Whereas, the Director, Sheep Husbandary Department, Jammu vide No. DSHJ/F&F/2025-26/1503-1505 dated 25-04-2025 has placed a formal indent for the acquisition of land for ''construction of Veterinary Dispensary at Ransoo situated at Village Sunarian, Tehsil Pouni, District Reasi ;

Whereas, vide SO-237 dated 23-07-2020 issued by the Revenue Department, J&K Government Assistant Commissioner Revenue, Reasi has been designated as Collector Land Acquisition to perform the functions of a Collector in Tehsils Reasi, Pouni, Bhomag and Thakrakote under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 ;

Whereas, it appears to the appropriate Government that a total of 01 Kanal land is required in the Village Sunarian, Tehsil Pouni, District Reasi for public purpose, namely ''construction of Veterinary Dispensary at Ransoo situated at Village Sunarian, Tehsil Pouni, District Reasi ;

Whereas, under Rule 4(1) of ''The Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023, a preliminary committee consisting of officers from Revenue, Rural Development, PW (R&B), Jal Shakti, Irrigation and Flood Control, Sheep Husbandary, Social Welfare, Forest, Agriculture, Horticulture under the chairmanship of Tehsildar Pouni was constituted vide this office No. DC/Rsi/LA(ACR)/25-26/33-45 (7548676) dated 23-05-2025 for conducting Preliminary Enquiry for the above said acquisition. The committee so constituted visited the spot and submitted the Preliminary Enquiry Report to this Collectorate vide No. : Teh/P/OQ/25-26/151-153 dated 07-07-2025 ;

Whereas, the committee submitted that the acquisition of land measuring 01 Kanal bearing Khasra No. 79 min situated at Village Sunarian, Tehsil Pouni does not involve any type of involuntary displacement or any rehabilitation of the land owners ;

Under Sub-Section (4) of Section 11 of the Act, no person shall make any transaction or cause any transaction of land i.e., sale/purchase etc, or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested within 60 (sixty days) from the date of publication of this notification as provided under Section 15 of the Act before Collector.

GOVERNMENT OF JAMMU AND KASHMIR CIVIL SECRETARIAT—TOURISM DEPARTMENT, J&K

Subject :– Grant of permission for the construction of Passenger Ropeway from 'Tarakote to Sanjhichhat'.

Reference :–1. Divisional Commissioner Letter No. : 502/Mis/Gen/ 24/227 dated 20-05-2024.

2. SMVD Letter No. : SMVDSB/CEO/215-16, dated 17-05-2024.

In exercise of the powers conferred by Section 7 (1) (2) of the Jammu and Kashmir Aerial Ropeway Act, 2002, and on the recommendations of the divisional Commissioner Jammu the Government of Jammu and Kashmir hereby grants permission to the Shri Mata Vaishno Devi Shrine Board (SMVDSB) for the construction of an Aerial Ropeway at Katra from Tarakote to Sanjhichhat. This permission is granted in consideration of the proposal submitted by SMVDSB to facilitate the pilgrimage to Shri Mata Vaishno Devi Shrine by providing an efficient and safe transportation system with following details :

i. Starting Point : Tarakote LTP

ii. Ending Point : Sanjhichhat UTP

iii. Length of Ropeway : 2.543 Km.

iv. Stations : 02 stations i.e. Tarakote LTP and Sanjhichhat UTP, with 16 towers along the corridor.

v. Carrying Capacity : 1500 persons per hour

vi. Type of Ropeway : Monocable with CEN standards,

vii. Estimated Project Cost : Rs. 200 Cr.

viii. Mode of Execution–Build-Own-Operate-Transfer (BOOT) Model : The project will be executed under the BOOT model, where the contractor will build, own, operate, and subsequently transfer the ropeway to SMVDSB after a specified period.

ix. Contractor Selection : SMVDSB shall engage a reputed and experienced contractor through a transparent bidding process, using the e-tendering mode to award the contract for project execution.

x. Ownership Period : Shall be decided by SMVDSB through contract.

xi. Revenue Sharing : Shall be decided between SMVDSB and the contractors. During the operation period, a revenue-sharing agreement will be in place between SMVDSB and the contractor, details of which will be outlined in the contract.

Terms and Conditions :

1. Time frames :

i. Capital raising : The bidder must raise the capital required for the construction of the Aerial Ropeway within six months.

ii. Commencement of construction : The construction shall commence within nine months from the date of issuance of this order.

iii. Completion of construction : The construction shall be completed within 1035 days (two years and ten months) from the appointed date.

3. Right of Purchase : After the expiry of the concession period the Shrine Board will be the owner of the ropeway.

4. Audit and Accounts : The SMVDSB shall maintain detailed accounts of the project as per SMVD Shrine Act, 1988.

5. Arbitration : Any disputes arising from this project shall be settled through arbitration according to the rules laid in the Arbitration and Conciliation Act, 1996.

