Whereas, the Bar Council of India, vide communication No. BCI : D : 1726/2024 dated 10-04-2024, has informed that the Hon'ble High Powered Committee constituted by the Hon'ble Supreme Court vide Judgment dated 10-04-2023 passed in Writ Petition (Civil) No. 82/2023 titled Ajay Shankar Srivastava Vs. Bar Council of India and Anr to monitor the process of verification of genuineness and validity of degrees/ certificate of advocates enrolled with the State Bar Councils. The relevant portion of Judgment of the Hon'ble Supreme Court reads as under :—

"3. In 2015, the Bar Council of India notified the Bar Council of India Certificate and Place of Practice (Verification) Rules 2015. The process of verification of certificates and place of practice commenced with efforts by the State Bar Councils and the Bar Council of India.

9. The above table indicates tltat a majority of advocates enrolled with the State Bar Councils No. 44] The J&K Official Gazette, the 30th Jan., 2025/10th Magha, 1946. 581 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––—— have not submitted their verification forms. The Bar Council of India apprehends that many advocates who have not submitted their forms for verification are persons who are not qualified or are "in possession of fake degrees". The Bar Council of India has submitted and, with justification, that this class of persons, without the possession of qualifications required for law practice, is known to enter upon the arena of courts for extraneous purposes, including the disruption of work. The Bar Council of India is justified in asserting that such persons have to be identified and weeded out from the list of advocates enrolled with the Bar Councils.

10. The due verification of advocates who are enrolled with the State Bar Councils, is of utmost importance to preserve the integrity of the administration of justice. Persons who profess to be lawyers, but do not either have the educational qualifications or degree certificates on the basis of which they could have lawfully granted entry to the Bar, pose a grave danger to the administration of justice to citizens. Hence, it is the duty of every genuine advocate of the country to ensure that they cooperate with the Bar Council of India which is seeking to ensure that the certificates of practice are duly verified, together with the underlying educational degree certificates. Unless this exercise is carried out periodically, there is a danger that the administration of Justice would be under a serious cloud. The written submission which has been placed on the record by the Bar Council of India indicates that several such persons have been elected to State Bar Councils and some persons have thereafter occupied judicial office in the district judiciary as well".

(i) Therefore, all those of advocates enrolled on J&K Bar Council, who have not submitted their verification forms in terms of Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015, are 582 The J&K Official Gazette, the 30th Jan., 2025/10th Magha, 1946. [ No. 44 ––––––––––––––––––––––––––––––––––––––––––––––––—–––———— hereby directed to submit the same before the Principal District and Sessions Judge concerned and the Registrar Judicial, High Court Wing Jammu/ Srinagar respectively along with requisite documents viz;two passport size photographs, self-attested copies of Enrolment Certificates, Matriculation/LL.B Degrees alongwith fee by way of valid Demand Draft of Rs.200(100+100 late fee) each in the name of Secretary, J&K Bar Council within 15 days from the date of issue of notice in the daily newspaper.

(ii) All the concerned Advocates enrolled on the roll of J&K Bar Council, who have submitted their Verification Forms in terms of Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015 and pursuant to the Notification No(s) 512 dated 21-07-2016, 571 dated 04-08-2016, 580 dated 07-09-2016,1990 dated 31-03-2018 and 1273 of 2023 dated 12-07-2023 of the Hon'ble High Court of Jammu and Kashmir and Ladakh are hereby directed to make up the deficiencies as per the Annexure "A" and submit the two photographs, the self-attested copies of Enrolment Certificates, Matriculation-(DOB) and LL.B Degree, if they have not submitted the same, along with their verification Forms, before the concerned Principal District and Sessions Judge and Registrar Judicial, High Court Wing Jammu/Srinagar respectively within a period of 15 days from the date of publication of this Notice in the news paper.

