Notification

No. 303 of 2026/RG/LP Dated 11-02-2026.

It is hereby notified that vide High Court Order dated 10-02-2026 Mr. Zahid Nazir Mir S/o Nazir Ahmad Mir R/o Raki Lojorah Tehsil and District Pulwama has been admitted and enrolled as an Advocate on the Rolls of Jammu and Kashmir Bar Council provisionally for a period of one year from the date of issuance of this notification, subject to the verification of educational certificates/degrees from concerned University and verification of his character and antecedents from CID. His name has been entered under Serial No. JK-62-2026 in the Roll of Advocates maintained by this Registry.

The renewal/extension of provisional licence/enrollment must be sought before the date of expiry unless the absolute/final enrollment as an Advocate is ordered therebefore.

Subject :—Appointment of Nodal Officer for Business Reform Action Plan (BRAP).

Government Order No. 14-L&E of 2026

Dated 10-03-2026.

In supersession of all previous orders issued on the subject, sanction is hereby accorded to the appointment of Mr. Charandeep Singh, JKAS, Labour Commissioner, J&K, as Nodal Officer for the Business Reform Action Plan (BRAP) in respect of the Labour and Employment Department.

The Nodal Officer shall be responsible for overall coordination and monitoring of matters relating to the implementation of reforms under BRAP in the Department. He shall :

1. Coordinate with the concerned Administrative Departments, Directorates, field officers and other stakeholder agencies for effective implementation of BRAP reforms ;

4. Take all necessary steps for effective implementation, review of BRAP-related initiatives within the Department and inter- departmental issues.

OF PROVISIONS) ACT, 2026

(Act No. IV of 2026)

[31st March, 2026] An Act to amend certain enactments of the Union Territory of the Jammu and Kashmir, for decriminalising and rationalizing offences to2 The J&K Official Gazette, the 31st March, 2026/10th Chai., 1948. [No. 1-12 further enhance trust-based governance for ease of living and doing business.

Be it enacted by the Legislature in the Seventy-seventh Year of the Republic of India as follows :—

1. Short title and commencement.—(1) This Act may be called the Jammu and Kashmir Jan Vishwas (Amendment of Provisions) Act, 2026.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. Amendment of certain enactments.—The provisions stated in column (5) of the enactments mentioned in column (4) of the Schedule appended are hereby amended to the extent and in the manner mentioned in column (6) thereof.

3. Repeal and Savings.—(1) The Jammu and Kashmir Jan Vishwas (Amendment of Provisions) Ordinance, 2025 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken (including any notification or order issued) under the said ordinance shall be deemed to have been done, taken or, as the case may be, issued under the corresponding provisions of the Acts, as amended by this Act.

For section 12, substitute the following. "12. Adjudicating Officer. 1. The Government, for the purposes of determining the penalties under section 10 shall appoint an officer not below the rank of Additional Secretary to the Government, to be the Adjudicating Officer, to hold an inquiry and to impose the penalty in the manner, as may be prescribed;
					2. The Adjudicating Officer may summon and enforce the attendance of any person acquainted with the facts and circumstances of the case to give evidence or to produce any document, which in the opinion of the adjudicating officer, may be useful for or relevant to the subject matter of the inquiry and if, on such inquiry, he is satisfied that the person concerned has contravened the provisions of this Act, he may determine such penalty as he thinks fit under the provisions of section 10, as the case may be : Provided that no such penalty shall be imposed without giving the person concerned a reasonable opportunity of being heard. 1 2-A. Appeal. 1. If any person is aggrieved by the order passed by the Adjudicating officer, he may prefer an appeal to the Administrative Secretary, Department of Forest, Ecology and Environment. 2. Every appeal shall be filed within sixty days from the date on which the copy of the order made by the adjudicating officer is received by the aggrieved person. 3. The Appellate Authority may, after giving the parties to the appeal an opportunity of being heard, pass such order as it thinks fit, confirming, modifying or setting aside the order appealed against. 4. Where an appeal is preferred against any order of the Adjudicating Officer, it shall not be entertained by the Appellate Authority unless the person has deposited with the Authority ten percent of the amount of the penalty imposed by the Adjudicating Officer."

