[ No. 7 ––––––––––––––––––––––––––––––––––––––––––––––––—–––———— and Ladakh, the High Court of Jammu and Kashmir and Ladakh has effected amendments to the Schedule-A and Schedule-B appended to UT of Ladakh Ministerial and other Staff of the Subordinate Courts (Recruitment and Conditions of Service) Rules, 2022 issued vide Notification No. 1093 of 2022/RG/NG-380(I) dated 02-09-2022, in the following manner :

(i) At S. No. 13 of the Schedule A & B appended to UT of Ladakh Ministerial and other Staff of the Subordinate Courts (Recruitment and Conditions of Service) Rules, 2022, the nomenclature of the post of "Driver Grade-II" is hereby amended and renamed as "Transport Assistant/Chauffeur".

(ii) At S. No. 14 of the Schedule A & B appended to UT of Ladakh Ministerial and other Staff of the Subordinate Courts (Recruitment and Conditions of Service) Rules, 2022, the nomenclature of the post of "Jamadar" is hereby amended and renamed as "Usher".

Subject :—Notification of Online Inspection checklist, Procedure and Mandatory Uploading of Inspection Report within 24 Hours for identified Online Services under Business Reforms Action Plan (BRAP).

In pursuance of the Business Reforms Action Plan (BRAP) and in order to enhance transparency, accountability, ease of doing business, and time-bound service delivery, it is hereby ordered that :

1. For the below mentioned online services all field inspections shall be conducted strictly as per the notified Inspection Checklist and Inspection Procedure.

2. The Inspection Report shall mandatorily be uploaded online within 24 hours of conducting the inspection.

3. No manual/offline inspection report shall be entertained by the authorities.

This shall apply to the following services :

i. Consent to Establish (Fresh/Renewal/Expansion).

ii. Consent to Operate (Fresh/Renewal/Expansion).

iii. Authorization under Hazardous and Other Wastes (Management and Transboundary, Movement) Rules, 2016.

iv. Authorization under Bio-medical Waste Management Rules, 2016 (amended thereof).

v. Authorization under Solid Waste Management Rules, 2026.

Application, inspection and reporting process for Grant/refusal of

consent and/or authorization for these services is as follows :

Step 1 : Register on the JK Single Window Portal : https://singlewindow.jk.gov.in/

Step 2 : Upon registration, the user will be redirected to the Online Consent Management and Monitoring System (JKOCMMS) portal.

Step 3 : Submit the online application along with all requisite documents on the JKOCMMS portal.

	Process	Timeline

Step–4	The application will be scrutinized at the Divisional Office	5 days
	and if found complete, the applicant will be advised to deposit the consent and/or authorisation fee. If any deficiency is found, it will be communicated to the applicant online for rectification. The applicant will re-submit the application after the • necessary corrections. If found complete, the applicant will be advised to • deposit the consent and/or authorisation fee.	15 days 5 days
Step-5	The site/unit will be inspected by field officers.	15 days
	Deficiency, if any will be communicated to applicant onsite and inspection report will be uploaded within 24 hours.

Step–6	Rectification of deficiencies by the Applicant.	15 days

Step–7	The case will be submitted by the Divisional Office to the Regional Office after applicant corrects the shortcomings.	5 days
Step–8	For Green Category cases, the Regional Office will a. grant or refuse consent/authorization with reasons. The final consent/authorization/refusal will be uploaded on the JKOCMMS portal, and can be downloaded by the applicant. other categories (Red/Orange/Blue), the b. The Checklist/mandatory documents in respect of each services are

as follows :

A. Consent to Establish (Fresh)

1. Licenses/Certificates :

a. Legal Status of Company :

i. Partnership/Proprietary/Company etc. ; (or)

ii. SSI/MSME Certificate (Udyog Aadhar)/Memorandum of Entrepreneurship, if applicable ;

iii. DIC Registration/Udyam Registration (if applicable).

b. Location of the Project:

i. Industrial Area: Allotment letter from the respective Industrial Area Development Board/Corporation/Land Possession Certificate ; or

ii. Other than Industrial Area: Registered Land Deed/Land Conversion Certificate from concerned Authority/Rent (or) Lease Agreement in case of the property is on rent/lease;

c. Mining Project: Mineral mining Lease permission granted by the Department of Mines &Geology, if applicable;

d. Environmental Clearance granted by Central Government or State Environment Impact Assessment Authority, if applicable,24 The J&K Official Gazette, the 14th May, 2026/24th Vai., 1948. [No. 7 under the notification of the Government of India number SO.–1533 (E), dated the 14th September, 2006 issued under the Environment (Protection) Act, 1986 (29 of 1986) ;

e. Investment : Chartered Accountant Certificate about proposed Capital Investment.

