ORDER

In exercise of the powers conferred by Central Government vide Notification No. S.O.-192(E) dated 19th January, 2017 of the Ministry of Labour and Employment, the undersigned hereby revise the rates of Variable Dearness Allowance on the basis of the average Consumer Price Index for Industrial workers reaching 402.09 from 399.70 as on 30-06-2024 (Base 2016=100) and thereby 424 The J&K Official Gazette, 9th Jan., 2025/19th Pausa, 1946. [No. 41 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––– resulting in an increase of 2.40 points. The revised Variable Dearness Allowance as under shall be payable from 01-10-2024 :—

Rates of VDA. For Employees Employed in loading and unloading in (i) Goods sheds, parcel Offices of Railways, (ii) Other Goods- Sheds, Go-downs, Warehouses and other simillar employments ; (iii) Docks and Ports ; and (iv) Passengers and Goods and Cargo Carried out at Airports (both international and domestic).

Therefore, the minimum rates of wages including the basic rates and Variable Dearness Allowance payable w. e. f. 01-10-2024 to the employees shall be as under :—

The VDA has been rounded off to the next higher rupee as per the

decision of the Minimum Wages Advisory Board.

The present classification of cities into areas A, B & C is enclosed at Annexure-I for ready reference.

Dated 12-02-2024.

It is hereby notified for information of all concerned employees that

submission of property returns for the year 2023 by the defaulting employees 430 The J&K Official Gazette, 9th Jan., 2025/19th Pausa, 1946. [No. 41 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––– shall be allowed through online mode on the Property Return System (PRS

Portal) for a period of 05 days w. e. f. 13-06-2024 to 17-06-2024.

All employees who have registered themselves on the Portal but not

submitted their property returns shall submit the same, besides, unregistered

employees shall get themselves registered on the portal and submit their

property returns during the stipulated period.

In case employees face issues related to OTP, they shall update their

current mobile numbers and email IDs on CPIS portal. Drawing and

Disbursing Officers (DDOs) shall ensure necessary facilitation in this regard.

In case of any other issue/technical support, employees shall forward their

concerns on [email protected] for speedy redressal.

It is further enjoined upon all the Controlling Officers/DDOs of all the

departments to submit the action taken report w.r.t. employees who have

not registered themselves on the PRS Portal/non-submission of Property

Return including their CPIS Numbers, to General Administration

Department, within a week's time after the expiry of the extension period.

A Plan of the land may be inspected in the office of the Collector

on any working day during the working hours. The Government

authorizes Tehsildar Drabshalla and his staff and officials of indenting

department to enter upon and survey the land, take levels of any land,

dig or bore into the sub-soil and do all other acts required for the proper

execution of their work as provided and specified in Section 12 of the

Act.

Further under Sub-Section (4) of Section 11 of this Act, no person

shall make any transaction or cause any transaction of land i.e, sale/

purchase, etc., or create any encumbrances on such land from the date

of publication of this notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person

interested within 60 (Sixty days) from the date of publication of this

notification as provided under Section 15 of the Act before the Collector.

SO-301.—Whereas, on 28-11-2023, a reliable information was received by the Police Station, Qaimoh, to the effect that three suspects identified as Adil Yaseen Malla S/o Mohd Yaseen Malla, Suhaib 2The J&K Official Gazette, 17thMay, 2024/27thVai., 1946.[No.7-g –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– Maqbool Lone S/o Mohd Maqbool Lone and Bilal Ahmad Sheikh S/o Gh. Mohd Sheikh residents of Qaimoh, Kulgam, are working for the terrorists of LeT/TRF banned outfits and procured some explosive material from the terrorists for carrying activities in the area ; and

2. Whereas, based on the above, a case FIR No.76/2023under Sections¾ ESAand the Sections 13, 18and 39 of ULA (P) Act, was registered in the Police Station, Qaimoh, and the investigations of the case was set into motion. Subsequently, during the investigation, the offence under Section 3/4 ESA was dropped and the Section 7/25 Arms Act, 201 IPC and the Sections 20,23 and 38 of ULA (P) Act were added in the case ; and

3. Whereas, during the investigation, theaccused viz. Adil Yaseen Malla, Suhaib Maqbool Lone and Bilal Ahmad Sheikh, were arrested in the case and 02 Hand Grenades and 02 Detonators were recovered at their instances respectively ;and

4. Whereas, during the course of investigation, the site plan of the occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, one more person identified as Mohd Asif Bhat S/o Mohd Rajab Bhat R/o Qaimoh, Kulgam, was found involved in the case. Subsequently, the accused was arrested and during the investigation, 01 Hand Grenade was also recovered at his instances ;

and

6. Whereas, during the investigation, it was found that the accused viz. Adil Yaseen Malla, Suhaib Maqbool Lone, Bilal Ahmad Sheikh and Mohd Asif Bhat, were in contact with a terrorist of LeT/TRF banned outfit namely, Firdous Ahmad Bhat S/o Ab. Salam Bhat R/o Thokerpora, Qaimoh, Kulgam, through virtual mode, who provided the recovered No.7-g]The J&K Official Gazette,17thMay, 2024/27thVai.,1946.3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– Hand Grenades and Detonators to the accused viz. Adil Yaseen Malla, Suhaib Maqbool Lone, Bilal Ahmad Sheikh and Mohd Asif Bhat, in order to promote terrorists activities in the area ; and

