Whereas, it appears to the appropriate Government that a total

of 62 Kanals 15 Marlas land is required in the Village Bhatan and

Dimji Tehsil Nagseni District Kishtwar for public purpose, namely,

Construction of Link Road from Bhagna to Dichlaa in Village Bhatan and

Dimji, Tehsil Nagseni & District Kishtwar, Social Impact Assessment

study was carried out by the Social Impact Assessment (SIA) Unit and

a report submitted/Preliminary investigation was conducted by a team

Whereas, after observing the acquisition case file for Construction of Link Road from Bhagna to Dichlaa in Village Bhatan and Dimji, Tehsil Nagseni and District Kishtwar it was noticed that during the preparation of SIA Committee by this Office under Section 4 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 vide No. ACR/LA/2022–23/ 68–74 Dated 05–05–2022, the Khasra No. 796/640/196 measuring 06 Marlas, Khasra No. 120 measuring 03 Kanal-13 Marlas, Khasra No. 119 measuring 04 Kanal-04 Marlas, Khasra No. 765/617/216 Min measur- ing 05 Kanal-14 Marlas, have been inadvertently left in the said SIA. The Khasra No: 796/640/196 measuring 06 Marlas, Khasra No: 120 measuring 03-Kanal-13 Marlas, Khasra No. 119 measuring 04 Kanal-04 Marlas, Khasra No. 765/617/216 Min measuring 05 Kanal- 14 Marlas are hereby incorpo- rated in acquisition proceedings of the case file.

The Total area worked out is 62 Kanals 15 Marlas instead of 48 Kanals

18 Marlas.

The notification is made under the provisions of Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and resettlement Act, 2013 (30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the office of the Collector Land Acquisition, ACR Kishtwar on any working day during the working hours.

The Government is pleased to authorize Officers of Indenting Department and his staff to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act.

Objections to the acquisition if any, may be filed by the persons inter- ested within 60 (sixty days) from the date of publication of this notification of this notification as provided under Section 15 of the Act before Collector.

Subject :— Preliminary notification (See Sub–Rule (1) of Rule 25 and Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Whereas, it appears that a total of 02 Kanals land is required in the village Misrata Tehsil Bhadarwah District Doda for public purpose namely for Construction of 3.15 MVA 33/11 KV Receiving Station ; and

Whereas, after seeking report from the Committee constituted under Sub–Rule (1) of Rule 4, it establishes that there is no involuntary displacement of persons due to the said acquisition of land with no adverse impact and no rehabilitation is involved, as such the said report and recommendations of the Committee is hereby considered as SIA report.

Therefore, it is notified that for the above said project in the Village Misrata Tehsil Bhadarwah District Doda, a piece of land measuring 02 Kanals whose detail description is as follows is as follows is under acquisition.

These proceedings are under provisions of Section 23 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for determination of compensation in respect of net area of land proposed to be acquired measuring 02 Kanals-17.5 Marlas for Construction of Water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town in Village Kishtwar Tehsil and District Kishtwar. The land acquisition proceedings were initiated with the publication of Preliminary Notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Chief Engineer Jal Shakti (PHE) Department Jammu vide No. : PHEJ/Plg/2427–2428 Dated 27-11-2020 endorsed by Executive Engineer Jal Shakti (PHE) Department Kishtwar vide No: HDK/2021/8987- 89 Dated 09-02-2021 submitted proper letter of indent for acquisition of land for Construction of water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town in Village Kishtwar Tehsil and District Kishtwar. Accordingly the Tehsildar Kishtwar vide No. 127-130/ OQ/LA Dated 07-10-2020, had submitted the land acquisition papers to this office duly completed in all respect for further necessary action.

The local SIA team was notified as Social Impact Assessment Team (SIA) under Section 4 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for conducting 2864 The J&K Official Gazette, the 17th July, 2025/26th Asad., 1947. Social Impact Assessment Team (SIA) vide No. ACR/LA/2022-23/411-17 Dated 31-08-2022. Accordingly, the concerned committee members had submitted the Social Impect Assessment Study report vide No. BDO/Estt/ 2022-23/574 Dated 19-09-2022 and the same was submitted to the District Collector Kishtwar for appraisal under u/s 7 of the RFCTLARR Act, 2013 vide No ACR/LA/2022-23/589. Dated 20-10-2022.

