GOVERNMENT OF JAMMU AND KASHMIR, CIVIL SECRETARIAT— INDUSTRIES AND COMMERCE DEPARTMENT, JAMMU/KASHMIR.

Subject:— Transfer/Adjustment of Employees of SICOP in UT of Ladakh.

Reference:— i. Managing Director, J&K SICOP vide his communication No.: SICOP/MD/2024/753 Dated: 10.12.2024.

ii. Minutes of the 92nd Meeting of the Board of Directors of J&K SICOP, held on 21.12.2023.

iii. The J&K Reorganization Act, 2019 (Act No. 34 of 2019) dated 09-08-2019.

———— Government Order No.: 04-JK (IND) of 2025 Dated 07.01.2025.

Whereas, General Administration Department, J&K, vide various Government Orders apportioned employees serving on substantive basis in erstwhile State J&K, to the UT of Ladakh on the basis of options exercised by them. Besides, vide Government Order No. 1212-JK(GAD) of 2021 444 The J&K Official Gazette, 13th Feb., 2025/24th Magha, 1946. [No. 46

dated 15.11.2021, it was ordered that apportionment of remaining employees referred by UT of Ladakh shall be considered upon after due verification /certification of their service records/credentials.

Whereas, vide Government Order No. 138-IND of 2021 dated 21.06.2021, Industries and Commerce Department, J&K accorded sanction to the apportionment of assets and liabilities of erstwhile J&K State on "as is where is" basis to the UT of Ladakh. Also, vide Government Order No. 14-JK(IND) of 2023 dated 09.01.2023, Managing Director, J&K SICOP was authorized to immediately initiate the process of apportionment of assets and liabilities of SICOP Ladakh strictly in terms of SO-339 dated 30.10.2020, in a time bound manner.

Whereas, Annexure I to Notification No. 339 dated 30.10.2020, inter alia, provides as under :—

3. The allocation of employees between the UT of J&K and UT of Ladakh shall be made on the basis of the options given by them as follows :—

a) if the number of employees opting for the UT of Ladakh is less than the number of posts transferred to the UT of Ladakh, all these employees shall be allocated to UT of Ladakh. As for the remaining vacancies, the Lieutenant Governor of the UT of J&K shall allocate non-optees, based on the suitable criterion evolved by the UT of J&K.

b) if the number of optees is more than the number of posts to be transferred to the UT of Ladakh, then the Lieutenant Governor of J&K shall allocate optees, based on the suitable criterion evolved by the UT of J&K.

Whereas, in terms letter dated 02.05.2023 from J&K SICOP, the employees have opted their options and all domiciles of Ladakh have opted for Ladakh Division and J&K domiciles have preferred to be in J&K.

Whereas, during a meeting on the subject chaired by Commissioner/Secretary, General Administration Department on 24.05.2023, it was directed that a copy of handover/takeover of Assets etc. between J&K SICOP and SIDCO Ladakh be shared with GAD immediately through Administrative Department, I&C Department. Subsequently, in keeping with the J&K SICOP Communication dated 03.05.2023, the Department vide letter dated 08.06.2023, requested GAD to issue formal orders in favour of the officials.

Whereas, the Board of Directors of J&K SICOP in its meeting dated 21.12.2023 "Resolved that Managing Director, SICOP is authorized to Handover all assets/liabilities of J&K SICOP in UT of Ladakh to Sindhu Infrastructure Development Corporation (SIDCO)."

