Whereas, it appears to the appropriate Government that a total of 18Kls–09Mls land in the Village Harog Tehsil and District Ramban is required for public purpose namely, ''extraction of Gypsum from Parlanka Mine''.

Whereas, on the basis of indent placed by Administrative Secretary Mining Department, Civil Secretariat Jammu/Srinagar vide No. : GM- JKML/16/2023-04 dated 12-09-2023, Collector Land Acquisition (ACR), Ramban constituted a committee vide No. Acq/Gen/Rbn/23/241-251 dated 26-09-2023 as per Rule 4 of the Rules notified vide S.O-440 of 2023 to conduct preliminary enquiry in the said land acquisition case.

Whereas, the committee submitted its report duly endorsed by Tehsildar Ramban vide his No. TR/OQ/2024-25/Acq/1313, dated 11-01-2025 wherein it has been reported that there is no involuntary displacement involved in the acquisition of said land and accordingly, no rehabilitation is required. The extraction of Gypsum has no economic as well as social adverse impact on the local inhabitants. Land owners have no objection on the said acquisition and consent as required under Sub-rule (2) of Rule 17 and Sub-rule (1) of Rule 20 on Form-V (Part-A) (prior Written Consent of the Affected Land Owners or Declaration Form) has been obtained from them. Resolution of Gram Sabha as per Sub-rule (7) of Rule 21 of Form-V (Part B) has also been obtained.

Whereas, the Collector Land Acquisition (ACR), Ramban issued a preliminary notification for the said land vide No. 01/ACR of 2025 dated 17-04-2025 under endorsement No. Acq/Gen/25/Rbn/34-46 dated 17-04-2025 for calling upon the objections from the interested persons. No objection either in verbal or written were received from any interested persons within stipulated time so far ; and

Whereas, the Government is satisfied after considering the report made by the Collector that the land particulars of which are given below is required for public purpose ;

The said accused has absconded and is avoiding execution of warrant and there is no immediate prospect of his being arrested. Upon being shown to this Court has proceeded U/S 299 Cr. PC. As such, you through this standing warrant of arrest is hereby authorized and directed to arrest the above mentioned accused and produce him before this Court. This file is taken up today for consideration. CCL is absent today. Perusal of the order sheets reveals that CCL lastly appeared before the Board on 30-11-2019 and after that exemption for personal appearance before the Board was granted to the CCL. After that his Counsel used to appear but from the last several dates of inquiry nobody is appearing before the Board on behalf of the CCL. On date 16-03-2024 exemption for personal appearance of CCL was cancelled. Summon which were issued to the CCL received back with reports that CCL is not found at the place of his residence. Accordingly, surety bond of the CCL was forfeited on 25-03-2025. And notice served to the surety with the direction to produce himself before the Board. But neither the surety nor the CCL appeared before the Board till date. On 11-09-2025 PSI Amjid Ali No. GEC-246723 P/S Bari Brahmana who was the member of the team constituted by worthy SSP Samba on the direction of JJB for the production of CCL before the Board, appeared before the Board. His statement has been recorded and made a part of file. He deposed that he along with SGCT Mohd Sadiq went to the P/S Sisia District Ghumla, Jharkhand to trace out the Village Dewaragani which is the native village of the CCL but worthy SHO told us that the said village is located under jurisdiction of P/S Bishanpur under District Ghumla. After reporting in P/S Bishanpur worthy SHO deputed his staff member with us and finally we located the place of 5006 The J&K Official Gazette, the 23rd Oct., 2025/1st Kart., 1947. [ No. 30 –––––––––––––––––––––––––––––––––––––––––––––––––––––– residence of CCL but CCL was not there. The villagers of that village told us that the said CCL is not residing there since long and also they were unable to tell the whereabouts of the said CCL. So by making all these efforts CCL could not be trace out and due to which he could not produce the CCL before the Board.

The Board has gone through the material placed on record. Perusal of the same reveals that the instant challan was transferred to the JJ Board Samba by the Hon'ble Court of worthy CJM Samba on 15-03-2019 for its disposal under law and CCL was alleged to be involved in commission of offences U/S 302/201/34 RPC. Further by taking into consideration the long absence of CCL before the Board, the Board has left with no option but to forfeit the personal bond of the CCL. In view of the aforesaid reasons, the Board is of considered opinion that the presence of CCL could not be secured as he has left his place of residence and run away without informing the Board. As such CCL is required to be dealt with Section 26 of JJ Act which is reproduce as under S.26 ''Provision with respect of run-away child in conflict with law''.

