Circular No. 28 - JK ( GAD ) of 2024

Dated 26-11-2024 .

In order to enhance the efficiency of processing and responding to RTI applications , the National Informatics Centre (NIC) , Jammu and Kashmir , has developed an online platform , the RTI Portal , accessible on https://rtionline.gov.in. This platform will maintain a comprehensive database ofall RTI applications received by the Central Public Information Officers (CPIOs) and the appeals received by the First Appellate Authorities ( FAAs ) across various departments .Additionally, it will facilitate the swift processing of applications by the concerned CPIOs and FAAs .

The RTI Portal aims to provide citizens with the convenience of submitting RTI requests , checking their status , and receiving responses electronically, without the need to visit government offices in person . This digital shift will make the entire RTI process more streamlined , transparent , and user -friendly . The initiative will contribute to greater transparency, accountability , and effective governance within the Union Territory of Jammu and Kashmir. The authorities have set a target for the portal to become fully operational by 10th December, 2024 .

For the smooth functioning of the RTI Online portal, the Nodal Officers at Administrative Department level have been nominated by all the No. 39 ] The J & K Official Gazette , 26th Dec. , 2024/5th Pausa . , 1946. 415

Departments who shall oversee the process of onboarding all the CPIOs/ FAAs on the portal . Accounts of these Nodal Officers have been created by the General Administration Department and have been provided with the login credentials of the Nodal Officer of the concerned Department . The Nodal Officers nominated at Administrative Department level in respect of the RTI portal , have been imparted the requisite training for further onboarding the CPIOS /FAAs .

In the case of the Departments having huge strength of CPIOs/ FAAS , the Departments are nominating Nodal Officers at Directorate level as well and their accounts are also being created by the General Administration Department on the portal on the basis of the information being shared by their respective Departments and simultaneously, being provided with the login credentials .

Further , a Nodal Officer at District level may also be nominated in all the Deputy Commissioner Offices , for overseeing the smooth operationalisation of the portal in all the Districts , and the information of the Nodal Officer for RTI portal at District level be shared with the General Administration Department on the email [email protected] in the

following format by today evening positively :

As such , for effective implementation of the portal , the following instructions are issued to all the Nodal Officers for compliance :-

i. All Nodal Officers shall on - board their respective Central Public Information Officers ( CPIOs ) and First Appellate Authorities (FAAs) on the RTI Online Portal , by or before 29th November, 2024 positively, using the login credentials being provided to them by the General Administration Department .

ii . Nodal Officers shall ensure provisioning of the user ID credentials to all the CPIOs / FAAs , after onboarding them on the RTI portal .

iii. Nodal Officers shall also furnish the information with respect to the number of CPIOs in their respective Departments and HoD Offices and particulars thereof ( Administrative Department , [No. 39

SO- 592.- Whereas , on 09-06-2023 , the Police Station, Trehgam , received a docket to the effect that a reliable information was received about the movement of some terrorist associates in Danam Dori , Awoora area . a suspect while seeing the Naka Party tried to escape but was chased down on the spot and identified as Nisar Ahmad Khan S/ o Wali Mohd Khan @ Hathi Bai R/ o Halmathpora , Kupwara. During his personal search , the Police recovered 01 Pistol with Magazine and 07 Rounds from his possession ; and

2. Whereas , based on the above , a Case FIR No. 33/2023 under Section 7/25 Arms Act and the Sections 13 , 23 and 39 of ULA (P) Act, was registered in the Police Station , Trehgam, and the investigation , of the case was set into motion ; and

3. Whereas , during the investigation, the site plan of place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , it was found that the accused viz . Nisar Ahmad Khan , was working for the terrorists and procured the recovered arms / ammunition from his father viz . Wali Mohd Khan @Hathi Bai , who remained affiliated with Jamait - ul - Mujahadin , a banned outfit , and later on surrendered before the Security Forces and in the year 2021 , he died due to illness ; and

5. Whereas , during the investigation , it was established that the accused viz . Nisar Ahmad Khan, was working as Over Ground Worker (OGW) for the terrorists of LeT , a banned outfit , and procured arms/ ammunition from his father for carrying out the terrorist activities in the area ; and

6. Whereas , on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer , has established prima facie involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of Unlawful Activities ( Prevention) Act , 1967 , as shown against his name :-

SO- 593 .--Whereas , on 31-05-2023 , the Police Station, Kreeri , received a docket to the effect that a reliable information was received about the movement of some unknown terrorists in the area . Subsequently, a Joint Naka was established by the Police/ Security Forces at Frastihar , Waripora , crossing and during the checking two suspects while seeing the Naka Party tried to escape but were chased down on the spot and identified as Suhail Gulzar S/ o Ghulam Mohammad Sheikh R/ o Frastihar, Kreeri and Waseem Ahmad Parra S/ o Ghulam Qadir Parra 2 The J& K Official Gazette , 21st Nov. , 2023 /30th Kart . , 1945. R/ o Hadipora , Rafiabad . During their personal search , the Police recovered 02 Pistols , 02 Magazines and 15 Rounds from their possession respectively ; and

2. Whereas , based on the above , a Case FIR No. 65/2023 under Section 7/25 Arms Act and the Sections 16 , 18 and 39 of ULA ( P) Act, was registered in the Police Station , Kreeri , and the investigation , of the case was set into motion . Subsequently, during the investigation , the offence under Section 16 of ULA (P ) Act was dropped and the offences under Sections 20 , 23 and 38 of ULA ( P) Act were added in the case ; and