Whereas, Managing Director, J&K SICOP vide communication No.: SICOP/MD/2024/753 dated 10.12.2024 requested for Issuance of formal transfer orders of the officials (who are domicile UT of Jammu and Kashmir) from Ladakh region to Jammu/Srinagar as per the details given below; and the officials (domicile of UT of Ladakh) be forwarded to the Government of the UT of Ladakh for their adjustment in the SINDHU Infrastructure Development Corporation (SIDCO). As such, orders to the effect of apportionment of the following posts and allocation of employees in terms of their domicile status are required to be issued:—

In the 'Uniform Policy for Settling all pending plot related cases

in the Housing Colonies developed by the Government and its agencies

in the UT of J&K' published in Government Gazette vide Notification

No. 26-JDA of 2022 Dated 08-03-2022 following are deemed to have

been incorporated :

'Under Sub-Clause 4 (Allotment of strips to the adjoining plot

holders) Clause 5, (Procedure) S. No. xii is deemed to have been

incorporated after xi. The xii shall be read as under :

1. Introduction :

These proceedings are under provisions of Section 23 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for determination of compensation in respect of net area of land proposed to be acquired measuring 00 Kanals-06 Marlas for Construction of Disposal Drain for Upgradation of road from Gurian to Pochhal in Village Matta, Tehsil and District Kishtwar. The land acquisition proceedings were initiated with the publication of Preliminary Notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Chief Engineer PMGSY Department Jammu vide No. CEJ/ PMGSY/23519-21 Dated 16-03-2020 submitted proper letter of indent for acquisition of land for Construction of Disposal Covered Drain of Link road from House of Lakhmi Chand to Upper Malipeath linking Petrol Pump NH-244 of Village Kishtwar, Tehsil and District Kishtwar. Accordingly, the Tehsildar Kishtwar vide No. 26-28/OQ. Dated 14-07-2020 had submitted the land acquisition papers to this office duly completed in all respect for further necessary action.

2. Publication of Notifications and Issue of Notices :

The local SIA team was notified as Social Impact Assessment Team (SIA) under Section 4 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 for conducting Social Impact Assessment Team (SIA) vide No. ACR/LA/2022-23/161-66 Dated 04-06-2022. Accordingly, the concerned committee members had submitted the Social Impact Assessment Study report vide No. BDO/Estt/2022-23/1198 Dated 31-01-2023 and the same was submitted to the District Collector Kishtwar for appraisal under under Section 7 of the RFCTLARR Act, 2013 vide No. ACR/LA/2022- 23/399 Dated 08-02-2023.

The District Collector Kishtwar, constituted a committee of expert group for appraisal of Social Impact Assessment Study report. Accordingly, the Multi-Disciplinary Expert Group for appraisal constituted vide Notification No. DCK/LA/22/F.No. 102/514 Dated 25-02-2023 submitted its recommendation vide No. EE/R&B/K/491 Dated 24-04-2023.

The SIA report and the recommendation of Multi-Disciplinary Expert Group was then approved and a Preliminary Notification No. ACR/LA/2023-24/82-88 Dated 09-05-2023 was issued under Section 11 of the Act stating that the land described in the schedule thereto (thereafter referred to as the said land) was needed or likely to be needed for the public prupose. The notification was issued for inviting objections within 60 days.

No objections were received against the Preliminary Notification. The proposal was then submitted to the Appropriate Government i.e. Deputy Commissioner (District Collector) Kishtwar vide No. : ACR/ LA/2023-24/352 Dated 05-08-2023, seeking approval to proceed with acquisition process and the same was approved ; and

Further, on approval of Appropriate Government i.e. Deputy Commissioner (District Collector) Kishtwar, Vide Declaration No. 11 of 2023 Dated 07-08-2023 read with endorsement No. DCK/LA/23/ F. No. 294/194 Dated 07-08-2023, it was declared under the provisions of Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the land was required for the public purpose namely Construction of Disposal Covered Drain of link road from House of Lakhmi Chand to Uppar No. 46 ] The J&K Official Gazette, 13th February, 2025/24th Magha, 1946. 1805

Malipeath linking Petrol Pump NH-244 of Village Kishtwar, Tehsil and

District Kishtwar. To facilitate causation of the above requirements,

Notice vide No. ACR/LA/2023-24/385-91 Dated 08-08-2023 was served

under Section 21 of the RTFCLARR Act, 2013, stating that all

persons having interest in the said land may submit their objections within

30 days and may appear personally or through an agent.

