Government Order No. 75 - JK ( Rev) of 2024 Dated 25-06-2024 .

Sanction is hereby accorded to the :

(a) Resumption of land measuring 03 Kanals under Khasra No.290 min at Village Kunkanyala , Tehsil Katra , District Reasi from Subsidiary Intelligence Bureau ( SIB ) , Ministry of Home Affairs , Government of India transferred vide Government Order No.60 - JK ( Rev ) of 2023 dated 28-04-2023 pursuant to Administrative Council Decision No.35/3 /2023 dated 25-04-2023 to the Revenue Department . Deputy Commissioner , Reasi shall work out modalities for proper utilization of the resumed land .

(b) Transfer of State land measuring 03 Kanals under Khasra No.351 in Village Kunkanyala , Tehsil Katra, District Reasi in favour of Subsidiary Intelligence Bureau ( SIB ) , Ministry of Home Affairs , Government of India , for construction of office- cum- residence accommodation in terms of Rule 310 of General Financial Rules , 2017 as per rates notified for the said land in terms of Market Value Guidelines /Rules 2011 issued by the Deputy Commissioner , Reasi for the year 2024 .

It is further ordered that :-

i. The balance transfer value of the land amounting to Rs . 2.88 lac (Rupees two lac eighty eight thousand only) shall be deposited in the relevant account of the Deputy Commissioner , Reasi who shall further deposit in the account head of Government of J & K, Major Head 0029 - Land Revenue , Minor Head 800- Other Receipts .

ii . The land shall be used only for the purpose for which the sanction of transfer has been accorded.

iii. The land shall put to use after obtaining all other permissions as may be required for its construction from the Competent Authority and pay any charges /compensation of the said land, if applicable .

iv. The user agency shall adhere to all such provisions of laws relating to Revenue/ Forest/Housing & Urban Development Department/ No. 30] The J& K Official Gazette , 24th Oct. , 2024/2nd Kart . , 1946. 345

J& K Water Resources ( Regulation and Management ) Act , 2010 etc. If any land found under water course/ source shall not in any way utilized for the construction purposes .

v. It would be the responsibility of the user agency to comply with directions of the Hon'ble High Court of J& K or any other Competent Court with regard to the usage of the said land and contest the litigation , if any pending .

vi. The land is transferred on ' as is where is basis ' and nothing in this order shall be construed to debar any Competent Authority to take legal action in case of violation on the field relating to usage of land.

vii . No diversion of transferred land for any other purpose shall be made .

viii . The user agency to take possession of the land within 30 days from the transfer order , and land to be put to use within 03 years failing which the land shall revert back to the Government .

Sanction is hereby accorded to the transfer of State land measuring 53 Kanals 03 Marlas as per description at Annexure " A" in District Baramulla in favour of Central Reserve Police Force ( CRPF ) for establishing Battalion Camping Site 53 Bn CRPF in terms of provisions of Rule 310 of General Financial Rules , 2017 on payment of transfer value of Rs.3 , 44 , 94 , 350/ - (Rupees Three Crore Forty Four Lac Ninety Four Thousand Three Hundred Fifty only) @ Rs.6,49,000 / - per Kanal .

It is further ordered that :

i. The transfer value of the land shall be deposited in the relevant account of the Deputy Commissioner , Baramulla, who shall further deposit in the account head of Government of J & K , Major Head 0029 - Land Revenue , Minor Head 800 - other receipts .

Whereas , the conditions imposed by the State Board for Wildlife as well as the Standing Committee of the National Board for Wildlife stand fulfilled , and in accordance with the conditions imposed by the said Boards , the State Government vide SRO - 47 of 2012 dated 30th January , 2012, constituted Tata Kuti Wildlife Sanctuary under the provision of sub- section ( 1 ) of section 17 of the Jammu and Kashmir Wildlife (Protection) Act , 1978 in lieu of de- notification of Trikuta Wildlife Sanctuary ; and

Whereas , the Hon'ble Supreme Court of India vide its order dated 13-03-2013 while considering the application moved by Shri Mata Vaishno Devi Shrine Board for de - notification of the entire Trikuta Wildlife Sanctuary granted permission for the same .

Now, therefore , the entire area of Trikuta Wildlife Sanctuary is hereby de-notified.

