No. 3167 of 2024/RG/NG-71(1) Dated 23-12-2024.

It is notified for the information of all concerned that the District Courts in Kashmir province and the Courts located in District Kishtwar, District Doda, and Courts at Batote, Gool, Banihal and Ukhral in District Ramban and Bani in District Kathua of Jammu Division in the Union Territory of Jammu and Kashmir as well as all Courts located in the Union Terrory of Ladakh shall observe 15 days winter vacations with effect from 06-01-2025 to 20-01-2025 (both days inclusive).

The Principal District and Sessions Judges and Chief Judicial Magistrates of the concerned Districts shall make the suitable arrangements for disposal of urgent criminal business arising during the period of such vacations in the areas within their respective jurisdictions.

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. CLA/SDM/M/2022-23/90-106 dated 27-05-2022 issued Preliminary notification U/S 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement No. 3 ] The J&K Official Gazette, 17th April, 2025/27th Chai., 1947. 267 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Act, 2013 for land measuring 102 Kanals 09 Marlas (local) calling upon the objections, if any, from the interested persons/ land owners within the stipulated time period from the date of issuance/publication of the said notice ; and

Whereas, in response to the said notification, 02 numbers of pbjections were received from the land owners/interested persons in the Collectorate of Sub Divisional Magistrate Mahore. After considering the objections there is a decrease (102 Kanals 09 Marlas to 101 Kanals and 14½ Marlas) and now the total land under acquisition i.e 101 Kanal 14½ Marlas instead of 102 Kanals 09 Marlas ; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. CLA/SDM/M/2024-25/01-03 dated 03-04-2024 requested this office for issuance of declaration under Section 19 (1) of the Right to Fair Compersation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the Acquisition of land measuring 101 Kanals 14½ Marlas instead of 102 Kanals 09 Marlas, (Local) situated at village Mahore Tehsil Mahore, District Reasi for construction/Up gradation of Budhal-Mahore-Gool GREF Road to NHDL specifications ; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide this office letter No. DC/Rsi/SQ/24-25/1497-98 dated 10-07-2024 was requested to issue appropriate corrigendum to notification U/S 11 (1) and thereafter make fresh request for issuance if declaration under Section 19 (1) of the Act ; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore has issued fresh corrigendum vide No CLA/SDM/M/2024-25/ 279-93 dated 13-07-2024 (copy enclosed) of land measuring 101 Kanals 14½ Marlas (Local) situated at Village Mahore, Tehsil Mahore, Disrict Reasi and Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide letter No. CLA/SDM/M/2024-25/294-97 dated15-07-2024 requested this office for issuance of Declaration under section 19 (1) of the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013 for the Acquisition of land measuring 101 Kanals 14½ Marlas (local) situated at Village, Mahore Tehsil Mahore, District Reasi for construction/upgardation of Budhal- Mahore-Gool GREF Road to NHDL specification ; and

Whereas, as per S.O No 17 dated 14-01-2022 issued by Government of Jammu & Kashmir, Revenue Department, the Approprite 268 The J&K Official Gazette, 17th April, 2025/27th Chai., 1947. Whereas, in accordance with S.O.17 the Collector Land Acquisition (Assistant Commissioner Rev) Pulwama submitted the instant acquisition case for issuance of Declaration under Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 vide above referred communication.

Whereas, the "Appropriate Government" District Collector is satisfied after considering the report made by the Collector Land Acquisition (Assistant Commissioner Rev) Pulwama that the said land is required for the public purpose.

Now, therefore, it is hereby declared under the provisions of Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land measuring 07 Marla 07 Sirsai 23 sqft is required for Erection of Tower location No. 161-X and land measuring 08 Marla 08 Sirsai 16 sqft.is required for the erection of tower location No.162-X at Village Nihama 402 The J&K Official Gazette, 17th April 2025/27th Chai., 1947. Jammu, the 12th March, 2024.

SO–158.—Whereas, on 30-09-2023, the Police Station, Banihal,

received a written docket to the effect a Naka was established by the

Police at Railway Chowk, Banihal. During checking, the Police signaled

to stop a vehicle (Innova), the driver and other person boarded in the

vehicle tried to escape but were chased down on the spot and identified

as Sarabjeet Singh S/o Parduman Singh R/o Balan Pind, Jalandhar, 2 The J&K Official Gazette, 12th March, 2024/22nd Phal., 1945. [ No. 49-h ––––––––––––––––––––––––––––––––––––––––––––––––––––––

Punjab and Honey Basra S/o Harmesh Lal R/o Mohalla Plahi Gate,

Phagwara, Kapurthala, Punjab. During the checking the Police

recovered 30 packets of contraband (Heroin like substance) substances

from the vehicle ; and

2. Whereas, based on the above a case FIR No. 242/2023 under Sections 8/21, 22, 29 NDPS Act, was registered in the Police Station, Banihal, and the investigation, of case was set into motion. Subsequently, during the investigation, Sections 27-A NDPS Act, 467, 468, 471, 489- C, 201, 120-B, 121, 121-A, 122 IPC, 3/7/25 Arms Act, 4/5/6 ESA and Sections 13, 18, 21, 23, 38, 39 and 40 of ULA(P) act were added in the case.

