This is to authorize you to arrest the accused person wherever he is found and produce him before the Court. [ No. 40 –––––––––––––––––––––––––––––––––––––––––––––––––––––– Whereas, Administrative Secretary Mining Department, Civil Secretariat, J&K placed indent vide his No. GM-JKML/6/2023-04 dated 12-09-2023 for the acquisition of land required for ''Extraction of Gypsum from Parlanka Mine'' at Harog Tehsil and District Ramban.

Whereas, this Collectorate constituted a committee vide No. Acq/ Gen/Rbn/23/241-251 dated 26-09-2023 as per rule 4 of the Rules notified vide S.O. 440 of 2023 to conduct preliminary enquiry in the said land acquisition case with the directions to submit its report within 15 days.

Whereas, the committee submitted its report duly endorsed by Tehsildar Ramban vide his No. TR/OQ/2024-25/Acq/1313 dated 11-01-2025 perusal of which reveals that there is no involuntary displacement involved in the acquisition of said land and accordingly, no rehabilitation is required. Land owners have no objection on the said acquisition and consent as required under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V (Part-A) (Prior Written Consent of the Affected Land Owners or Declaration Form) has been obtained from them. Resolution of Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part B) has also been obtained.

Whereas, keeping in view the findings and recommendations of the committee constituted by this Collectorate, written consent submitted by the land owners concerned as required under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V (Part-A) (Prior Written Consent of the Affected Land Owners or Declaration Form), resolution submitted by Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part B) and no family/families are likely to be displaced due to the instant land acquisition case, this Collectorate has decided to consider the report of the committee as Social Impact Assessment Report as required under Section 4, 5, 6, 7, and 8 of ''the Right to Fair Compensation and Transparency in Land Acquistion, Rehabilitation and Resettlement Act, 2013 and Rules 9, 13, 14, 15, 16, and 17 of ''the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023''.

Whereas, notification under Sub-Section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was issued by this Collectorate vide Notification No. 01/ACR of 2025 dated 17-04-2025 vide endorsement No. Acq/Gen/25/Rbn/34-46 dated 17-04-2025 which was served upon to the land owners, interested persons and Indenting Department, who were asked to file their objection(s) if any, within 60 days from the date of issuance/publication of the notification.

Whereas, this Collectorate vide letter No. Acq/Gen/2025/181-84 dated 01-08-2025 requested the Appropriate Authority i.e., Deputy Commissioner, Ramban to issue declaration under Section 19 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 to the effect that land measuring 18K-09M at Village Harog, Tehsil and District Ramban is required for ''Extraction of Gypsum from Parlanka Mine at Harog''.

Whereas, vide notification No. 06 of 2025 dated 11-10-2025, the Appropriate Authority i.e. Deputy Commissioner Ramban was pleased to issue declaration under Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisiton, Rehabilitation and Resettlement Act, 2013 for land measuring 18K-09M at Village Harog, Tehsil and District Ramban is required for ''Extraction of Gypsum from Parlanka Mine'' in Village Harog Tehsil and District Ramban.

Deputy Commissioner) Awantipora issued Preliminary Notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 vide No. ADC/AWP/LAS/ 2025/03 of 2025, dated 30-08-2025 for calling upon the objections, if any, from the interested persons/land owners.

Whereas, as per the S.O. 17 date 14-01-2022 in exercise of the powers conferred by proviso to clause (e) of Section 3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), the Government of Jammu and Kashmir designated Deputy Commissioner/District Collector of each District of Union Territory of Jammu and Kashmir as ''Appropriate Government'' within their respective jurisdiction for acquiring land for public purpose under the said Act for an area not exceeding 400 Kanals (50 acre).

Whereas, in accordance with S.O. 17 the Collector Land Acquisition (Additional Deputy Commissioner) Awantipora submitted the instant acquisition case for issuance of Declaration under Section 19(1) of the Right to Fair Compensation and Transparency in Land Acqusition, Rehabiliation and Resettlement Act, 2013 vide above referred communication.