7. Whereas,during the investigation,it was established that the accused viz. Adil Yaseen Malla, Suhaib Maqbool Lone, Bilal Ahmad Sheikh and Mohd Asif Bhat, were working as Over Ground Workers (OGWs) for the terrorists of LeT/TRF banned outfit, particularly the terrorist viz. Firdous Ahmad Bhat, and were providing logistic support to him, besides, under a well knit criminal conspiracy procured Hand Grenades/Detonators from the said terrorists for carrying out the terrorist/unlawful activities in the area ; and

8. Whereas, on the basis of investigation, the statement of witnesses recorded and the other evidence collected, the Investigating Officer has established aprima facie involvement of below mentioned accused for the commission of the offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967,as shown against theirnames:—

Whereas, the Authority appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that aprima faciecaseis made out against the above accused ;

and

11. Whereas, after perusing the Case Diary File,the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities(Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for his prosecution under the provisions of law.

Now, therefore,in exercise of the powers conferred bySub-Section (2) of Section 45 of the Unlawful Activities (Prevention)Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Adil Yaseen Malla, Suhaib Maqbool Lone, Bilal Ahmad Sheikh, Mohd Asif Bhat and Firdous Ahmad Bhat, for the commission of offences punishable under the relevant Sections of ULA (P) Act, as indicated against the each accused at Para (8) above, arising out of FIR No. 76/2023 of Police Station, Qaimoh.

SO-304.—Whereas, on 27-11-2023, the Police Station, Kupwara, received a docket to the effect that a reliable information was receivedabout the transportation of arms/ammunition in the area.

Subsequently, a joint Naka was established by the Police/Security Forces at Gushi Bridge, Kupwara. During the checking, the Naka Party 2 The J&K Official Gazette, 21st May, 2024/31st Vai., 1946. [No.7-j –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– intercepted a vehicle (Tavera) and on checking, the Police recovered 01Pistol with Magazine , 08 Rounds and 04 Hand Grenades from the vehicle and arrested driver alongwith his accomplice identified as Nazir Ahmad Dar S/o Ab/ Majid Dar R/o Shah Hamdan Colony, Chanpora, Srinagar and Mst.Shameema Akhter @ Ranjit Kour W/o Buta R/o Srinagar; and

2. Whereas, based on the above, a case FIR No.295/2023under Sections7/25Arms Actand the Sections 13, 23and 39 of ULA (P) Act, was registered in the Police Station, Kupwara, and the investigation of the case was set into motion. Subsequently, during the investigationthe offence under Section 120-B IPC and 20 and 38 of ULA (P) Act were added in the case ; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

4. Whereas, during the investigation, one more person identified as Sajad Ahmad Dar S/o Sonaullah Dar R/o Mithan, Chanpora, Srinagar, was found involved in the commission of crime. Subsequently, the accused was arrested and was found in contact with two terrorists of HM, a bannedoutfit, namely Mushtaq Ahmad Zargar @Mushtaq Latram R/o Maisuma, Srinagar A/P Pok and Altaf Ahmad Bhat S/o Ab. Jabar Bhat R/o Baghi Mehtab, Srinagar A/P Behriya Town, Islamabad, through virtual mode and was working for them in order to promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was found that the accused viz. Sajad Ahmad Dar, sent the accused viz Nazir Ahmad Dar and Mst.

Shameema Akhter @ Ranjit Kour, to Drugmulla, Kupwara, to collect the arms/ammunition and Hand Grenades, which were arranged by the Pakistani based terrorists viz. Mushtaq Ahmad Zargar @ Mushtaq Latram and Altaf Ahmad Bhat; and No.7-j] The J&K Official Gazette,21st May, 2024/31st Vai., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 6. Whereas,during the investigation,it was found that on the date of occurrence the accused viz. Nazir Ahmad Dar and Mst. Shameema Akhter @ Ranjit Kour, on the directions of accused viz. Sajad Ahmad Dar, procuredthe arms/ammunition and Hand Grenades fromDrugmulla, Kupwara, from one Javid Ahmad R/o Kralpora, and on their way were arrested by the Police/SecurityForces along with the said arms/ammunition and Hand Grenades; and

7. Whereas, during the investigation, it was established that the accused viz. Nazir Ahmad Dar, Mst. Shameema Akhter @ Ranjit Kour and Sajad Ahmad Dar, were working as Over Ground Workers (OGWs) for the terrorists of HM, a banned outfit, particularly the Pakistani based terrorists viz. Mushtaq Ahmad Zargar @ Mushtaq Latram and Altaf Ahmad Bhat, and were providing logistic support to them, besides, the accused viz. Nazir Ahmad Dar and Mst. Shameema Akhter @ Ranjit Kour, on the directions of accused viz. Sajad Ahmad Dar, procured arms/ammunition and Hand Grenades from the accused viz. Javid Ahmad, for carrying out the terrorist/ unlawful activities in the area; and

8. Whereas, the investigation , in respect of accused viz. Javid Ahmad, shall continue to ascertain his actual identity and to bring out his role/involvement in the case and the Supplementary Charge-Sheet against him would/be filed in the court of competent jurisdiction ; and

9. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has establishedprima facie involvement of below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, as shown against theirnames:—

SO-307.—Whereas, on 28-11-2023, a reliable information was received by the Police Station Baramulla, about the movement of some unknown terrorists of LeT, a banned outfit, in the area and one person 2The J&K Official Gazette, 22nd May, 2024/1st Jyai., 1946. [No.7-m –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– identified as Nadeem Mohidin Karnie S/o Gh. Mohidin Karnie R/o Khanpora, Baramulla, is working for the terrorists and facilitating their movement from one place to another for carrying out the terrorist activities in thearea ; and

2. Whereas, based on the above, a case FIR No.249/2023under Sections13, 18and 39 of ULA (P) Act, was registered in the Police Station, Baramulla,and the investigation, of the case was set into motion.