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, four other persons identified as Shafi Mohd @ Kala S/o Sardar Ali Khan R/o Ballan, Tehsil Kartarpur, District Jalandhar, Punjab, Manjit Singh @ Maan S/o Satnam Singh R/o Thandian, Shaheed Bhaghat Singh Nagar, Punjab, Safeer Ahmad S/o Ghulam Hyder Chowhan and Kafeel Ahmad S/o Bashir Ahmed R's/o Ibkote, Karnah, Kupwara, were found involved in the commission of crime. Subsequently, the accused were arrested in the case and during the investigation, 01 Revolver, 01 Hand Grenade, 04 packets of Narcotics, cash to the tune of Rs. 5,37,67000/- and some incriminatory material were recovered at their instances respectively ; and

5. Whereas, during the investigation, it was found that the accused viz. Safeer Ahmad was in contact with a terrorist of HM, a banned outfit, namely Shafiq Ahmed S/o Abdul Rehman Chokar R/o Amrohi, Karnah, Kupwara A/P PaK/PoK, who motivated the accused viz.Safeer Ahmad, to procure Narcotics from across the border in order to promote terrorist activities in the area ; and

6. Whereas, during the investigation, it was found that the accused viz. Safeer Ahmad, motivated three persons identified as Nazir Ahmed S/o Mohd Suliman, Bashir Ahmed S/o Tajdin and Qalam Din S/o Raj Mohd residents of Amrohi, Karnah, Kupwara, to procure the Narcotics from Amrohi border with the promise that they shall be No. 49-h ] The J&K Official Gazette, 12th March, 2024/22nd Phal., 1945. 3 ––––––––––––––––––––––––––––––––––––––––––––––––––––––

provided rupees fifty thousand (Rs. 50,000) for the procurement. Accordingly, the said accused procured 35 packets of Narcotics from Grangnar Nalla, Amrohi border, which were kept there by some unknown persons on the directions of Pakistani based terrorist viz. Shafiq Ahmed, and handed over the same to the accused viz. Safeer Ahmad. The accused viz. Safeer Ahmad, distributed 01 Packet of Narcotics among the each accused viz. Nazir Ahmad, Bashir Ahmed, Qalam Din and Kafeel Ahmad, with the directions to sell the same and earn the money and also kept 01 packet in his possession. Subsequently, during the investigtion, the accused viz. Nazir Ahmad, Bashir Ahmad and Qalam Din, were arrested in the case and during the investigation, 03 packets of narcotics drugs heroin were recovered at their instances respectively ; and

7. Whereas, during the investigation, it was found that the accused

viz. Safeer Ahmad, and Kafeel Ahmad, concealed remaining 30 packets

of Narcotics in a tube of tire of the vehicle of accused Kafeel Ahmad,

as per the directions of Pakistani based terrorist viz. Shafiq Ahmed.

Later on, the accused viz. Kafeel Ahmad, transported the consignment

upto Parimpora, Srinagar, in his vehicle (Truck) where he handed

over the same to the Punjab based smugglers viz. Sarabjeet Singh and

Honey Basra, and received cash to the tune of Rs. 45 lacs and handed

over the same to accused viz. Safeer Ahmad, who later-on provided

05 lacs to the accused viz. Kafeel Ahmad, for transportation of the

Narcotics ; and

8. Whereas, during the investigation, it was found that the accused

viz. Manjit Singh @ Maan was in contact with one Punjab based

narcotic drugs smuggler namely, Navpreet Singh @ Nav @ Aman S/o

Gurdev Singh R/o Village Vazir Bhullar, Beas, Tehsil Baba Bakala,

Amritsar, Punjab, who was providing all logistic support to the accused

viz. Manjit Singh @ Maan, for procurement of Narcotics, besides,

provided the recovered Revolver to the said accused ; and

9. Whereas, during the investigation, it was found that the accused

viz. Manjit Singh @ Maan, send the accused viz. Sarabjeet Singh and

Honey Basra, to Parimpora, Srinagar, for procurement of narcotics on

registration Number of the vehicle (Innova), which were provided to

him by two persons identified as Deep Chand S/o Gaindha Lal and

Kishan Paul S/o Hardayal residents of Paipura, Bilaspur UP A/P Preet

Vihar, Ganpat Enclave Gandhi Colony, Rudrapur, Uttrakhand. Subse-

quently, the accused viz. Deep Singh and Kishan Paul, were arrested

in the case and during the investigation, some fake Aadhaar Cards,

Driving Licences and Registration Certificates were seized at their

instances ; and

10. Whereas, during the investigation, it was established that the

accused viz. Manjit Singh @ Maan and Safeer Ahmad, were working

for the terrorists and were providing logistic support to them, and under

a well knit criminal conspiracy procured arms/ammunition, Hand

Grenade and incriminatory material from the terrorists, besides, were

facilitating the terrorists to sell the Narcotics so that the money

generated could be utilized for carrying out terrorist/unlawful activities

and to wage war against the Government of India. The accused viz.

