ORDER

05.02.2025; Ld APP for the State present. Nemo for accused person. From the perusal of challan, it reveals that accused is continuously absent since last more than last year and never appeared before this court after presentation of challan. It has also been perused from the file that despite repeated warrants, the presence of the accused could not be secured for the purpose of trial in the present case. The warrants issued against him time and again received back unexecuted and on dated 17.12.2024, Non Bailable Warrant was again issued against the accused with the directions to the TamiliNo. 49] The J&K Official Gazette, 6th March, 2025/15th Phal., 1946. 2223 concerned to remain present in the court on due date of hearing. Perusal of the file also reveals that personal bond and surety bond of the accused persons stand forfeited on 26-06-2024. Consequently, Show Cause Notices and Bailable Warrant on 17.12.2024 was also issued to the surety of the accused. However, inspite of various notices and bailable warrant issued to the surety of the accused, same were never executed and separate Robkars were framed against surety of the accused accordingly. Today on 05.02.2025, Process Server (Tamili Constable) namely Hassan Ali 952/K posted at Police Station Malhar present in the court whose statement on oath has been recorded in the open court with respect to non-execution of the warrants issued against the accused and retained on the record of the file: He stated that the accused could not traced out despite making many efforts and there are no imminent chances of the accused being apprehended as he is involved in multiple cases and to evade his arrest, he is residing somewhere outside the State, whereabouts are still unknown. Further, as stated by his wife, he neither contacted at his home nor he come since last one year. This shows that the conduct of the accused to remain absent from the proceeding is habitual and he deliberately remained absent from the proceedings. In the background, Ld. APP prays for initiating proceedings under Section 512 of Cr. PC against the accused Talib Hussain S/o Abdul Hamid R/o Lohai, Tehsil Lohai Malhar, District Kathua. I have given my thoughtful consideration to the submission made by the Ld. APP and perused the record. Taking into account the facts and circumstances of the case, as also the statements made, on oath, by the serving official, I am satisfied that the accused has absconded and there is no immediate prospect of his being arrested. Accordingly, proceeding under Section 512 of Cr. PC is initiated against accused namely Talib Hussain S/o Abdul Hamid R/o Lohai, Tehsil Lohai Malhar, District Kathua. Office is directed to issue, General Warrant of arrest against the accused. One copy each of the warrants are forwarded to SHO Police Station Billawar, and Senior Superintendent of Police, Kathua for execution and one copy of the warrants is forwarded to Manager, Ranbir Govt., Press, Jammu for publication in the Govt. Gazette and one copy of warrant to be attached with main challan file. The warrant shall remain alive till the same is executed and the accused will be apprehended and produced before this Court. Meanwhile file be consigned to record after due compilation under law and the same shall be taken up for consideration when the warrant will get executed. Robkars issued against surety of the accused are also consigned to records and shall be taken as upon appearance of accused before the court.

Whereas, Chief engineer PMGSY (JKRRDA) Kashmir, vide No. CE/PMGSY/NS/5468-70 Dated 10-10-2023 has furnished the indent/ requisition for cost of zero Rupee on account of acquisition of land measuring 02Kls-16Mls-06Srs-19Sft in estate Bakhipora, Batpora, Manchanpora, Fidarpora and Soin Sadnaar Tehsil Dangiwacha before Appropriate Government (Deputy Commissioner, Baramulla).

Whereas, on the basis of indent/requisition for acquisition of aforesaid land, the Collector Land Acquisition (ADC) Sopore issued a preliminary Notification under Section-11 of RFCTLARR Act, 2013 vide No. : ADC/Spr/LAC/793-99 Dated 29-07-2024 calling upon the land owners/interested persons to file their objections, if any.

Whereas, from perusal of the Notification under Section-11 of RFCTLARR Act, 2013, it appears that the preliminary Social Impact Assessment Study has been carried out and the findings thereof as mentioned in the said Notification are as under,—

1. That the land has been donated voluntarily by owners but the cost of the structure is to be paid for which they produced affidavits duly attested by Munsif Judicial Magistrate Tragpora Dangiwacha.

2. No owner becomes landless. Moreover, owners' offered land willfully is coming under the structures and required for the purpose.

Whereas, the Collector Land Acquisition (ADC) Sopore submitted the case vide No. ADC/Spr/LAC/Misc/24/1970-71(A) Dated 10-10- 2024 for issuance of declaration in pursuance of the provisions of Section-19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR) and relevant rules.