सं. 308 / जेएंडके - एलए / 2024.- यतः , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 15 की उप धारा (2 ) के तहत जम्मू- कश्मीर संघ राज्य- क्षेत्र के उप - राज्यपाल द्वारा 20.08.2024 , 29.08.2024 , 05.09.2024 को क्रमशः निर्गत अधिसूचना सं . का.आ. - 412 , का.आ. - 435 , का.आ. - 452 के अनुसरण में , जम्मू- कश्मीर संघ राज्य क्षेत्र के लिए नई विधान सभा का गठन करने के प्रयोजनार्थ साधारण निर्वाचन आयोजित किया गया; और

यतः , उक्त साधारण निर्वाचन में सभी 90 विधान सभा निर्वाचन क्षेत्रों के निर्वाचन परिणाम संबंधित रिटर्निंग अधिकारियों द्वारा घोषित कर दिए गए हैं ।

SO-609.- Whereas , on 08-09-2023 , the Police Station, Charar - i- Sharief, received a docket to the effect that a Joint Naka was established by the Police/ Security Forces at Check Karpora crossing and during the checking two suspects while seeing the Naka Party tried to escpae but were chased down on the spot and identified as Tanveer Ahmad Bhat S / o Gh . Mohd Bhat and Yawar Maqbool Ganie S / o Mohd Maqbool Ganie residents of Karpora , Pakherpora. During their personal 2 The J&K Official Gazette , 11th Dec. , 2023/20th Agra. , 1945. [No. 36 -d

search , the Police recovered 01 Chinese Pistol , 01 Magazine and 09 Rounds from their possession respectively ; and

2. Whereas , based on the above , a case FIR No. 66/2023 under Section 7/25 Arms Act, and Sections 18 , 19 , 20 and 23 of ULA (P) Act , was registered in the Police Station , Charar- i- Sharief, and the investigation , of the case was set into motion. Subsequently , during the investigation , the offence under Section 19 of ULA (P ) Act , was dropped and the offences under Sections 38 and 39 of ULA ( P ) Act were added in the case and

3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , it was found that the accused viz . Tanveer Ahmad Bhat and Yawar Maqbool Ganie , were in contact with two terrorist of LeT /TRF banned outfit namely Haris Nazir @ Qasim S / o Nazir Ahmad Dar R / o Kachipora , Pulwama and Ehsan - ul- Haq @ Numan S / o Ab . Rashid Sheikh R/ o Sheikh Mohalla , Muran , Pulwama, who provided the recovered arms / ammunition to them in order to promote terrorist activities in the area ; and

5. Whereas , during the investigation , it was established that the accused viz . Tanveer Ahmad Bhat and Yawar Maqbool Ganie , were working as Over Ground Workers ( OGWs ) for the terrorists of LeT/ TRF banned outfit , particularly the terrorist viz . Haris Nazir @ Qasim and Ehsan - ul - Haq @ Numan, and were providing logistic support to them , besides under a well knit criminal conspiracy procured arms/ ammunition from the said terrorists for carrying out the terrorist activities in the area ; and

6. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected , the Investigating Officer , has estagblished a prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their names :-

7. Whereas , the accused terrorist viz . Haris Nazir @ Qasim and Ehsan- ul- Haq @ Numan , are absconding and the proceedings under Section 299 Cr. P.C. have been proposed to be initiated against them ; and

Whereas , the Authority appointed by the Government under Sub- Section (2) of Section 45 of the Unlawful Activities ( Prevention) Act , 1967 , has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused ; and

Whereas , after perusing the Case Diary File , the relevant documents and also taking into consideration the views of the Authority appointed under Sub - Section (2 ) of Section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the above - mentioned accused for their prosecution under the provisions of law .

4. Whereas , during the investigation , it was found that on 29-09-2021 , the accused viz . Rayees Ahmad Dar, went missing from his home and joined the terrorist ranks of LeT, a banned outfit , for carrying out the terrorist activities in the area ; and

SO- 612.-Whereas , on 28-08-2015 , the Police Station , Kulgam , received a docket to the effect that a reliable information was received that two persons identified as Ameer Hamzah Shah S / o Gh . Mohi- ud- Din Shah R/ o Koil Muqam, Bandipora and Showkat Ahmad Dar S / o Mohd Yaqbool Dar R/ o Qaimoh , hoisted Pakistani flags on the electric polls at Chawalgam Chowk , Kulgam , instigating youth to join militancy [No. 37- a

thereby challenged the sovereignty and integrity of the Union of India ; and

2. Whereas , based on the above a case FIR No. 165/2015 under section 13 of ULA (P ) Act , was registered in the Police Station , Kulgam, and the investigation , of the case was set into motion ; and

3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , the accused viz . Ameer Hamzah Shah and Showkat Ahmad Dar , were arrested in the case and it was found that the accused were affiliated with the Hurriyat (G) group and on the date of occurrence hoisted the Pakistani flags on the electric poles , thereby instigated the general public and particularly youth of the area to join militancy , thereby challenged the sovereignty and territorial integrity of the Union of India ; and

5. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected , the Investigating Officer , has established a prima facie, involvement of the below mentioned accused for the commission of the offences punishable under Sections of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their Names :-

other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused ; and

7. Whereas , after perusing the Case Diary File , the relevant documents and also taking into consideration the views of the Authority appointed under Sub - Section ( 2) of Section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the above - mentioned accused for their prosecution under the provisions of law .