2. Technical Details :

i. Environmental Impact Assessment Report, submitted to the Central Government or State Environment Impact Assessment Authority under the notification of the Government of India number SO.–1533 (E), dated the 14th September, 2006 issued under the Environment (Protection) Act, 1986 (29 of 1986) ; or

ii. Project report comprising manufacturing process (write up with flow chart), raw materials products, by-products, extent of land, water source and consumption for various purpose, wastewater generation from various activity, Effluent Treatment Plant (write up with flow diagram), Water Balance, Fuel used, Sources of emission and Air pollution Control Devices proposed, D.G. sets, and Hazardous and Other Waste Generation along with Plant layout plan.

a. Sewage Treatment Plant(STP) proposal which should contain details of design characteristics of sewage, treatment methodology, mode of disposal, design criteria for various units, detailed drawing and specification of STP and its layout, mode of disposal of treated sewage and its adequacy (in case where STP is required).

b. Effluent Treatment Plant (ETP) Proposal which should contain details including breakup quantity of water requirement with sources, breakup quantity of trade effluent, sources of trade effluent, characteristics of waste water treatment methodology, mode of disposal, design criteria for various units, detailed drawing of ETP and its layout, mode of disposal, design criteria for various units, detailed drawing of ETP and its layout, mode of disposal of treated effluent, standards to be achieved and its adequacy (in case where ETP is required).

c. Air Pollution Control (APC) measures proposal which should contain the details regarding fuels used, sources of emission, characteristics, concentration and quantity of pollutants, proposal along with design criteria and drawing for the proposed APC measures, adequacy of APC measures and stack odour/noise causing operations and its specific odour/noise control measures (if applicable).

d. Air Pollution Control Devices (APCDs) in cases where emissions are released in the atmosphere APCDs details must show the diagram of APCDs such as Cyclone/Multi Cyclone, Wet Scrubber, Bag house filter etc. with specifications and standards to be achieved.

3. Other Documents :

i. Site Plan of the proposed unit.

ii. Layout plan/Building Plan Showing the Location and proposed pollution Control Devices, Plant/machinery and PCMs such as Green belt, waste minimization etc.

iii. KMZ file/geo-coordinates showing the distance of water bodies, roads, existing/proposed residential areas, agricultural lands, important religious places, educational institutions, ancient monuments, archeological sites and other sensitive areas, in 1 Km radius from the units, if the unit is located outside industrial area.

iv. Details of Water Balance and wastewater balance for process (water budgeting detail).

v. Change of land use certificate for proposed industrial activity in case of the unit proposed outside of industrial area from concerned Deputy Commissioner.

vi. Provide undertaking regarding date of commissioning of the unit after establishment is complete in all aspects.

a. In case of hazardous chemical being used as raw material, the Material Safety Data Sheets (MSDS) should be enclosed26 The J&K Official Gazette, the 14th May, 2026/24th Vai., 1948. [No. 7 for each and every item. If the quantity of the hazardous chemicals handled is more than the threshold limit, the unit shall furnish any one the following documents as required under the MSIHC Rules, in case of isolated storage tanks :

Risk assessment report/Onsite Emergency Preparedness Plan/Off Site Emergency Preparedness Plan.

b. In case of transport of hazardous chemical, details of chemicals transported, method of transport and its safety measures (if applicable).

vii. In case of Red Category units generating hazardous waste, the DPR must contain the adequate provision of Pollution Control Devices and Safety Measures as per the SOPs/Guidelines prescribed by the CPCB.

viii. Prescribed consent fee to be paid online.

