Whereas it appears to the appropriate Government that a total of 18 Kanals, 01 Marlas 5.5 Sirsais of land is required for Construction/ Upgradation of Kulgam Chatbal Panipora Kutbal including Bon Kandipora Road (05 KMs), Tehsil and District Kulgam for public purpose.

Whereas, a committee was constituted by this office under Sub- Rule (1) of Rule 4 of the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules 2023 vide No. 2 ] The J&K Official Gazette, 10th April, 2025/20th Chai., 1947. 185 –––––––––––––––––––––––––––––––––––––––––––––––––––––– No. : 05-DCK/NLA (ACR) of 2024 dated 27-07-2024 to visit the spot along with the representatives of Requiring Body to make a preliminary enquiry.

(i) That the indenting department was offered State/Government land at various locations for the proposed acquisition and have not found any suitable land and has agreed to the proposed land which serves public purpose ;

(ii) That the extent of land proposed for acquisition is the

absolute bare-minimum needed for the purpose/project.

(iii) That the acquisition of land at an alternative place has been

considered and found not feasible ;

(iv) That there is no sufficient/suitable unutilized land which has

been been previously acquired in the area ;

(v) That there is no State/Government/Common land available which would serve the public purpose and there is only option to acquire the proposed patch of land which also include private land :

(vi) That there is no acquired unutilized land which may be used

for such purpose ;

(vii) That the requisition is consistent to the provisions contained in Section 10 or other provisions of the Act, ; and

(viii) The committee is of view that land is absolutely required for the public purpose in order to make availability of road facility to large populace of the Tehsil Kulgam and adjacent areas, so it may be notified and acquired for the said project.

No families are likely to be displace due to the said land acquisition

with no adverse impact and rehabilitation involved.

The said report was considered SIA report as envisaged in Chapter III Rule 8 of the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023.

Therefore, it is notified that for the above said project in the Villages Tehsil and District Kulgam, a piece of land measuring 8 Kanals, 01 Marlas 5.5 Sirsais, whose detail description is as following, is under acquisition.
