Provisional admission as an Advocate, granted under the Advocates Act, 1961 in favour of Mr. Moien Ul Islam S/o Ab Majeed Raina R/o Hib- Dangerpora, Rafiabad, Tehsil Watergam, District Baramulla vide Notification No. 172 of 2023/RG/LP Dated 13-02-2023 has been declared as Absolute/ Final.

GOVERNMENT OF JAMMU AND KASHMIR

OFFICE OF THE COLLECTOR LAND ACQUISITION

(SUB-DIVISIONAL MAGISTRATE GUREZ)

Notification in terms of Section 21 of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013.

Whereas, it appears to the Government that land in the Wanpora-

Markoot alternate road area is required for a public purpose, a

preliminary notification to that effect was published on SDM/G/2024/

425-29 Dated 01-07-2024 in the prescribed manners.

And whereas, the Government intends to take possession of the

land described below, all persons interested in the land are hereby

required to appear personally or by agent or advocate before the

Collector at 11:00 A.M on 12-12-2024 at Revenue Complex, Dawar

Gurez.

The said land is private Shamilat, and State land. The total area

under acquisition is 53 Kanals 13 Marlas and 7.5 Sirsai under different

Khasra numbers (copy enclosed).

The land is being acquired for the purpose of Wanpora-Markoot

alternate road.

Interested persons are required to state the nature of their

respective interests in the land, the amount and particulars of their claims

to compensation for such interests, their claims to rehabilitation and

resettlement, along with their objections, if any, to the measurements

made.

A plan of the land may be inspected in the office of the Collector

during working hours.

No person shall make any transaction or cause any transaction

of land specified in the preliminary notification or create any

encumbrances on such land from the date of publication of such

notification till such time as the proceedings under this Act are

completed.

Persons interested in the land have the right to fair compensation,

rehabilitation and resettlement as per the provisions of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013.

1. Whereas, the proper indent was placed by General Manager

Chenab Valley Power Project Private Limited vide communication

No. CVPP/PDHEPP/LAND/2012/216 Dated 23-11-2012, and

Chief Engineer Kirthai/HEPPs/292-95 Dated 26-10-2015 for

acquisition of land for construction of Pakal Dool HE Project

at Village Kwartenji, Tehsil and District Kishtwar, before the

Collector Land Acquisition ACR Kishtwar ; and 2420 The J&K Official Gazette, 13th March, 2025/22nd Phal., 1946. [ No. 50

2. Whereas, the Collector under rules and as per the provisions of

J&K Land Acquisition Act issued notifications under Section 4(i),

Sec-6&7, Sec-9 & 9A followed by Final Award from this office

Vide No. ACR/K/2016/Award/01-10 Dated 10-02-2016, for Land

Measuring 1193Kls 04Mls comprising of Structures, Fruit Bearing

3. Whereas, some of the aggrieved landowners filed objections/

representations before this office as well as before Deputy

Commissioner Kishtwar for assessment and payment of left-

out fruit bearing trees and structures of Arzi Village coming under

the alignment of Pakal Dul HEPP. Accordingly, a commission

was constituted and joint inspection was conducted by concerned

technical departments at the relevant point of time and

also submitted assessment of left-out fruit bearing trees and

structures ; and

4. Whereas, the endorsement made by the indenting agency

pertaining to left out fruit bearing trees has been received in this

office Vide No. CVPP/PDHEP/CGM/2020/265 Dated 06-03-2020

inter alia, authorizing the Collector for further disbursement of the

amount of Rs. 1796500/= including Jabrana @ 15% ; and

5. Whereas, the endorsement made by the indenting agency

regarding authentication of left out structures has been received

in this office vide No. CVPP/PDHEP/CGM/2020-318 Dated

17-03-2020 followed by the letter No. CVPP/PDHEP/GM (I/c)/

2024/990 Dated 21-08-2024 inter alia, authorizing the Collector for

further disbursement of the amount of Rs. 29,00,300/= including

Jabrana @ 15% ; and

6. Whereas, it is the settled principle of law that all the reassessments

done on the basis of the consideration of the objections filed by

the landowners beyond the mandatory period as warranted under

law shall have to be treated as null and void and only such

assessments conducted under rules and duly endorsed by the

indenting agency as well as the respective agencies are to the

7. Whereas, the matter regarding the amount to be incorporated in

the supplementary award was considered and the case file was put

before the District Collector on 14-12-2024 for approval and necessary

directions and the District Collector has granted the approval for the

case file on 16-12-2024 for finalizing the compensation as arrived

after assessing the revised number of left out fruit bearing trees

and structures, done by the concerned technical departments ;

and

8. Whereas, the amount involved in finalizing the compensation as

arrived after assessing the revised number of left out fruit bearing

trees and structures, done by the concerned technical departments

is tabulated as under :—

9. Whereas, it is the settled principle of law that all the reassessments

10. Whereas, it is pertinent to mention here that the Hon'ble High

Court in the Judgement passed in case titled Divisional

Commissioner Srinagar V/s Gh. Nabi Butt and Ors has

adjundicated the matter, the relevant part of which is reproduced

as under :—

''10. As a sequel to the above discussion, we uphold the

view of the learned single judge in its conclusion but substituted 2422 The J&K Official Gazette, 13th March, 2025/22nd Phal., 1946. [ No. 50

the reasoning adopted by the Hon'ble Supreme Court in Mohanji's

case (supra) ; in other words there is no impediments for payment

of compensation by the state by publishing a supplementary award

in respect of the trees, super-structures and machinery, if the same

has been omitted in the original award. It is further clarified that

payment of compensation in respect of the super-structure, trees

and machinery would not result into lapse of proceedings having

gone beyond a period of two years. Therefore, the learned Single

Judge has rightly directed the appellants to re-consider the matter

and pay to the writ petitioner-respondents their dues even in respect

of super-structures, machinery and trees.''

Now, therefore, in pursuance to the Hon'ble High Court judgement/

directions in the case titled Divisional Commissioner Srinagar V/s Gh.

Nabi Butt and Ors. the facts and circumstances associated with the

instant case, I, Idrees Lone (JKAS) Collector Land Acquisition,

Kishtwar do hereby circulate the Draft Supplementary Award for

inviting objections, if any, by all concerned within a period of 15 (Fifteen)

Whereas, Chief Engineer PWD (R&B) Jammu vide No. CEJ/LA/ 0796-98 dated 6-09-2021 has placed indent for Acquisition of land measuring 25 Kanals 12 Marlas ½ Sarsai situated at village Kotedhara to Chambitrar Tehsil Rajouri District Rajouri for the construction of PMGSY road from Kotedhara to Chambitrar.

Whereas, vide No. AC/LA/501-11 dated 22-02-2024 a committee was constituted for conducting Preliminary Enquiry under SO 440 of 2023 dated 22-02-2024 for Acquisition of land under RFCTLARR Act, 2013 for public purpose.

Whereas, committee S.O. constituted has submitted Preliminary report vide No. 754 dated 13-09-2024 with a report that road has already been constructed, the project has been made in such way that no structures as well as Horticulture orchards came within alignment of road. That the proposed land is already under the use of Indenting Department and there is no displacement and no rehabilitation involved and no adverse impact of acquisition either socially or ecologically. The committee has recommended for acquisition of land for the said project.