The District Collector Kishtwar constituted a committee of expert group for appraisal of Social Impect Assessment Study report. Accordingly, the Multi-Disciplinary Expert Group for appraisal constituted vide Notification No DCK/LA/22/F.No. 102/425 Dated 26-12-2022 submitted its recommendation.

The SIA report and the recommendation of Multi-Disciplinary Expert Group was then approved and a Preliminary Notification No. ACR/LA/ 2022-23/350-56 Dated 18-01-2023 was issued under Section 11of the Act stating that the land described in the schedule thereto (thereafter reffered to as the said land ) was needed or likely to be needed for the public purpose. The notification has been issued for inviting objections within 60 days from all the concemed stakeholders.

No objections were received against the Preliminary Notification and served copy of th said notification was received from Tehsildar Kishtwar vide No. 474849/OQ/Gen. Dated 20-02-2023. The proposal was than sub- mitted to the Appropriate Government i.e Dupty Commissioner (District Collector) Kishtwar vide No: ACR/LA/2022-23/269 Dated 27-07-2023 seeking approval to proceed with acquisition process and the same was approved ; and

Further, on approval of Appropriate Government i.e. Deputy Commissioner (District Collector) Kishtwar, vide Declaration No. 10 of 2023 Dated 27-07-2023 read with endorsement No. DCK/LA/23/F. No. 294/182 Dated 27-07-2023. It was declared under the provisions of Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the land was required for the public purpose Construction of Water Filtration Plant of 07 MLD at Treser under WSS Naigad for Kishtwar Town in Village Kishtwar Tehsil and District Kishtwar. To facilitate causation of the above requirements, Notice vide No. ACR/LA/2023-24 /33946 Dated 03-08-2023 was served under Section 21 of the RTFCLARR Act, 2013, stating that all persons having interest in the said land may sumit their objections within 30 days and may appear personally or through an agent.

Under Section 21 of the RTFCLARR Act, 2013, the Government intended to take the possession of the land in 30 days from the date of issue of the Notice and claims to compensation for all interests in the land as well as objection to the measurement of land under Section-20 to be sumitted to the Collector for disposal within 30 daya from the date of issue of the Notice. No objections were received against the said notice.

The case file was as such submitted to the Deputy Commissioner (Appropriate Government) Kishtwar in the shape of Tentative award vide No. ACR/LA/2023-24/487 Dated 09-09-2023 and No.ACR/LA/ 2023-24/492. Dated. 12-09-2023 for approval of rates. The rates so recommended have been approved by the Deputy Commissioner (Appropriate Government) Kishtwar and conveyed to this office vide No. DCK/LA/24/F. No. 299/246 Dated 19-09-2023. After the receipt of the approved rates from Deputy Commissioner (Appropriate Government) Kishtwar Draft award has been issued and sent to Deputy Commissioner (Appropriate Government) Kishtwar from this office vide No. ACR/LA/ 2024/90 Dated 22-05-2024 for approval of the same, the draft award has been approved by Deputy Commissioner (Appropriate Government) Kishtwar and conveyed to this office vide No; DCK/LA/2024/F No. 297/ 101 Dated 15-06-2024.

Name of the persons whose land under acquisition is standing in the record of rights was ascertained from the revenue records and the same are shown in Award Statement.

The total acquired land measuring 02 Kanals -17.5 Marlas, under acquisition is un-irrigated agricultural land and situated in Village Matta of Tehsil Kishtwar District Kishtwar.

The principle for assessing the amount of compensation to be awarded has been land down under Section 26(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resttlement Act, 2013 read with endorsement No. REV/LAJK/254/2020 dated 26-08-2020 and accordingly the market value of the land was determined for further determination of compensation

The amount of compensation payable to interested persons as shown in the Apportionment Statement is in accordance with the provisions of Agr, Reform Act 1976 and the guidelines given by the Rev, Department vide No. REV (LB) 10/80 Dated 23-02-1980 and the latest Girdawari en- tries in the Field Book as well as in Girdawari Copies. However, in case of any dispute, which is not settled within reasonable time, the amount of compensation will be remitted to the Court under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for jurisdiction.