(iii) The concerned Registrar Judicial's, High Court Wing, Jammu/Srinagar and Principal District and Session Judges shall receive only those verification forms that are complete in all respects under Certificate and Place of Practice(Verification) Rules, 2015 and forward the consolidated data as per Format in Excel Format on email address [email protected]

(iv) The Registrar Judicials', High Court Wing Jammu/ Srinagar and all Principal District & Session Judges and the courts under their jurisdiction and the No. 44] The J&K Official Gazette, the 30th Jan., 2025/10th Magha, 1946. 583 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––—— Presiding Officers of the Tribunals shall ensure that only those of the advocates who possess the valid advocate license/Certificate of enrolment shall be allowed to practice in the concerned courts.

shall only be entertained.

The following case mentioned above accused Sohan Singh S/o

Hoshiar Singh R/o Malhori, Doda J&K in FIR No. 17/2023 U/S 420/

465/109 IPC has been deliberately absconding his arrest whose search

has been made in the locality but the accused has not been traced

and in the near future his availability is impossible. Therefore officials

of the Jammu and Kashmir Police are hereby ordered to pass on the

instructions to the police officials to search the accused in the Jammu

and Kashmir State and arrest him and then produce the accused in

the Court.

Warrant is issued till the arrest of the accused.

. APP present for UT. The file was taken up today for hearing.

Perusal fof record reveals that accused is continuously absent in this

case. The bail bonds of accused were forfeited on 18-04-2018. Vide

Order dated 28-08-2024 non-bailable warrants were issued against

accused No. 2, with the direction to tamili to remain present in case

of non-execution. Since the NBW was received back unexecuted,

statement of Tamili namely Mohd. Ashraf No. 1541/J P/S Nagrota was

recorded who stated that the accused has absconded and there are

no prospects of arresting him. The statement be made part of the file.

Upon perusal of the file and the staements of HC Mohd Ashraf,

I am satisfied that the accused No. 2. Namely Zulfeker Ali S/o Lal

Din R/o Lal House Tehsil Surankote District Poonch has absconded

and there is no immediate prospect of arresting him. Under these

circumstances, I deem it proper to proceed u/s 512 Cr. PC. against

the accused. Concerned clerk is directed to issue warrants under Section

512 Cr. PC. against the accused. Copy of warrants be forwarded to

concerned SSP and SHO. One copy of warrants shall also be forwarded

to Government Press for the purpose of publication. One copy of warrant

shall be made part of the file. Warrant shall remain in effect till the

SO-280.¾ Whereas, the Ministry of Home Affairs, Government of India, vide Notification S.O. 1416 (E) dated 15th March, 2024,

issued under Sub-Section (1) of Section (3) of the Unlawful Activities Prevention Act, 1967 (37 of 1967) declared Jammu and Kashmir 2 The J&K Official Gazette, 3rd May, 2024/13th Vai., 1946. [No. 5-f

Liberation Front (Mohd Yasin Malik faction), as an Unlawful Association ; and

Whereas, subsequently, the Ministry of Home Affairs, Government of India, in exercise of powers conferred by Section 42 of Unlawful Activities (Prevention) Act, 1967, vide Notification S.O.1580 (E) dated 28th March, 2024, directed that the State Governments and Union Territory Administrations shall exercise all the powers exercisable by the Central Government under Section 7 and Section 8 of the Act ibid. ; and

Whereas, vide order No. 14017/34/2024-NI-MFO dated 01st April, 2024, issued by the Ministry of Home Affairs, Government of India, approval of the Central Government under Section 42 of the Unlawful Activities (Prevention) Act, 1967 has been conveyed to all the States and Union Territory Administration to the effect that the States and Union Territory Administrations may, by order in writing, direct that any power which has been directed to be exercised by it, shall , in such circumstances and under such conditions, as may be specified in the direction, be exercised by any person subordinate to the State Government or the Union Territory Administration, as the case may be.

Now, therefore, the Government of Union Territory of Jammu and Kashmir, with the previous approval of the Central Government, conveyed vide order No. 14017/34/2024-NI-MFO dated 01st April, 2024, issued by the Ministry of Home Affairs, Government of India, hereby directs that the powers exerciseable by the Union Territory of Jammu and Kashmir under Section 7 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) shall be exercised by the Additional Director General of Police, Jammu/Inspector General of Police, Kashmir Zone, within their respective territorial jurisdictions and further directs that the powers exerciseable by the Union Territory of Jammu and Kashmir under Section 8 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) shall be exercised by the Divisional Commissioner(s), Jammu/Kashmir, within their respective territorial jurisdictions.