3. Whereas , during the investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , it was found that the accused viz Suhail Gulzar and Waseem Ahmad Parra , were in contact with the terrorists of LeT banned outfit namely Umar Lone S/ o Mohammad Akbar Lone R/ o Wussan , Pattan , Abid Bhai , Usman Bhai R's / o Pakistan and Mohammad Yousuf Dar S/ o Abdul Gani Dar R/ o Check -e - Kawoosa , Budgam, who provided arms / ammunition to them in order to promote terrorist activities in the area ; and

5. Whereas , during the investigation, the accused viz . Abid Bhai and Mohammad Yousuf Dar , were not found involved in the commission of crime and accordingly, were dropped from the case and the investigation , in respect of accused viz . Umar Lone and Usman Bhai , shall continue to bring out their role/involvement in the case and the supplementary charge sheet against them would be filed in the court of competent jurisdiction ; and

6. Whereas , during the investigation , it was established that the accused viz . Suhail Gulzar and Waseem Ahmad Parra , were working as Over Ground Workers ( OGWs ) for the terrorist of LeT banned outfit and were providing logistic support to them, besides , under a well knit criminal conspiracy procured arms / ammunition from the terrorists for carrying out the terrorist activities in the area ; and

SO-594 .--Whereas , on 31-05-2023 , the Police Station , Poonch , received a docket to the effect that a Joint Search Operation was . carried out by the Police/ Security Forces in village Karmara, and during the search some unknown terrorists fired indiscriminately upon the Search Party , with their illegal arms/ ammunition , with the intention to 2 The J& K Official Gazette , 23rd Nov. , 2023 /2nd Agra . , 1945. kill them, resulting in injuries to one Army jawan namely Sepoy Jaspreet Singh . The fire was retaliated , triggering an encounter. Later during, the search operation , three terrorist associates identified as Mohd Zabeer S / o Mohd Razaq, Mohammed Rieaz @ Rieaz Ahmed S / o Mohammad Farooq and Mohd Farooq S/ o Mohd Rafiq R's / o Karmara , Tehsil Haveli , District Poonch , were arrested on the spot and during their personal search , the Police recovered 01 AK- 56 rifle , 01 magazine , 10 rounds , 02 Pistols , 04 magazines , 70 rounds , 06 Chinese grenades , 01 IED and 20 packets of contraband from their possession respectively and one accused identified as Mohd Iqbal S / o Slam Din R/ o Karmara , Haveli , Poonch , managed his escape from the spot ; and

2. Whereas , based on the above , a Case FIR No. 69/2023 under Sections 307 , 120 - B , 121 , 122 IPC , 7/25 , 26, 27 Arms Act , 4/5 ESA, 8/21 , 22 , 29 NDPS Act , and the Sections 16 , 18 , 23 and 39 of ULA (P) Act , was registered in the Police Station, Poonch, and the investigation, of the case was set into motion. Subsequently, during the investigation , the offences under Sections 34, 201 IPC , 23 NDPS and the Section 38 of ULA (P) Act were added in the case ; and

3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation, the accused viz . Mohd Iqbal , was also arrested in the case and it was found that one Liaqat Hussain S/ o Mohd Sadiq R/ o Karmara , Haveli, Poonch , was in contact with Mohd Arshad S/ o Mohd Rashid R/ o Digwar Terwan, Tehsil Haveli , District Poonch A/ P Saudi Arabia and an unknown Pakistani based terrorist and on their directions , the accused viz Liaqat Hussain , motivated the accused viz Mohd Zabeer Mohammed Rieaz @ Rieaz Ahmed, Mohd Farooq and Mohd Iqbal , through other person namely Mohd Javed @ Javed Iqbal S/ o Mohd Ismail R/ o Karmara, Haveli , Poonch, to procure the consignment of arms / ammunition , explosive material and contraband from across the border in order to promote terrorist activities in the area . Subsequently , during the investigation, the accused viz Liaqat Hussain and Mohd Javed @ Javed Iqbal , were also arrested in the case and No. 34 - a] The J & K Official Gazette , 23rd Nov. , 2023 /2nd Agra. , 1945. 3

Whereas , during the investigation , it was found that on the date of occurrence , the accused viz Mohd Zabeer Mohammed Rieaz @ Rieaz Ahmed, Mohd Farooq and Mohd Iqbal , on the directions of accused viz Mohd Arshad, crossed the fence at village Karmara , and procured arms / ammunition , explosive material and some contraband ( Heroin) from two unknown Pakistan based terrorists and on their way three accused viz . Mohd Zabeer Mohammed Rieaz @ Rieaz Ahmed and Mohd Farooq , were arrested by the Police/Security Forces alongwith the said Arms/ ammunition and the other accused viz . Mohd Iqbal , managed his escape from the spot ; and

6. Whereas , during the investigation , one more accused namely Mohd Liaqat @ Billa S/ o Mohd Hussain R/ o Karmara , Haveli , Poonch , was found involved in the case , who is absconding and is evading his arrest ; and

