Jammu, the 28th March, 2024.

SO–213.—Whereas,on 16-10-2023, the Police Station,Imamsahib, received a docket to the effect that a joint Naka was established by the Police/Security Forces at Manihal crossing. During the checking,a suspect while seeing the Naka Party tried to escape but was chased down on the spot and identified as Bilal Ahmed Shah S/o Miraq Shah R/o Vessu, Qazigund.During his personal search,the Police recovered 01 Pistol with Magazine and 14 Rounds from his possession; and

2. Whereas,based on the above,a Case FIR No.54/2023 under section 7/25 Arms Act and Sections 18,20 and 23 of ULA(P) Act,was registered in the Police Station,Imamsahib,and the Investigation,of the case was set into motion.Subsequently, during the investigation, the offences under Sections 38 and 39 of ULA (P) Act were added in the case; and 2 The J&K Official Gazette, 28th March, 2024/8th Chai., 1946. 3. Whereas,during the investigation,the site plan of the place of

occurrence and the seizure memos were prepared and the statements

of witnesses acquainted with the facts and circumstances of the case

were recorded under the relevant provisions of law; and

4. Whereas during the investigation,it was found that the accused viz.

Bilal Ahmed Shah, was in contact with an unknown Pakistani based handler

of LeT, a banned outfit,through virtual mode and on his directions procured

the recovered arms/ammunition from a terrorist namely,Jazim Farooq Wani

@ Abrar S/o Farooq Ahmed Wani R/o Heff Shirmal, Zainpora, in order

to promote terrorist activities in the area; and

5. Whereas, during the investigation, it was established that the

accused viz.Bilal Ahmed Shah, was working as Over Gorund Worker

(OGW) for the terrorists of LeT, a banned outfit, and was providing

logistic support to them,basides, under a well knit criminal conspiracy

procured arms/ammunition from the terrorist viz. Jazim Farooq Wani @

Abrar,on the directions of Pakistani based handler for carrying out

terrorist activities in the area; and

6. Whereas, the accused terrorist viz. Jazim Farooq Wani @ Abrar,

has been killed in an encounter with the Security Forces and the

proceddings under the law would abate against him; and

7. Whereas,on the basis of the investigation,the statements of

witnesses recorded and other evidence collected,the Investigating

Officer,has established a prima facie involvement of the below

mentioned accused for the commission of offences punishable under

section of the Unlawful Activities (Prevention) Act,1967,as shown

Whereas,the Authority appointed by the Government under Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,1967,has independently examnied the Case Diary File and all the [ No. 52-g The J&K Official Gazette, 28th March, 2024/8th Chai., 1946. 3 –———–––––––––––––––––––––––––––––––––––––––––––––– other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out against the above accused, and;

9. Whereas,after perusing the Case Diary File,the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act,1967, the Government is of the view that there is

sufficient material and evidence available against the above-mentioned

accused for his prosecution under the provisions of law.

Now,therefore,in exercise of the powers conferred by Sub-

Section (2) of Section 45 of the Unlawful Activities (Prevention) Act

1967,the Government hereby accord sanction for launching prosecution

against the accused viz. Bilal Ahmed Shah, for the commission of

offences punishable under Sections 18, 23 and 39 of ULA (P) Act,

arising out of FIR No. 54/2023 of Police Station, Imamsahib.

Whereas, the Government of Jammu and Kashmir, in exercise of

SO-214 dated 29-03-2024 defined the area, the particulars/details of

which are given in Annexures-A, B, C, and D appended to this

notification,situated at Village Kaleeth, Tehsil Akhnoor, District Jammu,

J&K as an area for the purpose of carrying out periodically, ''Field

Firing Practice'' for Army for a period of ten (10) years, with effective

from 03-06-2024 to 02-06-2034.

Now, therefore, through the medium of this notice, the Government

in pursuance of Sub-Section (3) of Section 9 of the Manoeuvers,

Field Firing and Artillery Practice Act, 1938 hereby gives notice of its

intention to issue on or after expiry of two months from the date

SO–217.—In exercise of the powers conferred under Sub-Section (1) of Section 20 of the Code of Criminal Procedure, 1973, the Government hereby appoint officers as per appended Annexure "A"and "B" to be the Executive Magistrate,who shall exercise all the powers

of an Executive Magistrate within their respective territorial juridicion of District Poonch in view of the General Elections of the Lok Sabha- 2024.