6. Technical Specifications : The ropeway construction must adhere to the specified structure designs quality of materials, safety factors and methods of computing stresses as outlined in the technical guidelines provided.

7. Construction over Public Ways : The construction of the Aerial Ropeway over roads and other public ways of communication, excluding railways, must follow the prescribed rules. Prior sanction of the Central Government shall be taken, if required, for the construction over railways.

8. Transfer of Rights : After the expiry of the concession period, the Shrine Board will be owner of the ropeway.

9. Takeover conditions : The Government reserves the right to take over the aerial ropeway to be operated by SMVDSB or any other person, if deemed necessary.

10. Motive Power : The motive power to be used on the aerial ropeway shall be electric, subject to conditions on its use as specified by the relevant authrorities.

11. Minimum Headway : As per specified norms, a minimum headway must be maintained under different parts of the rope.

12. Bridges and Guards : To ensure safety, bridges or guards must be constructed and maintained at specified points under the ropeway.

13. Traffic Regulations :

(i) The ropeway is permitted to carry passengers and material goods within the specified operational capacity.

(ii) The promoter/operator shall not carry hazardous materials in the Ropeway.

14. Rates and Revisions :

(i) The rates shall be finalized by the Shrine Board

at the time of operationalization of the Project.

(ii) Revise the rates based on significant changes in operational costs, regulatory changes and annual economic reviews.

15. Security Deposit : A security deposit as specified in the tender document shall be deposited by the bidder with SMVDSB.

16. Environmental and Safety Standards :

i. The Project shall adhere to all relevant environmental, safety, and regulatory standards as prescribed by the Government.

ii. Regular maintenance and safety checks of the ropeway system shall be conducted by the promoter.

17. Disaster Management : A comprehensive Disaster Management Plan must be in place to address potential emergencies.

18. Cost Bearing : The promoter shall bear all costs associated with the ropeway project's installation, operation and maintenance to be executed through BOOT model.

19. Legal Jurisdiction : Any legal disputes arising from the project implemention shall be subject to the jurisdiction of the Hon'ble High Court at Jammu.

20. Validity and Revocation : This permission is valid for period of 1035 days subject to further extension of 181 days (6 months) if the promoter applies with justified reasons.

''During spot visit it is found that no rehabilitation or re-settlement is involved in the instant case of acquisition, and there is no adverse the social or environmental impact by the acquisition of the said land and type of soil is Gair Mumkin and Chahi. Also the extent of land is absolute bare minimum needed for the project. The proposed land acquisition fully serves the public purpose i.e. construction of approach link road to Industrial Estate, Tajoor, Majalta, Udhampur.

Whereas, Collector vide this office communication No. DCJ/LA/ IET/Kathar/2023-24/202 dated 03-06-2023 was intimated that the report by the SIA Committee constituted by the Collector shall be treated as SIA and was directed to proceed further in issuance of preliminary notification u/s 11(1) of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Whereas, vide endorsement No. DCJ/LA/IET/Kathar/2023-24/ 203-06 dated 03-06-2023, the Collector, Land Acquisition, Assistant Commissioner Revenue, Jammu issued Preliminary Notification under Section 11(1) of RFCTLARR Act, 2013, and called for objections from the interested person(s) within a period of sixty days from the date of publication of the Notification ;

Whereas, the Director, Sheep Husbandary Department, Jammu vide No. DSHJ/F&F/2025-26/1503-1505 dated 25-04-2025 has placed a formal indent for the acquisition of land for ''construction of Veterinary Dispensary at Ransoo situated at Village Sunarian, Tehsil Pouni, District Reasi ;

Whereas, vide SO-237 dated 23-07-2020 issued by the Revenue Department J&K Government, Assistant Commissioner Revenue, Reasi has been designated as Collector Land Acquisition to perform the functions of a Collector in Tehsils Reasi, Pouni, Bhomag and Thakrakote under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 ;

Whereas, it appears to the Appropriate Government that a total of 01 Kanal land is required in the Village Sunarian, Tehsil Pouni, District Reasi for public purpose, namely, ''construction of Veterinary Dispensary at Ransoo situated at Village Sunarian, Tehsil Pouni, District Reasi ;

Whereas, under Rule 4(1) of ''the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023, a preliminary committee consisting of officers from Revenue, Rural Development , PW (R&B), Jal Shakti, Irrigation and Flood Control, Sheep Husbandary, Social Welfare, Forest, Agriculture, Horticulture under the chairmanship of Tehsildar Pouni was constituted vide this office No. DC/Rsi/LA(ACR)/25-26/33-45 (7548676) dated 23-05-2025 4894 The J&K Official Gazette, the 16th October, 2025/24th Asv., 1947. [ No. 29 –––––––––––––––––––––––––––––––––––––––––––––––––––––– for conducting Preliminary Enquiry for the above said acquisition. The committee so constituted visited the spot and submitted the Preliminary Enquiry Report to this Collectorate vide No. Teh/P/OQ/25-26/151-153 dated 07-07-2025 ;

