Subject :—The Jammu & Kashmir and Ladakh, Lawyers Chambers

(Allotment and License Fee) Rules, 2024.

NOTIFICATION

No. 08 of 2025 RG/LP Dated 04-01-2025.

In exercise of the powers vested under Article 227 read with Article

235 of the Constitution of India and all other powers enabling in this behalf,

the High Court of Jammu & Kashmir and Ladakh, hereby makes the

following Rules for the allotment of Chambers to the lawyers in the premises

of the High Court and the Courts under its jurisdiction.

1. Short Title and commencement :

(a) These Rules shall be called "The Jammu & Kashmir and

Ladakh, Lawyers Chambers (Allotment and License Fee)

Rules, 2024.

(b) They shall come into force from the date they are notified by

the High Court.

2. Definitions : Unless there is anything repugnant to the subject

or context in these rules,—

(a) 'Advocate' means an Advocate entered on the roll of State

Bar Council of Jammu & Kashmir and Ladakh (High Court of

Jammu & Kashmir and Ladakh), under the provisions of the

Advocates Act, 1961 and who is ordinarily practising in the High

Court or in any Court Subordinate thereto, where the allotment

of chambers is to be made.

(b) 'Bar Association' means Bar Association of the High Court,

District or the Taluka Court concerned.

Jammu & Kashmir and Ladakh.

(d) 'District Judge' means a District & Sessions Judge of the

Civil District/Sessions Division, concerned.

(e) 'Registrar General' means the Registrar General of the High

Court of Jammu & Kashmir and Ladakh.

(f) 'Registrar Judicial' means the Registrar Judicial of Srinagar

or Jammu Wing of the High Court of Jammu and Kashmir and

Ladakh, as the case may be.

(g) 'High Court' means High Court of Jammu and Kashmir and

Ladakh.

(h) 'Subordinate Court' means a Court of original Civil or Criminal

Jurisdiction established under the provisions of the Jammu &

Kashmir Civil Courts Act, 1977 or the Bhartiya Nagrik Suraksha

Sanhita, 2023 or any other corresponding law and shall include

the Court of District and Sessions Judge/Additional District and

Sessions Judge.

(i) 'Lawyers Chamber' shall mean any room in the building

constructed and earmarked for being used as the Chamber, by

the eligible Advocates within the premises of the High Court or

the Subordinate Court concerned.

(j) Categories of Chambers :—Lawyers Chambers, in the High

Court premises, shall comprise of the following categories :—

(A) Category-I- shall be earmarked for the Designated Senior

Advocates and one Assisting Advocate.

Provided that the Chief Justice, in his discretion may permit

allotment of the specified number of such Chambers in this

category, to any other class of Advocates.

(B) Category-II- shall be meant for group of at least three eligible

Advocates. (Note : The maximum number of the Advocates in

the group, to whom the Chamber can be allotted, shall be such,

as may be decided by the Committee and approved by the Chief

Justice.

High Court, shall be of single category and shall be allotted to a

group of at least three Advocates.

(j) 'Committee' means a committee constituted for the purpose

of allotment of Chambers in the High Court premises or in any

premises of any Court subordinate to its jurisdiction. The

Committee for allotment of chambers in the High Court premises,

shall comprise of three Judges of the High Court to be nominated

by the Chief Justice and for allotment of Chambers in the

premises of any Court subordinate to High Court, shall comprise

of the District Judge (Chairman), Senior most Additional District

Judge and the Chief Judicial Magistrate of the District concerned

(as members) and the President of the Bar Association

concerned or his nominee (as the Member). Chief Judicial

Magistrate concerned shall act as Member Secretary of the

Committee.

3. Eligibility :

Only those Advocates who have been continuously practising

in the High Court or in the Subordinate Court concerned for a

period of 5 years or more and are the members of the Bar

Association concerned, shall be eligible for allotment of

Chamber.

4. Disqualification :

(i) An Advocate who is already having a Chamber allotted to

him either in the premises of High Court or in the premises of

any Subordinate Court, shall not be eligible for allotment of

Chamber unless he/she has surrendered the possession of the

already allotted Chamber.

(ii) Any Advocate against whom disciplinary proceedings

have been initiated in terms of Advocates Act 1961, shall not be

eligible for allotment of Chamber during pendency of the

proceedings.

5. Mode of allotment :

(i) The allotment of Chamber shall be made on License basis,

initially for a period of 2 years extendable for such period and No. 51] The J&K Official Gazette, the 20th March., 2025/29th Phal., 1946. 677 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––—— on such terms as may be determined on the expiry of the said

term by the concerned committee and approved by the Chief

Justice.

(iii) Lawyers Chamber in the High Court or in any Subordinate

Court premises shall be allotted only to groups of Advocates

which shall comprise of a Designated Senior Advocate and one

assisting Advocate or a group of at least three Advocates out

of which, the Advocate with maximum years of practice shall

be the main allottee and the other two Advocates in the group

shall be the co-allottees of the Chamber :

Provided where the physical dimensions of any Chamber permit

for accommodation of more Advocates, the same may be allotted

to a group of Advocates comprising of more than three

Advocates.

(iii) The possession of the Chamber shall be handed over only to

the main allottee.

6. Application for Allotment & Procedure for Allotment :

(i) A group of eligible Advocates, as mentioned above, desirous

of occupying a lawyers Chamber in the premises of the High

Court or of a Court subordinate thereto, as the case may be,

may make an application for allotment of Chamber, to the

Registrar Judicial or to the District and Sessions Judge concerned,

as the case may be, through the President of the Bar Association

concerned in the prescribed Form (Annexure -A).

(ii) The application for allotment of Chamber, shall be

accompanied by an application fee of Rs 500/- by way of Demand

Draft in the name of Registrar Judicial or The District Judge

concerned as the case may be.

(iii) On receipt of the application, the same shall be placed before

the Committee concerned.