7. Whereas , during the investigation , it was established that the accused viz Mohd Arshad , is working for Pakistan based unknown terrorists and the other accused viz Mohd Zabeer Mohammed Rieaz @Rieaz Ahmed, Mohd Farooq , Mohd Iqbal , Liaqat Hussain , Mohd Javed @ Javed Iqbal , and Mohd Liaqat @ Billa , were working as Over Ground Workers ( OGWs ) for the terrorists and under a well knit criminal conspiracy were providing logistic support to them for waging war against the Government of India , besides , the accused viz Mohd Zabeer Mohammed Rieaz @ Rieaz Ahmed , Mohd Farooq and Mohd Iqbal , on the directions of accused viz Mohd Arshad , procured arms / ammunition , explosive material and contraband (Heroin) from two unknown Pakistan based terrorists for carrying out the terrorist activities in the area; and

8. Whereas , the investigation, in respect of other accused and two unknown Pakistan based terrorist who handed over the arms / ammunition , explosive material and contraband to the accused viz Mohd Zabeer Mohammed Rieaz @ Rieaz Ahmed, Mohd Farooq and Mohd Iqbal , shall continue to ascertain their actual identity and to bring out their role/ involvement in the case and the supplementary charge sheet against them would be filed in the Court of competent jurisdiction ; and

SO - 596 .-- Whereas , vide SRO 297 dated loth of August , 2007 , Ld . Additional District and Sessions Judge , Jammu , was appointed as 2 The J& K Official Gazette , 30th Nov. , 2023/9th Agra. , 1945. [ No. 35 - a

arbitrator for making the award for payment of compensation in respect of land measuring 374 Kanals and 05 Marlas , situated at Village Deeli , Tehsil and District Jammu ; and

Whereas , the Arbitration proceedings were not completed within the stipulated period and on the request of the Arbitrator, the time to complete the proceedings was extended from time to time, the previous extension having been granted vide S.O - 343 dated 7th of October , 2021 , in terms of which the time for making the award was extended by a further period of four months w.e.f.07-10-2021 ; and

Whereas , the Arbitrator in terms of his communication No.339/ ADJ - J dated 05.02.2022 , while informing , inter - alia , that due to Covid- 19 for long time and heavy work load in the Court , the award could not be passed within the stipulated time , sought extension in time by a period of four months for giving his findings ; and

Whereas , a writ petition WP( C ) No. 2447/2022 titled Ranjeet Singh and others vs. UT of J & K and Others was filed in the Hon'ble High Court of J & K and Ladakh at Jammu , praying therein for a direction upon the State to take a decision on the communication ibid of the Arbitrator for extension in time to complete the arbitration proceedings ; and

Whereas , the Hon'ble High Court vide its order dated 16-11-2022 disposed of the writ petition, inter - alia , with the direction to the respondent No - 1 therein to decide the application dated 05.02.2022 preferred by the Ld . Additional District and Sessions Judge , Jammu for seeking extension of time of four months for concluding the arbitration proceedings , within two weeks positively ; and

Whereas , upon examination of the matter , in consultation with the District Magistrate , Jammu , it was found that the arbitration proceedings are at the stage of final arguments and it would be appropriate to accept the recommendation of the Arbitrator. Accordingly, it was decided that another extension of (04) months be granted to the arbitrator so that the matter is concluded by the arbitrator within the extended period .

Now, therefore , in exercise ofthe powers conferred under sub- rule ( l ) of Rule 10 of the Jammu and Kashmir Requisitioning and Acquisition of Immovable Property Rules , 1969 , the Government hereby direct that the time for making the award shall and shall always be No. 35 - a] The J & K Official Gazette , 30th Nov. , 2023/9th Agra. , 1945. 3

deemed to have been extended by a further period of four months w.c.f the date of issuance of this notification .

SO - 597.- In exercise of the powers conferred by section 6 of the Anand Marriage Act , 1909 (Central Act 7 of 1909 ) read with Government of India , Ministry of Home Affairs Notification S.O. 1467 (E ) dated 19th April , 2016 , the Lieutenant Governor of the Union Territory of Jammu and 2 The J& K Official Gazette , 30th Nov. , 2023/ 9th Agra . , 1945. [No. 35 - b

Kashmir is hereby pleased to make the following Rules for the purposes of Registration of Anand Marriages in the Union Territory of Jammu and Kashmir , namely :-

1. Short title and commencement .- ( 1 ) These rules may be called the Jammu and Kashmir Anand Marriage Registration Rules , 2023 .

(2) These rules shall come into force from the date of its publication in the Official Gazette .

2. Definitions .-( 1 ) In these rules , unless the context otherwise requires ,-

(a) " Act " means the Anand Marriage Act , 1909 (Central Act 7 of1909) ;

(b) " Anand Marriage " means a Sikh Marriage commonly known as "Anand Karaj " solemnized by " Anand " under the provisions of the Act ;

( c ) " Chief Registrar of Marriages " means the Secretary to Government , Department of Law, Justice and Parliamentary Affairs ;

(d) " District Registrar " means the Deputy Commissioner of the concerned district ;

( e) " Foreign National " means any person who is not Indian Citizen and shall include Persons of India Origin ( PIO ) and Overseas Citizens of India ( OCI ) ;

( f) " Form " means the form appended to these Rules ;

(g) " Government " means the Government of Union Territory of Jammu and Kashmir ;

(h) " Non - resident Indian (NRI ) " means a person of Indian origin, who is either permanently or temporarily settled outside India for any of the following purposes :-

(i) for or on taking up employment outside India ; or

(ii) for carrying on a business or vocation outside India ; or

(iii) for any other purpose as would indicate his / her intention in such circumstances to stay outside the territorial limits No. 35 - b ] The J & K Official Gazette , 30th Nov. , 2023 /9th Agra . , 1945. 3

of India for an uncertain or determined period for fulfilling or completing such purpose :-

(i) " Parties " to the marriage mean both Bride and Groom .