Whereas, the ''Appropriate Government'' (District Collector) is satisfied after considering the report made by the Collector Land Acquisition (Addl. Deputy Commissioner) Awantipora that the said land is required for the public purpose.

Now, therefore, it is hereby declared under the provision of Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land measuring 05M-01S is required for construction of 1x15 mtr. Span Plate Girder Bridge in Estate Sheikh Mohalla Hariparigam, Tehsil Awantipora.

Whereas, Chief Engineer PMGSY (JKRRDA), Jammu placed an indent vide his letter No. CEJ/PMGSY/1988-91 dated 11-05-2022 for the acquisition of private land measuring 05K-07M situated in Village Duthan Tehsil and District Ramban, for the construction of Kothi Jagir to Duthan Jagir Road.

Whereas, this Collectorate constituted a committee vide No. Acq/ PMGSY/Rbn/23/241-50 dated 02-11-2023 under Sub-Rule (1) of Rule 4 of the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023 notified vide notification S.O. 440 dated 24-08-2023 to conduct preliminary enquiry in the said land acquisition case with the directions to submit its report within 15 days.

Whereas, the committee submitted its report duly endorsed by Tehsildar Ramban vide his No. TR/OQ/2025-26/Acq/963 dated 24-10- 2025, perusal of which reveals that the road stands already constructed and blacktopped, alternate State/Government land cannot be proposed for the land in question. As there in no involuntary displacement involved in the said acquisition, assessments of FBTs, and NFBTs has already been done by the Department concerned, the land owners/Grams Sabha have no objections on the said acquisition and have submitted their consent as required under Sub Rule (2) of Rule 17 and Sub Rule (1) of Rule 20 on Form-V (Part-A) (Prior Written Consent of Affected Land Owners or Declaration Form), it is hereby unanimously recommended that the Social Impact Assessment Study as required under Sections 4, 5, 6, 7 and 8 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and Rule 6724 The J&K Official Gazette, the 1st Jan., 2026/11th Pausa., 1947. 9, 13, 14, 15, 16 and 17 of the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023 notified vide S.O 440 of 2023 dated 24 August, 2023.

Whereas, keeping in view the findings and recommendations of the committee constituted by this Collectorate, written consent submitted by the land owners concerned as required under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V (Part-A) (Prior Written Consent of the Affected Land Owners or Declaration Form), resolution submitted by Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part-B) and no family/families are likely to be displaced due to the instant land acquisition case, this Collectorate has decided to consider the report of the committee as Social Impact Assessment Report as required under Sections 4, 5, 6, 7 and 8 of the ''Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and Rules 9, 13, 14, 15, 16 and 17 of ''the Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023''.

Whereas, it appears to the Appropriate Government that a total of 4 Marlas land, falling under Survey No. 320 min (Khata No. 34, Khewat No. 13) is required in the Village Hydergund, Tehsil Zainapora, District Shopian for public purpose namely ''for Construction/ Commissioning of Circuit-II of 220 KV, D/C Mir Bazar-Lassipora Transmission Line (LILO), Tower Location No. 61-X(A), at Estate Hydergund, Tehsil Zainapora, District Shopian ;

Whereas, a Committee was constituted by this Office, under Sub- Rule (1) of Rule 4 of the Jammu and Kashmir Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023, vide No. CLA/ ZNP/2025/467-82, Dated 17-05-2025, to visit the spot along with the representatives of Requiring Body to make a Preliminary Enquiry.