B. Consent to Establish (Renewal) :

i. Latest Copy of Consent to Establish (Fresh).

ii. Statement showing steps taken so far during the period of CTE (F) and required period of commissioning.

iii. Photographs showing the steps taken for establishment (building, plant and machinery) after grant of CTE (F) till date.

iv. Prescribed consent fee to be paid online.

C. Consent to Establish (Expansion) :

i. Detailed Project Report/Techno Feasibility Report which includes the details of raw material, products to be manufactured during expansion and their process and flow chart, capital cost of unit (land, building, plant and machinery), providing manufacturing process details, effluents/emissions generation and their treatment within prescribed norms and details of PCDs/ETP/STP.

ii. Adequacy report of ETP/STP/PCD in case the existing ETP/STP is being used from the approved consultant/chartered Engineer.

iii. Permission from DIC for expansion of the unit.

iv. Audited Balances sheets indicating the Existing Gross fixed Assets of the Industry alone must be enclosed and Auditor's Certificate with break up details for the proposed Gross fixed Assets duly certified by a Chartered Accountant with existing and proposed Expansion costs.

v. Comparison statement of the existing and expansion activities proposed.

vi. Layout Plan showing the location of various process, equipments, utilities like boiler, generator etc. Effluent Treatment Plant, outlet location, non-hazardous and hazardous waste storage yard if any change due to expansion and justification of quantity of products to be manufactured during expansion as per the space availability/machinery/increase of labour etc.

vii. Copy of Sale deed / Lease deed or any other relevant documents as proof to ensure possession of the site / factory for which application is made by the applicant if any change due to Expansion.

viii. Consent fee to be deposited online for the expansion part.

D. Consent to Operate (Fresh) :

i. Copy of last Consent to Establish (CTE).

ii. Compliance statement on the conditions stipulated in the CTE issued under Water and Air Acts.

iii. Photographs of the Pollution Control Devices/Measures (FTP/APCDs) as proposed in the DPR/techno-feasibility report etc.

iv. Adequacy certificate of the APCDs/ETPs/PCMs from the approved consultants/Chartered Engineers.

v. Copy of valid DIC registration.

vi. In case of hazardous waste generating units, the relevant documents/forms /authorization under Hazardous and Other Waste Management and Transboundary Movement Rules 2016.

vii. Compliance statement on the Environmental Clearance (EC) stipulated under Environment Protection Act (if applicable).

viii. Agreement with Common TSDF/CBMWTF (if applicable).

ix. Consent fee to be paid online.

x. Documents specific to Health Care Facilities :

a. Valid Agreement with CBWTF for BMW disposal.

b. Registration Certificate from Director Health Services/ Dental Council/Director ISM/ Director Animal Husbandry (as applicable).

c. Proof of barcode disposal implementation, with Barcode allotted to HCF

E. Checklist for Health Care Facilities (HCFs)

iii. Valid Agreement with Common Bio-Medical Waste Treatment Facility along with Lifting Certificate.

iv. Specification of captive treatment facilities, if any (STP/ ETP/Autoclave/Deep Burial) and DG Sets.

v. Application for bar code allotment.

vi. Layout plan of the various treatment facilities.

vii. Affidavit/Self declaration with regard to bed capacity and line of activity.

b. Authorization for Health Care Facilities (Renewal Cases) :

i. Duly filled online Application with GPS location.

vi. Annual Report of preceding year in Form IV (for time period Jan-Dec).

vii. Documentary proof of any conditions mentioned in the previous authorization.

F. Check List of Documents for obtaining Authorization under

Hazardous and other Wastes (Management and Transboundary

Movement) Rules, 2016

i. Form-I as per Rules, 6(1) as an application form.

ii. Form-4 for Annual Return.

iii. Form-10 in case of transportation of Hazardous and other waste within country for recycling or utilization including co-processing

iv. Previous Authorization in case of Renewal of Authorization.

v. Documentary proof of the installation of display board showing the updated data of hazardous waste stored in the premises/disposed.

vi. Photographic proof of the labelling of the drums containing hazardous waste used at the time of disposal and also the photographic proof of the hazardous waste storage room/site.

vii. Valid copy of agreement with the hazardous waste facility where hazardous waste shall be disposed as per norms.

viii. Documents related to any conditions applicable, in previous authorization.