Subsequently, during the investigation, the offence under Section 18 of ULA (P) Act was dropped from the case ; and

3. Whereas, during the investigation, the accused viz. Nadeem Mohidin Karnie, was arrested in the case and 20 posters of LeT, a banned outfit, were recovered at his instance. The accused was found in contact with an unknown person who provided the recovered posters to the accused viz. Nadeem Mohidin Karnie, with the directions to paste the same in the area in order to threaten the Panchs/Sarpanchs and Ward Members not to participate in the upcoming elections; and

4. Whereas,during the course of investigation,the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, it was established that the accused viz. Nadeem Mohidin Karnie, was working as Over Ground Worker (OGW) for the terrorists of LeT, a banned outfit, and was providing logistic support to them, besides, procured incriminatory material from an unknown person for carrying out the unlawful activities in the area ; and

6. Whereas, the investigation, in respect of unknown person who provided the posters to the accused viz. Nadeem Mohidin Karnie, shall continue to ascertain his actual identity and to bring out his role/involvement in the case and the Supplementary Charge-sheet against him would be filed in the court of competent jurisdiction; and No.7-m] The J&K Official Gazette, 22nd May, 2024/1st Jyai., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 7. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has establishedprima facie involvement of below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967, as shown against hisname:—

Whereas, the Authority appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima faciecaseis made out against the above accused ;

and

Whereas, after perusing the Case Diary File,the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities(Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for his prosecution under the provisions of law.

Now, therefore,in exercise of the powers conferred bySub-Section (2) of Section 45 of the Unlawful Activities (Prevention)Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Nadeem Mohidin Karnie, for the commission of offences punishable under Sections 13 and 39 of ULA (P) Act, arising out of FIR No. 249/2023 of Police Station, Baramulla.

SO-308.—Whereas, on 27-11-2023, the Police Station, Handwara, received a docket to the effect that a reliable information was received that some individuals of Handwara, including one missing person namely, Parvaiz Ahmad Dar S/o Mohd Rustam Dar R/o Tutigund, have 2The J&K Official Gazette, 22ndMay, 2024/1stJyai., 1946.[No.7-n –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– been working for the terrorists operating from across the border and are providing information about the movement of Security Forces to them for carrying out the terrorists activities in the area ; and

2. Whereas, based on the above, a case FIR No.264/2023under Sections18, 38 and 39of ULA (P) Act, was registered in the Police Station, Handwara, and the investigation of the case was set into motion.

Subsequently, during the investigation, the offences under Section 7/25 Arms Act and Section 18-B of ULA (P) Act were added in the case ; and

3. Whereas, during the investigation, the accused viz. Parvaiz Ahmad Dar, was arrested in the case and 01 Hand Grenade was recovered at his instance ; and

4. Whereas, during the course of investigation,the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, two more persons identified as Showkat Ahmad Shergojri S/o Gh. Mohd Shergojri R/o Tutigund and Yasir Ahmad Malik S/o Mohd Ishaq Malik R/o Kanipora, Balapora, Shopian were found involved in the case. Subsequently, the accused were arrested and during the investigation, 01 Hand Grenade was also recovered at the instance of accused viz. Showkat Ahmad Shergojri; and

6. Whereas, during the investigation, it was found that the accused viz. Parvaiz Ahmad Dar, Showkat Ahmad Shergojri and Yasir Ahmad Malik, were in contact with a Pakistani handler of LeT, a banned outfit, namely Jarar, through virtual mode, who provided the recovered Hand Grenades to the accused viz. Parvaiz Ahmad Dar and Showkat Ahmad Shergojri, in order to promote terrorist activities in the area, besides, the accused viz. Yasir Ahmad Malik , on the directions of Pakistani handler brought the accused viz. Whereas,during the investigation,it was established that the accused viz. Parvaiz Ahmad Dar, Showkat Ahmad Shergojri and Yasir Ahmad Malik, were working as Over Ground Workers (OGWs) for the terrorists of LeT, a banned outfit, particularly the Pakistani handler viz. Jarar , and under a well knit criminal conspiracy were providing logistic support to them, besides, the accused viz. Parvaiz Ahmad Dar and Showkat Ahmad Shergojri, procured the Hand Grenades from the said terrorist for carrying out the terrorist activities in the area ; and

8. Whereas, the investigation, in respect of Pakistani handler viz. Jarar and two unknown terrorists shall continue to ascertain their actual identity and to bring out their role/involvement in the case and the Supplementary Charge-Sheet against them would be filed in the court of competent jurisdiction ; and

SO-309.—Whereas, on 24-11-2023, the Police Station, Mandi, received a docket to the effect that a reliable information was received about the movement of some unknown suspects in general area of Kalsi Mohalla. Subsequently, a Joint Search Operation was launched by the 2The J&K Official Gazette, 22ndMay, 2024/1stJyai., 1946.[No.7-o –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– Police/Security Forces and during the Search at Seri Khawaja, the Police/Security Forces recovered 01 Pistol with magazine and 13 Rounds from the residential house of one Ghulam Mohd @ Gama S/o Gaffar Joo R/o Seri Khawaja, Haveli, Poonch; and