(j ) " Register " means a register of Anand Marriages maintained by the Registrar of Marriages ;

(k) " Registrar of Marriages " means a Tehsildar within the respective territorial jurisdiction ; and

(1 ) " Relations " means the family members of the Bridegroom and the Bride apart from their parents , namely :-

( i) paternal and maternal grandfather /grandmother ;

(ii) uncle and Aunt ;

brother ;

(iii)

( iv) sister ; and

(v) cousin.

(2) The words and expressions used in these rules , but not defined , shall have the meanings as assigned to them in the Act .

3. Authorization of Registrar. For the purpose of registration of Anand Marriage solemnized within the Union Territory of Jammu and Kashmir , the Tehsildars concerned shall be the Registrar of Anand Marriages within their respective territorial jurisdiction.

4. Jurisdiction . The Anand Marriage shall be registered with the Registrar within whose jurisdiction such marriage is solemnized .

5. Presentation of memorandum for Registration of Marriage.- ( 1 ) The parties to an Anand Marriage or any of their parents or relations , as the case may be , shall present the memorandum in Form - I before the Registrar of Marriages concerned , for registration of marriage within a period of three months from the date of such marriage.

(2) If one of the parties to the marriage is non - resident Indian, in that case , they shall attach all necessary information as specified in the Form II , along with the memorandum of marriage in Form - I .

(3) The memorandum shall be accompanied with a fee of rupees one thousand and five hundred in the form of court fee stamps .

(4) The Registrar of Marriages , after satisfying himself as per provisions of Rule 7 shall register the marriage within a period of one month from the date of receipt of the memorandum for the purpose .

6. Memorandum submitted after the stipulated period.-( 1 ) In case the parties to an Anand Marriage or any of their parents or relations , as the case may be , submit memorandum for registration of marriage to the Registrar of Marriage concerned :-

(i) after the expiry of a period of three months but not after a period of six months from the date of solemnization of the marriage , such marriage shall be registered subject to the payment of a late fee of rupees two thousand in addition to the fee , as specified in sub - rule (3 ) of rule 5 ; and

( ii) after the expiry of a period of six months but within a period of one year from the date of solemnization of the marriage , such marriage shall be registered only after obtaining the written permission of the District Registrar concerned subject to payment of a late fee of rupees three thousand in addition to the fee as specified in sub - rule ( 3) of rule 5 ; and

(iii) after a expiry of period of one year or above , from the date of solemnization of the marriage , such marriage shall be registered only after obtaining the written permission of the Chief Registrar of Marriages subject to the payment of a late fee of rupees five thousand in addition to the fee as specified in sub -rule (3 ) of Rule 5 .

(2) The parties referred above in sub - rule ( I ) , shall submit their memorandum along with an affidavit ( duly attested by the Notary or any other officer authorized by the Government ) describing the reasons for its late submission .

7. Verification and Registration of Anand Marriage .-( 1 ) Where on verification and scrutiny of the Memorandum and documents 5

received under sub - rule ( 1) or sub - rule (2) of Rule 5 , the Registrar is satisfied that the marriage has be - m duly solemnized , he shall enter the particulars of the marriage in the register and issue a certificate of Anand Marriage in Form - III .

(2) Where the Registrar has reason to believe that-

(a) the marriage between the party is not an Anand Marriage; or

(b) the identitym of the parties or the witnesses testifying the solemnization of the marriage is not established ; or

he shall , call upon the parties to produce such further information or documents as he may deem necessary, for establishing the identity of the parties and witnesses or correctness of the information or documents presented to him/her within a period of 30 days from the receipt of Memorandum .

8. Refusal of Registration of Anand Marriage. The Registrar shall , for the reasons to be recorded in writing , refuse the registration of Marriage, if the parties to the marriage fail to comply with the directions issued by him under sub - rule (2) of Rule 7 .

9. Issuing of Certificate of Marriage . The Registrar shall provide two copies of certificate of Anand Marriage to the parties , free of costs within 15 days from the date of registration of marriage .

10. Correction or cancellation of entry in the Marriage Register. If the Registrar , either suo moto or on receipt of an application from any person , finds that any entry in the Register of Marriages is erroneous in form or substance or has been fraudulently or improperly made , he may correct or cancel , as the case may be , such entry 6 The J& K Official Gazette , 30th Nov. , 2023/ 9th Agra . , 1945. in the register maintained for the purpose , after passing a speaking order in this behalf and make an entry to the effect in the remarks column of such Register :

Provided that the parties concerned shall be given a reasonable opportunity of being heard , before passing of such an order by the Registrar of Marriages , for such correction or cancellation , as the case may be , of entry in the register pertaining to such marriage.

11. Appeal.-( 1 ) Any person aggrieved of an order passed by the Registrar , may file an appeal within a period of thirty days from the date of passing of such order to the District Registrar on payment of fee of rupees one thousand in form of court fee stamps :

Provided that the delay , if any, in filing such appeal may be condoned for the reasons to be recorded in writing by the District Registrar, if the District Registrar is satisfied that the applicant had sufficient cause and reasons for not preferring the appeal with the specified period .

(2) The District Registrar shall , after giving opportunity of hearing to the parties concerned , dispose of the appeal preferably within the period of fifteen days .