SO–281.—Whereas, on 04-04-2019, a reliable information was

received by the Police Station, Rainawari, to the effect that some jail

inmates lodged in the Central Jail, Srinagar, set ablaze some barracks

and raised anti-national slogans against the sovereignty and territorial

integrity of the India, besides, pelted stones upon the jail staff, with the

2. Whereas, based on the above, a Case FIR No. 19/2019 under

Sections 336, 436 RPC and the Section 13 of ULA(P) Act, was

registered in the Police Station, Rainawari, and the investigation, of the

case was set into motion. Subsequently, during the investigation, the

offences under Sections 147, 148, 149, 427, 332, 307 and 435 RPC,

were added in the Case ; and

3. Whereas, during the investigation, the site plan of the place

of occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, twenty six persons identified

involved in the commission of crime ; and

5. Whereas, during the investigation, four accused viz. Arif

Ahmad Sheikh, Sameer Ahmad Khan, Imran Khan and Imran Aslam

Baba, were arrested in the case and the accused viz. Zia Mustafa, has

been killed in an encounter with the Security Forces and the proceedings

under the law would abate against him ; and

6. Whereas, during the investigation, it was established that on the

date of occurrence the accused viz. Arif Ahmad Sheikh, Sameer Ahmad

Khan, Imran Khan and Imran Aslam Baba, raised anti-national slogans

against the sovereignty and territorial integrity of India, besides, pelted

stone upon the jail staff in order to cause damage to them ; and

7. Whereas, the sanction for launching prosecution against the

accused viz. Arif Ahmad Sheikh, Sameer Ahmad Khan, Imran Khan

and Imran Aslam Baba, was accorded by the Government vide

Notification (S.O) No. 109 dated 15th February, 2024, and the

investigation, in respect of other accused was continued ; and

8. Whereas, during the further investigation, two other accused

viz. Asif Sultan and Eycon Parveez, were arrested in the case and it

was found that on the date of occurrence the accused viz. Asif Sultan

and Eycon Parveez, alongwith the other accused viz. Ishfaq Ahmad

Bhat, Zubair Shabir Bhat, Mohd Khalil Najar, Ali Mohammad Lone @

Advocate Zahid, Faisal Manzoor Khan @ Bali, Tauseef Ahmad Shah,

Feroze Ahmad Dar, Dawood Fayaz Zargar, Basit Ashraf Malik, Sheikh

Khalid Rasool, Urooj Afaq Bhat, Arsalan Ahmad Bangree, Adil Siraj

Misgar, Danish Ayub Budoo, Moin Ahmad Matoo, Iqbal Ahmad Khan,

Imran Nabi Wani, Mushtaq Ahmad Ganie, and Juwaiz Hussain Khan,

also raised anti-national slogans against the sovereignty and territorial

integrity of the Union of India, besides, pelted stone upon the jail staff

in order to cause damage to them ; and

9. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

sufficient material and evidence available against the above-mentioned

accused for their prosecution under the provisions of law.

the Police recovered 01 Pistol, 02 Magazines and 10 rounds from a bag

carried by the accused ; and

2. Whereas, based on the above, a Case FIR No. 194/2023 under

Section 7/25 Arms Act, and Sections 18, 23 and 39 of ULA(P) Act,

was registered in the Police Station, Shopian, and the investigation, of

the case was set into motion ; and

3. Whereas, during the investigation, the site plan of the place

of occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused

viz. Farman Khursheed Wani, was in contact with a Pakistan based

terrorist of Ansar-ul-Gazwatul Hind (AUGH), a banned outfit, namely

Hamza Sarosh, through virtual mode, who provided the recovered arms/

ammunition to the accused viz. Farman Khursheed Wani, in order to

promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was established that the

