Whereas, it appears to the District Collector (Appropriate Government) that the land quantum of 05 Marla is required for Erection of Tower location No. 162(A+6) at Village Nihama, Tehsil Kakapora District Pulwama for 220 KV D/C Wagoora Transmission Line_.

Pulwama issued Preliminary Notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 vide No. DCP/ Coll/2024/329-35 dated 20-12-2024 for calling upon the objections, if any, from the interested persons/land owners.

Whereas, in response to the said notification, no objection stands received with regard to the area and suitability of the land proposed to be acquired, within the stipulated time.

Whereas, as per the S.O. 17 Dated 14-01-2022 in exercise of the powers conferred by proviso to clause (e) of Section 3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), the Government of Jammu and Kashmir whereby designated Deputy Commissioner/District Collector of each District of Union Territory of Jammu and Kashmir as ''Appropriate Government'' within their respective jurisdiction for acquiring land for public purpose under the said Act for an area not exceeding 400 Kanala (50 acre).

Whereas, in accordance with S.O.17 the Collector Land Acquisition (Assistant Commissioner Rev) Pulwama submitted the instant acquisition case for issuance of Declaration under Section 19 of Right to Fair Compensation and Transparency Acquisition, Rehabilitation and Resettlement Act, 2013 vide above referred communication.

Whereas, the ''Appropriate Government'' District Collector is satisfied after considering the report made by the Collector Land Acquisition (Assistant Commissioner Rev.) Pulwama that the said land is required for the public purpose.

Now, therefore, it is hereby declared under the provision of Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land measuring 05 Marla is required for Erection of Tower location No. 162(A+6) at Village Nihama, Tehsil Kakapora District Pulwama for 220 KV D/C Wagoora-Mirbazar Transmission Line_.

The land statement and plan can be inspected in the office of Collector Land Acquisition (Assistant Commissioner Rev.) Pulwama and Tehsildar concerned.

It is reported by the police that it is impossible to arrest the accused through usual mode, hence the instant general warrant of arrest.

Whereas the police personals of the J & K police are ordered and authorized to arrest the said accused whenever and wherever he is found and produced befor this Court under proper custody. The instant general warrant of arrest shall remain in force till accused is arrested.

FINAL AWARD

Subject :—Acquisition of land measuring 64 Kanals 02 Marlas situated in Village Saloon Tehsil Pouni acquired for the construction of PMGSY road from Dhanwan to Saloon at Village Saloon, Tehsil Pouni, District Reasi, Phase-VII, Length=2.20 Km.

No. 11] The J&K Official Gazette, the 12th June, 2025/22nd Jyai., 1947. 2093 –––––––––––––––––––––––––––––––––––––––––––––––––––––– District Collector (Deputy Commissioner) Reasi, was requested by Superintending Engineer, PMGSY Circle Reasi/Udhampur, vide his office letter No.SE/PMGSY/R/2762-64 dated 7-12-2009, for the acquisition of land for public purpose namely ''Construction of PMGSY road from Dhanwan to Saloon at village Saloon'', Tehsil Pouni and District Reasi. The case was referred to this Collectorate for initiating land acquisition proceedings under the provision of Land Acquisition Act, 1990 BK and rule made thereunder. The revenue papers were got prepared through Tehsildar Reasi and also got authenticated by the Indenting Department.

Accordingly, a notification under Section 4 (1) of Land Acquisition Act No.X SMVT 1990 was issued by this Collectorate vide No. Col/LA/ ACR/Reasi/15/477-480 dated 12-10-2015 and was served upon the land owners/interested persons and Indenting Department, who were asked to file their objections, if any within 15 days from the date of issuance of said notification. No objection was received by this Collectorate in response to said notification. The notification under Sections 6 & 7 was issued by District Collector (Deputy Commissioner) Reasi vide notification No. 208/N/DC/Reasi of 2015 under endorsement No. DC/Rsi/15-16/2523- 26/SQ dated 16-12-2015 in the light of SRO 235 of 2009 dated 11-08-2009. Thereafter, notification under Sections 9 and 9A was issued vide No. Col/ LA/ACR/Reasi/15/688-693 dated 06-01-2016 and served upon the land owners/interested persons and Indenting Department. Further, Government vide notification SRO 25 dated 28-01-2016 rescinded the Notification SRO 235 of 2009 dated 11-08-2009 and the case was again submitted to the District Collector (Deputy Commissioner) Reasi vide No. Col/LA/ACR/ Reasi/16/9 dated 05-04-2016 for issuance of declaration under Sections 6 & 7 of the Land Acquisition Act 1990 BK.

The District Collector (Deputy Commissioner) Reasi requested, Commissioner/Secretary to Government, Revenue Department, Civil Secretariat, J&K, Jammu vide No. DC/Rsi/16-17/73-74/SQ dated 11-04-2016, for issuance of the declaration under Sections 6 and 7 of Land Acquisition Act. Thereafter, Government Issued declaration under Section 6 & 7 vide Notification No. 43-Rev(LAJ) of 2016 dated 29-06-2016 under endorsement No. Rev/LAJ/49/2016-Saloon dated 29-06-2016, with direction to the Collector Land Acquisition (Assistant Commissioner Revenue) Reasi that he shall be personally responsible for identification and proper title verification of all types of land involved in the case and apportionment of compensation amongst all the interested persons/rightful 2094 The J&K Official Gazette, the 12th June, 2025/22nd Jyai., 1947. [ No. 11 –––––––––––––––––––––––––––––––––––––––––––––––––––––– claimants in accordance with the relevant laws/rules in force, while making the award and directed this Collectorate under Section 7 of the said Act to take order for acquisition of the said land after giving prescribed notice to the interested person(s) as required under Land Acquisition Act/Rules.