(3) Any person aggrieved of an order passed by the District Registrar ofMarriages , may file a second appeal to the Chief Registrar of Marriages within a period of sixty days from the date of receipt of copy of such order on payment of a fee of rupees five hundred in the form of court fee stamps .

12. Submission of report of the marriages registered.-( 1 ) The District Registrar of Marriages shall prepare a report of the marriages solemnized in Union Territory of Jammu and Kashmir , in Form - IV and submit the same to the Chief Registrar of Marriages on quarterly basis .

(2) The Chief Registrar of Marriages , shall issue directions to the District Registrar and the Registrar of Marriages regarding maintenance of records / registers , from time to time , as he deems fit .

(3) The Chief Registrar of Marriages may direct the District Registrar to periodically inspect the records or the Registrar of Marriages , Union Territory of Jammu and Kashmir .

(4) The Registrar of Marriages shall also forward particulars of the corrections made under Rule 10 with the date of correction and a copy thereof to the District Registrar .

13. Maintenance of Register of Marriages . Every Registrar of Marriages shall maintain an Anand Marriage Register in Form - IV in English language.

SO- 598.- Whereas , on 27-07-2023 , a reliable information was received by the Police Station , CI , Kashmir to the effect that prescribed terrorist organization ( s ) operating within the J & K and across the LoC on the behest of Pakistan agencies / ISI , under a well knit criminal conspiracy hatched with their OGWs / supporters / sympathizers in Kashmir valley are continuously in the process of creating new terror modules ( gangs ) , in 2 The J & K Official Gazette , 30th Nov. , 2023 / 9th Agra . , 1945. the valley by uploading criminal and malicious content laced with terrorist secessionist tinge on the social media , in order to motivate and radicalize the youth ( s ) of Kashmir to join the terrorist ranks , besides , promoting feelings of enmity and disharmony among different religious and regional groups and inciting youth to indulge in large sacale violence , disturbance , thereby causing disaffection and hatred among the public against the Union of India by active support of secessionists and terrorists sitting in Pakistan with the intention to flourish terrorism within the valley , disrupt the sovereignity and integrity of India and to wage war against the Government of India ; and

2. Whereas , based on the above , a case FIR No. 06/2023 under Sections 153 - A, 505 , 121 , 120B IPC and Sections 13 and 39 of ULA ( P ) Act , was registered in the Police Station , CI , Kashmir , and the investigation of the case was set into motion . Subsequently , during the investigation , the offences under Sections 153 - A , 505 and 121 IPC , were dropped and Section 38 of ULA ( P ) Act was added in the case ; and

3. Whereas , during the course of investigation the seizure memos were prepared and the statements of the witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , five persons identified as Junaid - ul - Islam S / o Ghulam Nabi Dar R/ o Sail , Awantipora , Pulwama , Sheikh Najmu Saqib S / o Mohammad Ramzan Sheikh R/ o Ganstan , Sumbal , Bandipora , Waseem Ferooz Sheikh S / o Ferooz Ahmad Sheikh R/ o Karimabad, Pulwama , Saqib Maqbool S/ o Mohammad Maqbool Kumar R/ o Dachipora , Shopian and Moomin Yousyuf Sheikh S / o Mohammad Yousuf Sheikh R/ o Dangerpora , Shahzadpora , Baghat , Kanipora , Srinagar , were found involved in the commission of crime. Subsequently , during the investigation , the accused were arrested in the case and some incriminatory material was recovered at their instances respectively ; and

5. Whereas , during the investigation , it was found that the accused viz . junaid - ul - Islam , Sheikh Najmu Saqib , Waseem feeroz Sheikh , Saqib Maqbool and Moomin Yousuf Sheikh , were in contact with a Pakistan based handler of JeM banned outfit namely Abdul Rehman @ Riyaz @ Umar @ Jigar @ Ashfaq @ Luqman Ali S / o Mohammad Bashir R/ o 3 No. 35 - c] The J & K Official Gazette , 30th Nov. , 2023/ 9th Agra. , 1945 .

Village Momin Zafarwal , Narowal , Pakistan , and were working for the outfit in order to promote terrorist activities in the valley ; and

6. Whereas , during the investigation it was established that the accused viz . Junaid - ul - Islam, Sheikh Najmu Saqib , Waseem Feeroz Sheikh , Saqib Maqbool and Moomin Yousuf Sheikh , were working as Over Ground Worker ( OGW) for the terrorists of JeM banned outfit particularly the Pakistan based handler viz . Abdul Rehman @ Riyaz @ Umar @ Jigar @ Ashfaq @ Luqman Ali , and were providing logistic support to him , besides , were faciliting the terrorists for transportation of arms / ammunition from one place to another for carrying out the terrorist activities in the valley ; and

7. Whereas , the investigation of the case shall continue to bring out the role/ involvement of the other accused and the supplementary charge sheet against them would be filed in the Court of competent jurisdiction ; and

8. Whereas , on the basis of the investigation , the statement of the witnesses recorded and other evidence collected , the Investigating Officer , has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Actvities ( Prevention ) Act , 1967 , as shown against their names :

10. Whereas , the accused terrorist viz . Abdul Rehman @ Riyaz @ Umar @ Jigar @ Ashfaq @ Luqman Ali is absconding and the proceedings under Section 299 Cr.PC have been proposed to be initiated against him ; and

11. Whereas , the Authority , appointed by the Government under Sub - Section ( 2) of Section 45 of the Unlawful Activities ( Prevention) Act , 1967 , has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accussed ; and

12. Whereas , after perusing the Case Dairy File , the relevant documents and also taking into consideration the views of the Authority appointed under Sub - Section ( 2 ) of Section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the above mentioned accused for their prosecution under the provisions of law .