Whereas, the committee submitted that the acquisition of land measuring 01 Kanal bearing Khasra No. 79 min situated at Village Sunarian, Tehsil Pouni does not involve any type of involuntary displacement or any rehabilitation of the land owners ;

Whereas, Rule 8 of ''The Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquistion, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023, provides that where no involuntary displacement of persons due to acquisition of land with no adverse impact, and no rehabilitation is involved then the Collector shall obtain report of the committee as constituted under Sub-Rule (1) of Rule 4 along with the consent of the interested persons (at least 70%) which shall be considered as SIA report and in such cases the Collector shall proceed for issuance of preliminary notification under Section 11 of the Act.

Whereas, Social Impact Assessment study was carried out by SIA team constituted by District Collector Pulwama vide No. DCP/LA/ 2023/121-22 Dated 07-07-2023 as laid down under Rule 4 of said Act and a detailed Social Impact Assessment Report has been submitted through Tehsildar Rajpora vide his No. TR-OQ-25/612-14 Dated 16-09- 2025 which is as under :–

1. That the proposed acquisition of land for the said project absolutely serves the public purpose.

2. That as per project requirement presently the land proposed for acquisition as per the alignment shown by the officials of indenting department is bare minimum needed for the said project and building stands already constructed in the said land which is already in possession of the said indenting department.

3. That no land at any alternate place has been considered and found feasible for the said project.

4. That as per the available records no land has earlier been acquired for the said project which remains unutilized.

5. That no land of the previous acquisition has remained un utilized in the area which can preferably be used for the said project.

6. That all the details of the land proposed for the said purpose are more specifically and elaborately given in Shajrah Khasra already communicated by this office.

7. That the acquisition of land for the said project is of pivotal importance in the large interest of general public. As the said project is required for the Police Department, it will play an important rule in curbing the crime and maintenance of law and order in the society. The Commitee also observed that the said area is surrounded by forests so there could be also a control on illegal smuggling of forest wood and limitless cutting down of preserved/royal trees from these forests. The Committee is of the view of that the land is absolutely required for the public purpose and may be notified and acquired for the said project.

i. the 20th October, 2025 (Monday), as the last date for making nominations;

ii. the 22nd October, 2025 (Wednesday), as the date for the scrutiny of nominations;

iii. the 24th October, 2025 (Friday), as the last date for the withdrawal of candidatures;

iv. the 11th November, 2025 (Tuesday), as the date on which a poll shall, if necessary, be taken; and

v. the 16th November, 2025 (Sunday), as the date before which the election shall be completed; and

by Police Station, Lalpora, to the effect that some persons including

Ahmad Lone S/o Gh. Mohammad Lone residents of Dever, Anderbugh

are working as OGWs for the terrorists of LeT, a banned outfit, and are

providing shelter/logistic support to them, besides, are providing

transportation facilities to the terrorists for promotion of terrorism in the

area ; and

2. Whereas, on receipt of information, a Case FIR No. 09/2024 under Sections 13,18,19,20 and 39 of ULA (P) Act, was registered in the

Police Station, Lalpora and the investigation of the case was set into

motion. Subsequently, during investigation the offence under Sections 23

and 38 of ULA (P) Act, were added in the case ; and

3. Whereas, during the course of the investigation, the statements of

witnesses acquainted with the facts and circumstance of the case were

recorded ; and

4. Whereas, during the investigation, the accused namely, Ashiq

Hussain Naiko and Muneer Ahmad Lone, were arrested in the case and

04 hand grenades and 40 rounds were recovered at the instance of

accused namely, Ashiq Hussain Naiko in presence of Ex-Magistrate

Ist Class, Lalpora ; and

5. Whereas during the Investigation, involvement of 05 more persons

namely, Tanveer Ahmad Ganie S/o Gh. Rasool Ganie R/o Reban

Sopore, Bilal Ahmad Ganie S/o Nazir Ahmad Ganie R/o Bohripora

Sopore, Mohammad Shafi Naiko S/o Gh. Nabi Naiko R/o Dever (Lolab),

Shariq Ahmad Naiko S/o Gh. Mohammad Naiko R/o Dever Anderbugh,

and Naseer Ahmad Naiko S/o Ghulam-ud-Din Naiko R/o Dever

Anderbugh, also came to fore in the commission of offence and

subsequently were arrested in the case ; and

6. Whereas, during the investigation, it was established that the

accused namely, Ashiq Hussain Naiko, Muneer Ahmad Lone, Tanveer

Ahmad Ganie, Bilal Ahmad Ganie, Mohammad Shafi Naiko, Shariq

Ahmad Naiko, and Naseer Ahmad Naiko, were working as Over Ground

Workers (OGWs) for the terrorists of banned LeT outfit and were in

close contact with an active terrorist namely Adil Ahmad Thoker S/o No. 23-j ] The J&K Official Gazette, 9th Sept., 2024/18th Bhad., 1946. 3