Manjit Singh @ Maan and Safeer Ahmad, were knowingly holding the

proceeds of terrorism ; and

11. Whereas, the investigation, in respect of accused viz.

Navpreet Singh @ Nav @ Aman, and Satnam Singh (Father of

Manpreet Singh) shall continue to bring out their role/involvement in the

case and the Supplementary Charge sheet against them would be filed

in the Court or competent jurisdiction ; and

12. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections as shown against their name :—

14. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activites (Prevention)

Act, 1967, has independently examined the Case Diary File and all

the other relevant documents relating to the case and has come to

the conclusion that a prima facie case is made out against the above

accused ; and

15. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above mentined

accused for their prosecution under the provisions of law ; and

16. Whereas, the Government has independently examined the

Case Diary File and all the other relevant documents relating to the case

and has come to the conclusion that a prima facie is made out against

the above accused under the aforementioned provision of the Indian

Penal Code (IPC).

Now, therefore, in exercise of the powers conferred by Sub-

Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,

and Section 196 of the code of Criminal Procedure, 1973 the

Government hereby accord sanction for launching prosecution against

Ahmed, for the commission of offences punishable under the relevant

Jammu, the 22nd March, 2024.

SO–200.—Whereas, on 31-08-2022, the Police Station, Handwara,

received a docket to the effect that a Joint Naka was established by

the Police/Security Forces at Gund Chowgal. During the checking, two

suspects while seeing the Naka Party tried to escape but were chased

down on the spot and identified as Saqib Manzoor Sofi S/o Manzoor

Ahmad Sofi R/o Arampora, Sopore and Imran Nazir Wagay S/o Nazir 2 The J&K Official Gazette, 22nd Mar., 2024/2nd Chai., 1945. [ No. 51-c ––––––––––––––––––––––––––––––––––––––––––––––––––––––

Ahmad Wagay R/o Warpora, Sopore. During their personal search,

the Police recovered two Hand Grenades from their possession

respectively ; and

2. Whereas, based on the above a case FIR No. 239/2022 under

Section 3/4 ESA was registered in the Police Station, Handwara, and

the investigation, of case was set into motion. Subsequently, during the

investigation, the offences under Sections 13, 18 and 23 of ULA(P) Act

were added in the case ; and

3. Whereas, during the course of investigation, the site plan of the

place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the

accused viz. Saqib Manzoor Sofi and Imran Nazir Wagay were in

contact with an unknown person through virtual mode who provided the

recovered Hand Grenades to them in order to promote terrorist

activities in the area ; and

5. Whereas, during the investigation, it was established that the

accused viz. Saqib Manzoor Sofi and Imran Nazir Wagay, under a well

knit criminal conspiracy procured Hand Grenades from an unknown

person for carrying out the terrorist/unlawful activities in the area ; and

6. Whereas, the investigation in respect of unknown person who

provided the Hand Grenades to the accused viz. Saqib Manzoor Sofi

and Imran Nazir Wagay, shall continue to ascertain his actual identity

and to bring out his role/involvement in the case and the supplementary

Charge Sheet against him would be filed in the Court of competent

jurisdiction ; and

7. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established prima facie involvement of the below

mentioned accused for the commission of offences punishable under No. 51-c ] The J&K Official Gazette, 22nd Mar., 2024/2nd Chai., 1945. 3 ––––––––––––––––––––––––––––––––––––––––––––––––––––––

8. Whereas, during the investigation, the accused viz. Imran Nazir

Wagay, has been found juvenile and in view of the Section 1(4) of the

Juvenile Justice (Care and Protection of Child) Act, 2015, the

apprehension, detention, prosecution, penalty or imprisonment shall be

goverend by the said Act ; and

9. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all

the other relevant documents relating to the case and has come to

the conclusion that a prima facie case is made out against the above

accused ; and

10. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above mentioned

accused for his prosecution under the provisions of law.

Now, therefore, in exercise of powers conferred by Sub-

Section (2) of Section 45 of Unlawful Activities (Prevention) Act 1967,

against the accused viz. Saqib Manzoor Sofi, for the commission of

offences punishable under Sections 13, 18 and 23 of ULA(P) Act,

arising out of FIR No. 239/2022 of Police Station, Handwara.