SO- 599.- Whereas , on 09-07-2023 , a reliable information was received by the Police Station , Kothibagh , to the effect that one Mohammad Yaseen Bhat S/ o Ghulam Mohammad Bhat R/ o Naseembagh , Srinagar has organized a meeting in Habib Restaurant , situated at Residency Road , Srinagar , and invited many ex - members of JKLF (Y) , a banned unlawful association, in order to revive the 2 The J & K Official Gazette , 30th Nov. , 2023 / 9th Agra. , 1945. JKLF ( Y) , besides , conspiring to wage war against the Government of India , thereby challenged the sovereignity and integrity of the Union ofIndia ; and

2. Whereas , based on the above , a case FIR No. 23/2023 under Section121 - A IPC and Sections 10 and 13 of ULA ( P) Act , was registered in the Police Station , Kothibagh , and the investigation of the case was set into motion . Subsequently , during the investigation, the offence under Section 201 IPC and Section 18 of ULA ( P ) Act were added in the case ; and

3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of the witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , the accused viz . Mohammad Yaseen Bhat , was arrested in the case and nine other persons identified as Mohd Rafiq Phaloo @ Salim Nanaji S/ o Gh . Hassan R/ o Basantbagh , Gowkadal A/P Natipora , Srinagar , Syed Rehman Shamas @ Shamas - ud- Din Rehmani S / o Shamas Amir - ud - Din R/ o Village Goti Uttar , Dinajpur , West Bengal A/ P Lal Bazar , Srinagar , Jahangir Ahmad Bhat S / o Ab . Gani R/ o Batangoo , Sopore , Khursheed Ahmad Bhat S / o Gh . Mohammad R/ o Braripora , Nowakadal A/P Iqbal Colony , Rawalpora , Shabir Ahmad S / o Gh . Nabi R/ o Batpora , Sopore A/P Badambagh , Sopore , Sajad Hussain Gul S / o Ab . Subsequently , the accused were arrested in the case ; and

5. Whereas , during the investigation , it was found that the accused viz . Yaseen Bhat , Mohd Rafiq Phaloo @ Salim Nanaji , Syed Rehman Shamas @ Shamas - ud - Din Rehmani , Jahangir Ahmad Bhat , Khursheed Ahmad Bhat , Shabir Ahmad, Sajad Hussain Gul , Firdous Ahmad Shah , Gh. Hassan Parray @ Firdousi and Saheel @ Suhail Ahmad Mir , were in contact with two persons namely Farooq Siddiqui @ Papa @ Dada S / o Habibullah R/ o New Colony , Nigeen , Hazratbal A/P Canada and No. 35 - d ] The J & K Official Gazette , 30th Nov. , 2023 / 9th Agra . , 1945. 3

Khursheed Ahmad Mir S / o Late Mohd Akram Mir R/ o Ward - 6 , Bandipora A/ P POK , through virtual mode in order to promote unlawful activities in the valley ; and

6. Whereas , during the investigation , it was established that the accused viz . Yaseen Bhat , Mohd Rafiq Phaloo @ Salim Nanaji , Syed Rehman Shamas @ Shamas - ud - Din Rehmani , Jahangir Ahmad Bhat , Khursheed Ahmad Bhat , Shabir Ahmad , Sajad Hussain Gul , Firdous Ahmad Shah , Gh . Hassan Parray @ Firdousi , Saheel @ Suhail Ahmad Mir , Farooq Siddiqui @ Papa @ Dada and Khursheed Ahmad Mir , were members of JKLF ( Y) , a banned unlawful association , and were carrying out the unlawful activities in the area , besides , were conspiring to wage war against the Government of India ; and

7. Whereas , on the basis of the investigation , the statements of the witnesses recorded and other evidence collected , the Investigating Officer , has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Actvities ( Prevention) Act , 1967 , and Indian Penal Code (IPC ) , as shown against their names :

8. Whereas , the accused viz . Farooq Siddiqui @ Papa @ Dada and Khursheed Ahmad Mir , are absconding and the proceedings under Section 299 Cr.PC have been proposed to be initiated against them ; and

Whereas , the Authority , appointed by the Government under Sub - Section ( 2) of Section 45 of the Unlawful Activities ( Prevention) Act, 1967 , has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accussed ; and 5 No. 35 - d ] The J & K Official Gazette , 30th Nov. , 2023 / 9th Agra . , 1945 .

10. Whereas , after perusing the Case Dairy File , the relevant documents and also taking into consideration the views of the Authority appointed under Sub - Section ( 2 ) of Section 45 of the Unlawful Activities (Prevention ) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the above mentioned asccused for their prosecution under the provisions of law ; and

11. Whereas , the Government has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused and under the aforementioned provision of the Indian Penal Code ( IPC) .