(1) Notwithstanding anything to the contrary contained in any other law for the time being in force, any police officer may take charge of a child in conflict with law who has run away from a special home or an observation home or a place of safety or from the care of a person or institution under whom the child was placed under this Act.

(2) The child referred to in Sub-Section (1) shall be produced within twenty-four hours, preferably before the Board which passed the original order in respect of that child, if possible, or to the nearest Board where the child is found.

(3) The Board shall ascertain the reasons for the child having run away and pass appropriate orders for the child to be sent back either to the institution or person from whose custody the child had run away or any other similar place or person, as the Board may deem fit :

Provided that the Board may also give additional directions regarding any special steps that may be deemed necessary, for the best interest of such child.

(4) No additional proceeding shall be instituted in respect of such child.

In view of the aforesaid reasons, CCL is considered as run-away child due to his prolonged absence. Office is directed to send the copy of the order to concerned SHO and SSP Samba for information and compliance. CCL shall be produced by the concerned Police Officer who will take the charge of the CCL before the Board as and when apprehended. In the meanwhile, file be consigned to record and the shall be summoned when CCL will be produced before the Board.

Srinagar, the 29th of August, 2024.

SO433. Whereas on 18-03-2024, an information was received

at Police Station, Shaheedgunj, to the cffect that some unknown terrorists

of banned TRF outfit have posted a threat message on social media2 The J&K Official Gazette, 29th August, 2024/7th Bhad., 1946. [No. 22-a against the BLOs/other officials associated with the upcoming

parliamentary elections. It was revealed that a list was also uploaded on

social media with the intention to refrain these employees to be part of

the said election ; and

2. Whereas, on receipt of information. FIR No. 11/2024 under

section 506 IPC, 13 of ULA (P) Act came to be registered in the Police

Station, Shaheedgunj, and the investigation, of the case was set into

motion. Subsequently, during investigation, the offence under sections

18,20,38,39,40 of ULA (P) Act were added in the case ; and

3. Whereas during the course of the investigation the statement of

witnesses acquainted with the facts and circumstances of the case were

recorded ; and

4. Whereas during the investigation, 02 persons namely

Mohammad Manan Dar S/o Gulzar Ahmad Dar R/o Firdousabad,

Batamaloo and Adnan Bashir Bangroo S/o Bashir Ahmad Bangroo R/o

Batamaloo, were found involved in the Commission of crime. The

accused were arrested and during the investigation, 39 posters of TRF, a

banned outfit and cash of Rs. 100,000/- (Rupee one lac) was recovered at

their instance respectively; and

5. Whereas during the investigation, it was found that the accused

Mohammad Manan Dar and Adnan Bashir Bangroo were in close contact

with PaK based handler through virtual mode who provided the

recovered posters and cash to the accused through an unknown person

and investigation also revealed that accused Mohammad Manan Dar with

assistance of Adnan Bashir Bangroo, on the directions of PaK handler

had to hand over the said amount to an active terrorist namely Momin

Gulzar S/o Gulzar Ahmad Mir R/o Eidgah Srinagar, for promotion of

terrorism in the area ; and

6. Whereas, the investigation in respect of accused who uploaded

threat posters on social media and the unknown persons who handed

over the posters and cash to accused Mohammad Manan Dar and Adnan

Bashir Bangroo, shall continue, and supplementary charge-sheet could be

filed in the court of law ; and

7. Whereas, the investigation conducted by the Police Station

Shaheedgunj has prima facie established that accused MohammadNo. 22-a] The J&K Official Gazette, 29th August, 2024/7th Bhad., 1946. 3 Manan Dar and Adnan Bashir Bangroo, were working as Over Ground

Workers (OGWs) for the terrorists of banned TRF outfit particularly

Momin Gulzar and have in furtherance of conspiracy have committed the

activities declared unlawful under UAP Act ; and

8. Whereas, the accused terrorist Momin Gulzar, got killed in an

encounter with the Security Forces and proceedings against him would

abate ; and

9. Whereas, on the strength of evidence collected and the

statement of witnesses recorded, the Investigating Officer, has

established a prima facie case against the below mentioned accused

for the commission of offences punishable under Sections of the

Unlawful Activities (Prevention) Act, 1967, as shown against their

names:─

10. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all

the other relevant documents relating to the case and has come to the

conclusion that prima facie case is made out against the above

accused ; and

11. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the views of the

Authority appointed under Sub-Section (2) of Section 45 of the

Unlawful Activities (Prevention) Act, 1967, the Government is of the

view that there is sufficient material and evidence available against

the above-mentioned accused for their prosecution under the

provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-

Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,4 The J&K Official Gazette, 29th August, 2024/7th Bhad., 1946. [No. 22-a 1967, the Government hereby accord sanction for launching

prosecution against the accused viz. Mohammad Manan Dar and

Adnan Bashir Bangroo, for the commission of offences punishable

under Sections 13,18,39,40 of ULA (P) Act, arising out of FIR No. 11/2024 of Police Station, Shaheedgunj.