The land under acquisition is free from all encumbrances and it has

been mentioned in the Award Statement.

SO-277.¾ Whereas, on 26-11-2023, the Police Station, Safakadal, received a docket to the effect that a reliable information was received

in the area. Subsequently, a Naka was established by the Police at Tanga Adda, Bagiyas, Srinagar. During the checking, the Naka Party intercepted a vehicle (Wagon-R) and on personal search of the driver identitied as Umer Khan S/o Gh. Nabi Khan R/o Kalamdanpora, Nawa Bazar, Maharaj Gunj, Srinagar, the police recovered 01 Pitol with Magazine, 12 Rounds and cash to the tune of Rs. 17000/- Indian currency from his possession; and

2. Whereas, based on the above, a case FIR No. 156/2023 under Section 7/25 Arms Act, and Sections 13, 23 and 39 of ULA (P) Act, was registered in the Police Station, Safakadal, and the investigation of the case was set into motion ; and

3. Whereas, during the investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of the witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused viz. Umer Khan, was in contact with some unknown Pakistani based terrorists of LeT, a benned outfit, through virtual mode, who provided the recovered arms/ammunition to him through some unknown persons in order to promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was estavblished that accused viz. Umer Khan, was working as Over Ground Worker (OGW) for the terrorists of LeT, a banned outfit and was providing logistic support to them, besides, procured arms/ammunition from the terrorists for carrying out the terrorist activities in the area ; and

6. Whereas, the investigation, in respect of unknown terrorists who provided the arms/ammunition to the accused viz. Umer Khan, shall continue to ascertain their identified and to bring out their role/involvement in the area and the supplementary charge sheet against them would be filed in the Court of Competent Jurisdiction ; and

7. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below No. 5-c] The J&K Official Gazette, 3rd May, 2024/13th Vai., 1946. 3

mentioned accused for the commission of offences punishable under Sections of the Unlawful Actvities (Prevention) Act, 1967, as shown against his name :─

Whereas, the Authority, appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accussed ; and

9. Whereas, after perusing the Case Dairy File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for his prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Umer Khan, for the commission of offences punishable under Sections 13, 23 and 39 of ULA(P) Act, arising out of FIR No. 156/2023 of Police Station, Safakadal..

SO-278.¾ Whereas, on 14-11-2023, the Police Station, Surankote, received a docket to the effect that a reliable information was received about the movement of some unknown terrorists in the area.

during checking, the Naka Party intercepted a vehicle (Fortuner Toyota) in which three persons identified as Ajaz Ahmad S/o Abdul Rashid Caste Sheikh R/o Sailian, Surankote, Poonch, Gulshan Ahmad S/o Mohd Sharief Caste Sheikh R/o Bhunikhait, Surankote and Farooq Feroz S/o Mohd Rafiq Dar R/o Rajdhani, Thannamandi, were boarded. During the personal search of accused viz. Ajaz Ahmed and Gulshan Ahmad, the Police recovered 02 Pistols, 04 Magazines, 48 Rounds and cash to the tune of Rs. 2.5 lacs Indian currency from their possession respectively, besides, recovered 04 Posters of HM, a banned outfit from the vehicle ; and

2. Whereas, based on the above, a case FIR No. 358/2023 under Sections 120-B, 121, 122 IPC, 7/25, 26, 27 Arms Act, and the Sections 13, 18 and 20 of ULA (P) Act, was registered in the Police Station, Surankote, and the investigation of the case was set into motion.