Now, therefore , in exercise of the powers conferred by Sub- Section ( 2) of Section 45 of the Unlawful Activities ( Prevention) Act, 1967 and Section 196 of Code of Criminal Procedure , 1973 , the Government hereby accord sanction for launching prosecution against the accused viz , Mohammad Yaseen Bhat , Mohd Rafiq Phaloo @ Salim Nanaji , Syed Rehman Shamas @ Shamas - ud - Din Rehmani , Jahangir Ahmad Bhat , Khursheed Ahmad Bhat , Shabir Ahmad , Sajad Hussain Gul , Firdous Ahmad Shah , Gh . SO-638.- Whereas , on 10-10-2023 , the Police Station, Barmulla , received a docket to the effect that a reliable information was received about the movement of some unknown terrorists in the area . Subsequently, a Joint Naka was established by the Police/ Security Forces at Uskhara , Baramulla , and during the checking a suspect while seeing the Naka Party tried to escape but was chased down on the spot 2 The J&K Official Gazette , 28th Dec. , 2023 / 7th Pausa , 1945. and identified as Mudasir Ahmad Bhat S/ o Abdul Hamid Bhat of R/ o Ushkara , Baramulla . During his personal search , the Police recovered 02 hand grenades and cash to the tune of Rs . 40,000/ - (Indian currency ) from his possession ; and

2. Whereas , based on the above a Case FIR No. 205/2023 under Sections 7/25 , Arms Act and Sections 13 , 17 , 20 , 23 , 38 and 39 of ULA (P ) Act, was registered in the Police Station , Baramulla , and the investigation of the case was set into motion. Subsequently, during the investigation, the offence under Section 18 of ULA ( P ) Act was added in the case ; and

3. Whereas , during the course of investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquanited with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , it was found that the accused viz . Mudasir Ahmad Bhat , was in contact with a terrorist of LeT , a banned outfit , namely Umar Lone S/ o Mohd Akbar Lone R/ o Wussan , Pattan , Baramulla, who provided the recovered hand grenades and cash to the tune of Rs . 40,000/- to the accused in order to pomote terrorist activities in the area ; and

5. Whereas , during the investigation, it was established that the accused viz . Mudasir Ahmad Bhat , was working as Over Ground Worker ( OGW) for the terrorists of LeT, a banned outfit, particularly Umar Lone , and was providing logistic support to him , besides , under a well knit criminal conspiracy procured band grenades and cash to the tune of Rs . 40,000/ - ( Indian currency) from the said terrorist for carrying out the unlawful activities in the area ; and

6. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected, the Investigating Officer , has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their names :-

Whereas , based on the above a Case FIR No. 103/2023 under Section 3/4 ESA and Sections 18 and 23 of ULA ( P) Act , was registered in the Police Station , Bandipora , and the investigation , of the case was set into motion . Subsequently, during the investigation, the offence under Section 18 of ULA( P ) Act , was dropped and the Section 39 of ULA ( P ) Act was added added in the case ; and

4. Whereas , during the investigation , it was found that the accused

viz . Javid Ahmad Malla , was in contact with an unknown person who

provided the recovered Hand Grenades to him in order to promote

terrorist activities in the area ; and

5. Whereas , the investigation, in respect of unknown person shall continue to ascertain his actual identification and to bring out his role/ involvement in the case and the Supplementary charge sheet against him would be filed in the court of competent jurisdiction ; and

6. Whereas , during the investigation , it was established that the accused viz . Javid Ahmad Malla , was working as Over Ground Worker (OGW) for the terrorists of LeT , a banned outfit , and was providing logistic support to them, besides , procured Hand Grenades from an unknown person for carrying out the terrorist activities in the area ; and

Whereas , after perusing the Case Diary File , the relevant documents and also taking into consideration the views of the Authority appointed under Sub - Section (2) of Section 45 of the Unlawful Activities (Prevention) Act , 1967 , the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for their prosecution under the provisions of law .

Now, therefore , in exercise of the powers conferred by Sub- Section ( 2) of Section 45 of the Unlawful Activities ( Prevention ) Act , 1967 , the Government hereby accord sanction for launching prosecution against the accused viz . Javid Ahmad Malla , for the commission of offences punishable under Sections 23 , and 39 of ULA ( P) Act , arising out of FIR No. 103/2023 of Police Station , Bandipora .

SO- 640.-Whereas , on 09-08-2023 , the Police Station , Khansahib , received a docket to the effect that during the Joint Patroling conducted by Police / Security Forces at Kremshora/ Wager area , three suspects , while seeing the Police/ Security Forces near PHC , Kremshora , tried to escape but were chased down on the spot and identified as Mohd Qaisar Dar S / o Gh . Rashid Ganie S/ o Ab . Rashid Ganie residents of Wager , Khansahib . During their personal search , the Police recovered 01 hand grenade , 02 AK magazines and 56 rounds were recovered from their possession respectively ; and

2. Whereas , based on the above a Case FIR No. 105/2023 U/ S 7/25 Arms Act and Sections 18 , 23 and 39 of ULA( P) Act , was registered in the Police Station , Khansahib , and the investigation , of the case was set into motion ; and

4. Whereas , during the investigation, it was found that the accused viz . Mohd Qaisar Dar , Tahir Ahmad Dar and Auqib Rashid Ganie , were instigated/ motivated by one person namely Saqib Bashir Lone S / o Bashir Ahmad Lone R/ o Wager , Khansahib , to work for the terrorists of LeT, a banned outfit , in order to promote terrorist activities in the area. The accused viz . Saqib Bashir Lone , was already arrested by Budgam Police in Case FIR No. 17/2020 of Police Station , Khansahib

: and 5. Whereas , the investigation, in respect of accused viz . Saqib Bashir Lone , shall continue to bring out his role/ involvement in the case and the supplementary chargesheet against him would be filed in the Court of competent jurisdiction ; and