(iv) The Committee, after scrutiny of the applications received,

shall draw a lot for the purpose of allotment of Chambers.

(v) Notwithstanding anything contained in sub rule (i) and (iii)

above, the Committee may allot a Chamber to an Advocate,

who is physically handicapped or is otherwise deserving.

husband/wife or a firm of Advocates, they shall be eligible for

allotment of only one Chamber.

Provided always that the Committee may, in appropriate cases,

relax the bar in case of otherwise eligible Advocates.

7. Security Amount :

(i) Within 15 days' time from the date of publication of final

allotment list the Allottees shall deposit by way of Demand Draft

Security Deposit in such amount as may be fixed by the committee

and approved by the Chief Justice from time of time favouring

Registrar Judicial concerned or the District Judge concerned, as

the case may be.

(ii) The money received on account of Security Deposits shall

be kept in a Fixed Deposit Account to be opened by the Registrar

Judicial concerned or the District Judge concerned, as the case

may be.

(iii) The interest accrued on such deposits shall be credited in

the Savings Bank A/C to be maintained by Registrar Judicial or

District Judge for deposition of License fee, for defraying the

expenses as may be required to be incurred for routine up-keep

of the Chamber premises and for payment of wages etc.

8. Monthly License fee :

(a) The monthly License fee for the Allotted Chamber shall

beas under ;—

(i) For Chambers allotted to Senior Designated Advocates with

one Assistant: Rs. 1200 p. m. i. e. Rs. 800/p.m. for Designated

Senior Advocate and Rs 400/- p.m for one Assisting Advocate.

(ii) Chamber allotted to a group of three Advocates: Rs 1200/- p.m.

i.e each allottee Advocate shall pay Rs 400 p.m. (Note: In case

the Chamber is allotted to a group of more than three Advocates

Licence fee Amount of Rs. 1200/- p. m shall be payable in

equal proportion by the Advocates.

(iii) The license fee shall also be payable by the allottees for the

period during which courts remain closed.

9. Electricity Charges :

(a) A separate electricity meter shall he installed for each of the

Lawyers Chamber and the electricty bill thereof shall be paid

by the allottees of the respective Chamber, as per the actual

consumption shown in the electricity meter.

(b) The electricity & other charges incurred for maintaining

power supply and cleanliness of the common facilities such

as toilet, lift, stairs etc shall be borne by the Registrar Judicial

or the District Judge out of the License Fee Account,

maintained for the purpose.

10. Effective Date of Allotment :

The allotment shall be effective from the date on which the

Chamber is allotted for occupation, pursuant to an order of

allotment. If the chamber is not occupied within a period of

fifteen days from allotment, the allotment shall be cancelled.

11. Allotment not to confer any tenancy, sub-tenancy, lease,

title, or interest etc. in favour of allottee :

The allotment of Chamber, in no case shall operate, nor shall be

construed, to create or grant any lease, tenancy, or any right,

title or interest into or upon the Chamber in favour of the allottee.

The allottee shall, in no circumstance claim or plead any right to

tenancy or sub-tenancy, lease or sub-lease with regard to the

allotted Chamber or any right other than that of a bare user.

12. Termination of allotment : Allotment of Chamber shall

terminate : -

(a) on its cancellation by the Committee ; or

(b) on its surrender by the allottee concerned ; or

Association ; or

(d) on the allottee's name being removed from the roll of State

Bar Council ; or

(e) on death of the allottee.

(f) on failure to pay license fee for three consecutive months.

13. Duties of allottees :

(i) The allottee shall use the Chamber only as a Lawyer's office

and for no other purpose whatsoever.

(ii) The allottee shall not part with, in any manner the user and

consequent occupation of possession of the premises to any other

person or grant any special user or license to any person or to

transfer or assign the whole or any part of the Chamber in favour

of any other person. It is expressly intended and meant that the

permission given hereunder can and shall in no event be

assignable, or transferable in any form, device, method or

arrangement.

(iii) The allottee shall not make any structural additions or

alterations in the Chamber without the consent in writing of the

Registrar Judicial or the District Judge concerned.

(iv) The allottee shall, during the currency of the allotment, be

responsible for the proper up-keep & maintenance of the

Chamber.

(v) The allottee shall, during the currency of the allotment, be

responsible for any damage caused to the Chamber or to the

services provided therein beyond usual wear and tear and act of

God.

(vi) Allottee shall not be in arrears of license fee for a period

exceeding three months.

(vii) The allottee shall not cause or permit to be caused any

damage to the Chamber or to the main building or any part

thereof.

(vii) The allottee shall indemnify the High Court against any loss

or claim preferred against him/it by third parties as a result of

acts of omissions and commissions by the allottee or his agent(s).

(viii) The allottee shall not conduct himself in manner which is a

nuisance and which causes annoyance to any adjoining or

neighbouring allottee.

(ix) The allottee shall not impede in any way the officers, servants

or agents of the High Court or Subordinate Court, as the case

may be, in the exercise by them of the Court's right of possession No. 51] The J&K Official Gazette, the 20th March., 2025/29th Phal., 1946. 681 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––—— and control of the Chambers and in particular shall give reasonable

assistance and facility to such officers, servants or agents for

the general up-keep and maintenance of the layout, decoration,

fittings and fixture of the Chambers

14. Chamber Timings :

No allottee shall be entitled to use the allotted Chamber

w.e.f. 1st May to 31st October before 9.00 a.m and after

6.00 p.m & w.e.f 1st November to 30th April before 9.30

a.m and after 5.30 p.m, on any day except with the written

permission of Registrar Judicial or District and Sessions

Judge concerned, as the case may be.

15. Non-compliance of the terms & conditions by

Allottee : If the allottee at any time, fails or neglects to

perform and observe any of the terms and conditions or

the rules herein contained, and on his part to be observed

and performed, then in any such case, or for any reason

whatsoever, the Committee may, without prejudice to other

rights and remedies, by giving fifteen days' notice in writing

to him/her, determine the license and the allottee shall, upon

such determination, make over vacant possession of the

Chamber without any right to compensation whatsoever

and without any let or hindrance.