Wali Mohammad R/o Gori Bijbehara, who had provided the recovered

grenades/ammunition to the accused Ashiq Hussain Naiko for promotion

of terrorism in the area. Besides, the accused namely, Ashiq Hussain

Naiko and Muneer Ahmad Lone, provided shelter and facilitated

transportation of terrorists particularly the terrorist namely, Adil Ahmad

Thoker from one place to another by using their vehicles for carrying out

the terrorist activities ; and

7. Whereas, on the strength of evidence collected and the statements

of witnesses recorded, the Investigating Officer, has established a prima

facie case against the below mentioned accused for the commission of

offence punishable under sections of the Unlawful Activities

(Prevention) Act,1967 as shown against their names :

8. Whereas, the Accused namely, Adil Ahmad Thoker, is

absconding and proceedings Under Section 299 Cr. PC have been

9. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all the

other relevant documents relating to the case and has come to the

conclusion that prima facie case is made out against the above accused; and

10. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the view of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above mentioned

accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Ashiq Hussain Naiko, Muneer Ahmad Lone,Tanveer Ahmad Ganie, Bilal Ahmad Ganie, Mohammad Shafi Naiko, Shariq Ahmad Naiko, Naseer Ahmad Naiko, and Adil Ahmad Thoker, for the commission of offences punishable under the relevant Sections of ULA (P) Act, indicated against the each accused at para (7) above, arising out of FIR No.09/2024 of Police Station, Lalpora.

estblishment particularly newly established Army Camp at Ramgarh

Bugam in order to carry out terrorist attacks and with the help of another

associate namely Amir Ahmad Sheikh R/o Awagam are providing

shelter/logistic support to the terrorist of JeM/HM banned outfits namely

Rouf Ahmad Dar R/o Awhatoo, Sheeraz Ahmad Lone @ Molvi R/o

Shouch and Shakir Ahmad Najar R/o Panipora ; and

2. Whereas, on receipt of information, a Case FIR No. 18/2020 Under Sections 13,18,19,38 and 39 of ULA (P) Act, came to be

registered in the Police Station, Kulgam and the investigation of the case

was set into motion. Subsequently, during investigation the offence

under Sections 18,19 of ULA (P) Act, were dropped and Section 20 of

ULA (P) Act was added in the case ; and

3. Whereas, during the course of the investigation, the statements of

witnesses acquainted with the facts and circumstances of the case were

recorded ; and

4. Whereas, during the Investigation, the accused namely Amir

Ahmad Sheikh and Wajid Ahmad Sheikh, were arrested in the case and

the accused namely Zakir Ahmad Ganie, is yet to be arrested ; and

5. Whereas during the Investigation, it was found that accused

namely, Amir Ahmad Sheikh, Wajid Ahmad Sheikh and Zakir Ahmad

Ganie were working as Over Ground Workers (OGWs) for the terrorists

namely Rouf Ahmad Dar, Sheeraz Ahmad Lone @ Molvi and Shakir

Ahmad Najar and were providing logistic support to them, besides,

facilitated their movement from one place another for carrying out the

terrorist activities ; and

6. Whereas, the accused terrorists namely Rouf Ahmad Dar,

Sheeraz Ahmad Lone @ Molvi and Shakir Ahmad Najar, have been

killed in the different encounters with the Security Forces and

proceedings under the law would abate against them ; and

7. Whereas, on the strength of evidence collected and the

statements of witnesses recorded, the Investigating Officer, has

established a prima facie case against the below mentioned accused for

SO465. Whereas on 23-03-2024, an information was received

by Police Station, Kulgam, to the cffect that OGWs of proscribed

terrorist organizations operating within J&K and across the LOC are 2 The J&K Official Gazette, 10th Sept., 2024/19th Bhad., 1946. [No. 23-o