6. Whereas , during the investigation , it was established that the accused viz . Mohd Qaisar Dar , Tahir Ahmad Dar and Auqib Rashid Ganie , were working as Over Ground Workers ( OGWs ) for the terrorists of LeT , a banned outfit , and were providing logistic support to them besides , under a well knit criminal conspiracy were facilitating the terrorists for transportation of their arms/ ammunition from one place to another for carrying out the terrorist activities in the area ; and

7. Whereas , on the basis of the investigation , the statements of witnesses recorded and other evidence collected, the Investigating Officer , has established prima facie involvement of the below mentioned accused for the commission of offences punishable under sections of the Unlawful Activities ( Prevention) Act , 1967 , as shown against their names :-

SO- 641.-Whereas , on 07-02-2023 , the Police Station , Nowgam , received a docket to the effect that a Naka was established at Lasjan Crossing , NHW . During the checking , three suspects while seeing the Naka Party tried to escape but were chased down on the spot and identified as Umar Adil Dar S / o Ghulam Hassan Dar R/ o Soiteng , Lasjan, Srinagar , Bilal Ahmad Sidiqui S/ o Ghulam Ahmad Sidiqui 2 The J& K Official Gazette , 28th Dec. , 2023/ 7th Pausa, 1945. R/o Kursoo , Rajbagh , Srinagar and Salik Mehraj S/ o Mehraj - ud- Din Dar R / o Soiteng , Lasjan , Srinagar. During their personal search, some letter heads of LeT , a banned outfit , as well as cash of more than 31 lacs were recovered which they could not account for ; and

2. Whereas , based on the above a Case FIR No. 20/2023 under Sections 120 - B , 121 , 121 - A IPC and the Sections 13 , 18 , 39 and 40 of ULA ( P ) Act , was registered in the Police Station , Nowgam , and the investigation , of the case was set into motion. Subsequently, during the investigation , the offence 489 IPC was added in the case ; and

3. Whereas , during the investigation , the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas , during the investigation , the accused viz . Umar Adil Dar , was found in contact with a Pakistani based handler of LeT , a banned outfit , namely Aijaz Rehmani , and on his directions procured an amount of Rs . 25 lakhs and some incriminatory material from an unknown person at Khudwani , Kulgam , and distributed the same among the accused viz . Bilal Ahmad Sidiqi and two ladies namely Mst . Zamrooda Habib D/ o Habibullah Bhat R / o Sanatnagar, Srinagar and Mst . Yasmeen Raja D/ o Gh. Nabi Bhat R/ o Tull Bagh , Pampore , on the directions of the Pakistani handler. Subsequently, during the investigation , the accused ladies viz . Zamrooda Habib and Mst . Yasmeen Raja , were arrested in the case ; and

5. Whereas , during the investigation , it was found that the accused viz . Umar Adil Dar , alongwith his associate namely Salik Mehraj , on the directions of Pakistani handler viz . Aijaz Rehmani also procured an amount of Rs . 31,65,200/ - on different occasions from Khudwani , Kulgam, area in order to promote terrorist activities in Srinagar District which was recovered from his possession ; and

6. Whereas , during the investigation , it was established that the accused viz . Umar Adil Dar, Bilal Ahmad Sidiqui and Salik Mehraj , were working as Over Ground Workers ( OGWs ) for the terrorists of LeT, a banned outfit , particularly the Pakistani handler namely Aijaz Rehmani , and under a well knit criminal conspiracy were providing logistic support to him, besides were raising funds for the terrorists for carrying out the terrorist activities and to wage war against the Government of India , whileas the accused ladies viz . 7. Whereas , the sanction has already been accorded in respect of accused viz . Umar Adil Dar , Bilal Ahmad Sidiqui , Salik Mehraj , Mst . Zamrooda and Mst . Yasmeen Raja , vide Notification S.O. No. 401 dated 27th July , 2023 , by the Competent Authority and the investigation , of the case was continued with respect to the other accused ; and

8. Whereas , during the futher investigation , one Muzamil Zahoor Malik S / o Zahoor Ahmad Malik R/ o Andergam, Pattan , was found involved in the commission of crime . Subsequently, the accused was arrested in the case and during the investigation 12 Letter Heads of LeT, a banned outfit , were recovered at his instance ; and

9. Whereas , during the investigation , it was found that the accused viz . Umar Adil Dar , transferred an amount of Rs . 05 lacs in the account of accused viz . Muzamil Zahoor Malik, and the said account was found operated/maintained by the accused viz . Muzamil Zahoor Malik , in Punjab National Bank , Branch , Sopore , on a fake name of Sheikh Anamul Haq S / o Mohammad Ashraf Sheikh R/ o Indergam, Pattan ; and

10. Whereas , during the investigation , it was established that the accused viz . Muzamil Zahoor Malik, was working as Over Ground Worker ( OGW) for the terrorists of LeT a banned outfit , and under a well knit criminal conspiracy was providing logistic support to them, besides , received an amount of Rs . 5 lacs from the accused viz . Umar Adil Dar, for carrying out the unlawful activities in the area ; and

11. Whereas , on the basis of investigation , statements of witnesses recorded and other evidence collected , the Investigating Officer has established prima facie involvement of below mentioned accused for the commission of offences punishable in terms of the provisions of Unlawful Activities ( Prevention) Act , 1967 , as shown against his name :-