16. Forfeiture of Security :

(i) In the event of breach of any term or condition of allotment

required to be observed by the allottee, the Registrar Judicial

or the District and Sessions Judge concerned, as the case

may be, without prejudice to the other rights and remedies,

will be entitled to forfeit the security or any part thereof; and

in such an event the allottee shall pay such additional sum

immediately as may be called upon by the Registrar Judicial

or the District and Sessions Judge, concerned, as the case

may be, to pay so that the security deposit shall at all times,

during the continuance of allotment, be the sum as may have been fixed by the High Court.

[ No. 51 ––––––––––––––––––––––––––––––––––––––––––––––––—–––———— (ii) On the expiration or early termination of license or when the allottee ceases to be in possession of Chamber, the Registrar Judicial or the District & Judge concerned, shall return the security deposit or part thereof as aforesaid.

17. Control :

The Administrative control over the Lawyer's Chambers shall vest in the Registrar Judicial or District Judge, as the case may be.

18. Appeal :

(i) In case of an Advocate being aggrieved by any decision/ order of the Committee and/ Registrar Judicial or the District Judge, as the case may be, in respect of any subject matter of these rules, an appeal shall lie to the Chief Justice against such decision within a period of 30 days from the date of the impugned decision/order.

Provided that the period spent for obtaining a copy of the order, if applied for within limitation, shall be excluded for the purpose of computing the period of limitation.

(ii) Immediately on receipt of the appeal, the Registrar General submit a request to the committee for record pertaining to decision taken by it or call the record from Registrar Judicial or District Judge concerned, as the case may be and place the same before the Chief Justice for perusal and orders.

(iii) The decision of the Chief Justice on the appeal preferred under sub-rule (i) above shall be final and it shall not be open to challenge in any Court.

19. Amendments of Rules :

The High Court may, from time to time, make amendments and additions to these rules as may be considered necessary.

20. Interpretations :

In the event of any dispute as to the interpretation of any of these rules, the decisions of the Chief Justice shall be final.

21. Residuary Powers : Nothing in these rules shall be

deemed to affect the powers of the Chief Justice to make No. 51] The J&K Official Gazette, the 20th March., 2025/29th Phal., 1946. 683 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––—— such order and amend the rules from time to time as may

be deemed fit with regard to all matters forming part of

subject matter of these rules and all matters incidental or

ancillary thereto not specifically provided for herein or in

regard to matters as have been provided for or have not

been sufficiently provided for herein.

22. Repeal & Savings : On coming into force of these rules,

all the previous rules, instructions and Guidelines governing

any matter covered by the present rules, shall stand

repealed.

Provided nothing contained in the present rules shall affect

the validity of anything done, any action or decision taken

under the previous rules, before the commencement of the

present rules.

REPORT OF SIA :

The proceess for conduct of Social Impact Assessment report

under the provisions of Section 4 of the Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 was initiated as per this office No. ADC/AWP/LA/20-21/

148-57 Dated 23-10-2020, in concurrence with the District Collector

Office order under endorsement No. DCP/LA/2020/610-30 Dated

the task for conduct of the field survey for the proposed project.

EVALUATION OF SOCIAL IMPACT ASSESSMENT REPORT :

On the basis of the recommendations and the observations

submitted by he committee constituted, it was established that the land

for which the indent stands placed is required for legitimate and bona fide

public purpose which necessitates the acquisition of land identified.

LA/2021/1618-19 Dated 23-02-2021 and DCP/LA/2024/716 Dated

30-03-2024.

PUBLICATION OF NOTIFICATION AND ISSUE OF

NOTICES :

The preliminary notification under section 11(1) of the Right to

Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013 was issued vide this office Notification

No. 05 of 2021 Dated 08-06-2021 under endorsement No. ADC/AWP

/LA/21-22/98-104 Dated 08-06-2021 for calling upon the objections, if

any, from the interested person/landowners. The same was got published

in the official gazette on 5th May, 2022 in Volume 135 and wide publicity

was also made. In response to the said notification, during the stipulated

period of time no objection was received by this Collectorate and

accordingly the case was submitted under Section 15 of the Act vide

this office No. ADC/AWP/LA/24-25/100-104 Dated 20-06-2024 with

recommendations to the District Collector, Pulwama for a decision and

issuance of declaration under Section 19 of the Act.

The case was examined by the ''appropriate Government'' District

Collector who after thoughtful consideration is satisfied that the land

under acquisition is in the interest of the public purpose. The

''appropriate Government'' District Collector has issued declaration

under section 19 (1) of the Right to Fair Compensation and Transparency

in Land Acquisition, Rehabilitation and Resettlement Act, 2013 vide

Notification No. 01 of Rev/LA of 2024 Dated 01-10-2024 under

endorsement No. DCP/LA/2024/892-96 Dated 01-10-2024, that the land

measuring 01 Kanal is required for construction of Tube-Well and

Service Reservoir for WSS, Khandaypora at Village Khandaypora,

Tehsil Awantipora.

Public notice under Section 21(1) of the Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 was issued to the interested persons/land owners to state

the particulars of the land so needed, and to state the nature of their

claims to compensation for such interests, their claims to rehabilitation

and resettlement along with their claims to compensation for such

interests, their claims to rehabilitation and resettlement along with their

objections, if any, to the measurement made and to appear personally

or by agent or advocate within a period of 30 days. During the prescribed

period of time no such objections was received by this Collectorate.