accused viz. Farman Khursheed Wani, was working as Over Ground

Worker (OGW) for the terrorists of Ansar-Ul-Gazwatual Hind

(AUGH), a banned outfit particularly the Pakistani handler viz. Hamza

Sarosh, and was providing logistic support to them, besides, under a well

knit criminal conspiracy procured arms/ammunition from the terrorists

for carrying out the terrorist activities in the area ; and

6. Whereas, during the investigation, in respect of Pakistani

handler viz. Hamza Sarosh, shall continue to ascertain his indentity and

to bring out his role/involvement in the area and the Supplementary

Charge Sheet against him would be filed in the Court of competent

jurisdiction ; and

7. Whereas, on the basis of the investigation the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established prima facie involvement of the below

mentioned accused for the commission of offences punishable under

Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

against his name :—

SO-283¾Wheareas , on 21-11-2023, the Police station Batmaloo, received a docket to the effect that a reliable information was received about the movement of some unknown terrorists in the area. accomplice tried to escape but were chased down on the spot and identifiedas Mumtaz Ahmed Lone S/o Ghulam Qadir Lone R/o Trehgam, Kupwara and Jahangir Ahmad Lone S/o Ghulam Mohi-din LoneR/o Baba Gund, Trehgam, Kupwara. During the search, the Police recovered 02 Pistols, 04 magazines, 02filler magazines and 08 hand grenades from the vehicle;and ;and

2. Wheareas, based on the above, a Case FIR No. 128/2023 U/s 7/25 Arms act, and Section 13,18,23 and 39 of ULA (P) Act, was registered in the Police Station, Batmaloo and the investigation, of the case was set into motion;and

3. Wheareas, during the investigation , the site plan of the place of occurance and the seizure memos were prepared and the statement of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law;and

4. Wheareas during the Investigation, one more person identified as Zahoor Ahmed Lone S/o Late Mohd Sultan Lone R/o Hajinar, Karnah, Kupwara was found involved in the commission of crime, Subsquently,the accused was arrested in the case; and

5. Wheareas during the Investigation, it was found the accused Zahoor Ahmed Lone , was in contact with a Pakistani hander namely Ashraf Peer, and was working for him. The Accused viz. Zahoor Ahamd Lone, on the direction of Pakistani hander procured a bag containing 02 hand grenades form Meerpor, Kupwara, with the directions to hand over the same to some person(s) at Srinagar , Subsequently, during the investigation,02 hand grenades were recovered at the instance of accused viz. Zahoor Ahmad Lone; and

6. Whereas, during the investigation, it was found that the accused viz. Mumtaz Ahmad Lone, also came in contact with the Pakistani hader viz. Ashraf Peer, through the accused viz. Zahoor Ahmad Lone,and later on both the accused were working for the said terrorist in order to promote terrorist activities in the area; and

7. Wheareas, during the investigation, it was found that on the date of occurance the accused viz. Mumtaz Ahmad Lone, and Jahangir Ahmad Lone, on the directions of Pakistani hander viz. Ashraf Peer, procured arms/ammunition and hand grenades from an unknown person at Dardpora, Kralpor, with the directions to hand over the same to some person (s) at Srinagar. The accused viz Mumtaz Ahmad Lone and Jahangir Ahmad Lone, went to Srinagar and on their way were arrested No. 5-i] The J&K Official Gazette, 7th May, 2024/17th Vai., 1945. 3

by the Police at NR Colony , Tengpora, Srinagar, alongwith the arms /ammunition and hand grenades;and

8. Whereas, during the investigation, It was established that the accused viz. Mumtaz Ahmad Lone, Jahangir Ahmad Lone and Zahoor Ahmad Lone, were working as over ground Workers (OGWS) for the terrorists particularly the Pakistani handler viZ. Ashraf Peer, and were providing logistic support to them, besides, under a well knit criminal conspiracy procured arms/ammunition and hand grenades from the terrorists through/unlawful activities in the area;and

9. Whereas, the investigation, in respect of Pakistani handler viz. Ashraf Peer, and unknown person(s) shall continue to ascertain their actual identified and to bring out their role /involvement in the area and Supplementary Charge Sheet against them would be filed in the Court of competent jurisdiction; and