Then, a notification under Sections 9 & 9 A of the Land Acquisition Act was issued by this Collectorate vide No.Col/LA/ACR/Reasi/16/188- 195 dated 26-10-2016, and served upon the land owners/interested persons and Indenting Department asking them to file their objections regarding measurement, title and quantum of compensation within a stipulated period. In response to this notification, no objections were received from anyone concerned.

PRINCIPLE OF COMPENSATION

This land is located in village Saloon, out of limits of Municipal Committee and is being acquired for PMGSY road. The land coming under the acquisition of PMGSY Department is agriculture as well as non-agriculture in nature. As per report of Tehsildar Pouni vide No.149/ Teh/P/OQ dated 30-06-2017, that in village Saloon there is no sale deed in the last three years and in the nearest village Dhanwan the three years average sale deed rate Rs.70,909/- per local kanal and current market rate is Rs.67,100/- per local kanal the Village Saloon. Also the stamp duty rates for the year 2017-18 notified by the District Collector Reasi vide No. DC/Rsi/16-17/1672-97 dated 31-03-2017 of Village Saloon, Tensil Pouni District Reasi are Rs.0.83 (in lacs) for irrigated, Rs.0.61 (in lacs) for unirrigated and Rs.1.12. (in lacs) for small plots, per local kanal.

Therefore, keeping in view the report of field staff, location of land, agriculture/commercial potential of land, notified Stamp duty rate for the year of 2017-18 and other factors this Collectorate recommended the following rates for the approval in the Collectors meeting.

''@ Rs.1,25,000/- for Abi, HA, HW, W-I, W-II and

@ Rs.80,000/- for BQ & GM, per local kanal''

The instant case of the land acquisition was placed in the Collectors meeting on 09-08-2017 under the Chairmanship of District Collector, Reasi and rates of land compensation proposed by the Collector concerned were discussed threadbare. The meeting of Collectors found the rates of land No. 11] The J&K Official Gazette, the 12th June, 2025/22nd Jyai., 1947. 2095 –––––––––––––––––––––––––––––––––––––––––––––––––––––– compensation proposed by the Collector concerned to be reasonable and justifiable and hence approved a rate of Rs.1,25,000/- for Abi, HA, HW, W- I, W-II and Rs.80,000/- for BQ & GM, per local kanal.

The assessment of non-fruit bearing trees standing on the land under acquisition has been obtained from Divisional Forest Officer Reasi who vide his office No. DFO/RFD/3839 dated 30-01-2016 submitted the requisite assessment. Assessment of structures within the alignment of road has also been obtained from Executive Engineer, PWD(R&B) Division Reasi.

The approval of rates of land compensation and sanction of awarded amount has been obtained from District Collector (Deputy Commissioner) Reasi vide No. DC/Rsi/17-18/1703-1706/SQ dated 31-3-2018.

THE REQUISITE CERTIFICATES ARE RECORDED AS UNDER :

1. The land is needed for public purpose i.e. Construction of PMGSY road from Dhanwan to Saloon at Village Saloon, Tehsil Pouni.

2. That the adequate funds on account of land compensation are available with this Collectorate.

3. That no compensation has been paid in respect of the land under acquisition earlier.

4. That the Shajra Khasra of the land has been authenticated by the indenting department as token of its correctness.

5. That the land compensation will be paid in accordance with the provisions of Agrarian Reforms Act, 1976.

6. That the land under acquisition is free from all encumbrances.

7. The Shajra Khasra/AKs prepared in the instant case is in accor- dance with the spot position and field book.

8. That no evacuee property/Auqaf property/Dharmarth/Forest land is involved in the instant case of land acquisition.

9. It is also certified that the land compensation payable to the owners/interested persons as shown in the apportionment statement shall be tendered in accordance with the provisions of Agrarian Reforms Act, 1976 and guidelines given in the Circular issued by the Revenue Department under No. (LB)-10/80 dated 23-03-1980.

Whereas, it appears to the Government of Jammu and Kashmir that the land measuring 01 Kanal-11 Marlas of Village Nadoora Kralmud Tehsil Dooru District Anantnag is required for public purpose namely construction of Service Reservoir for WSS Wavethroo Arabal at Village Nadoora Kralmud :

Whereas, on the basis of indent placed by Chief Engineer Kashmir, Jal Shakti (PHE) Department Srinagar (requiring body) vide No. PHE/Estt/ 34227-29 dated 09-01-2024 for acquisition of land measuring 2 Kanal-2½ Marlas for construction of Service Reservoir for WSS Wavethroo Arabal, the Collector Land Acquisition (SDM Dooru) was requested to initiate land acquisition proceedings for bare minimum land required for the said prupose vide this office letter No. DCA/LA/2024-25/23-25 dated 18-04-2024.

Whereas, the Collector Land Acuisition (SDM Dooru) has issued pre- liminary notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2110 The J&K Official Gazette, the 12th June, 2025/22nd Jyai., 1947.