METHODOLOGY USED FOR DETERMINATION OF

COMPENSATION :

On the basis of alignment given by the PHE (Jal Shakti) Department

revenue extracts, including khasra Paimaish were submitted by the

Tehsildar Awantipora. The type of land for khasra number 162 Min

(01 Kanal) is recorded as Bagi Khushki. The land rates per kanal as

applicable to the type of land stands notified by the Chairman District

Valuation Committee vide his office Notification Number 80/DCP-SQ

of 2023 Dated 23-12-2023 under endorsement number DCP-SQ/22-23/

4065-78 dated 23-12-2022. The value of the land as per the market

value guidelines for the corresponding year is as under :—

There is no residential/commercial structure on the proposed site.

POSSESSION OF LAND :

The possession of the land was handed over by the land owner to the Executive Engineer, PHE, Jal Shakti Division, Pulwama prior to initiating the land acquisition proceedings. Therefore the department had already started the developmental activities.

MUTATION OF OCCUPANCY IN RESPECT OF THE SAID

LAND BEING ACQUIRED :

Consequent upon taking over possession of the said land and the

payment of the compensation to the concerned interested person, the

Tehsildar concerned shall ensure that the revenue records and all the

relevant documents relating to the ownership/occupancy of the said land

are accordingly updated and show the transfer of the said land solely

in the name of Government through Jal Shakti (PHE) Department.

APPORTIONMENT :

Compensation amount will be paid accordingly to the latest entries

in the Revenue Record and as per enquiry conducted under Section 23.

In case of any dispute, which I cannot settle within reasonable time,

the amount of compensation will be remitted to the court under Section

64 of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013 for the

determination of ownership rights.

ENCUMBRANCES :

The land under acquisition is free from all encumbrances and has

been mentioned in the Award statement.

DETERMINATION OF SOLATIUM :

As per the provisions of Section 30(1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013, 100% of the market value is awarded as

Solatium has been determined in the award statement.

COMPENSATION OF LAND :

After considering the parameters provided in Section 26 across

29 of the Act, the compensation of the land stands determined. The

total amount of award works out to be Rs. 17,96,000/- (Rupees

Seventeen Lac Ninety Six Thousand Only).

INTRODUCTION

These proceedings are under provisions of Section 23 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for determination of compensation in respect of net area of land proposed to be acquired measuring 18 Kanals 07 Marlas for Construction of link road namely Shivnagar Sarwan road to Shanna road via HSS Feller Village Feller of tehsil and District Kishtwar. The land acquisition proceedings were initiated with the publication of Preliminary Notification Under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Chief Engineer PW(R&B) Department, Jammu vide No. CEJ/ LA/02-07 Dated 18-11-2021, submitted proper letter of indent for acquisition of land for Construction of link Road namely Shivnagar Sarwan road to Shanna road via HSS Feller Village Feller of Tehsil and District Kishtwar. Dated 01-10-2021, had submitted the land acquisition papers to this duly completed in all respect for further necessary action.

1. PUBLICATION OF NOTIFICATIONS AND ISSUE OF

NOTICES :

The local SIA team was notified as Social Impact Assessment Team (SIA) U/s 4 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for conducting Social Impact Assessment Team (SIA) Vide No. ACR/LA/ 2022-23/183-88, Dated 07-06-2022. Accordingly, the concerned committee members had submitted the Social Impact Assessment Study report within a time bound manner and the same was submitted to the District Collector Kishtwar for appraisal under u/s 7 of the RFCTLARR Act, 2013 vide No. ACR/LA/2023-24/397. Dated 09-08-2023.

The District Collector Kishtwar, constituted a committee of expert group for appraisal of Social Impact Assessment Study report. Accordingly, the Multi-Disciplinary Expert Group for appraisal constituted was constituted by District Collector Vide Notification No. DCK/LA/ 23/F.No. 294/261 Dated 22-08-2023.

The SIA report and the recommendation of Multi-Disciplinary Expert Group was then examined and a Preliminary Notification No. ACR/LA/2023-24/575-81 Dated 09-10-2023 was issued u/s 11 of the Act stating that the land described in the schedule thereto (thereafter referred to as the said land) was needed or likely to be needed for the public purpose. The notification issued for inviting objections within 60 days.

No objections were received against the Preliminary Notification and served copy has been received back from Tehsildar Kishtwar vide No. OQ/Gen/1033 Dated 13-03-2024. The proposal was then submitted to the Appropriate Government i.e. Deputy Commissioner (District Collector) Kishtwar vide No. ACR/LA/2023-24/59 Dated 13-05-2024, seeking approval to proceed with acquisition process and the same was approved ; and

Further, on approval of Appropriate Government i.e. Deputy Commissioner (District Collector) Kishtwar, vide Declaration No. 17 of 2024 Dated 21-05-2024 read with endorsement No. DCK/LA/23/F. No. 287/49 Dated 21-05-2024, it was declared under the porvisions of Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the land was required for the public purpose namely Construction of link road namely Shivnagar Sarwan road to Shanna road via HSS Feller Village Feller No. 51 ] The J&K Official Gazette, 20th March, 2025/29th Phal., 1946. 2571

of Tehsil and District Kishtwar to facilitate causation of the above requirements, Notice vide No. ACR/LA/2024/282-88 Dated 18-07-2024 was served under section 21 of the RTFCLARR Act, 2013, stating that all person having interest in the said land may submit their objections within 30 days and may appear personally or through an agent.

Under Section 21 of the RTFCLARR Act, 2013, the Government intended to take the possession of the land in 30 days from the date of issue of the Notice and claims to compensation for all interests in the land, had to submitted to the Collector for disposal within 30 days from the date of issue of the Notice No. objections were received against the Notice u/s 21 of the Act and served copy has been received back from Tehsildar Kishtwar vide No. 955-56/Gen/OQ dated 24-07- 2024.

The case file was as such submitted to the Deputy Commission (Appropriate Government) Kishtwar in the shape of Tentative award Vide No. ACR/LA/2024/484 Dated 23-10-2024 for approval of rates. The rates so recommended have been approved by the Deputy Commission (Appropriate Government) Kishtwar and conveyed to this office vide No. DCK/LA/24/F.No. 80(A)379 dated 29-10-2024.