Subsequently during the investigation, the offences under Sections 26 and 27 Arms Act were dropped and the offences under Section 201 IPC and Sections 17, 18-B, 21, 23, 38, 39 and 40 of ULA(P) Act were added in the case ; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of the witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, one more person identified as Mehraj Ahmad S/o Maqbool Ahmad R/o Bhunikhait, Surankote, Poonch was found involved in the case. Subsequently, the accused was arrested and during the investigation, 20 Posters of HM, a banned outfit and cash to the tune of Rs. 49,000/- Indian currency were recovered at his instance ; and

5. Whereas, during the investigation, the person viz. Farooq Feroz, was not found involved in the case and accordingly, was dropped from the case and was given benefit under Section 169 Cr. PC. ; and

6. Whereas, during the investigation, it was found that the accused viz. Ajaz Ahmad, Gulshan Ahmed and Mehraj Ahmed, were in contact with a terrorist of HM, a banned outfit, namely, Abid Ramzan S/o Mohd Ramzan Sheikh R/o Chotipora, Heerpora, Shopian A/P PoK, through virtual mode, who provided the recovered arms/ammunition, Posters No. 5-d] The J&K Official Gazette, 3rd May, 2024/13th Vai., 1946. 3

and cash to the accused viz. Ajaz Ahmed, Gulshan Ahmed and Mehraj Ahmed, through an unknown person, in order to promote terrorist activities in the area and threatened the sovereignty and integrity of India ; and

7. Whereas, the investigation, it was established that the accused viz. Ajaz Ahmad, Gulshan Ahmed and Mehraj Ahmad, were working for the terrorists particularly the Pakistani base terrorist viz. Abid Ramzan, and were providing logistic support to him, besides, procured arms/ammunition, indiscriminatory material and cash from the said terrorist through an unknown person for carrying out the terrorist activities in the area and to wage war against the Government of India ; and

8. Whereas, the investigation, in respect of an unknown person shall continue to ascertain his identity and to bring out his role/involvement in the case and the Supplementary charge sheet against him would be filed in the Court of competent jurisdiction ; and

9. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967, and Indian Penal Code, as shown against their names :─

10. Whereas, the accused viz. Abid Ramzan, is absconding and the proceedings under Section 299 Cr. PC. have been proposed to be initiated against him ; and

Whereas, the Authority, appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accussed ; and

12. Whereas, after perusing the Case Dairy File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned asccused for their prosecution under the provisions of law ; and

13. Whereas, the Government has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused under the aforementioned provision of the Indian Penal Code (IPC).

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) No. 5-d] The J&K Official Gazette, 3rd May, 2024/13th Vai., 1946. 5

Act, 1967, and Section 196 of the Code of Criminal Procedure, 1973, the Government hereby accord sanction for launching prosecution against the accused viz. Ajaz Ahmed, Gulshan Ahmed, Mehraj Ahmed, and Abid Ramzan, for the commission of offences as indicated against the each accused at Para (9) above, arising out of FIR No. 358/2023 of Police Station, Surankote.

two suspects while seeing the patrolling party at Peer Baba Shrine near Krishan Ganga River, Keran, tried to escape but were chased down on the spot and identified as Sayyad Ahmad Khan S/o MohammadAfzal Khan R/o KeranBala, Kupwara and Rafaqat Ahmad Khan S/o Naseer Ahmad Khan R/o Dader, Kundiyan, KeranKupwara. During their personal search, the Police recovered 01 AK-47 rifle, 01 Pistol with magazine and 05 rounds from theirpossession respectively; and

Sayyad Ahmad Khan and Rafaqat Ahmad Khan, were in contact with a Pakistani based terrorist of LeT, a banned outfit, namely Basharat Ahmad Khan S/o Shabir Ahmad Khan R/o Keran A/P PoK/PaK, through virtual mode, who provided the recovered arms/ammunition to the accused viz.Sayyad Ahmad Khan and Rafaqat Ahmad Khan, in order to promote terrorist activities in the area; and

5. Whereas during the investigation, it wasestablished that the accused viz. Sayyad Ahmad Khan and Rafaqat Ahmad Khan, were working as Over Ground Workers (OGWs) for the terrorists particularly the Pakistani based terrorist viz. Basharat Ahmad Khan, and were providing logistic support to him besides, under a well knit criminal conspiracy procured arms/ammunition from the said terrorist for carrying out the terrorist/unlawful activities in the area; and

6. Whereas during the investigation the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima facie involvement of the below mentioned accused for the commission of offences punishable under Sections No. 13-J] The J&K Official Gazette, 2ndJuly., 2024/11th Asad., 1946. 3

Whereas the Authority appointed by the Government under Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused; and

9. Whereas after perusing the Case Diary File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosection against the accused viz.Sayyad Ahmad Khan, Rafaqat Ahmad Khan and BasharatAhmad Khan, for the commission of offences punishable under the relvant Sections of ULA (P) Act, as indicated against the each accused at Para (6) above, arising out of FIR No.02/2024 of Police Station, Keran.