Under Section 21 of the RTFCLARR Act, 2013, the Government

intended to take the possession of the land in 30 days from the date

of issue of the Notice and claims to compensation for all interests in

the land as well as objections to the measurement of land under Section-

20 to be submitted to the collector for disposal within 30 days from

the date of issue of the Notice. No objections were received against

the Notice under Section 21 of the Act.

The case file was as such submitted to the Deputy Commissioner

(Appropriate Government) Kishtwar in the shape of Tentative award

Vide No. ACR/LA/2024/603 Dated 16-11-2024 and No. ACR/LA/2024/

608 Dated 22-11-2024 for approval of rates. The rates so recommended

have been approved by the Deputy Commissioner (Appropriate

Government) Kishtwar and conveyed to this office vide No. DCK/LA/

24/F No. 80(A)480 Dated 26-11-2024.

3. Ownership :

Name of the persons of whose land under acquisition is standing

in the record of rightways ascertained from the revenue records and

the same are shown in Award Statement.

4. Situation, Description and Location of the Land :

The total acquired land measuring 00 Kanals-06 Marlas under

acquisition is un-irrigated agricultural land and situated in Village Matta

of Tehsil Kishtwar District Kishtwar.

5. Valuation of the Land :

The principal for assessing the amount of compensation to be

awarded has been laid down under Section 26(1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 read with endorsement No. REV/LAJK/254/

2020 Dated 26-08-2020 and accordingly the market value of the land

was determined for further determination of compensation.

6. Determination of Compensation :

As per the provisions of the Section 30 of the Right to Fair Compensation and Transparecny in Land Acquisition, Rehabilitation and Resettlement Act, 2013, 100% of the Compensation Amount (including market value multiplied by Multiplication Factor) is to be awarded as solatium as has been determined in the Award Statement.

7. Compensation of Land :

The compensation of land is to be paid to land interested persons. The total amount of Award Workout to be Rs. 24,42,780/- (Rupees Twenty Four Lakhs Forty Two Thousand Seven Hundred and Eighty Only).

8. Summary of the Award :

The award is summarized as under :—

9. Mutation of occupancy in respect of the said land being

acquired :

The acquiring department shall ensure that the record of right and all the relevant documents related to the ownership/occupancy of the said land are accordingly modified and show the transfer of the said land solely in the name of Government consequant to taking over possession of the said land and the payment of the compensation to the concerned interested parties.

10. Correction of the record in the Record of Rights :

The Tehsildar, Kishtwar shall carry out necessary mutation in the Record of Rights in the name of Indenting Department in respect of land so acquired as per the enclosed Award Statement.

11. Apportionment :

The amount of compensation payable to interested persons as shown in the Apportionment Statement is in accordance with the provisions of Agr. Reform Act, 1976 and the guidelines given by the Revenue Department vide No. REV (LB) 10/80 Dated 23-02-1980 and the latest Girdawari entries in the Field Book as well as in Girdwari Copies. However, in case of any dispute which is not settled within reasonable time, the amount of compensation will be remitted to the court under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for jurisdiction.

12. Encumbrances :

The land under acquisition is free from all encumbrances and it

has been mentioned in the Award Statement.

13. Documents required for obtaining Award :

All the interested persons who are deemed lawfully entitled may receive compensation on submission of the below mentioned documents to office of the Collector Land Acquisition, AC (Rev) Kishtwar during working hours.