Savings.—The amendment by this Act of any enactment shall not affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired, accrued or incurred or any remedy or proceeding in respect thereof, or any release or discharge of, or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing.

An Act to amend the Jammu and Kashmir State Civil Courts Act, (Svt) 1977.

Be it enacted by the Legislature of Union Territory of Jammu and Kashmir in the Seventy-seventh Year of the Republic of India as follows :—

1. Short title, extent and commencement.— (1) This Act may be called the Jammu and Kashmir Civil Courts (Amendment) Act, 2026.

(2) It shall come into force from the date of its publication in the Official Gazette.

2. Substitution of expressions "Munsiff" and "Subordinate Judge".—In the Jammu and Kashmir State Civil Act, (Svt) 1977 (hereinafter referred to as the 'principal Act'), for the words "Munsiff" and "Subordinate Judge" wherever occurring, the words, "Civil Judge (Junior Division)" and "Civil Judge (Senior Division)" shall respectively be substituted.

3. Amendment of section 21, Act No. XLVI of (Svt) 1977.— In section 21 of the 'principal Act', in sub-section (2) :–

(i) for the words, "fifteen thousand rupees" the words, "ten lakh rupees" shall be substituted.

(ii) the proviso shall be omitted.

(1) for sub-rule (1), the following shall be substituted, namely :—

SO–107(E).—Whereas the use of Aadhaar number to establish identity enables individuals to receive subsidies, benefits and services in a convenient and seamless manner, obviates the need for multiplicity of documents to establish identity, simplifies processes and promotes transparency and efficiency ;

And whereas the Ministry of Electronics and Information Technology, Government of India, after consultation with the Unique Identification Authority of India (UIDAI), had allowed vide its letter No. eF. No. 13(6)/2022-EG-II, dated 04.12.2025 to the Forest, Ecology and Environment Department, (hereinafter referred to as the said Agency), Government of Jammu and Kashmir (hereinafter referred to as the said3-a] The J&K Official Gazette, 13th April, 2026/ 23rd Chai., 1948. 2 Government) for the purposes prescribed under sub-rule (1) of rule 3 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 (hereinafter referred to as the said rules) that the said Government/Ministry/Department/Agency may be allowed to perform authentication and be permitted the use of Aadhaar number during authentication for establishing identity of Aadhaar number holder and notify the same under rule 5 of the said rules read with sub- clause (ii) of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (hereinafter referred to as the Act) ;

And whereas, the Aadhaar authentication shall be performed for usage of digital platform to ensure Good Governance (hereinafter referred to as the said purpose) as prescribed under sub-rule (1) of rule 3 of the said rules and the performance of Aadhaar authentication for the said purpose shall be on voluntary basis and that the said Department shall perform the Aadhaar authentication only for establishing the identity of Nomadic graziers for issuance of Grazing Pass and collection of fee, using Yes/No Authentication facility. [hereinafter referred to as the use case(s)].

Now, therefore, in pursuance of rule 5 of the said rules read with sub- clause (ii) of clause (b) of sub-section (4) of section 4 of the Act and in the supersession of notification SO–20 of 2026 dated 28th January, 2026, the said Department hereby notifies the following, namely :-

(1) The Forest, Environment and Ecology Department, of the Government of Jammu and Kashmir as provided in the Act, shall obtain the consent of the Aadhaar number holder for the purpose of authentication herein.

(2) As per sub-rule (2) of rule 3 of the said rules, Aadhaar authentication is on voluntary basis. The Forest, Ecology and Environment Department shall inform to the Aadhaar number holder of alternate and viable means of identification and shall not deny any service to the Aadhaar number holder for refusing to, or being unable to, undergo Aadhaar authentication, namely:-

i. Bank or Post office passbook with Photo; or

ii. Permanent Account Number (PAN) Card; or

iii. Passport; or

iv. Ration Card; or3 The J&K Official Gazette, 13th April, 2026/ 23rd Chai., 1948. [3-a v. Voter Identity Card; or

vi. Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988(59 of 1988); or

vii. Certificate of Identity having photo of such person issued by a Gazetted Officer or a Tehsildar or an official letter head; or

viii. Any other document as specified by the Department.

This notification shall come into effect from the date of its publication in the official Gazette.