SO-356.¾Whereas, on 25-01-2024, the Police Station, Boniyar, received a docket to the effect that a reliable information was received about the transportation of arms/ammunition in the area. Subsequently, 2 The J&K Official Gazette, 5th July, 2024/14th Asad., 1946. [No. 14-a

Joint Nakas were established by the Police/Security Forces and during the checking, at Challa TCP, two vehicles were intercepted, driven by Rashid Ahmad Mangral S/o Mushtaq Ahmad Mangral R/o Dwaran, Uri and Syed Irfan Ali S/o Syed Abid Hussain R/o Gingal, Mahura, Uri, and on search, the Police recovered 02 Pistols, 02 Magazines, 24 Rounds, 01 Silencer,02 Hand Grenades and an amount of Rs. 1,69000/- from the vehicles respectively; and

2. Whereas based on the above, a Case FIR No. 07/2024 under Section 7/25, Arms Act and Sections 13,16,18,23 and 39 of ULA (P) Act, was registered in the Police Station, Boniyar, and the investigation, of the case was set into motion. Subsequently, during the investigation, the offence under Section 16 of ULA (P) Act was dropped and Sections 17 and 40 of ULA (P) Act were added in the case; and

3. Whereas, during the course of investigation, the site plan of the place of occurrence and the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

4. Whereas, during the investigation, one more person identified as Mohd Ishfaq Mir S/o Gh.Hussain Mir R/o Hajitrah, Tangdhar, Kupwara, was found involved in the commission of offence. Subsequently, the accused was also arrested in the case and during the investigation, 02 Hand Grenades were recovered at his instance; and

5. Whereas, during the investigation, it was found that the accused viz. Rashid Ahmad Mangral, was in contact with a terrorist of HM, a banned outfit, namely, Azad Saudi, through virtual mode and on his directions the accused viz. Rashid Ahmad Mangral, motivated the other two accused viz. Syed Irfan Ali and Mohd Ishfaq Mir, to work for the outfit in order to promote terrorist activities in the area; and

6. Whereas, during the investigation, it was found that the accused viz. Rashid Ahmad Mangral and Syed Irfan Ali, on the directions of terrorist viz. Azad Saudi, went to Cholan Pahadi Hilla, and procured arms/ammunition, Hand Grenades and cash to the tune of Rs 1,69000/- from an unknown person for further distribution among the terrorists.

The accused viz. Rashid Ahmad Mangral, handed over 01 Pistol with Magazine, 10 Rounds, 01 Hand Grenade and cash to the tune of Rs.69000/- to the accused viz. Syed Irfan Ali and 02 Hand Grenades to No. 14-a] The J&K Official Gazette, 5th July, 2024/14th Asad., 1946. 3

the accused viz.Mohd Ishfaq Mir, besides, retained 01 Pistol, with magzzine, 14 Rounds. 01 Silencer, 01 Hand Grenade and cash to the tune of Rs.01 lac in his possession, which were later on recovered from the accused; and

7. Whereas, during the investigation, it was established that the accused viz. Rashid Ahmad Mangral, Syed Irfan Ali and Mohd Ishafq Mir, were working as over Ground Workers (OGWs) for the terrorists particularly the terrorist viz. Azad Saudi, and were providing logistic support to him, besides under a well knit Criminal consipiracy procured arms/ammunition, Hand Grenades and cash to the tune of Rs. 1,69000/- from the said terrorist through an unknown person for further distribution among the terrorists for carrying out the terrorist activities in the area ; and

8. Whereas, the investigation, in respect of accused viz. Azad Saudi, and an unknown person who handed over the arms/ammunition, Hand Grenades and cash to the accused viz. Rashid Ahmad Mangral and Syed Irfan Ali, shall continue to ascertain their actual identity and to bring out their role/ involvement in the case and the Supplementary Charge Sheet against them would be filed in the court of competent jurisdiction ; and