channeling funds to separatist organizations for promating terrorism. One

Sajad Ahmad Mir S/o Gulam Mohammad Mir R/o Tengbal, Kulgam,

acting under the directions of Manzoor Ahmad Shah of Kupwara

(operating from Pakistan), collected and raised a substantial amount of

cash to the tune of around 40 to 50 lakh INR in the recent past and

distributed among the terrorists and their sympathizers to promote and

launch a secessionsist campaign against the territorial integrity and

sovereignty of the India; and

2. Whereas, on receipt of information, Case FIR No. 33/2024

under Sections 13,18,39,40 of ULA (P) Act, 124A, 124B IPC was

registered in the Police Station, Kulgam, and investigation, of the case

was set into motion. Subsequently, during investigation, the offence

under Section 18 of ULA (P) Act, 124A, 124B IPC was dropped and

Sections 120-B, 506 IPC, 20 ULA(P) Act, were added in the case; and

3. Whereas during the course of the investigation, the statements of

witnesses acquainted with the facts and circumstances of the case were

recorded; and

4. Whereas during the investigation, it was found that the accused

namely, Manzoor Ahmad Shah S/o Ghulam Ahmad Shah R/o Salkoot,

Kupwara A/P Pakistan based Kashmiri terrorist of Jamait-ul-Mujahideen,

a proscribed terrorist organization, who hatched a criminal conspiracy

with the accused viz. Sajad Ahmad Mir, to radicalize Youth of J&K

through a proxy organization named Itihad-i-Islami, to gather public

support, by delivering sermons and speeches on social evils and after

getting the support, use the same organization in propagating, advocating

and supporting terrorism and secessionist activities in J&K and

5. Whereas the accused namely, Manzoor Ahmad Shah through

Sajad Ahmad Mir coaxed a considerable number of Muslim clerics of

J&K for joining Itihad-i-Islami and was successful in motivating Molvis

namely, Mohammad Iqbal Sheikh S/o Mohammad Shaban Sheikh R/o

Nathpora, Khanbal, Anantnag and Manzoor Ahmad Mir of Tengbal,

Kulgam to propagate secessionism and express support to terrorists by

exploiting religious sermons in the mosques; and

6. Whereas, during the investigation, it was established the accused

viz. Manzoor Ahmad Shah, was to create an undercurrent and conducive

atmosphere, whereby youth of J&K would be radicalized and also to No. 23-o] The J&K Official Gazette, 10th Sept., 2024/19th Bhad., 1946. 3

ensure acceptance of terrorists within general masses for logistic support,

and also provided money to several religious clerics through the accused

viz. Sajad Ahmad Mir and Mohammad Iqbal Sheikh for carrying on the

task of disseminating anti-Indian content and to garner support for

terrorist activities in J&K and

7. Whereas, the investigation, in respect of Manzoor Ahmad Mir

of Tengbal, Kulgam and other suspects shall continue and supplementary

charge sheet under Section 173 (8) Cr.PC against them would be filed in

the court of competent jurisdiction; and

8. Whereas, on the strength of evidence collected and the

statements of witnesses recorded, the Investigating Officer, has

established a prima facie case against the below mentioned accused

for the commission of offences punishable under Sections of the

Unlawful Activities (Prevention) Act, 1967, as shown against their

names:-

9. Whereas, the accused namely, Manzoor Ahmad Shah, is

absconding and proceedings under Section 299 Cr.PC have been

proposed to be initiated against him; and

10. Whereas, the Authority appointed by the Government under

SO469. Whereas on 23-03-2024, information was received at Police Station, Anantnag, to the effect that a person namely Waseem Ahmad Ganie S/o Bashir Ahmad Ganie R/o Lukbawan, Larkipora, Anantnag joined the terrorist cadre and has illegally acquired 2 The J&K Official Gazette, 12th Sept., 2024/21st Bhad., 1946. arms/ammunitions intending to carry out the terrorist activities and sabotage the forthcoming Lok-Sabha elections in the area; and

2. Whereas, on receipt of information, Case FIR No. 49/2024 under section 7/25 Arms act and Section 18 and 20 of ULA (P) Act, came to be registered at the Police Station, Anantnag, and the investigation,of the case was set into motion. Subsequently, during the investigation, the offences under Sections 3/4 ESA, 120-B IPC, 18-B, 23 and 38 of the ULA (P) Act, were added to the case; and

3. Whereas during the course of the investigation, the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded; and

4. Whereas during the investigation, Cordon and Search

Operation was launched by the Police in collaboration with 19 RR

Army in the area during which the accused viz. Waseem Ahmad

Ganie was found in his residential house, who, while seeing the

Security Forces tried to flee from the spot but was tactfully

apprehended. During the search, 01 pistol, 02 magazines, 24 rounds

and a hand grenade were recovered from his possession in the presence of Executive Magistrate 1st Class; and

5. Whereas during the investigation, it was found that the accused viz. Waseem Ahmad Ganie, was affiliated with JeM, a banned outfit, who was instigated/motivated by one accused Mudasir Mehraj Khan S/o Mehrajudin Khan R/o Rawalpora, Srinagar to join the terrorist cadre for promation of terrorism in the area. Both the auccsed entered into a criminal conspiracy in the Central Jail Srinagar and the accused Mudasir Mehraj Khan motivated the accused viz. Waseem Ahmad Ganie to join terrorist ranks, after his release from the Jail. The accused viz. Mudasir Mehraj Khan arranged arms and ammunition for him to carry out terrorist activities in the area. The accused viz. Mudasir Mehraj Khan was already arrested by Srinagar Police in case FIR No.193/2021 of Police Station Saddar and subsequently, his custody was changed in the instant case; and

6. Whereas, on the strength of evidence collected and the statements of witnesses recorded the Investigating Officer, has established a prima facie case against the below-mentioned accused for the commission of offence punishable under Sections of the Unlawful Activities (Prevention) Act, 1967 as shown against their names:

7. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 or the Unlawful activities (Prevention )

Act, 1967 has independently examined the Case Diary File and all the

other relevant documents relating to the case and has come to the

conclusion that prima facie case is made out against the above

accused; and

8. Whereas, after persuing the Case Dairy File, the relevant

documents and also taking into consideration the views of the

Authority appointed under Sub-Section (2) of Section 45 of the

Unlawful Activities (prevention) Act, 1967, the Government is of the

view that there is sufficient material and evidence available against

the above mentioned accused for their prosecution under the

provision of law.