The summary of the report submitted by the Designated Committee reads as : ''....there is no other land available near the site which could have been feasible for the construction/ commissioning of the Circuit-II of 220 KV D/C Mir Bazar-Lassipora Transmission Line, Tower Location No. 61-X(A) at Village Hydergund, Tehsil Zainapora. The Transmission Line is passing through Survey No. 320 min at estate Hydergund but is passing at a very low altitude which poses threat to the life and property of the inhabitants of the said Estate. The Indenting Department has proposed a construction of a Tower beneath the Transmission Line at Survey No. 320 min to avoid any loss of life in future. Also the Committee is of the view that there is no other remedy, but to construct a Tower beneath the said Transmission Line. The extent of 4 Marlas of land, falling under Khasra No. 320 min (Khata No. 34, Khewat No. 13), at estate Hydergund Tehsil Zainapora, District Shopian, proposed for acquistion is absolute bare minimum needed for the project. The requisition is consistent with the provisions, specifically Section 10 of the Right to Fair Compensation and Tramsparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 ; and the rules made thereunder. By way of this acquisition there shall be no displacement, disturbance to the environment or ecological hazard or any ill effect, whatsoever, which could prove detrimental to the general public.The instant patch of land is fit for acquisition :''

SO-213.––In exercise of the powers conferred under Sub-Section (1) of Section 14 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Government hereby appoints Mr. Shokat Hayat Mattoo, JKAS, Assistant 2 The J&K Official Gazette, 13th Aug., 2025/22nd Srav., 1947. [No. 20-h –––––––––––––––––––––––––––––––––––––––––––––––—–––————— Commissioner, Ramban to be the Executive Magistrate, who shall exercise all the powers of an Executive Magistrate within his territorial jurisdiction of District Ramban.

The Government further in exercise of the powers conferred by Sub-Section (2) of Section 14 of the Bharatiya Nagarik Suraksha Sanhita, 2023 appoints the aforesaid Executive Magistrate as Additional District Magistrate within the territorial jurisdiction of District Ramban.

SO-215.––In exercise of the powers conferred by the proviso to article 309 read with article 233 of the Constitution of India, the Lieutenant Governor, Union Territory of Jammu and Kashmir is pleased to make the following 2 The J&K Official Gazette, 14th Aug., 2025/23rd Srav., 1947. [No. 20-j –––––––––––––––––––––––––––––––––––––––––––––––—–––————— amendments to the Jammu and Kashmir Higher Judicial Service Rules, 2009, namely:–

1. In rule 2, after clause (d), the following clause shall be inserted ; namely:—

''(da) 'Person with Benchmark Disability' shall have the same meaning as defined under section 2(r) of the Rights of Persons with Disabilities Act, 2016''.

2. In rule 5, in sub rule (2), for clause (c), the following clause shall be substituted ; namely :—

''(c). must have attained the age of thirty five years and not above the age of forty five years (relaxable in case of candidates belonging to Scheduled Castes. Scheduled Tribes, Persons with Benchmark Disability (PwBD) or Other Backward Classes by two years as on the date of receipt of the applications).

3. In rule 8,—

(i). in clause (ii), for proviso thereto, the following proviso shall be substituted namely.—

''Provided that the Schedule Caste/Scheduled Tribe and Persons with Benchmark Disability (PwBD), candidates who obtain 45% or more marks in the written examination shall be eligible for viva-voce examination.''

(ii). for clause (iii), the following clause shall be substituted ;

namely.—

''(iii). The candidate has to obtain 50% marks out of 40 marks earmarked for viva-voce :

Provided that in case of Scheduled Caste, Scheduled Tribe and Persons with Benchmark Disability (PwBD), the candidate has to obtain 45% marks out of 40 marks reserved for viva-voce.''

SO-217.––In exercise of powers conferred by Sub-Section (1) of Section 45 of the Indian Veterinary Council Act, 1984, read with notification SO—403 dated 24th November, 2021, the Government hereby directs that entry 1 of the table appended in notification SO—236, dated 23rd July, 2020 shall be substituted by the following entry, namely :

	1 Dr. Sanjay Gupta, I/c Joint Director, Poultry Jammu, looking Registrar after the charge of Director, Animal Husbandry, Jammu,