SO–134.—In exercise of the powers conferred by proviso to Article 309 of the Constitution read with Section 15 of the Jammu and Kashmir Civil Services (Decentralization and Recruitment) Act, 2010, the Lieutenant Governor is pleased to direct that after Sub-Rule (6) of Rule 14 of the Jammu and Kashmir Civil Services Decentralization and Recruitment Rules, 2010, the following shall be added as sub- rule (7) ; namely :—

''(7) The concerned Selection Committees of the Board shall also draw up a waiting list of 50% of the total number of posts 2 The J&K Official Gazette, 28th Feb., 2024/9th Phal., 1945. [ No. 47-o –––––––––––––––––––––––––––––––––––––––––––––––––––––– advertised, which shall extend to 100% where the number of vacancies is 10 (Ten) or less. The Selection Committees shall forward the waiting list, through the Board, to the requistioning authority for consideration against drop-out vacancies. The waiting list shall remain in force for a period of one year from the date the original selection list is sent to the requistioning authority. The Selection Committees shall not maintain or recommend any select or waiting list for any future vacancy or any vacancy caused on account of resignation by any selectee after appointment :

Provided that the validity period of one year of the waiting list of those selectees whose recommendation/selection is kept withheld by the recruiting agency shall be reckoned from the date of release of their recommendation.''

This notification shall be deemed to have come into force

with effect from 26-09-2023.

SO–135.—In exercise of the powers conferred by proviso to Article 309 of the Constitution read with Section 15 of the Jammu and Kashmir Civil Services (Decentralization and Recruitment) Act, 2010, the Lieutenant Governor is pleased to direct that after Rule 6 of Rule 14 2 The J&K Official Gazette, 28th Feb., 2024/9th Phal., 1945. [ No. 47-p –––––––––––––––––––––––––––––––––––––––––––––––––––––– of the Jammu and Kashmir Appointment to Class-IV (Special Recruitment) Rules, 2020, the following shall be added as Rule-7 ; namely :—

''7. Wait list.–(1) The Board shall draw a separate wait list for each combined cadre (UT/Divisional/District) equal to the number of selected candidates in each cadre, which shall remain in force for a period of one year. The Government, for the reasons to be recorded, may extend the validity of the waiting list for another 6 months.

(2) The combined wait list shall be maintained by the Service Selection Board separately.

(3) In case any vacancy remains unfilled due to non-joining, the Administrative Department shall immediately and not later than three months inform the Genral Administration Department.

(4) The General Administration Department shall consolidate the vacanices that accrue due to non-joining and forward the same to Service Selection Board, which shall forward a list of candidates next in merit to General Administration Department after following the procedure as adopted at the time of framing of the Select List.''

This notification shall be deemed to have come into force

with effect from 26-09-2023.

[ No. 47-q –––––––––––––––––––––––––––––––––––––––––––––––––––––– Rule (1) of Rule 16 of the Jammu and Kashmir Combined Competitive Examination Rules, 2018 ; namely :—

''Provided that along with the list of recommended candidates, the Commission shall also maintain a consolidated reserve list of candidates, which will include candidates from general and reserved category ranking in order of merit below the last recommended candidate under each category. The reserve list so maintained shall be treated confidential till the process of recommendations is finalized by the Commission. The reserve list shall be operated when the Government may forward a requisition to the Commission requiring it to recommend, in order of merit from the reserve list, the same number of candidates as requistioned for the purpose of filing-up the vacancies in each category. The reserve list shall be valid for a period of one year from the date of recommendation of the first list by the Commission.''

The Government futher in exercise of the powers conferred by Sub-Section (2) of Section (2) of Section (20) of the said code appoints the aforesaid Executive Magistrate as Additiona District Magistrate within the territorial Jurisdiction of District Ramban who shall have all the powers of District Magistrate under the said code.