10. Whereas, on the basis of the investigation, the statement of witnesses recorded and other evidence collected, the Investigating Officer,has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their names:-

SO–284.—In exercise of the powers conferred by proviso to

Article 309 of the Constitution of India, the Government hereby direct

that Sub-Rule (3) and Sub-Rule (4) of Rule 8 of the Jammu and Kashmir

Prosecution Service Recruitment Rules, 2020, notified vide S.O. 245

dated 05-08-2020, shall be substituted by the following, namely :—

''(3) Every probationer shall on the completion of training appear

in a final examination to be conducted by the Commission in

accordance with such regulations as the Government may from

time to time, make. These regulations shall, inter-alia, indicate the

scheme of distribution of marks between the competitive

examination and the final examination and the aggregate marks

shall be the basis to determine the seniority.

(4) Where a probationer is prevented, either through sickness or

other cause over which he has no control from appearing in the

final examination, mentioned in Sub-Rule (3), he may be allowed

to appear in the examination which may be conducted by the

Commission as early as possible, preferably within a period of six

months from the last date of the final examination in which the

probationer did not appear.''

The above amendments shall be deemed to have come into

effect from the date of notification of the Jammu and Kashmir

Prosecution Service Recruitment Rules, 2020 notified vide S.O 245

dated 05-08-2020.

During the checking, a suspect while seeing the Naka Party tried to escape but was chased down on the spot and identified as Suhail Ahmed Lone S/o Ali Mohammad Lone R/o 2 The J&K Official Gazette, 8th May, 2024/18th Vai., 1946. 2. Whereas, based on the above, a case FIR No. 178/2021 Under Section 7/25 Arms Act, was registered in the Police Station, Bijbehara, and the investigation, of the case was set into motion. Subsequently, during the investigation, the Offences Under Sections 13, 23 and 39 of ULA (P) Act were added in the case; and

3. Whereas, during the investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstance of the case were recorded under the relevant provisions of law; and

4. Whereas, during the investigation,it was found that the accused viz.Suhail Ahmad Lone, was working for the terrorists of HM, a banned outfit, in order to promote terrorists activities in the area; and

5. Whereas, during the investigation, it was established that the accused viz. Suhail Ahmad Lone,was working as Over Ground Worker (OGW) for the terrorists of HM, a banned outfit, and was providing logistic support to them,besides procured AK ammunition from the terrorists for carrying out the terrorists/unlawful activities in the area;and

6. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below mentioned accused for the commission of offence punishable under Section of the Unlawful Activities (Prevention) Act, 1967, as shown against his name :—

SO-288.¾Whereas, on 12-10-2022, a credible information was recived by the Police Station, CIK/SIA, Srinagar, to the effect that OGWs of proscribed terrorist organization (s) operating within the J&K 2 The J&K Official Gazette, 15th May, 2024/25th Vai., 1946. [No. 6-c

with the active support of Pakistani based agencies, hostile to India, are involved in cross Loc smuggling of banned narcotics and drugs into J&K. The sale proceeds of such drugs are being used in order to promote terrorist activities, besides, one OGW namely Mst. Rubeena Nazir D/o Nazir Ahmad Malik R/o Panzipora, Tarzoo, Sopore, is responsible for having illegally brought up of a huge amount of banned narcotics from Pakistan and the sale proceeds of such drugs are used for the ongoing terrorist and secessionist campaign against the territorial integrity and security interests of the Union of India; and

2. Whereas based on the above, a Case FIR No. 19/2022 under Sections 8/21, 29 NDPS, 120-B,121,121-A IPC, and the Sections 13,17,18,39 & 40 of ULA (P) Act was registered in Police Station, CIK/SIA, Sringar and the investigation of the case was set into motion.

Subsequently, during the investigation, the offences under Sections 8/21 NDPS, 120-B IPC and the Section 17 of ULA (P) Act were dropped and the offences under Sections 27-B NDPS, 201 IPC and Section 38 of ULA (P) Act were added in the case; and

3. Whereas, during the investigation, the accused lady viz. Mst.

Rubeena Nazir, was arrested in the case and she alongwith one more person identified as Ishfaq Ahmad Mir S/o Mohammad Maqbool Mir R/o Mir Mohalla, Tarzoo, Sopore were found in contact with some LeT banned terrorists of Sopore area who had crossed the LoC and are presently operating from Pakistan through the virtual mode.

