3. Learned APP presents the compliance report in respect of the proclamation under Section 82/83 Cr. PC read with 84 BNSS, issued by this Court. It is reported that the SHO P/S Miransab has issued the publication of proclamation in respect of absconding accused namely Ashok Kumar @ Shoka S/o Mool Raj R/o Kirpind, Tehsil R.S. Pura, Jammu in compliance to the order of this Court.

4. The report submitted by the applicant/SHO Miransab reveals that the copy of proclamation was affixed on the house of accused, at the premises of Police Station Miransab, Jammu. The publicity is also reported to have been given through drum beating and publishing of proclamation in daily news paper State Times in its issue dated 08-04-2025, whereby the accused was required to attend this Court on 30-04-2025.

5. Despite publication of proclamation in the manner noted above, the accused namely Ashok Kumar @ Shoka S/o Mool Raj R/o Kirpind, Tehsil R.S. These proceedings are under provisions of Section 23 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for determination of compensation in respect of net area of land proposed to be acquired measuring 02 Kanals–17.5 Marlas for Construction of Water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town in Village Kishtwar Tehsil and District Kishtwar. The land acquisition proceedings were initiated with the publication of Preliminary Notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Chief Engineer Jal Shakti (PHE) Department, Jammu vide No. : PHEJ/Plg/2427-2428 Dated 27-11-2020 endorsed by Executive Engineer Jal Shakti (PHE) Department Kishtwar vide No. : HDK/ 2021/8987-89 Dated 09-02-2021 submitted proper letter of indent for acquisition of land for Construction of Water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town in Village Kishtwar Tehsil and District Kishtwar. Accordingly, the Tehsildar 2356 The J&K Official Gazette, the 26th June, 2025/5th Asad., 1947. [ No. 13 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Kishtwar vide No. 127-130/OQ/LA Dated 07-10-2020, had submitted the land acquisition papers to this office duly completed in all respect for further necessary action.

1. PUBLICATION OF NOTIFICATIONS AND ISSUE OF

NOTICES :

The local SIA team was notified as Social Impact Assessment Team (SIA) under Section 4 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for conducting Social Impact Assessment Team (SIA) vide No. ACR/LA/2022-23/411-17 Date 31-08-2022. Accordingly, the concerned committee members had submitted the Social Impact Assessment Study report vide No. : BDO/Estt/2022-23/574 Dated 19-09-2022 and the same was submitted to the District Collector Kishtwar for appraisal under under Section 7 of the RFCTLARR Act, 2013 vide No. ACR/ LA/2022-23/589 Dated 20-10-2022.

The District Collector Kishtwar, constituted a committee of expert group for appraisal of Social Impact Assessment Study report. Accordingly, the Multi-Disciplinary Expert Group for appraisal constituted vide notification No. DCK/LA/22/F. No. 102/425 Dated 26-12-2022 submitted its recommendation.

The SIA report and the recommendation of Multi-Disciplinary Expert Group was then approved and a Preliminary Notification No. ACR/LA/2022-23/350-56 Dated, 18-01-2023 was issued under Section 11 of the Act stating that the land described in the schedule thereto (thereafter referred to as the said land) was needed or likely to be needed for the public purpose. The notification has issued for inviting objections within 60 days from all the concerned stakeholders.

No objections, were received against the Preliminary Notification and served copy of the said notification was received from Tehsildar Kishtwar vide No. : 4748-49/OQ/Gen. Dated 20-02-2023. The proposal was then submitted to the Appropriate Government i.e Deputy Commissioner (District Collector) Kishtwar vide No : ACR/LA/2022- 23/269 Dated: 27-07-2023, seeking approval to proceed with acquisition process and the same was approved : and

Further, on approval of Appropriate Government i.e Deputy Commissioner (District Collector) Kishtwar, vide Declaration No. 10 of 2023 Dated 27-07-2023, read with endorsement No. DCK/LA/23/ F. No. 294/182 Dated 27-07-2023, it was declared under the provisions of Section 19 of the Right to Fair Compensation and Transparency No. 13] The J&K Official Gazette, the 26th June, 2025/5th Asad., 1947. 2357 –––––––––––––––––––––––––––––––––––––––––––––––––––––– in Land Acquisiton, Rehabilitation and Resettlement Act, 2013 that the land was required for the public purpose Construction of Water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town Tehsil and District Kishtwar. To facilitate causation of the above requirements, Notice vide No. ACR/LA/2023-24/33946 Dated 03-08-2023 was served under Section 21 of the RTFCLARR Act, 2013, stating that all persons having interest in the said land may submit their objections within 30 days and may appear personally or through an agent.