SO–139.—Whereas, on 20-10-2023, a reliable information was

received by the Police Station, Pulwama, to the effect that one person

identified as javid Ahmad Thoker S/o Ghulam Nabi Thoker R/o Gudoora,

Pulwama, has been working for the terrorists in order to promote

terrorist activities in the area, besides, facilitating the terrorists for

transportation of arms/ammunition from one place to another for

carrying out the terrorist activities in the area ; and 2 The J&K Official Gazette, 29th Feb., 2024/10th Phal., 1945. [ No. 48-b –––––––––––––––––––––––––––––––––––––––––––––––––––––– 2. Whereas, based on the above a case FIR No. 284/2023 under Sections 18, 20 and 39 of ULA(P) Act, was registered in the Police Station, Pulwama, and the investigation, of the case was set into motion. Subsequently, during the investigation, the offences under Section 7/25 Arms Act and the Sections 23 and 38 of ULA(P) Act, were added in the case ; and

3. Whereas, during the investigation, the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the accused viz. Javid Ahmad Thoker, was arrested in the case and 02 AK-47 Rounds 02 Empty Cartridges, 02 Pouches, 04 Diaries, 01 Pen Drive, 02 Matrix Sheets and 01 Blank Poster of HM, a banned outfit, were recovered at his instance ; and

5. Whereas, during the investigation, it was found that the accused viz. Javid Ahmad Thoker, was in contact with two terrorists of HM, a banned outfit, namely Majid Ahmad Mir S/o Abdul Hamid Mir R/o Kakapora, Pulwama and Aqib Ahmad Shergojri S/o Nazir Ahmad Shergojri R/o Khampora, Budgam, who provided the recovered ammunition and incriminatory material to the accused viz. Javid Ahmad Thoker, in order to promote terrorist activities in the area ; and

6. Whereas, during the investigation, it was established that the accused viz. Javid Ahmad Thoker, was working as Over Ground Worker (OGW) for the terrorists of HM, a banned outfit, particularly the terrorists viz. Majid Ahmad Mir and Aqib Ahmad Shergojri, and was providing logistic support to them, besides, under a well knit criminal conspiracy procured ammunition and incriminatory material from the terrorists for carrying out the terrorist activities in the area ; and

7. Whereas, the accused terrorist viz. Majid Ahmad Mir, has been killed in an encounter with the Security Forces and the proceedings under the law would abate against him ; and

8. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under No. 48-b ] The J&K Official Gazette, 29th Feb., 2024/10th Phal., 1945. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their name :—

Whereas, the Authority appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused ; and

11. Whereas, after perusing the Case Diary File the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for his prosecution under the provisions of Law.

Now, therefore, in exercise of the powers conferred by Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Javid Ahmad Thoker and Aqib Ahmad Shergojri, for the commission of offences punishable under the relevant Sections of ULA(P) Act, as indicated against the each accused at Para (8) above, arising out of FIR No. 284/2023 of Police Station, Pulwama.

SO-143.––Whereas, on 08.09.2023, a reliable information was received by the Police Station, Pulwama, to the effect that two persons identified as Sahil Firdous Sheikh R/o Puchal, Pulwama and Shahid Gull R/o Wagum, Pulwama, have been working as OGWs for a terrorist namely Aqib Shergojri, and are providing logistic support to him, besides,