SO-435.—WHEREAS, on 09th August, 2019, the Jammu & Kashmir Reorganisation Act, 2019 was enacted through which the then state of Jammu & Kashmir was bifurcated into two Union Territories i.e. (i) Union Territory of Jammu & Kashmir (ii) Union Territory of Ladakh; and

WHEREAS, Section 14 (2) of the Jammu & Kashmir Reorganisation Act, 2019 provides that there shall be a Legislative Assembly for the Union territory of Jammu and Kashmir; and2 The J&K Official Gazette, 29th Aug., 2024/7th Bhadra, 1946. [No. 22-1 Whereas, a Delimitation Commission was set up under Delimitation Commission Act, 2002 vide notification dated 06th March 2020, to inter-alia carry out delimitation of constituency of the Union territory of Jammu and Kashmir which has been completed vide notification dated on 05th May, 2022;

and

Whereas, in terms of sub-section (1) of section 15 of the Representation of the People Act, 1951 (43 of 1951), a general election has to be held for the purpose of constituting the first Legislative Assembly of the newly carved Union Territory of Jammu & Kashmir; and

Now, therefore, as recommended by the Election Commission of India in pursuance of sub-section (2) of section 15 of the said Act, the Lieutenant Governor of the Union Territory of Jammu and Kashmir is hereby pleased to call upon each of the Assembly Constituencies of the Union Territory of Jammu and Kashmir, specified in the TABLE below, to elect members to the Legislative Assembly of the Union Territory of Jammu and Kashmir, in accordance with the provisions of the said Act and of the rules and orders made thereunder: —

SO–488.—Whereas, on 29-11-2023 a written docket from ASI

Mohammad Younis was received by Police Station, Kulgam, to the

effect that a person namely Adil Ahmad Hajam S/o Gh. Mohammad

Hajam R/o Khandipora Kulgam, got missing and it was learnt that he

had joined terrorist cadre of banned HM outfit. The said person was

instigated/motivated by an active terrorist namely Mushtaq Ahmad Itoo 2 The J&K Official Gazette, 27th September, 2024/5th Asv., 1946. [ No. 26-d –––––––––––––––––––––––––––––––––––––––––––––––––––—

S/o Ghulam Hassan R/o Mohammadpora Kulgam to join the outfit for

promotion of terrorism in the area ; and

2. Whereas, on receipt of information, Case FIR No. 196/2023 under sections 13, 19 abd 20 of ULA(P) Act, came to be registered in the Police Station, Kulgam, and the investigation of the case was set into motion. Subsequently, during the investigation, the offence under Section 19 of ULA(P) Act was dropped and Sections 18, 18-B and 38 of ULA(P) Act were added in the case ; and

3. Whereas, during the course of the investigation, the statements of witnesses acquainted with the facts and circumstances of the case were recorded ; and

4. Whereas, during the investigation, it was found that the accused namely, Adil Ahmad Hajam, had gone missing on 08-08-2023 and subsequently joined the terrorist ranks on the instigation/motivation of accused terrorist namely, Mushtaq Ahmad Itoo ; and

5. Whereas, the investigation conducted by the investigating agency has prima facie established that the accused namely, Adil Ahmad Hajam and Mushtaq Ahmad Itoo, are associated/members with HM, a banned outfit, and in furtherance of criminal conspiracy the accused viz. Adil Ahmad Hajam, to join terrorist cadres for promotion of terrorist activities in the area ; and

6. Whereas, on the strength of evidence collected and the statements of witnesses recorded, the Investigating Officer, has established a prima facie case against the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967 as shown against their names :—

Act, 1967, has independently examined the Case Diary File and all the other relevant documents relating to the case and has come to the conclusion that prima facie case is made out against the above accused ; and

9. Whereas, after perusing the Case Diary File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available against the above-mentioned accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub- Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Adil Ahmad Hajam and Mushtaq Ahmad Itoo, for the commission of offences punishable under the relevant Sections of ULA(P) Act, as indicated against the each accused at Para (6) above, arising out of FIR No. 196/2023 of Police Station, Kulgam.