2. Whereas, based on the above, a case FIR No.105/2023under Sections7/25Arms Act, 120-B IPCand Sections 13, 23and 39 of ULA (P) Act, was registered in the Police Station, Mandi, and the investigationof the case was set into motion. Subsequently, during the investigation, the offence under Section 120-B IPC was dropped from the case ; and

3. Whereas, during the course of investigation,the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

4. Whereas, during the investigation, the accused viz. Ghulam Mohd @ Gama, was arrested in the case and was found in contact with some unknown terrorists of LeT, a banned outfit, who providedthe recovered arms/ammunition to the accused viz.Ghulam Mohd @ Gama, in order to promote terrorist activities in the area ; and

5. Whereas,during the investigation,it was established that the accused viz. Ghulam Mohd @ Gama, was working as Over Ground Worker (OGWs) for the terrorists of LeT, a banned outfit, and was providing logistic support to them, besides, procured arms/ammunition from an unknown terrorist for carrying out the terrorist activities in the area; and

6. Whereas, the investigation, in respect of unknown terrorist who provided the arms/ammunition to the accused viz. Ghulam Mohd @ Gama, shall continue to ascertain his identity and to bring out his role/involvement in the case and the Supplementary Charge-sheet against him, would be filed in the court of competent jurisdiction; and

7. SO-310.—Whereas, on 09-11-2023, the Police Station, Kellar, received a docket to the effect that a reliable information was received 2 The J&K Official Gazette 22nd May, 2024/1st Jyai., 1946. Subsequently, a Joint Cordon and Search Operation was launched by the Police/Security Forces and during the search, the terrorists hiding in the shop of one Manzoor Ahmad Ganie S/o Sonaullah Ganie R/o Kathuhallan, hurled a Hand Grenade upon the Search Party followed by indiscriminate firing, with their illegal arms/ammunition, with the intention to kill them. The fire was retaliated, triggering an encounter;

and

2. Whereas, based on the above, a case FIR No.73/2023under Section 307 IPC, 3/4 ESA, 7/27 Arms Act, and Sections 16, 20 and 38 of ULA (P) Act, was registered in the Police Station, Kellar, and the investigationof the case was set into motion. Subsequently, during the investigation, the offences under Section 18,18-B and 39 of ULA (P) Act were added in the case ; and

3. Whereas, during the investigation, the dead body of one terrorist who was later on identified as Mysar Ahmad Dar S/o Gh. Nabi Dar R/o Vishroo Payeen, Shopian, was recovered from the place of encounter.

During the search, arms/ammunition viz. 01 Pistol with magazine and 12 Rounds were also recovered from the encounter site;and

4. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, one more person identified as Sheezan Javaid Zargar S/o Javaid Ahmad Zargar R/O S.K. Colony, Anantnag, was found involved in the case. Subsequently, the accused was arrested and was found in contact with a Pakistan based terrorist of TRF, a banned outfit namely Hamza through virtual mode and was working for him in order to promote terrorist activities in the area ; and No.7-p] The J&K Official Gazette, 22nd May, 2024/1st Jyai., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 6. Whereas, during the investigation, it was found that the accused viz. Sheezan Javaid Zargar, on the directions of Pakistan based terrorist viz. Hamza, instigated/motivated the accused viz. Myser Ahmad Dar, to join the terrorist ranks and arranged arms/ammunition and Hand Grenades for him through the Pakistan based terrorist ; and

7. Whereas, during the investigation, it was established that the accused viz. Sheezan Javaid Zargar, was working as Over Ground Worker (OGW) for the terrorists of TRF, a banned outfit, particularly the Pakistan based terrorist viz. Hamza, and was providing logistic support to them, besides, under a well knit criminal conspiracy motivated and facilitated the joining of deceased terrorist viz. Myser Ahmad Dar, with the terrorist ranks for carrying out the terrorist activities in the area ; and

8. Whereas, the accused terrorist viz. Myser Ahmad Dar, has been killed in the said encounter with the Security Forces and the proceedings under the law would abate against him ; and

9. Whereas, during the investigation, the shop owner viz. Manzoor Ahmad Ganie, has not been found involved in the case and the investigation, in respect of Pakistan basedterrorist viz. Hamza, shall continue to bring out his role /involvement in the case and the Supplementary Charge Sheet against him would be filed in the court of competent jurisdiction ; and

10. Whereas, on the basis of investigation, the statementsof witnesses recorded and the other evidence collected, the Investigating Officer has establishedprima facie involvement of below mentioned accused for the commission of the offences punishable under sectionsas shown against hisname:—

4. Whereas, during the investigation, the accused viz. Jahangir Anzer Peer, was arrested in the case and it was found that the accused uploaded some incriminatory audios/videos and photograph of terrorists on the social media in order to create hatred and spread anti-national propaganda among the general public, thereby threatened the sovereignty and territorial integrity of the India; and

5. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has established aprima facie involvement of below mentioned accused for the commission of the offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967,as shown against hisname:—