Subsequently the accused viz. Ishfaq Ahmad Mir was also arrested in the case; and

4. Whereas, during the investigation, it was found that the accused lady viz. Mst. Rubeena Nazir, on the directions of accused viz. Ishfaq Ahmad Mir recived 47 kgs of narcotics from one Mudasir Ahmad Poswal S/o Nazir Ahmad Poswal R/o Amrohi, Tangdhar, Karnah through two persons identified as Safeer Ahmad Mughal S/o Abdul Rashid Mughal R/o Taad, Karnah and lftikhar Ahmad Sheikh S/o Abdul Lateef Sheikh R/o Amrohi Tangdhar, Karnah and delivered the same to other two persons namely Abdul Rashid Bhat S/o Ghulam Mohammad Bhat R/o Lakripore Padgampora and Abdul Rashid Mir S/o Mohammad Sultan Mir R/o Amargrah Sopore. During investigation the accused viz. Mudasir Ahmad Poswal was also arrested in the case; and No. 6-c] The J&K Official Gazette, 15th May., 2024/25th Vai., 1946. 3

5. Whereas, during the investigation, it was found that the accused lady viz. Mst. Rubeena Nazir, transferred an amount of Rs. 20 Lacs and 72 thousand among the terrorists of LeT, JeM and HM banned outfit and their associates as well as their families which was generated from the proceeds of smuggled narcotics/sale of drugs. Subsequently during the investigation an amount of Rs. 199800/- were recovered at her instances; and

6. Whereas, during the investigation the accused viz. Safeer Ahmad Mughal alongwith two other persons identified as Mohammad Rashid Thakkar S/o Mohammad Younis Thakkar R/o Dara Barhoon Thannamandi, Rajouri and Mohammad Rayaz Lohar S/o Hakim-ud-Din R/o Khanyal Kote Thanamandi, Rajouri were found involved in the commission of crime. Subsequently the accused were arrested in the case and it was found that the accused viz. Safeer Ahmad Mughal was a driver by profession and on the directions of accused Lady viz. Mst.

Rubeena Nazir, Ishfaq Ahmad Mir and Mudasir Ahmad Poswal was facilitating the terrorists for transportation of Narcotics from one place to another. The accused viz. Mohammad Rayaz Lohar on the directions of accused viz. Mohammad Rashid Thakkar, and one Javid Ahmad Thakkar @ Raja Thakkar credited an amount of Rs. 01 Lac in the account of accused Lady viz. Mst. Rubeena Nazir which was raised through sale of Narcotics by the said accused; and

7. Whereas, during the investigation, it was established that the accused Lady viz. Mst. Rubeena Nazir, Ishfaq Ahmad Mir, Mudsir Ahmad Poswal, Safeer Ahmad Mughal, Mohammad Rashid Thakkar and Mohammad Rayaz Lohar were working as over ground Workers (OGWs) for the banned terrorist organizations and under a well knit criminal conspiracy were providing logistic support to them, besides were facilitating the transportation and selling of narcotics for the terrorists so that the money generated could be utilized to commit terrorist activities in Jammu and Kashmir and to wage war against the Government of India; and

8. Whereas, the Sanction in respect of accused Lady viz. Mst. Rubeena Nazir, Ishfaq Ahmad Mir, Mudsair Ahmad Poswal, Safeer Ahmad Mughal, Mohammad Rashid Thakkar and Mohammad Rayaz Lohar, has already been accorded by the Competent Authority vide Notification S.O. No. 287 dated 26th May, 2023 and Notification 4 The J&K Official Gazette, 15th May, 2024/25th Vai., 1946. [No. 6-c

S.O. No. 436 dated 18th August, 2023, and the investigation, in respect of other accused was continued; and