Now, therefore , in exercise of powers conferred by Sub - Section ( 2) of Section 45 of Unlawful Activities ( Prevention ) Act 1967 , the Government hereby accord sanction for launching prosecution against the accused viz . Ameer Hamzah Shah and Showkat Ahmad Dar , for the commission of offences punishable under Section 13 of ULA(P) Act, arising out of FIR No. 165/2015 of Police Station , Kulgam .

SO-613.- Whereas , on 06-07-2023 , a reliable information was received by the Police Station , Karnah , to the effect that two persons identified as Khalid Ahmad Piswal S / o Qaisir - ud- Din Piswal and Shafiq Ahmad Piswal S/ o Qaisir - ud - Din Piswal residents of Shamshipora , Karnah , are working as OGWs for the terrorists of LeT, a banned outfit , and procured some arms / ammunition and narcotics from across the [No. 37-b

border in order to transport the same to the terrorists for carrying out the terrorist activities in the area ; and

2. Whereas , based on the above a case FIR No. 53/2023 under sections 8/21 , 29 NDPS Act , 7/25 Arms Act and Section 13 of ULA(P ) Act, was registered in the Police Station , Karnah , and the investigation , of the case was set into motion . Subsequently , during the investigation , the offence under Sections 18 , 20 , 23 , 38 and 39 of ULA ( P) Act , were added in the case ; and

3. Whereas , during the course of investigation , the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , the accused viz . Khalid Ahmad Piswal and Shafiq Ahmad Piswal , were arrested in the case and during the investigation 01 Pistol with Magazine , 12 Rounds and 01 Kg of narcotics were recovered at their instances respectively ; and

5. Whereas , during the investigation , it was found that the accused viz . Khalid Ahmad Piswal and Shafiq Ahmad Piswal were in contact with two terrorists of LeT banned outfit namely Bashir Ahmad Piswal S / o Mohammad Yaseen Piswal R/ o Nowa- Gabra , Karnah A/ P PaK and Siraj -ud- Din Cheechi S / o Baghu Cheechi R/ o Jarda , Karnah A/ P PaK , who provided the recovered arms / ammunition and narcotics (Heroin) to them in order to promote terrorist activities in the area ; and

6. Whereas , during the investigation, it was established that the accused viz . Khalid Ahmad Piswal , and Shafiq Ahmad Piswal , were working as Over Ground Workers ( OGWs ) for the terrorists of LeT, a banned outfit , particularly the terrorists viz . Bashir Ahmad Piswal and Siraj - ud- Din Cheechi , and were providing ligistic support to them, besides , under a well knit criminal conspiracy procured arms / ammunition and narcotics ( Heroin) from the said terrorists for carrying out the terrorist activities in the area ; and

Whereas , the Authority appointed by the Government under Sub- Section ( 2) of Section 45 of the Unlawful Activities ( Prevention ) Act , 1967 , has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused ; and 10. Whereas , after perusing the Case Diary File the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub- Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act , 1967 , the Government is of the view that there is

sufficient material and evidence available against the above - mentioned

accused for his prosecution under the provisions of Law.

SO-615.-Whereas , the Ministry of Home Affairs , Government of India , vide notification S.O. - 4348 (E) dated 5th October , 2023 , issued under Sub - Section ( 1 ) of Section (3 ) of the Unlawful Activities (Prevention) Act , 1967 (37 of 1967) declared the Jammu and Kashmir Democratic Freedom Party ( hereafter referred to as the JKDFP ) , an unlawful association ; and 2 The J& K Official Gazette , 15th Dec. , 2023/24th Agra . , 1945. [ No. 37 -d

Whereas , subsequently, the Ministry of Home Affairs , Government of India , in exercise of powers conferred by Section 42 of the Unlawful Activities (Prevention) Act , 1967 vide notification S.O - 4377 (E) dated 7th October , 2023 , directed that all the States and Union Territory administrations shall exercise the powers exercisable by the Central Government uner Section 7 and Section 8 of the Act ibid .; and Whereas , vide Order No. 14017/ 13/2023 - NI - MFO dated 7th October , of 2023 , issued by the Ministry of Home Affairs , Government of India approval of the Central Government under Section 42 of the Unlawful Activities ( Prevention) Act , 1967 was conveyed to all the States and the Union Territory administrations to the effect that the States and Union Territory administrations may, by order in writing , direct that any power which has been directed to be exercised by it , shall , in such circumstances and under such conditions , as may be specified in the direction , be exercised by any person subordinate to the State Government or the Union Territory administrations , as the case may be.