9. Whereas, on the basis of the investigation, the statements of witnesses recorded and other evidence collected, the Investigating Officer, has established a prima face involvement of the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activites (Prevention) Act, 1967, as shown against their names:-

Whereas, during the investigation, two more persons identified as Adil Ayoub Sofi S/o Mohammad Ayoub Sofi R/o Rathpora, Eidgah, Srinagar and Kaisar Altaf Hakeem S/o Mohammad Altaf Hakeem R/o Nawabazar, Srinagar were found involved in the case. Subsequently, the accused were arrested and during the investigation some incriminatory material were also recovered at their instance ; and

5. Whereas, during the investigation, it was found that the accused viz. Arsalan Altaf Bhat,was in contact with an unknown person through virtual mode, who provide the recovered posters and flag to the accused viz. Arsalan Altaf Bhat, with the directions to distribute the same among other accused viz. Whereas,during the investigation,it was established that the accused viz. Arsalan Altaf Bhat, Salman Farooq Dar, Moomin Mehraj Sofi, Adil Sofi and Kaisar Altaf Hakeem, were working as Over Ground Workers (OGWs) for the terrorist organization of ISJK outfit and were providing logistic support to them, besides, procured incriminatory material from the terrorist for carrying out the unlawful activities in the area; and

7. Whereas, the investigation, in respect of unknown person who provided the incriminatory material to the accused viz. Arsalan Altaf Bhat, shall continue to ascertainis actual identity and to bring out his role/involvement in the case and the Supplementary Charge Sheet against him would be filed in the court of competent jurisdiction ; and

8. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has establishedprima facie involvement of below mentioned accused for the commission of the offences punishable under sections of the Unlawful Activities (Prevention) Act, 1967,as shown against theirnames:—

Whereas, after perusing the Case Diary File,the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities(Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for their prosecution under the provisions of law.

Now, therefore,in exercise of the powers conferred bySub-Section (2) of Section 45 of the Unlawful Activities (Prevention)Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. [No.17-d –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– identified as Mubarak Ahmad Thokar S/o Abdul Rashid Thokar, Saif Gulzar S/o Gulzar Ahmad Ganie and Adil Ahmad Thokar S/o Mohammad Amin Thokar residents of Sopat, Devsar, are working for the terrorists of LeT, a banned outfit namely, Muzaffer Ahmad Bhat S/o Mohammad Amin Bhat and Abu Maviya R/o Pakistan, and are providing shelter/logistic support to them, besides, are arranging meetings for the said terrorists in their residential houses. It was further learnt that accused viz. Mubarak Ahmad Thokar, was close assosciate of killed terrorist namely , Shakoor Ahmad Dar S/o Mohammad Munawar Dar R/o Sopat, Devsar and on his directions was motivating the youth to join the terrorists ranks ; and

2. Whereas, based on the above, a case FIR No.57/2018under Sections13 (2), 18, 19, 38and 39 of ULA(P) Act, was registered in the Police Station Devsar, and the investigation of the case was set into motion. Subsequently, during the investigation, the offences under Section 18 ULA (P) Act was dropped and Section 20 of ULA (P) Act was added in the case ; and

3. Whereas, during the course of investigation, the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law; and

4. Whereas, during the investigation, the accused viz. Mubarak Ahmad Thokar, Saif Gulzar and Adil Ahmad Thokar, were arrested in the case and one more person identified as Mohammad Rafiq Sheikh S/o Mohammad Ismail Sheikh R/o Sopat, Devsar, was found involved in the commission of crime. Subsequently, the said accused was also arrested in the case. During the investigation, some incriminatory material was recovered at his instance ; and