Under Section 21 of the RTFCLARR Act, 2013, the Government intended to take the possession of the land in 30 days from the date of issue of the Notice and claims to compensation for all interests in the land as well as objection to the measurement of land under Section-20 to be submitted to the Collector for disposal within 30 days from the date of issue of the notice. No objections were received against the said notice.

The case file was as such submitted to the Deputy Commissioner (Appropriate Government) Kishtwar in the shape of Tentative award vide No. ACR/LA/2023-24/487 Dated 09-09-2023 and No. ACR/LA/2023-24/492 Dated 12-09-2023 for approval of rates. The rates so recommended have been approved by the Deputy Commissioner (Appropriate Government) Kishtwar and conveyed to this office vide No. DCK/LA/24/F.No. 299/246 Dated 19-09-2023. After the receipt of the approved rates from Deputy Commissioner (Appropriate Government) Kishtwar Draft award has been issued and sent to Deputy Commissioner (Appropriate Government) Kishtwar from this office vide No. ACR/LA/2024/90 Dated 22-05-2024 for approval of the same, the draft award has been approved by Deputy Commissioner (Appropriate Government) Kishtwar and conveyed to this office vide No. DCK/LA/2024/F.No. 297/101 Dated 15-06-2024.

2. OWNERSHIP :

Name of the persons whose land under acquisition is standing in the record of right was ascertained from the revenue records and the same are shown in Award statement.

3. SITUATION, DESCRIPTION AND LOCATION OF THE

LAND :

The total acquired land measuring 02 Kanals-17.5 Marlas, under acquisition is un-irrigated agricultural land and situated in Village Matta of Tehsil Kishtwar, District Kishtwar.

4. VALUATION OF THE LAND :

The principal for assessing the amount of compensation to be awarded has been laid down under Section 26(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 read with endorsement No. REV/LAJK/ 254/2020 Dated 26-08-2020 and accordingly the market value of the land was determined for further determination of compensation.

5. DETERMINATION OF COMPENSATION :

As per the provisions of the Section 30 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act. 2013, 100% of the Compensation Amount (including market value multiplied by Multiplication Factor) is to be awarded as Solatium as has been determined in the Award Statement.

6. COMPENSATION OF LAND :

The compensation of land is to be paid to land interested persons. The total amount of Award workout to be Rs.24,42,780/= (Rupees Twenty Four Lakhs Forty Two Thousand Seven Hundred and Eighty Only).

The acquiring department shall ensure that the record of right and all the relevant documents related to the ownership/occupancy of the said land are accordingly modified and show the transfer of the said land solely in the name of Government consequent to taking over possession of the said land and the payment of the compensation to the concerned interested parties.

9. CORRECTION OF THE RECORD IN THE RECORD OF

RIGHTS :

The Tehsildar, Kishtwar shall carry out necessary mutation in the Record of Rights in the name of Indenting Department in respect of land so acquired as per the enclosed award statement.

10. APPORTIONMENT :

The amount of compensation payable to interested persons as shown in the Apportionment Statement is in accordance with the provisions of Agr. Reform Act, 1976 and the guidelines given by the Rev. Department vide No. REV(LB) 10/80 Dated 23-02-1980 and the latest Girdawari entries in the Field Book as well as in Girdawari Copies. However, in case of any dispute, which is not settled within reasonable time, the amount of compensation will be remitted to the Court under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for jurisdiction.

11. ENCUMBRANCES :

The land under acquisition is free from all encumbrances and

it has been mentioned in the Award Statement.