Now therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 the Unlawful Activities (Prevention)

Act, 1967 the Government hereby accord sanction for launching

prosecution against the accused viz. Waseem Ahmed Ganie and

Mudasir Mehraj Khan, for the commission of offences punishable

under the relevant Sections of ULA (P) Act, as indicated against the

each accused at Para (6) above, arising out of FIR No. 49/2024 of

Police Station, Anantnag.

SO-521.—Whereas, on 08-04-2024, an information through reliable means was received at Police Station, Heerpora, to the effect that some unknown terrorists have fired indiscriminately upon Foreign Tourists staying in Hotel Danish Resorts at Borihalan, Heerpora, with their illegal 2 The J&K Official Gazette, 25th Oct., 2024/3rd Kart., 1946. [No. 30-c –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– arms/ammunition, with the intention to kill them, resulting in injuries to their driver and guide namely Dil Ranjay Singh S/o Param Hans Singh R/o Rudrapur, Utranchal, who were shifted to hospital for treatment. The unknown terrorists after the commission of crime escaped from the spot ; and

2. Whereas, based on the above, a Case FIR No. 11/2024 Under Sections 307 IPC, 7/27 Arms Act and Sections 16,18, 20 & 38 of ULA (P) Act, came to be registered in the Police Station, Heerpora, and the investigation, of the case was set into motion. Subsequently, during the investigation, the offence under Section 7/25 Arms Act and Section 23 and 39 of ULA(P) Act, were added in the case; and

3. Whereas, during the investigation, the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the role of 02 persons namely Abid Ahmad Parrey S/o Bashir Ahmad Parrey R/o Chotipora and Kashif Ahmad Thoker S/o Khurshid Ahmad Thoker R/o Baba Mohalla, Shopian, came to the fore in the commission of crime. Subsequently, the accused were arrested and were found in contact with 03 terrorists namely; Abid Ramzan Sheikh S/o Mohammad Ramzan Sheikh, Shahid Ahmad Kuttay S/o Mohammad Yousuf Kuttay residents Chotipora, Shopian and Amir Bashir Dar S/o Bashir Ahmad Dar R/o Darmadoora, Shopian;; and

5. Whereas, during the investigation, it was found that on the date of occurrence the accused viz. Shahid Ahmad Kuttay and Amir Bashir Dar, with the assistance of accused Abid Ahmad Parrey, fired upon the Foreign Tourists at Borihalan, Heerpora, on the directions of accused terrorist viz. Abid Ramzan Sheikh, and escaped from the spot. During the investigation, 06 AK-47 rounds were recovered at the instance of accused viz. Whereas, the investigation conducted by the investigating agency has prima facie established that the accused viz. Abid Ahmad Parrey and Kashif Ahmad Thoker were working as Over Ground Workers (OGWs) for the terrorists of LeT, a banned outfit, namely, Abid Ramzan Sheikh, Shahid Ahmad Kuttay, and Amir Bashir Dar, and under a well knit criminal conspiracy were providing logistic and other support to them in order to promote terrorist activities in the area ; and

7. Whereas on the basis of the investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable Under Sections of the Unlawful Activities (Prevention) Act, 1967, as shown against their names :—

Sub-Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Abid Ahmad Parrey, Kashif Ahmad Thoker, Abid Ramzan Sheikh, Shahid Kuttay and Amir Bashir Dar, for the commission of offences punishable under the relevant Sections of ULA (P) Act, as indicated against the each accused at Para (7) above, arising out of FIR No. 11/2024 of Police Station, Heerapora.

SO-527.—Whereas, on 25-04-2024, an information was received at Police Station, Sopore, regarding presence of some unknown terrorists equipped with illegal arms/ ammunition in Village Nowpora Kallan, who 2 The J&K Official Gazette, 29th Oct., 2024/7th Kart., 1946. [No. 30-i –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– are planning to carry out terrorist attack in order to disrupt the upcoming Lok Sabha Elections in the area ; and

2. Whereas, based on the above, a Case FIR No. 105/2024 Under Sections 7/25 Arms Act, 13,16,18,20 & 23 of ULA (P) Act, came to be registered in the Police Station, Sopore, and the investigation, of the case was set into motion. Subsequently, during the investigation, the Sections 307 IPC, 17, 19, 38, 39 and 40 of ULA(P) Act, were added in the case ; and

