिखित को ध्यान में रखते हुए साधारण आदेश द्वारा तारीख और समय अधिसूचित करेगा , अर्थात : -
(क ) साधारण निर्वाचन की दशा में , वह अवधि मतदान के पहले दिन के संबंध में मतदान के लिए नियत समय के आरंभ होने से शुरू होगी और सभी राज्यों और संघ राज्य क्षेत्रों में मतदान समाप्त होने के आधे घंटे तक जारी रहेगी;
(ख ) किसी उप - निर्वाचन या एक साथ कराए जाने वाले अनेक उप - निर्वाचनों की दशा में वह अवधि मतदान के पहले दिन से ही मतदान के लिए नियत समय के आरंभ होने से शुरू होगी और मतदान समाप्त होने के पश्चात् आधे घंटे तक जारी रहेगी:
परंतु भिन्न - भिन्न दिनों पर एक साथ कराए जाने वाले अनेक उप - निर्वाचनों की दशा में , वह अवधि मतदान के पहले दिन के संबंध में मतदान के लिए नियत समय के आरंभ होने से शुरू होगी और अंतिम मतदान समाप्त होने के पश्चात आधे घंटे तक जारी रहेगी ।

3. अब , इसलिए , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 126 क की उपधारा ( 1 ) के अधीन शक्तियों का प्रयोग करते हुए निर्वाचन आयोग उक्त धारा की उप - धारा (2 ) के उपबंधों के दृष्टिगत , 18.09.2024 ( बुधवार) , को पूर्वाद्ध 7.00 बजे से तथा 05.10.2024 (शनिवार) को अपराह्न 6.30 बजे के बीच की अवधि को , ऐसी अवधि के रूप में अधिसूचित करता है जिसके दौरान उपर उल्लिखित साधारण निर्वाचनों के संदर्भ में किसी भी प्रकार के एग्जिट पोल का आयोजन करने तथा प्रिंट या इलेक्ट्रॉनिक मीडिया द्वारा इसके परिणाम के प्रकाशन या प्रचार अथवा किसी भी अन्य तरीके से उसका प्रचार - प्रसार करने पर प्रतिबंध होगा ।
4. यह भी स्पष्ट किया जाता है कि लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 126 ( 1 ) ( ख ) के अधीन उपर्युक्त साधारण निर्वाचनों के संबंध में मतदान की समाप्ति के लिए नियत समय पर समाप्त होने वाली 48 घंटों की अवधि के दौरान किसी भी इलेक्ट्रानिक मीडिया में किसी भी ओपिनियन पोल या किसी अन्य मतदान सर्वेक्षण के परिणामों सहित किसी भी प्रकार के निर्वाचन संबंधी मामले के प्रदर्शन पर प्रतिबंध होगा ।

[ सं . 22-8 2 के उपबंधों के अंतर्गत जारी अधिसूचना और उक्त अधिनियम की धारा 30 और 56 के अंतर्गत निर्वाचन आयोग द्वारा जारी अधिसूचना के द्वारा 06 अक्तूबर 2024 ( रविवार) को उस तिथि के रूप में नियत किया था जिससे पहले निर्वाचन पूरे कर लिए जाएंग ; और

SO-40 . In exercise of the powers conferred by Section 148 of the Jammu and Kashmir Goods and Services Tax Act , 2017 (Act No. V of 2017 ) ( hereinafter referred to as the said Act) . The Government on the recommendations of the Council , hereby makes the following amendments in the notification of the Government of Jammu and Kashmir, Finance Department S.O. No. 546/2023 , dated the 19th of October , 2023 , namely : -
In the said notification , after the words " hereby notifies the following special procedure to be followed " the words and figures " with effect from 1st day of January 2024 " shall be inserted and shall deemed to have been inserted with effect from the 31st July 2023 .