Whereas, on receipt of information, Case FIR No. 103/2023 under Sections 13, 18, 20 and 38 of ULA(P) Act, came to be registered in the Police Station, Kulgam, and the investigation of the case was set into motion. Subsequently, during investigation, the offence under Section 18-B of ULA(P) Act was added in the case ; and

3. Whereas, during the course of the investigation, the statements of witnesses acquainted with the facts and circumstances of the case were recorded ; and

4. Whereas, during the investigation, it was found that the accused namely, Tawheed Ahmad Rather, was initially gone missing on 31-08- 2022 and subsequently joined the terrorist ranks on the instigation/ motivation of accused terrorist namely, Mushtaq Ahmad Itoo ; and

5. Whereas, the investigation conducted by the investigating agency has prima facie established that the accused namely Tawheed Ahmad Rather and Mushtaq Ahmad Itoo, are associated/members with HM, a banned outfit, and in furtherance of criminal conspiracy the accused viz. Mushtaq Ahmad Itoo, instigated/motivated the accused viz. Tawheed Ahmad Rather, to join terrorist cadre for promotion of terrorist activities in the area ; and

6. Whereas, the accused terrorist namely, Tawheed Ahmad Rather, has been killed in an encounter with the Security Forces and the proceedings under the law would abate against him ; and

7. Whereas, on the strength of evidence collected and the statements of witnesses recorded the Investigating Officer has established a prima facie case against the below mentioned accused for the commission of offences punishable under Sections of the Unlawful Activities (Prevention) Act, 1967 as shown against his name :—

SO-499.––Whereas, on 17-04-2024, a written docket was received at Police Station, Bijbehara, to the effect that a Naka was established by Police in collaboration with 3rd RR Army near Naina.

who, while seeing the Naka party tried to flee from the spot but were

tactfully apprehended. The persons were identified as Sameer Ahmad

Dar S/o Ab. Gani Dar R/o Wadina, Shopian A/P Baba Gund Khalil,

Naina, Sangam and Waseem Ahmad Wani S/o Mohammad Akram Wani

R/o Wooderpora, Safanagri, Zainapora. On being searched, 01 Pistol

with magazine, 08 pistol rounds, 01 hand grenade and 50 AK rounds

were recovered from their possession respectively; and

2. Whereas, based on the above, a Case FIR No. 82/2024 under

section 7/25 Arms Act, 120-B IPC, 18,20,23, 38 of ULA (P) Act, was

registered in the Police Station, Bijbehara, and the investigation, of the

case was set into motion. Subsequently, during the investigation, the

offence under 4/5 ESA and 39 of ULA (P) Act, were added in the

case ; and

3. Whereas, during the investigation, the statements of witnesses

acquainted with the facts and circumstances of the case were recorded

under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused

namely, Sameer Ahmad Dar and Waseem Ahmad Wani, were working

as OGWs for the terrorists of LeT, a banned outfit, and were in close

contact with an active terrorist namely Umais Ahmad Wani S/o Nisar

Ahmad Wani R/o Pazalpora, Chawalgam, who provided the recovered

arms/ammunition to them for promotion of terrorism in the area ; and

5. Whereas, the investigation conducted by the investigating agency

has prima facie established that the accused viz. Sameer Ahmad Dar

and Waseem Ahmad Wani were working as Over Ground Workers

(OGWs) for the terrorists of LeT, a banned outfit, particularly the

terrorist viz. Umais Ahmad Wani, and in furtherance of criminal

conspiracy procured arms/ammunition from the terrorists for carrying

out the terrorist activities in the area ; and

6. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

8. Whereas, the Authority appointed by the Government under

Sub- Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all the

other relevant documents relating to the case and has come to the

conclusion that prima facie case is made out against the above accused

; and

9. Whereas, after perusing the Case Diary File, the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above mentioned

accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-

Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,

the Government hereby accord sanction for launching prosecution

against the accused viz. Sameer Ahmad Dar, Waseem Ahmad Wani 4 The J&K Official Gazette, 9th Oct., 2024/17th Asv., 1946. [No. 27-g –––––––––––––––––––––––––––––––––––––––––––––––—–––————— and Umais Ahmad Wani, for the commission of offences punishable

under the relevant sections of ULA (P) Act, as shown against each

at Para (6) above, arising out of FIR No. 82/2024 of Police Station, Bijbehara