SO-318.—Whereas, on 01-07-2017, information was received by the Police Station, Achabal, to the effect that a Joint Cordon and Search Operation was launched by the Police/ Security Forces in village Brinty, 2 The J&K Official Gazette, 30th May, 2024/9th Jyai., 1946. [No.9-c –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– Batapora. During the search, the terrorists hiding in the residential house of one Bashir Ahmad Ganie S/o Gh. Hassan Ganie R/o Brinty, Batpora, fired indiscriminately upon the Search Party,with their illegal arms/ammunition, with the intention to kill them resulting in injuries to some police personnel and 04 civilians on the spot, among which 02 civilians succumbed to their injuries. The fire was retaliated and during the ensuing gunfight two terrorists identified as Bashir Ahmad Wani @ Bashir Lashkari R/o Soaf Shali, Kokernag and Abu Maaz R/o Pakistani, were killed on the spot. During the encounter some miscreants pelted stones upon the Police/Security Forces, in order to facilitate the holed up terrorists to manage their escape from the encounter site; and

2. Whereas, based on the above, a case FIR No.92/2017 under Sections302, 307, 148, 149, 332, 336 RPC, 7/27 Arms Act, was registered in the Police Station, Achabal, and the investigation of the case was set into motion. Subsequently, during the investigation,the offences under Sections 13, 16, 18, 19, 20, 23, 38 and 39 of ULA (P) Act were added in the case ; and

3. During the investigation, the dead bodies of killed terrorists viz. Bashir Ahmad Wani @ Bashir Lashkari and Abu Maaz, were recovered from the place of encounter and arms/ammunition viz. 02 AK-47 rifles, 02 Magazines. 01 Pistol and 48 Rounds were also recovered from the encounter site ; and

4. Whereas, during the course of investigation,the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, 16 persons were found involved in stone pelting upon the Police/Security Forces. Subsequently, the accused were arrested in the case and the charge sheet against them would be file in the Court of competent jurisdiction for the commission of offences punishable under Sections 148, 149, 332, 336 RPC; and No.9-c] The J&K Official Gazette, 30th May, 2024/9th Jyai., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 6. Whereas , during the investigation, it was found that the encounter took place in a joint house of Bashir Ahmad Ganie and his son namely Khursheed Ahmad Ganie, who are separately residing in the said house.

On the date of occurrence, the accused viz. Khursheed Ahmad Ganie, provided shelter to the terrorists viz. Bashir Ahmad Wani @ Bashir Lashkari and Abu Maaz, in his share. Subsequently, the accused was arrested in the case. During investigation, the person viz. Basir Ahmad Ganie, was not found involved in the case and accordingly was dropped from the case and was given benefits under Section 169 Cr. PC ; and

7. Whereas, during the investigation. it was established that the accused viz. Khursheed Ahmad Ganie, was working as Over Ground Worker (OGW) for the terrorists of LeT, a banned outfit particularly the killed terrorists viz.Bashir Ahmad Wani@ Bashir Lashkari and Abu Maaz, and was providing logistic support to them, besides, on the date of occurrence voluntarily harboured the said terrorists in his residential house for carrying out the terrorist activities in the area ; and

8. Whereas, the accused terrorists viz. Bashir Ahmad Wani @ Bashir Lashkari and Abu Maaz, have been killed in the said encounter with the Security Forces and the proceedings under the law would abate against them ; ands

9. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has established aprima facie involvement of below mentioned accused for the commission ofoffences punishable under sections of the Unlawful Activities (Prevention) Act, 1967,as shown against hisname:—

SO-319.—Whereas, on 17-11-2023, the Police Station, Budhal, received a docket to the effect that a Joint Search Operation was carried out by the Police/Security Forces in the Behrooth, Upper Rajnagar, area. The fire was retaliated and during the ensuing gunfight, the said unknown terrorist was killed on the spot. During search, the Police recovered 01 AK Rifle, 03 Magazines,70 Rounds and 02 Hand Grenades from the killed terrorist ; and

2. Whereas, based on the above, a case FIR No.128/2023under Sections307, 120-B, 121, 122 IPC, 7/25, 27 ArmsAct, 3/4 ESA, and the Sections 13, 16, 18 and 23 of ULA (P) Act, was registered in the Police Station, Budhal, and the investigation, of the case weas set into motion. Subsequently, during the investigation, the offences under Sections19, 20, 38 and 39 of ULA (P) Act, were added in the case; and

3. Whereas, during the investigation, the dead body of killed terrorist who was later on identified as Bilal S/o not known R/o Pakistan, affiliated with the terrorist organization of LeT, a banned outfit, was recovered from the place of encounter ; and

4. Whereas, during the course of investigation,the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

5. Whereas, during the investigation, three more persons identified as Mohd Farooq S/o Mohd Latief caste Gujjar R/o village Guller, Rajnagar, Koteranka, Budhal, Mohd Nazir S/o Mohd Din caste Gujjar R/o Rajnagar,Koteranka,Budhal and Mohd Shabir S/o Mohd Latief caste Bakerwal R/oBehrooth,Koteranka, Budhal,were found involved in the case. Subsequently, the accused was arrested and during the investigation, 02 Hand Grenades, 01 Pistol, 02 Magazines and 28 Rounds were recovered at the instance of accused viz. Mohd Farooq and Mohd Nazir respectively, which were provided to them by the terrorist viz. Bilal; and

6. Whereas,during the investigation,it was found that the accused viz. Mohd Farooq, was in contact with the killed Pakistani based terrorist viz. Whereas, during the investigation, it was found that the accused viz. Mohd Farooq, brought the said Pakistani based terrorist viz. Bilal, to his residential house and provided shelter to him. Later on the accused viz. Mohd Farooq handed over the said terrorist to the accused viz. Mohd Nazir, who also provided the shelter to the terrorist in his residential house for two nights. Subsequently, the accused viz. Mohd Nazir, handed over the terrorist viz. Bilal to the other accused viz. Mohd Shabir, for providing further shelter to the terrorist in his dhok at Behrooth; and