9. Whereas during the further investigation, six other persons identified as Tariq Ahmad Malik @ Dilawar S/o Mohammad Ramzan, Mushtaq Ahmad Malik @ Rahee S/o Mohammad Yousf Malik residents of Panzipora, Sopore A/P Pakistan, Alif- ud-Din Badana S/o Ghulam-ud- Din Badana R/o Amrohi Karnah, Kupwara A/P Pakistan Mushtaq Ahmad Naik @ Usman Bhai S/o Ghulam Nabi Naik R/o Kundan Khari Ramban A/P Pakistan Firdous Ahmad Dar @ Umar Dar S/o Abdul Khaiq Dar R/o Harwan Sopore A/P Pakistan and Javid Iqbal Thakkar @ Raja Thakkar S/o Tasaduq Hussain Thakkar R/o Barhon Thannamandi, Rajouri were found involved in the commission of crime. Subsequently, during the investigation the accused viz. Javid Iqbal Thakkar @ Raja Thakkar, was arrested in the case; and

10. Whereas during the investigation, it was found that the accused viz. Tariq Ahmad Malik @ Dilawar, Mushtaq Ahmad Malik @ Rahee, Alif-ud-Din Badana, Mushtaq Ahmad Naik @ Usman Bhai and Firdous Ahmad Dar @ Umar Dar crossed the LoC and are presently operating from the Pakistan with the terrorist origination of LeT, a banned outfit and facilitated the delivery of narcotics from across the border in order to promote terrorist activities in the Jammu and Kashmir besides shared account numbers of the families of booked/arrested terrorists of the outfit with the accused lady viz.Mst. Rubeena Nazir for disbursement of terror fund in their accounts. The accused viz. javid Iqbal Thakkar @ Raja Thakkar, received terror fund of an amount of Rs.10 lac from the accused viz. Mohd Rashid Thakkar and disbursed the same among the other accused; and

11. Whereas during the investigation it was established that the accused viz. Tariq Ahmad Malik @ Dilawar, Mushtaq Ahmad Malik @ Rahee, Alif-ud-Din Bandana, Mushtaq Ahmad Naik @ Usman Bhai and Firdous Ahmad Dar @ Umar Dar, are members of LeT, a banned outfit and the acuused viz. Mohd Rashid Thakkar was working as over Ground Worker (OGW) for the terrorists and was providing logistic support to them for carrying out the terrorist activities and to wage war against the Government of India; and No. 6-c] The J&K Official Gazette, 15th May., 2024/25th Vai., 1946. 5

12. Whereas on the basis of investigation, statements of witnesses recoded and other evidence collected the investigation Officer has established prima facie involvement of below mentioned accused for the commission of offences punishable in terms of the provisions of Unlawful Activities (Prevention) Act, 1967 and Indian Penal Code, 1860 as shown against their name;-

13. Whereas, the accused viz.. Tariq Ahmad Malik @ Dilawar, Mushtaq Ahmad Malik @ Rahee, Alif-ud-Din Badana, Mushtaq Ahmad Naik @ Usman Bhai and Firdous Ahmad Dar @ Umar Dar, are absconding and proceeding under Section 299 Cr.PC have been proposed to be initiated against them; and

14. Whereas, the Authority appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) 6 The J&K Official Gazette, 15th May, 2024/25th Vai., 1946. [No. 6-c

Act, 1967 has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused;

and

15. Whereas, after perusing the Case Diary File the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the unlawful activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for their prosecution under the provisions of law; and

16. Whereas, the Governmnet has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused under the aforementioned provision of the Indian Penal Code (IPC).

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967 and Section 196 of the Code of Criminal Procedure, 1973 the Government hereby accord sanction for Launching prosecution against the accused viz.. Tariq Ahmad Malik @ Dilawar, Mushtaq Ahmad Malik @ Rahee, Alif-ud-Din Badana, Mushtaq Ahmad Naik @ Usman Bhai, Firdous Ahmad Dar @ Umar Dar and Javid Iqbal Thakkar @ Raja Thakkar, for the commission of offences punishable under the relevant Section as indicated against the each accused at Para (12) above, arising out of FIR No. 19/2022 of Police Station, CIK/SIA Srinagar.