5. Whereas, during the investigation, it was found that the accused viz. Mubarak Ahmad Thokar, Saif Gulzar, Adil Ahmad Thokarand Mohammad Rafiq Sheikh, were in contact with the terrorists viz. Muzaffer Ahmad Bhat, Abu Maviya, Shakoor Ahmad Dar and Waleed @ Chota Abu Maviya @ Maviya Sani R/o Pakistan, and were working No.17-d] The J&K Official Gazette, 30th July, 2024/8th Srav.,1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– for the said terrorists in order to promote terrorist activities in the area;

and

6. Whereas, during the investigation, it was established that the accused viz. Mubarak Ahmad Thokar, Saif Gulzar, Adil Ahmad Thokar and Mohammad Rafiq Sheikh, were working as Over Ground Workers (OGWs) for the terrorists of LeT, a banned outfit viz. Muzaffer Ahmad Bhat, Abu Maviya, Shakoor Ahmad Dar and Waleed @ Chota Abu Maviya @ Maviya Sani, and were providing logistic support to them, besides were voluntarily harbouring the said terrorists for carrying out the terrorists activities in the area ; and

7. Whereas,the accused terrorists viz. Muzaffer Ahmad Bhat, Abu Maviya and Shakoor Ahmad Dar, have been killed in the different encounters with the Security Forces and the proceedings under the law would abate against them; and

8. Whereas, on the basis of investigation, the statement of witnesses recorded and the other evidence collected, the Investigating Officer has establishedprima facie involvement of below mentioned accused for the commission of the offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967,as shown against theirnames:—

[No.18-a –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– Colony, New Colony, Sopore, Javaid Ahmad Teeli S/o Nissar Ahmad Teeli R/o Armapora, Sopore and Javaid Ahmad Reshi S/o Mohd Jamal Reshi R/o Harwan, Sopore, had left to Gulf Countries on valid travel documents and thereafter, went to Pakistan in order to join the terrorist ranks to promote terrorism in the UT of J&K and

2. Whereas, based on the above, a case FIR No.307/2023under Sections13, 18-B, 20 and 39 of ULA(P) Act, was registered in the Police Station Sopore, and the investigation of the case was set into motion.

Subsequently, during the investigation, the offences under Section 7/25 Arms Act 4/5 ESA and Sections 18, 19, 23and 38 of ULA (P) Act of ULA (P) Act were added in the case ; and

4. Whereas, during the investigation, three more persons identified as Abdul Rashid Najar S/o Abdul Ahad Najar R/o Naseembagh, Sopore, Abdul Jameel Lara S/o Abdul Gani Lara R/o Nigeenbagh, Sopore A/P Green Town, Sopore and Mohammad Rafi Najar S/o Abdullah Najar R/o Mumkak, Batpora, Sopore, were found involved in the commission of offence. Subsequently, the accused were arrested and during the investigation, 02 Pistols, 02 Magazines, 27 Rounds, 282 AK Rounds, 92 SLR Rounds, 02 IEDS and some incriminatory material were recovered at the instance of accused viz. Abdul Rashid Najar and Abdul Jameel Lara, respectively; and

5. Whereas, during the investigation, it was found that the accused viz. Abdul Rashid Najar, Abdul Jameel Lara and Mohammad Rafi Najar,were in contact with the terrorists of HM/LeT banned outfits viz. Abdul Majeed Sofi @ Majid Bisati,Javaid Ahmad Teeli, Javaid Ahmad Reshi, Abdul Qayoom Najar S/o Abdul Ahad Najar R/o Batapora, Sopore, Javaid Ahmad Matoo S/o Abdul Gani Matoo R/o Khushal Matoo, Soppore and ShamusdinKhooru S/o Ghulam Ahmad Khooru R/o Krankshivan, Sopore, and were working for them in order to promote No.18-a] The J&K Official Gazette,1st Aug., 2024/10th Srav.,1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– terrorist activities in the area. The accused viz. Mohammad Rafi Najar and Javaid Ahmad Matoo,were found already arrested by Sopore Police in Case FIR No. 42/2013 of Police StationTarzoo. Subsequently, their custody was changed in the instant case ; and

6. Whereas, the investigation, in respect of accused viz. Javaid Ahmad Teeli, Javaid Ahmad Reshi and ShamusdinKhooru, shall continue to bring out their role/involvement in the case and the Supplementary Charge Sheet again them would be filed in the court of competent jurisdiction ; and