8. Whereas,during the investigation, it was established that the accused viz. Mohd Farooq, Mohd Nazir and Mohd Shabir, were working as Over Ground Workers (OGWs) for the terrorists particularly the killed Pakistani terrorist viz. Bilal, and were providing logistic support to him. Besides, under a well knit criminal conspiracy voluntarily harboued the said terrorist in their residential houses/dhok for carrying out the terrorist activities and to wage war against the Government of India. The accused viz. Mohd Farooq and Mohd Nazir, also procured arms/ammunition and Hand Grenades from the said terrorist for carrying out the terrorist activities in the area ; and

9. Whereas, the accused terrorist viz. Bilal has been killed in the said encounter and the proceedings under the law would abate against him ; and

10. Whereas, the investigation, of the case shall continue in respect of unknown Pakistani handlers and their sympathizers and the Supplementary Charge Sheet against them would be filed in the Court of competent jurisdiction ; and

11. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has established aprima facie involvement of the below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention), Act 1967, and Indian Penal Code,as shown against theirnames:—

Whereas, after perusing the Case Diary File,the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities(Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for their prosecution under the provisions of law ;

and

14. Whereas, the Government has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused under the aforementioned provision of the Indian Penal Code (IPC).

Now, therefore,in exercise of the powers conferred bySub-Section (2) of Section 45 of the Unlawful Activities (Prevention)Act, 1967, and Section 196 of the Code of Criminal Procedure, 1973,the Government hereby accord sanction for launching prosecution against the accused viz. Mohd Farooq, Mohd Nazir and Mohd Shabir, for the commission of offences as indicated against the each accused at Para (11) above, arising out of FIR No. 128/2023 of Police Station, Budhal.

SO-320.—In exercise of the powers conferred by Section 64 of the Wildlife Protection Act, 1972 (No.53 of 1972), the Government of Jammu and Kashmir hereby makes the following rules, namely :—

2 The J&K Official Gazette, 31st May, 2024/10th Jyai., 1946.[No.9-e –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 1. Short title, extent and commencement.—(1)These rules may be called the Jammu and Kashmir Wildlife (Protection) Rules, 2024.

(2) They shall extend to the whole of the Union Territory of Jammu and Kashmir.

(3) They shall come into force from the date of their publication in the official Gazette.

2. Definitions.—In these rules, unless the context otherwise requires ;

a) "Act" means the Wildlife Protection Act, 1972 (No. 53 of 1972);

b) "Board" means Wildlife Board for Union Territory of Jammu and Kashmir;

c) "Chairman" means the Chairman of the Wildlife Board for Union Territory of Jammu and Kashmir;

d) "Form" means a form appended to these rules;

e) "Fee" means amount chargeable from a permit holder; f) "Government" means the Government of Jammu and Kashmir;

g) "Non-official member" means member of Wildlife Board for Union Territory of J&K referred to in clauses (d) & (e) of Sub-Section (1) of Section 6 of the Act ;

h) "Permit" means permission granted under the Act and Rulesmade thereunder;

i) "Section" means the Section of the Act;

j) "Schedule" means a schedule to the Act; and

k) All other words, expressions used herein but not defined in these rules shall have the same meaning as assigned to them under the Act.

3. Terms of office.—The term of office of a non-official member of the Board referred to in clauses (d) & (e) of Sub-Section (1) of Section 6 of the Act shall be two years from the date of his/her appointment.

4. Resignation.—(1)A non-official member of the Board may resign in writing under his hand addressed to the Chairman.

(3) The power to accept the resignation of a member of the Board shall vest in the Chairman.

5. Filling of casual vacancies.—When a non-official member of the Board resigns or dies or is removed from office or becomes incapable of acting, the Government may, by notification, appoint a person to fill the vacancy.

6.Removal from the Board.—The Government may remove anynon-official member from the Board if he/she:—

a) is of unsound mind and stands so declared by a

competentMedical Board ; or

b) is an un-discharged insolvent ; or c) is convicted of a criminal offence involving moral turpitude ; or d) is held guilty by a Court of law for contravention of any of

theprovisions of the Act or the rules framed thereunder.

7. Allowances.—(1) The non-official member of the Board shall get travelling allowance and daily allowance as admissible to ClassIofficer(s) of the Union Territory for attending meeting of the Board.

(2) Non-official members of the board shall get sitting fee/honorarium for attending the meeting of the board at the rate as prescribed by the Government.

(3) The Secretary of the Board shall be the controlling authority in respect of payment of allowances under this rule.

8. Quorum.—The quorum for meeting of the Board shall not be less than 50% of the total members.

9. Entry in National Park, Sanctuary or Reserve Area.—(1)

Every person desiring to enter a Sanctuary or National Park or Conservation reserve for purposes of photography/tourism/transaction 4 The J&K Official Gazette, 31st May, 2024/10th Jyai., 1946.[No.9-e –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– of any other lawful business, shall obtain a permit which may be issued by Chief Wildlife Warden or Wildlife Warden or any person authorized by Chief Wildlife Warden in Form No.1.

(2) A permit issued under Sub-Rule (1) shall be subject to payment of fee at the rate prescribed by the Government from time to time.

(3) Fee for entry of light vehicles in National Parks, Wildlife Sanctuaries and Conservation Reserves shall be charged at the rate as prescribed by the Government from time to time.