2. OWNERSHIP :

Name of the persons of whose land under acquisition is standing in the record of rightwas ascertained from the revenue records and the same are shown in Award statement.

3. SITUATION DESCRIPTION AND LOCATION OF

THE LAND :

The total acquired land measuring 18 Kanals 07 Marlas under acquisition is un-irrigated and irrigated agricultural land and situated in village Feller of Tehsil Kishtwar District Kishtwar.

4. VALUATION OF THE LAND :

Principal for assessing the amount of compensation to be awarded has been laid down under section 26(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, read with endorsement No. REV/LAJK/254/ 2020 Dated 26-08-2020 and accordingly the market value of the land was determined for further determination of compensation.

5. DETERMINATION OF COMPENSATION :

Resettlement Act, 2013, 100% of compensation Amount (including market value multiplied by Multiplication Factor) is to be awarded as Solatium as has been determined in the Award statement.

The compensation of land is to be paid to land interested persons. The total amount of Award Workout to be Rs. 2,02,38,215/- (Rupees Two Crore Two Lakhs Thirty Eight Thousand Two Hundred and Fifteen Only).

8. MUTATION OF OCCUPANCY IN RESPECT OF THE

The acquiring depatment shall ensure that the record of right and all the relevant documents related to the ownership/occupancy of the said land are accordingly modified and show the transfer of the said land solely in the name of Government consequent to taking over possession of the said land and the payment of the compensation to the concerned interested parties.

9. CORRECTION OF THE RECORD IN THE RECORD

OF RIGHTS :

The Tehsildar Kishtwar shall carry out necessary mutation in the Record of Rights in the name of Indenting Department in respect of land so acquired as per the enclosed Award statement.

10. APPORTIONMENT :

The amount of compensation payable to interested persons as shown in the apportionment Statement is in accordance with the provisions of Agr. Reform Act, 1976 and the guidelines given by the Revenue Department Vide No. REV (LB) 10/80 Dated 23-02-1980 and the latest Girdawari entries in the Field Book as well as in Girdawari Copies. However, in case of any dispute which is not settled within reasonable time, the amount of compensation will be remitted to the Court under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for jurisdiction.

11. ENCUMBRANCES :

The land under acquisition is free from all encumbrances and it

has been mentioned in the Award Statement.

Removal of Chairperson/Vice-Chairperson of District Development Council.—(1) A written notice of the intention to move a motion for removal of Chairperson and Vice-Chairperson under Sub-Section (14) of Section 45-A of the act, signed by not less than two third of elected members of that Council, together with a copy of the motion which is proposed to be moved shall be delivered in person by any two of the elected members of the District Development Council signing the notice, to the Deputy Commissioner.

(2) The officer referred to in Sub-Rule (1) shall convene a meeting of the elected members of Council for the consideration of the motion, to be held at the office of the Council at a time appointed by him which shall not be later than fifteen working days from the date on which the notice under Sub-Rule (1) is delivered to him.

(3) The officer referred to in Sub-Rule (1) shall send by registered post to the elected members of the Council concerned notice of not less than seven working days of any meeting held under this section and in the time appointed, thereof. (iii) The Chairman of the Standing Committee in order of preference mentioned in Sub-Section (1) of Section 45 (D), if the Chairperson or the Vice-Chairperson is unable to preside over the meeting as provided under clause (a) or clause (b) by reason of his absence from station or otherwise.

(4) The Officer authoried under Sub-Rule (1) shall attend the meeting conveyed for the purpose, as an observer.

(5) The meeting conveyed for the purpose shall not be adjourned except the reasons beyond human control. The quorum required for such meeting shall be two-third of the elected members of that Council.

(6) As soon as the meeting convened under Sub-Rule (2) has commenced, the person presiding shall read at the meeting the motion for consideration of which it has been convened and declare it to be open for debate.

(7) No debate on any motion under this rule shall be adjourned except for reasons beyond human control.

(8) A debate on any no-confidence motion shall automatically terminate on the expiry of three hours from the time appointed for the commencement of the meeting if it is not concluded earlier and upon the conclusion of the debate or upon the expiry of such period of three hours as the case may be, the motion shall be put to vote.

(9) Voting shall be by open ballot and the member who voted shall record in writing his name and signature on the reverse side of ballot paper.

(10) The person presiding shall not speak on the merit of the motion , and shall be entitled to vote thereon except the right of a casting vote or second vote.

(11) The copy of the minutes of the meeting together with the copy of the motion and the result of the voting therein shall forthwith, on the termination of the meeting, be forwarded to the Government by the officer referred to in Sub-Rule (1).

(12) If the motion is carried with the support of the two-third majority of the elected members of the Council, the Chairperson or the Vice-Chairperson as the case may be, shall cease to hold office thereafter and their offices shall be deemed to be vacant forthwith, 4 The J&K Official Gazette, 19th Feb., 2024/30th Magha, 1945. and the officer authorized under Sub-Rule (1) shall report the vacany in such offices to the Government and the State Election Commission and the fact shall be published in the Notice Board of the Council, and on receipt of such a report, the Government shall notify in the official Gazette the cessation of the office by the Chairperson or the Vice-Chairperson, as the case may be.

(13) If the motion is not carried by such majority as aforesaid or the meeting cannot be held for want of quorum, no notice of any subsequent motion expressing want of confidence in the same Chairperson or the Vice-Chairperson shall be received until after the expiry of one year from the date of meeting, or the date fixed for the motion, as the case may be.

(14) No notice of a motion under this rule shall be accepted within one year of the assumption of office by a Chairperson or the Vice- Chairperson.