are in the orchards of village Gudoora, Pulwama, intended to carry out

terrorist activities in the area ; and

2. Whereas, based on the above, a Case FIR No. 239/2023 under

Sections 18, 20 and 39 of ULA (P) Act, was registered in the Police

Station, Pulwama, and the investigation, of the case was set into motion,

Subsequently, during the investigation, the offences under Section 7/25

Arms Act, and Sections 23 and 38 of ULA (P) Act were added in

the case ; and

3. Whereas, during the course of investigation, the seizure memos

were prepared and the statements of witnesses acquainted with the

facts and circumstances of the case were recorded under the relevant

provisions of law ; and

4. Whereas, during the investigation, the accused viz. Sahil Firdous

Sheikh S/o Firdous Ahmad Sheikh R/o Mahirad, Utterpora, Puchal,

Pulwama and Shahid Gull Bhat S/o Gh. Mohammad Bhat R/o Wagum,

Pulwama, were accordingly, arrested from the orchards of village

Gudoora, Pulwama, and during their personal search, the Police recorded

15 AK-47 rounds from their possession respectively ; and

5. Whereas, during the investigation, it was found that the accused

viz. Sahil Firdous Sheikh and Shahid Gull Bhat, were in contact with

a terrorist of LeT, a banned outfit, namely Aqib Shergojri S/o Nazir

Ahmad Shergojri R/o Chadoora, Budgam, who provided the recovered

ammunition and 02 hand grenades to the accused in order to promote

terrorist activities in the area. Subsequently, during the investigation, 02

hand grenade were also recovered at the instance of accused viz. Sahil

Firdous Sheikh ; and

6. Whereas, during the investigation, it was established that the

accused viz. Sahil Firdous Sheikh and Shahid Gull Bhat, were working

as Over Ground Workers (OGWs) for the terrorists of LeT, a banned

outfit, particularly the terrorist viz. Aqib Shergojri, and were providing

logistic support to him, besides, under a well knit criminal conspiracy

procured ammunition and hand grenades from the said terrorist for

Notification

Jammu, the 18th March, 2024.

SO-180.––Whereas, on 05-8-2020, a reliable information was received by the Police Station, Reasi, to the effect that some unknown persons of Mahore, area were working for Pakistan based Agency (ISI) 2 The J&K Official Gazette, 18th March, 2024/28th Phal., 1945. [No. 50-s –––––––––––––––––––––––––––––––––––––––––––––––—–––————— and were trying to establish OGW network in the area in order to

wage war against the Government of India and to disturb the peace

and tranquility in the area ; and

2. Whereas, based on the above, a Case FIR No. 63/2020 under

Sections 120-B, 121, 122, 123 and 124 IPC was registered in Police

Station, Mahore, and the investigation, of the case was taken up ; and

3. Whereas, during the course of investigation, the seizure memos

were prepared and the statement of witnesses acquainted with the facts

and circumstances of the case were recorded under the relevant

provisions of law ; and

4. Whereas, during investigation, four persons identified as Ghulam

Hussain S/o Ali Mohd R/o Kalwa Mulass, Mahore, Reasi, Ishfaq Ahmed

S/o Jamal Din R/o Mallan, Bathoie, Mahore, Reasi, Abdul Aziz S/o

Ahamadu R/o Sildhar, Mahore, Reasi and Shabir Ahmed S/o Ahmed

Din R/o Balmatkote, Mahore, Reasi, were found involved in the

commission of crime. Subsequently, the accused were arrested in the

case ; and

5. Whereas, during the investigation, it was found that the accused

viz. Ghulam Hussain, Ishfaq Ahmed, Abdul Aziz and Shabir Ahmed,

were in contact with a terrorist of LeT, a banned outfit, namely, Mohd

Qasim @ Salman S/o Mohd Shafi R/o Angralla, Mahore A/P PaK/

PoK, and were working for him in order to promote terrorist activities

in the area ; and

6. Whereas, during the investigation, it was established that the

accused viz. Ghulam. Hussain, Ishfaq Ahmed, Abdul. Aziz and Shabir

Ahmed, were working for the terrorists of LeT, a banned outfit,

particularly the Pakistani based terrorist viz. Mohd Qasim @ Salman,

and were facilitating the said terrorist for distribution of terrorist fund

among the families of killed terrorists in the area in order to wage

war against the Government of India ; and

7. Whereas, in terms of Section 196 Cr. PC., the sanction in respect

of accused viz. Ghulam Hussain, Ishfaq Ahmed, Abdul. Aziz, Shabir

Ahmed and Mohd Qasim @ Salman, has already been accorded vide

Notification S.O. No. 414 dated 8th December, 2021, by the Competent No. 50-s] The J&K Official Gazette, 18th March, 2024/28th Phal., 1945. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––———