(4) The Departmental Officers and officials while performing their duties in the Wildlife Protected Areas shall be exempted from payment of entry fee.

10. Cancellation of permit.—The Chief Wildlife Warden or Incharge of the National Park or Sanctuary or the Conservation Reserve may, for good and sufficient reasons, to be recorded in writing, cancel any permit granted under these rules.

11. Permission for making feature films.—Permissions for making feature films, documentary films, Television Serial or Professional Photography in a National Park or Sanctuary or Conservation Reserve shall be granted by the Chief Wildlife Warden on payment of fee at the rate as prescribed by the Government from time to time.

12. Power to exempt.—Where it is considered necessary to expedient so to do in the public interest, the Chief Wildlife Warden may exempt any person (s) and/or vehicle (s) from the payment of the fee payable under these rules.

13. Registration of certain persons in possession of arms.—The

registration of certain persons in possession of arms shall be as under :—

a. For the registration of arms as provided in Section 34, the person possessing the arm shall apply to Wildlife Warden on Form II.

b. The fee to be paid as per Sub-Section (1) of Section 34 shall be at the rate as prescribed by the Government.

14. Cognizance of offences.—Besides the Chief Wildlife Warden, the following officers shall be authorized to make complaints under Section 55 within their respective jurisdictions;namely :—

i. Conservator of Forests (Territorial) ;

ii. Regional Wildlife Warden ;

iii. Divisional Forest Officer (Territorial) ; iv. Deputy Conservator of Forests ;

v. Wildlife Warden ; vi. Assistant Conservator of Forests ;

vii. Assistant Wildlife Warden ;

viii. Range Officer ;

15. Repeal and Savings.—(1) The Jammu and Kashmir Wildlife Protection Rules 1979, are hereby repealed.

(2) Notwithstanding such repeal, any action taken under the rules so repealed shall be deemed to have been taken under the corresponding provisions of these rules.

SO-322.—Whereas, on 11-12-2023, the Police Station, Bijbehara, received a docket to the effect that a Naka was established by the Police/Security Forces at Jablipora, Bijbehara. During the checking two suspects while seeing the Naka Party tried to escape but were chased down on the spot and identified as Mohd Altaf Bhat S/o Ghulam Rasool Bhat R/o Semthen, Bijbehara and Shabir Ahmad Mir S/o Mohammad Ismail Mir R/o Kuchmulla, Pulwama. During the search, the Police recovered 01 Pistol, 02 magazines, 30 rounds, 02 metallic IEDs and 10 detonators from the bags carrying by the accused ; and 2 The J&K Official Gazette, 3rd June, 2024/13th Jyai., 1946. [ No. 9-g –––––––––––––––––––––––––––––––––––––––––––––––––––—— 2. Whereas, based on the above, a Case FIR No. 284//2023 under

Sections 120-B IPC, 7/25 Arms Act, 3/4 ESA and Sections 18, 20, 23

and 38 of ULA (P) Act, was registered in the Police Station, Bijbehara,

and the investigation, of the Case was set into motion ; and

3. Whereas, during the course of investigation, the site plan of

the place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused

viz. Mohd Altaf Bhat and Shabir Ahmad Mir, were in contact with two

Pakistani based terrorists of LeT, a banned outfit, namely Haroon

Rashid Ganie S/o Ab. Rashid Ganie R/o Hassanpora, Taweela and

Hamza Mauvia @ Abu Hamza R/o Pakistan, through virtual mode and

the accused terrorist viz. Haroon Rashid Ganie, provided the recovered

arms/ammunition and explosive material to the accused viz. Mohd Altaf

Bhat and Shabir Ahmad Mir, through an unknown terrorist in order to

promote terrorist activities in the area ; and

5. Whereas, the investigation, with respect to Pakistani based

terrorists viz. Haroon Rashid Ganie and Hamza Mauvia @ Abu Hamza,

and the unknown terrorist who handed over the arms/ammunition to the

accused viz. Mohd Altaf Bhat and Shabir Ahmad Mir, shall continue

to ascertain their actual identity and to bring out their role/involvement

in the case and the Supplementary Charge Sheet against them would

be filed in the court of competent jurisdiction ; and

6. Whereas, during the investigation, it was established that the

accused viz. Mohd Altaf Bhat and Shabir Ahmad Mir, were associated

with the terrorist organization, of LeT a banned outfit, and under a well

knit criminal conspiracy procured arms/ammunition and explosive

material from the terrorists for carrying out the terrorist activities in the

area ; and

7. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected the Investigating

Officer, has established prima facie involvement of the below

9. Whereas, after perusing the Case Diary File the relevant

documents and also taking into consideration the views of the Authority

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above-mentioned

accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-

Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,

the Government hereby accord sanction for launching prosecution

against the accused viz. Mohd Altaf Bhat and Shabir Ahmad Mir, for

the commission of offences punishable under Sections 18, 23 and 38

of ULA (P) Act, arising out of FIR No. 284/2023 of Police Station,

SO–324.—Whereas, on 09-12-2023, a reliable information was

received by the Police Station, Bemina, to the effect that some unknown

terrorist fired upon one Police official namely Mohd Hafeez Check S/o

Gh. Hassan Check R/o Lotha, Karna A/P Hamdaniya Coloney, Bemina,

resulting in serious injuries to the Police official on the spot, who was

shifted to hospital for treament. The unknown terriorists after the

commission of crime escaped from the spot ; and

2. Whereas, based on the above, a Case FIR No. 112/2023 under

Sections 307 IPC, 7/27 Arms Act, and 16, 18 and 38 0f ULA (P) Act,

was registered in the Police Station, Bemina, and the investigation, of

the case was set into motion. Subsequently, during the investigation, the

offences under Section 120-B IPC and Sections 20 and 23 of ULA (P)