"108-ZR. Role Function, and Power of the Chief Executive

Officer (Additional District Development Commissioner).—

(1) Save as otherwise expressly provided by or under Jammu and Kashmir Panchayati Raj Act, 1989, the Chief Executive Officer shall—

(a) exercise all the powers specially imposed or conferred upon him by or under Jammu and Kashmir Panchayati Raj Act, 1989, or under any other law for the time being in force ;

(b) take necessary measures for the speedy execution of all works and developmental schemes of the District Development Council and its committees.

(c) supervise, control and monitor the execution of all works of the District Development Council, Block Development Council and Halqa Panchayats.

(d) have custody of all papers and documents connected with the proceedings of the meeting of the District Development Council and its Committee.

(e) draw and disburse money out of the District Development Council Fund.

(f) lay down the duties, supervise and control the officers and officials of , or holding office under the District Development Council.

(2) The Chief Executive Officer shall attend every meeting of the District Development Council and may take part in the discussion but shall not have the right to move any resolution or to vote and if in the opinion of the Chief Executive Officer any proposal before the District Development Council is in violation of or inconsistent with the provisions of the Jammu and Kashmir Panchayati Raj Act, 1989 or any other law or the rules or orders made thereunder, it shall be his duty to bring the same to the notice of and advice the District Development Council or the Committee in the form of a written note containing the reasons for his opinion and specify the law, rule, order, regulation or provision with which the proposal or resolution or order is inconsistent and if the proposal or resolution or order has been considered and passed by the District Development Council or the Committee before such advice is tendered, the Executive Officer may resubmit the proposal or resolution or order with his advice after such examination as he considers necessary.

(3) If the District Development Council or any of its Committees passes the resolution or order withoiut resolving the inconsistency referred to in Sub-Rule (2), it shall be the duty of the Chief Executive Officer, notwithstanding any other provision in the Act, to forward forthwith to the Government under intimation to Chairperson of District Development Council concerned, a copy of the said resolution or order along with his written note and he shall not implement such resolution or order otherwise than as decided by the Government.

(4) The Government may also appoint from time to time in every District Development Council such Officers/Officials out of different departments of the Government for carrying out the working of District Development Council.

(5) The Assistant Commissioner, Panchayat shall be the Deputy Chief Executive Officer of the District Development Council.

(6) The Chief Planning Officer and Deputy Chief Executive Officer shall assist the Chief Executive Officer in the performance of his duties, advise the Chief Executive Officer in matters of plan formulation and shall be responsible for all matters relating to planning including the preparation of plans for economic development and social justice and annual plan of the district.

(7) The Chief Accounts Officer/Accounts Officer in the office of Deputy Commissioner shall assist the Chief Executive Officer, District Development Council in all matters relating to the accounts of the District Development Council including the preparation of annual accounts and budget and ensure that no expenditure is incurred except under proper sanction and in accordance with the Jammu and Kashmir Panchayati Raj Act, 1989 and the rules and regulations made thereunder and shall disallow any expenditure not warranted by the Act or the rules or regulations for which no provision is made in the budget.

(8) The Chief Executive Officer of the District Development Council shall be responsible for the overall financial policy of the District Development Council.

(9) Every order or circular or notification or instrument shall be signed either by the Chief Executive Officer or Deputy Chief Executive Officer or such other officer as may be specially empowered by the Government in this behalf and such signature shall be deemed to be proper authentication of such order or instrument."

"Rule 108-ZS, Right to Requisition of Records.—(1) Every person in possession of money, accounts or other property pertaining to a Halqa Panchayat or Block Development Council or District Development Council shall on the requisition in writing of Chief Executive Officer for this purpose, forthwith hand over such money or deliver up such accounts, records or other property to the Chief Executive Officer or the person authorized in the requisition to receive the same.

(2) The Chief Executive Officer may also take steps to recover any money due from any such person in the same manner and subject to the same provisions as provided in Jammu and Kashmir Land Revenue Act, Svt., 1996 as arrears of land revenue, and for the purpose of recovering the accounts, records and other property pertaining to the Halqa Panchayat or Block Development Council or District Development Council and may issue a search warrant and exercise all such powers with respect thereto as may lawfully be exercised by the Executive Magistrate under the provisions of Chapter VII of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974).

(3) Every person having knowledge as to where any money, accounts, records or other property pertaining to Halqa Panchayat or Block Development Council or District Development Council are concealed, shall be bound to give information of the same to the Chief Executive Officer.

(4) An appeal shall lie from an order of the Chief Executive Officer made under this rule to the concerned Divisional Commissioner whose decision thereon shall be final."

direct that following amendment shall made in the Jammu and Kashmir Civil Services Regulations, 1956 (Vol. I ); namely:-

1. Article 249-P shall be substituted by the following ; namely:-

"249-P. Entitlements of family of a missing Government

Servant/Pensioner/Family Pensioner.- (1) In the case of a missing employee/pensioner/family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of GPF and gratuity (whatever has not already been received) to the Head of Office of the department where the employee/pensioner had last served, six months after lodging of Police report. The family pension and/or retirement gratuity may be sanctioned by the Administrative Department after observing the following formalities:-

(i) The family must lodge a report with the concerned Police Station and obtain a report from the Police, that the employee/ pensioner/family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary/General Diary Entry.

(ii) An Indemnity Bond should be taken from the nominee/dependants of the employee/pensioner/family pensioner that all payments will be adjusted against the payments due to the employee/pensioner /family pensioner in case she/he appears on the scene and makes any claim.

(2) In the case of a missing employee, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date up to which pay and allowances have been paid or the date of the police report, whichever is later.

(3) In the case of a missing pensioner/family pensioner, the family pension will accrue from the date of the police report or from the date immediately succeeding the date till which pension/family pension had been paid, whichever is later.

(4) The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.

(5) Before sanctioning the payment of gratuity, the Head of Office will assess all Government dues outstanding against the employee/pensioner and effect their recovery in accordance with Article 168-AA of J&K CSR, Vol. I and other instructions in force for affecting such recoveries.