3. Whereas, during the investigation, Cordon and Search Operation was launched by the Police in collaboration with 22 RR Army and 179 Bn CRPF in Village Chickpea Nowpora. During the search, the terrorists hiding in the residential house of one Javid Ahmad Khan S/o Mohammad Subhan Khan R/o Checkpora, Nowpora, Sopore fired indiscriminately upon the Search Party, with their illegal arms/ammunition, with the intention to kill them, resulting in injuries to 02 Army personnel and a civilian, who were shifted to Hospital for treatment ; and

4. Whereas, during the investigation, the dead bodies of two terrorists of LeT, a banned outfit, who were later on identified as Abdul Wahab @ Abu Saifullah @ Saifullah and Sanan Zaffar @ Huzaifa @ Abu Muslim@ Sultan @ Malik R's/o Pakistan were recovered from the place of encounter. During the investigation, the arms/ ammunition viz. 02 AK rifles, 08 magazines, 150 rounds, 03 hand grenades, Indian currency and other incriminating material were recovered from the place of occurrence ; and

5. Whereas, during the investigation, the accused viz. Javid Ahmad Khan was arrested in the case and involvement of his brother namely Bashir Ahmad Khan S/o Mohammad Subhan Khan R/o Checkpora Nowpora, Sopore, also came to fore in the commission of crime who was subsequently, arrested in the case. The accused viz. Javid Ahmad Khan and Bashir Ahmad Khan, were found working as OGWs for the terrorists and were providing logistic and other support including shelter/hiding No. 30-i] The J&K Official Gazette, 29th Oct., 2024/7th Kart., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– space to them, besides, were raising/distributing terror money for promotion of terrorist activities in the area ; and

6. Whereas, the investigation conducted by the investigating agency has prima facie established that the accused viz. Javid Ahmad Khan and Bashir Ahmad Khan were working as Over Ground Workers (OGWs) for the terrorists viz. Abdul Wahab @ Abu Saifullah @ Saifullah and Sanan Zaffar @ Huzaifa @ Abu Muslim @ Sultan @ Malik, and in furtherance of conspiracy were providing logistic support to them, besides, on the day of occurrence voluntarily provided shelter/hiding space to the terrorists in their residential house for promotion of terrorism in the area ; and

7. Whereas, the accused terrorists viz. Abdul Wahab @ Abu Saifullah @ Saifullah and Sanan Zaffar @ Huzaifa @ Abu Muslim @Sultan @ Malik, have been killed in the said encounter with the Security Forces and the proceedings under the law would abate against them ; and

8. Whereas on the basis of the investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable Under Section of the Unlawful Activities (Prevention) Act, 1967, as shown against their names :—

SO-528.—Whereas, on 10.05.2024, a written docket was received at Police Station, Heerpora, to the effect that a Joint Naka was established by the Police in collaboration with 14 Bn. CRPF and 44 RR Army at Malik Check crossing. During checking 02 persons were noticed in 2 The J&K Official Gazette, 31st Oct., 2024/9th Kart., 1946. [No. 31-a –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– suspicious circumstances, who while seeing the Naka Party tried to flee from the spot but were tactfully apprehended. The said persons were identified as Suhaib Iqbal Malik S/o Mohd Iqbal Malik and Tufail Yousuf Malik S/o Mohd Yousuf Malik residents of Baba Mohalla, Shopian. On being searched, 06 posters each of 'Lone Wolf Warriors and Al-Bark' outfits were recovered from their possession. The posters were meant to incite the public to boycott the Lok Sabha Elections, 2024 ; and

2. Whereas, based on the above, a Case FIR No. 14/2024 Under Section 13 of ULA (P) Act, came to be registered in the Police Station, Heerpora, and the investigation, of the case was set into motion ; and 3. Whereas, during the investigation, the statement of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law and during investigation ; and

4. Whereas, during the investigation, it was found that the accused viz. Suhaib Iqbal Malik and Tufail Yousuf Malik, procured the posters from an unknown masked person near Rajouri Sumo Stand, Shopian, with the directions to paste the posters in Village Malik Check, Shopian, in order to refrain the general public to participate in Lok Sabha elections and intended to cause disaffection against India ; and

5. Whereas on the basis of the investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable under section of the provisions of Unlawful Activities (Prevention) Act, 1967, as shown against his name :—

SO-530.—Whereas, on 07.05.2022, a reliable information was received by the Police Station, Soura, to the effect that some unknown terrorists fired upon a Police Official at Aiwa Bridge, Soura, Srinagar, with their illegal arms/ ammunition, with the intention to kill him, 2 The J&K Official Gazette, 5th Nov., 2024/14th Kart., 1946. [No. 31-c –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– resulting in serious injury to him. The injured Police official was shifted to hospital for treatment and the unknown terrorists after the commission of crime escaped from the spot ; and