Act, were added in the Case ; and

3. Whereas, during the investigation, the site plan of the place of

occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, three persons identified as

Mehnan Khan @ Mehran S/o Mehrajudin Khan R/o Khawajapora,

Syedpora, Rainawari, Imtiyaz Ahmad Khanay @ Raju S/o Tariq Ahmad

Khanday and Danish Ahmad Malla S/o Ghulam Mohammad Malla

residents of Hamdaniya Coloney, Bemina, were found involved in the

commission of crime. Subsequently, the accused were arrested in the

case and during the investigation, 02 Pistol, 04 magazines and 65 rounds

were recovered at their instance respectively ; and

5. Whereas, during the investigation, it was found that the accused

viz. Mehnan Khan @ Mehran, Imtiyaz Ahmad Khanday @ Raju and

Danish Ahmad Malla, were in contact with a terrorist of Al-Badr, a

banned outfit namely Arjumand Gulzar Dar @ Hamza Burhan S/o

Gulzar Ahmad Dar R/o Khurbatpora. Ratnipora, Pulwama A/P Pakistan,

who provided the recovered arms/ammunition to the accused viz.

Mehnan Khan @ Mehran, Imtyaz Ahmad Khanday @ Raju and Danish

Ahmad Malla, in order to promote terrorist activities in the area ; and

6. Whereas, during the investigation, it was found that the accused

Mehnan Khan @ Mehran, Imtiyaz Ahmad Khanday @ Raju and Danish

Ahmad Malla, on the directions of Pakistani based terrist viz. Arjumand

Gulzar Dar @ Hamza Burhan, collected arms/ammunition from

Hamdaniya Coloney Bund, Bemina, near Graveyard, which were kept

there by some unknown person on the directions of said terrorist, with

7. Whereas, during the Investigation, it was found that on the date

of occurrence the accused viz. Mehnan Khan @ Mehran and Imtiyaz

Ahad Khanday @ Raju, on the directions of Pakistani terrorist viz.

Arjumand Gulzar Dar @ Hamza Burhan, went to Hamdaniya Coloney,

Bemina, where the accused viz. Imtiyaz Ahmad Khanday @ Raju, fired

indiscriminately upon the Police official viz. Mohd Hafeez Check, which

resulted serious injuries to him and escaped from the spot ; and

8. Whereas, during the investigation, it was established that the

accused viz. Mehnan Khan @ Mehran, Imtiyaz Ahmad Khanday @

Raju and Danish Ahmad Malla, were associated with the terrorist

organization of Al- Badar, a banned outfit and under a well knit criminal

conspiracy procured arms/ammunition from the Pakistan based terrorist

viz. Arjumand Gulzar Dar @ Hamza Burhan for carrying out the

terrorist activities in the area, besides, the accused viz. Imtiyaz Ahmad

Khanday @ Raju, with the assistance of accused viz. Mehnan Khan

@ Mehran,fired upon the Police official viz. Mohd Hafeez Check, in

order to kill him and escaped from the spot ; and

9. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established a prima facie involvement of the below

mentioned accused for the commission of offences punishable under

Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

received a docket to the effect that a reliable information was received

about the movement of some unknown terrorists in Village Naina.

Subsequently, a Joint Naka was established by the Police/Security

Forces at Naina Batpora, bridge. During the checking a suspect while

on the spot and identified as Ruahil Abdullah S/o Mohd Abdullah Thoker

R/o Nulley, Poshwari, Shopian. During his personal search, the

Police recovered 01 Pistol, 02 magazines and 13 rounds from his

possession ; and

2. Whereas, based on the above, a Case FIR No. 116/2023 under

Sections 120-B IPC, 7/25 Arms Act, and Sections 18, 20, 23 and 39

of ULA(P) Act, was registered in the Police Station, Litter, and the

investigation, of the case was set into motion. Subsequently, during the

investigation, the Section 39 of ULA (P) Act was dropped and Section

38 of ULA (P) Act was added in the case ; and

3. Whereas, during the investigation, the site plan of the place

of occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused

viz. Ruahil Abdullah, was in contact with a terrorist of JeM, a banned

outfit, namely, Ashiq Ahmad Nengroo S/o Gh. Ahmad Nengroo R/o

Hanjan Bala A/P Pakistan, through virtual mode, and was working for

the said outfit in order to promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was found that the accused

viz. Ruahil Abdullah, on the directions of Pakistani based terrorist viz.

Ashiq Ahmad Nengroo, procured a bag from Village Rangmulla near

a Chinar tree, containing 01 AK-56 rifle, 02 magazines, 60 rounds 01

Pistol, 02 magazines, 26 rounds and 05 hand grenades. Subsequently,

during the investigation, 01 AK-56 rifle, 02 magazines, 60 rounds 05

hand grenades and 13 Pistol rounds were also recovered at the instance

of accused viz. Ruahil Abdullah ; and

6. Whereas, during the investigation, it was established that the

accused viz. Ruahil Abdullah, was member of terrorist organization of

JeM, a banned outfit, and under a well knit criminal conspiracy procured

arms/ammunition and hand grenades from the Pakistani terrorist viz.

Ashiq Ahmad Nengroo, for carrying out the terrorist activities in the