(6) The amount of salary due, leave encashment due and the amount of GPF will be paid to the family in the first instance as per the nominations made by the employee/pensioner on filing of a police report and subrnission of an indemnity bond as indicated above.

(7) The benefits to be sanctioned to the family/nominee of the missing employee/pensioner will be based on and regulated by the emoluments drawn by him/her and the rules/orders applicable to him/her as on the last date he/she was on duty including authorized periods of leave.

2. Form 5 referred to in Article 249-0, as contained in Schedule XII, Volume II, shall be substituted by Form-5 forming Annexure to this notification.

SO–140.—Whereas, on 12-11-2020, during the search of a missing

person namely Aqib Ahmad Lone S/o Mohammad Amin Lone R/o Peth

Khandaypora, Kulgam, the Police Station, Kulgam, reliably came to

know that the missing person had joined the terrorist ranks of LeT, a

banned outfit, on the instigation/motivation of three terrorists identified

as Sheeraz Ahmad Lone S/o Ab. Rasheed Lone R/o Souch, Kulgam, 2 The J&K Official Gazette, 29th Feb., 2024/10th Phal., 1945. 2. Whereas, based on the above a case FIR No. 205/2020 under Sections 13, 18-B, 20 and 38 of ULA(P) Act, was registered in the Police Station, Kulgam, and the investigation, of case was set into motion ; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, one more person identified as Faheem Nisar Bhat S/o Nisar Ahmad Bhat R/o Kharbrari, Kulgam, was found involved in the commission of crime. Subsequently, the accused was arrested in the case ; and

5. Whereas, during the investigation, it was established that on 30-10-2020 the accused viz. Aqib Ahmad Lone, went missing from his home and joined the terrorist ranks of LeT, a banned outfit, on the instigation/motivation of terrorists viz. Sheeraz Ahmad Lone, Shakir Ahmad Najar and Umais Ahmad Wani, besides, the accused viz. Faheem Nisar Bhat, was carrying the Unlawful activities in the area ; and

6. Whereas, the accused terrorists viz. Aqib Ahmad Lone, Sheeraz Ahmad Lone and Shakir Ahmad Najar, have been killed in the different encounters with the Security Forces and the proceedings under the law would abate against them ; and

7. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their names :—

8. Whereas, the accused terrorist viz. Umais Ahmad Wani, is

Nisar Bhat, has been found juvenile and in view of the Section 1(4) of

the Juvenile Justice (Care and Protection of Child) Act, 2015, the

apprehension, detention, prosecution, penalty or imprisonment shall be

governed by the said Act ; and

10. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all the

other relevant documents relating to the case and has come to the

conclusion that a prima facie case is made out against the above

accused ; and

11. Whereas, after perusing the Case Diary File the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above-mentioned

accused for his prosecution under the provisions of Law.

Now, therefore, in exercise of powers conferred by Sub-

Section (2) of Section 45 of Unlawful Activities (Prevention) Act

1967, the Government hereby accord sanction for launching prosecution

against the accused viz. Umais Ahmad Wani, for the commission of

offences punishable under the relevant Sections 13, 18-B, 20 and 38

of ULA(P) Act, arising out of FIR No. 205/2020 of Police Station,

Kulgam.

SO-142.––-Whereas, on 21-09-2023, a reliable information was received by the police Station, Baramulla, to the effect that one person identified as Mohammad Yaseen Shah S/o Tariq Ahmad Shah R/o Shah Mohalla, Janbazpora, Baramulla as joined the terrorist ranks of LeT/ TRF, banned outfit, in order to carry out terrorist activities in the area

Sections 16, 18, 20 and 38 of ULA (P) Act, was registered in the

Police Station, Baramulla, and the investigation, of the case was set

into motion. Subsequently, during the investigation, the offence under

Section 16 of ULA (P). Act was dropped and the offences under

Sections 7/25 Arms Act, 207, 3/181 MV Act and Sections 23 & 39

of ULA (P) Act were added in the case ; and

3. Whereas, during the course of investigation, the seizure memos

were prepared and the statements of witnesses acquainted with the

facts and circumstances of the case were recorded under the relevant

provisions of law ; and

4. Whereas, during the investigation, the accused viz. Mohammad

Yaseen Shah, was arrested by the Police/Security Forces during a Naka

checking at Kreeri Tappar, NHW crossing and recovered 01 Pistol with

magazine and 08 rounds from his possession ; and

5. Whereas, during the investigation, it was found that in the year

2022, the accused viz. Mohammad Yaseen Shah, was arrested by

Baramulla Police in case FIR No. 156/2022 of Police Station, Baramulla,

and was lodged in Sub Jail, Baramulla, where he came in to contact

with a Pakistani prisoner namely Imdaullah @ Ali Babar @ Dujana,

who instigated the accused viz. Mohammad Yaseen Shah, to join the

terrorist ranks ; and

6. Whereas, during the investigation, it was found that after the

release of accused viz. Mohammad Yaseen Shah, from the said case,

he came in contact with two terrorists of LeT/TRF banned outfit namely

Syed Aijaz Rizwi @ Javid S/o Late Dr. Syed Sadiq Rizwi R/o

Shareerabad, Srinagar A/P PoK and one Umar Lone S/o Mohd Akbar

Lone R/o Wussan, Pattan. Subsequently, the accused viz. Mohammad

Yaseen Shah, joined the terrorist ranks for carrying out terrorist activities

in the area ; and

7. Whereas, during the investigation, five other persons identified

as Parvaiz Ahmad Shah S/o Ali Mohammad Shah R/o Takiya Wagoora,

Baramulla, Mst. Nageena W/o Manzoor Ahmad Lone R/o Vijpara,

Hajan, Bandipora, Mst. Aafreena D/o Gulzar Ahmad Ganie R/o Putpora,

Shalteng, Srinagar, Showkat Ahmad Malik S/o Habibullah Malik No. 48-e] The J&K Official Gazette, 29th Feb., 2024/10th Phal., 1945. 3 –––––––—––––––––––––––––––––––––––––––––––––––––––––––––——— R/o Wagila, Wagoora, Kreeri, Baramulla and Mudasir Mohi-ud-Din