Now, therefore , the Government of union Territory of Jammu and Kashmir , with the previous approval of the Central Government , conveyed vide order No. 14017/ 13 / 2023 - NI - MFO dated 7th October , 2023 issued by the Ministry of Home Affairs Government of India , hereby directs that the powers exerciseable by the Union Territory of Jammu and Kashmir under section 7 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967 ) shall be exercised by the Inspector (s ) General of Police , Kashmir/ Jammu Zones , within their respective territorial jurisdictions and further directs that the powers exerciseable by the Union Territory of Jammu and Kashmir under Section 8 of the Unlawful Activities (Prevention) Act , 1967 ( 37 of 1967 ) shall be exercised by the Divisional Commissioner ( s ) , Kashmir/Jammu , within their respective territorial jurisdictions .

the Police Station, Anantnag , and the investigation , of the case was set into motion . Subsequently, during the investigation , the offence under Section 120 - B RPC was dropped and the offences under Sections 18 , 20, 38 and 39 of ULA(P) Act were added in the case ; and

3. Whereas , during the course of the investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , nine persons identified as Arshid Ahmad Mir S/ o Ab . Rehman Mir R/ o Brakpora , Anantnag , Khursheed Ahmad Wani S/ o Ab . Ahad Wani R/ o Hallan , Verinag , Anantnag, Mohd Younis Makroo S / o Gh . Nabi Makroo , Mudasir Ahmad Makroo S / o Nazir Ahmad Makroo R's / o Arwani , Bijbehara , Umar Gull Khan S / o Gull Mohd Khan R /o Baba Mohalla , Bijbehara , Sahir Ahmad Makroo S/ o Mohd Akber Makroo , Showket Ahmad Lohar S/ o Ab . Rehman Lohar , Nasir Gulzar Chadoo S / o Gulzar Ahmad Chadoo and Idress Ahmad Bhat S / o Mohd Ramzan Bhat R's / o Arwani , Bijbehara , Were found involved in the commission of crime. Subsequently, the accused were arrested and during the investigation, 08 Posters of HM banned outfit were recovered at the instances of accused viz . Arshid Ahmad Mir and Khursheed Ahmad Wani , respectively ; and

5. Whereas , during the investigation , it was found that the accused viz . Arshid Ahmed Mir , Khursheed Ahmad Wani , Mohd Younis Makroo , Mudasir Ahmad Makroo , Umar Gull Khan , Sahir Ahmad Makroo , Showket Ahmad Lohar , Nasir Gulzar Chadoo and Idress Ahmad Bhat , were in contact with the terrorists of HM banned outfit namely, Mushtaq Ahmad Haroo S/ o Mohd Amin Haroo R/ o Pushpora , Anantnag and Mohd Abass Sheikh S/ o Gh . Hassan Sheikh R/ o Rampora , Qaimoh , Kulgam, who provided the recovered posters to them in order to promote terrorist and unlawful activities in the area ; and

6. Whereas , the accused viz . Sahir Ahmad Makroo , Showket Ahmad Lohar , Nasir Gulzar Chadoo and Idress Ahmad Bhat , after their release from the instant case also joined the terrorist ranks of HM a banned outfit ; and

7. Whereas , during the investigation , it was established that the accused viz . Arshid Ahmad Mir , Khursheed Ahmad Wani , Mohd Younis Makroo , Mudasir Ahmad Makroo and Umar Gull Khan , were working as Over ground Workers ( OGWs ) for the terrorists of HM banned outfit 3

particularly the terrorist viz . Sahir Ahmad Makroo , Showkaet Ahmad Lohar , Nasir Gulzar Chadoo , Idress Ahmad Bhat , Mushtaq Ahmad Haroo and Mohd Abass Sheikh , and under a well knit criminal conspiracy were providing logistic support to them for carrying out unlawful and terrorist activities in the area ; and

8. Whereas , the accused terrorist viz . Sahir Ahmad Makroo, Showket Ahmad Lohar , Nasir Gulzar Chadoo , Idress Ahmad Bhat , Mushtaq Ahmad Haroo and Mohd Abass Sheikh, have been killed in different encounters with the Security Forces and the proceedings under the law would abate against them ; and

Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected, the Investigating Officer , has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their names :-