2. Whereas, based on the above, a Case FIR No. 39/2022 Under Sections 307 IPC, 7/27 Arms Act and Sections 13, 18 and 20 of ULA (P) Act, was registered in the Police Station, Soura, and the investigation, of the case was set into motion. Later on, the injured Police Official identified as Ghulam Hassan Dar S/o Ghulam Rasool Dar R/o Danmer, Sangam, Srinagar, succumbed to his injuries. Subsequently, during the investigation, the offence under Section 307 IPC was dropped and the offences under Section 302 IPC and Sections 16, 38, 39 of ULA (P) Act were added in the case ; and

3. Whereas, during the course of investigation, the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, two terrorists of LeT/TRF, banned outfit, identified as Adil Ahmad Parray @ Hafiz Adil S/o Habibullah Paray R/o Badergund, Ganderbal and Basit Ahmad Dar @ Kamran S/o Late Abdul Rashid Dar R/o Redwani, Qaimoh, Kulgam, were found involved in the commission of crime ; and

5. Whereas, during the investigation, it was established that the accused viz. Adil Ahmad Parray @ Hafiz Adil and Basit Ahmad Dar @ Kamran, were members of LeT, a banned outfit, and on the date of occurrence under a well knit criminal conspiracy fired upon the Police official namely, Ghulam Hassan Dar, at Aiwa bridge, Soura, Srinagar, which resulted death of the deceased person ; and

6. Whereas, the sanction against the accused viz. Basit Ahmad Dar @ Kamran, has been accorded by the Government vide Notification S.O. No. 07 dated 03.01.2024, and the accused viz. Adil Ahmad Parray @ Hafiz Adil, got killed in an encounter with the Security Forces and the No. 31-c] The J&K Official Gazette, 5th Nov., 2024/14th Kart., 1946. 3 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– proceedings under the law stands abated against him, besides, the investigation, of the case was continued ; and

7. Whereas, during the further investigation, the role of one more person identified as Faisal Ahmad Lone S/o Abdul Rehman Lone R/o Kokerbagh, Zoonimar, Soura, came to fore in the commission of crime.

Subsequently, the accused was arrested and was found in close contact with accused viz. Basit Ahmad Dar @ Kamran, who provided a photograph of deceased Police official to accused viz. Faisal Ahmad Lone, for keeping an eye on him and getting his routine timing for going to duty and coming back from duty, prior to his killing which was recovered at his instance ; and

8. Whereas, the investigation conducted by the investigating agency has prima facie established that the accused viz. Faisal Ahmad Lone, was working as Over Ground Worker (OGW) for the terrorists viz. Basit Ahmad Dar @ Kamran and Adil Ahmad Parray @ Hafiz Adil, and in furtherance of conspiracy was providing logistic support to them, besides, facilitated the said terrorists to kill the deceased constable ; and

Whereas on the basis of the investigation, the statements of witnesses recorded and the other evidence collected, the Investigating Officer, has established prima facie involvement of the below mentioned accused for the commission of offences punishable in terms of the provisions of Unlawful Activities (Prevention) Act, 1967, as shown against his name :—

Now, therefore, in exercise of the powers conferred by Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. SO-548.—Whereas, on 03-06-2024, the Police Station, Kupwara, received a docket to the effect that a Joint Naka was established by the Police/Security Forces at Govt. Higher Secondary School, Nagri. [No. 34-e –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– the checking, a suspect while seeing the Naka Party tried to escape but was chased down on the spot and identified as Aijaz Ahmad Parray S/o Ghulam Mohammad Parray R/o Kunan, Poshpora, Kupwara. During the search, the Police recovered 01 Pistol with magazine, 04 Rounds and 01 Chinese Hand Grenade from a box carried by the accused ; and

2. Whereas, based on the above, a Case FIR No. 125/2024 under Sections 7/25 Arms Act, 13, 23, 39 of ULA (P) Act, was registered in the Police Station, Kupwara, and the investigation, of the case was set into motion ; and

3. Whereas, during the course of the investigation, the statements of witnesses acquainted with the facts and circumstances of the case were recorded under the relevant provisions of law and during investigation ;

and

4. Whereas, during the investigation, it was found that the accused viz. Aijaz Ahmad Parray, was in contact with two PaK based handlers namely, Jabbar @ Jibran and Zubair, through virtual mode, who provided the recovered arms/ammunition to the accused viz. Aijaz Ahmad Parray, through an unknown person for the promotion of terrorism in the area. The identity/involvement in respect of PaK based handlers and unknown person are yet to be ascertained and the investigation shall continue and Supplementary Charge Sheet against them would be filed in the competent court of law ; and

5. Whereas, during the investigation, it was established that the accused viz. Aijaz Ahmad Parray, was working as Over Ground Worker(OGW) for the terrorist of HM, a banned outfit, and procured arms/ammunition and explosive material from an unknown person for carrying out terrorist activities in the area ; and

6.