Rather S/o Gh. Mohi-ud-Din Rather R/o Takiya, Wagoora, Kreeri,

Baramulla, were found involved in the case. Subsequently, the accused

were arrested and during the investigation, 01 Pistol with magazine, 08

rounds and 05 hand grenades were recovered at their instances

respectively ; and

8. Whereas, during the investigation, it was found that the accused

viz. Mohammad Yaseen Shah, procured arms/ammunition and hand

grenades from the terrorist viz. Umar Lone, on the direction of Pakistani

terrorist viz. Syed Aijaz Rizwi @ Javid, and distributed among the

accused viz. Parvaiz Ahmad Shah, Mst. Nageena, Mst. Aafreena,

Showkat Ahmad Malik and Mudasir Mohi-ud-Din Rather, in order to

promote terrorist activities in the area, which were recovered at their

instances. During the investigation, 01 Pistol with magazine and 08

rounds were also recovered at the instance of accused viz. Mohammad

Yaseen Shah ; and

9. Whereas, during the investigation, it was established that the

accused viz. Mohammad Yaseen Khan, was member of LeT /TRF

banned outfit and the accused viz. Parvaiz Ahmad Shah, Mst. Nageena,

Mst. Aafreena, Showkat Ahmad Malik and Mudasir Mohi-ud-Din Rather,

were working as Over Ground Workers (OGWs) for the terrorists

particularly the terrorist viz. Mohammad Yaseen Shah, and were

providing logistic support to him, besides, the accused viz. Mohammad

Yaseen Shah, procured arms/ammunition and hand grenades from the

terrorists viz. Syed Aijaz Rizwi @ Javid and Umar Lone, and under

a well knit criminal conspiracy distributed among the accused viz.

Parvaiz Ahmad Shah, Mst. Nageena, Mst. Aafreena, Showkat Ahmad

Malik and Mudasir Mohi-ud-Din Rather, for carrying out the terrorist

activities in the area ; and

10. Whereas, the investigation, in respect of Pakistani prisoner viz.

Imdaullah @ Ali Babar @ Dujana, shall continue to bring out his role/

involvement in the case and the supplementary charge sheet against

him would be filed in the court of competent jurisdiction ; and

11. Whereas, on the basis of the investigation, the statement of

Whereas, the accused terrorist viz. Syed Aijaz Rizwi @ Javid and Umar Lone, are absconding and proceedings under Section 299 Cr.PC have been proposed to be initiated against them ; and

14. Whereas, the Authority appointed by the Government under sub-section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967,has independently examined the Case Diary file and all the other relevant documents relating to the case and has come

t o t h e c o n c l u s i o n t h a t a prima facie case is made out against the above accused ; and

15. Whereas, after perusing the Case Diary file, the relevant

documents and also taking into consideration the views of the Authority appointed under sub-section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above mentioned accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against

the accused viz. Mohammad Yaseen Shah, Parvaiz Ahmad Shah, Mst. Nageena, Mst. Aafreena, Showkat Ahmad Malik, Syed Aijaz Rizwi @ Javid and Umar Lone, for the commission of offences punishable under the relevant Sections of ULA (P) Act, as indicated against the each accused at Para (11) above, arising out of FIR No. 194/2023 of Police Station, Baramulla.

SO-143.––Whereas, on 08.09.2023, a reliable information was received by the Police Station, Pulwama, to the effect that two persons identified as Sahil Firdous Sheikh R/o Puchal, Pulwama and Shahid Gull R/o Wagum, Pulwama, have been working as OGWs for a terrorist namely Aqib Shergojri, and are providing logistic support to him, besides,

are in the orchards of village Gudoora, Pulwama, intended to carry out

terrorist activities in the area ; and

2. Whereas, based on the above, a Case FIR No. 239/2023 under

Sections 18, 20 and 39 of ULA (P) Act, was registered in the Police

Station, Pulwama, and the investigation, of the case was set into motion,

Subsequently, during the investigation, the offences under Section 7/25

Arms Act, and Sections 23 and 38 of ULA (P) Act were added in

the case ; and

3. Whereas, during the course of investigation, the seizure memos

were prepared and the statements of witnesses acquainted with the

facts and circumstances of the case were recorded under the relevant

provisions of law ; and

4. Whereas, during the investigation, the accused viz. Sahil Firdous

Sheikh S/o Firdous Ahmad Sheikh R/o Mahirad, Utterpora, Puchal,

Pulwama and Shahid Gull Bhat S/o Gh. Mohammad Bhat R/o Wagum,

Pulwama, were accordingly, arrested from the orchards of village

Gudoora, Pulwama, and during their personal search, the Police recorded

15 AK-47 rounds from their possession respectively ; and

5. Whereas, during the investigation, it was found that the accused

viz. Sahil Firdous Sheikh and Shahid Gull Bhat, were in contact with

a terrorist of LeT, a banned outfit, namely Aqib Shergojri S/o Nazir

Ahmad Shergojri R/o Chadoora, Budgam, who provided the recovered

ammunition and 02 hand grenades to the accused in order to promote

terrorist activities in the area. Subsequently, during the investigation, 02

hand grenade were also recovered at the instance of accused viz. Sahil

Firdous Sheikh ; and

6. Whereas, during the investigation, it was established that the

accused viz. Sahil Firdous Sheikh and Shahid Gull Bhat, were working

as Over Ground Workers (OGWs) for the terrorists of LeT, a banned

outfit, particularly the terrorist viz. Aqib Shergojri, and were providing

logistic support to him, besides, under a well knit criminal conspiracy

procured ammunition and hand grenades from the said terrorist for

witnesses recorded and other evidence collected, the Investigating