7. Whereas,during the investigation,it was established that the accused viz. Abdul Rashid Najar, Abdul Jameel Lara and Mohammad Rafi Najar, were working as Over Ground Workers (OGWs) for the terrorists viz. Abdul Majeed Sofi @ Majid Bisati, Abdul Qayoom Najar and Javaid Ahmad Matoo, and under a well knit criminal conspiracy were providing shelter/logistic support to them, besides the accused viz. Abdul Rashid Najar and Abdul Jameel Lara, procured arms/ammunition from the terrorists for carrying out the terrorists activities in the area ;

and

8. Whereas, the accused terrorist viz. Abdul Qayoom Najar, has been killed in an encounter with the Security Forces and the proceedings under the law would abate against him ; and

9. Whereas, on the basis of investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer has established aprima facie involvement of below mentioned accused for the commission of the offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967,as shown against theirnames:—

SO-379.—Whereas, on 08-04-2024, information was received by Police Station, Baramulla, to the effect that some unknown terrorists of 2 The J&K Official Gazette, 2nd Aug., 2024/11th Srav.,1946.[No.18-b –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– LeT, banned outfit are moving in Baramulla town with the intention to carryout terrorist activities besides, three persons identified as Owais Ahmad Waza S/o Gh. Mohd Waza, Basit Fayaz Kaloo S/o Fayaz Ahmad Kaloo residents of Ganie Hamam, old Town, Baramulla and Faheem Ahmad Mir S/o Tariq Ahmad Mir R/o Mirashaib, old Town, Baramulla, are assisting them and providing information about the movement of Security Forces, for carrying out terrorist activities in the area ; and

2. Whereas, based on the above, a case FIR No.79/2024under Sections13, 18and 39 of ULA(P) Act, was registered in the Police Station Baramulla, and the investigation of the case was set into motion.

Subsequently, during the investigation, the offences under Section 7/25 Arms Act, and Sections 20, 23 and 38 of ULA (P) Act were added in the case ; and

3. Whereas, during theinvestigation, the accused viz. Owais Ahmad Waza, Basit Fayaz Kaloo and Faheem Ahmad Mir, were arrested in the case and during the investigation, 03 Hand Grenades were recovered at their instance respectively; and

4. Whereas, during the course of the investigation, the seizure memos were prepared and the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

5. Whereas, during the investigation, it was found that the accused viz. Owais Ahmad Waza, Basit Fayaz Kaloo and Faheem Ahmad Mir, were in contact with a terrorist namely, Imadullah @ Ali Babar @ Dujana S/o Mohammad Hanief Jatt R/o Wasiwalla, Punjab, Pakistan, who provided the recovered Hand Grenades to the accused viz. Owais Ahmad Waza, Basit Fayaz Kaloo and Faheem Ahmad Mir, through an unknown person in order to promote terrorist activities in the area; and

6. Whereas, the accused viz. Imadullah @ Ali Babar @Dujana, was already arrested by Baramulla Police for which a separate acase FIR No. 99/2021 was registered in Police Station, Uri and is presently facing trial in the said case; and No.18-b] The J&K Official Gazette, 2nd Aug., 2024/11th Srav.,1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– 7. Whereas, during the investigation, it was established that the accused viz. Owais Ahmad Waza, Basit Fayaz Kaloo and Faheem Ahmad Mir, were working as Over Ground Workers (OGWs) for the terrorist of LeT, a banned outfit, particularly the terrorist viz. Imadullah @ Ali Baba @ Dujana, and were providing logistic support to him, besides procured Hand Grenades from an unknown for carrying out the terrorist activities in the area; and

8. Whereas, the investigation,in respect of the unknown person, shall continue to ascertain his actual identity and to bring out his role/involvement in the case and the Supplementary Charge Sheet against him would be filed in the court of competent jurisdiction; and

Whereas, the Authority appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion thatprima faciecaseis made out against the above accused ;

Whereas, after perusing the Case Diary File,the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities(Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above- mentioned accused for their prosecution under the provisions of law.

Now, therefore,in exercise of the powers conferred bySub-Section (2) of Section 45 of the Unlawful Activities (Prevention)Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Owais Ahmad Waza, Basit Fayaz Kaloo, Faheem Ahmad Mir and Imadullah @ Ali Babar @ Dujana, for the commission of offences punishable under the relevant Section of ULA (P) Act, as indicated against each accused at Para (9) above, arising out of FIR No. 79/2024 of Police Station, Baramulla.