Authority for the commission of offence punishable under Sections 121,

122, 123 and 124 IPC and the charge sheet of the case was filed

in the Court of Competent jurisdiction ; and

8. Whereas, during the trail of the case the accused viz. Ghulam

Hussain, Ishfaq Ahmed, Abdul. Aziz and Shabir Ahmed, were admitted

to bail by the Hon'ble Court. Subsequently, the Investigating Officer,

of the case has sought the permission from the Hon'ble Court vide

order dated 04-02-2023, for further investigation, of the case ; and

9. Whereas, during the further investigation, it was found that the

accused viz. Ghulam Hussain, Ishfaq Ahmed, Abdul. Aziz and Shabir

Ahmed, were in contact with the said Pakistani based terrorist viz. Mohd

Qasim @ Salman, through virtual mode and were working for him in

order to promote terrorist activities in the area. Subsequently, the

accused were re-arrested in the case and during the investigation, the

offences under Sections 18, 20, 38, 39 and 40 of ULA (P) Act were

added in the case ; and

10. Whereas, during the investigation, it was established that the

accused viz. Ghulam Hussain, Ishfaq Ahmed, Abdul. Aziz and Shabir

Ahmed, were working as Over Ground Workers (OGWs) for the

terrorists of LeT, a banned outfit, particularly the Pakistani based terrorist

viz. Mohd Qasim @ Salman, and under a well knit criminal conspiracy

were providing logistic support to him, besides, the accused viz. Ghulam.

Hassan, on the directions of said terrorist was distributing the terror

funds among the families of killed terrorists ; and

11. Whereas, on the basis of the investigation, the statement of

witnesses recorded and other evidence collected, the Investigating

Officer, has established a prima facie involvement of the below

12. Whereas, the accused viz. Mohd Qasim @ Salman, is

absconding against whom proceedings u/s 299 Cr.PC has been proposed

to be initiated against him ; and

13. Whereas, the Authority appointed by the Government under

sub-section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary file and all

the other relevant documents relating to the case and has come to

the conclusion that prima facie case is made out against the above

accused ; and

14. Whereas, after perusing the Case Diary file, the relevant

documents and also taking into consideration the views of the Authority No. 50-s] The J&K Official Gazette, 18th March, 2024/28th Phal., 1945. 5 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––——— appointed under sub-section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above mentioned accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against

the accused viz. Ghulam Hussain, Ishfaq Ahmed, Abdul. Aziz, Shabir Ahmed and Mohd Qasim @ Salman, for the commission of .offences punishable under the relevant Sections of ULA (P) Act, as indicated against the each accused at Para (11) above, arising out of FIR No. 63/2020 of Police Station, Mahore.

SO-185.––In terms of Section 28A of the Representation of the Peoples Act, 1951, the Government of Jammu and Kashmir hereby designate the following categories of Police officers and Police Personnel in all the wings of the Police Department who are involved in anly way in election related arrangements, in view of the General

Election  to Lok  Sabha  2024  for 05  Parliamentary Constituencies  of UT
of  Jammu  and  Kashmir,  as  per  the  schedule  announced  by  the  Election
Commission  of  India  vide  press  note  No.  ECI/PN/23/2024  dated  16-
03-2024,  to  perform  duties  in  connection  with  the  conduct  of  elections;
namely  :—
     1.   Director  General  of  Police.
     2.   Additional  Director  General  of  Police.
     3.   Inspector  General  of  Police.
     4.   Deputy  Inspector  General  of  Police.
     5.   Senior  Superintendent  of  Police.
     6.   Superintendent  of  Police.
     7.   Additional  Superintendent  of  Police.
     8.   Deputy  Superintendent  of  Police.
     9.   Inspector  of  Police.
    10.   Sub-Inspector  of  Police.
    11.   Assistant  Sub-Inspector  of  Police.
    12.   Head  Constable.
    13.   Constable.

The above indicated categories of the Police Officers shall be deemed to be on deputation to the Election Commission of India till the date of declaration of results of the election.
