Order

1. The above titied challan is pending disposal before this court since 13.12.2016. Perusal of the record shows that accused no 03 namely Fazl-ud-Din Doi son of Ghulam Hassan Doi R/o Sone banjar Pulwama remained continuously absent since 04.02.2025 and bail bonds of the accused no 03 has been forfeited on 27.02.2025.

2. Eventually warrants came to be issued consistently, and the report has been filed by concerned executing officer stating that the accused has filed to Saudi Arabia and is deliberately avoiding appearance before this Court. The said report was taken on record with the warrants on 13.03.2025. On 22.10.2025, Tameeli namely Abdul Rasheed Bhat S/o Ghulam Ahmad Bhat R/o Dalwan, bearing No 1247/BD, Occupation Employee Age 50 years, Presently at Pakherpora appeared before this court and submitted that accused no 03 had left the Saudi Arabia before 2 years.

3. On 10.02.2026, the statement of the Investigating Officer, namely ASI Abdul Rasheed S/o Abdul Raheem R/o Putri Gaam, bearing No. 193/CID (retired employee), was recorded, wherein he stated that Accused No. 03 has fled and is currently in Saudi Arabia and has supported the contentions of the Tameeli concerned.

4. Therefore, in view of this factual background of the case it appears that the accused no 03 namely Fazl-ud-Din Doi son of Ghulam Hassan Doi R/o Sone banjar Pulwama is willfully avoiding the arrest and execution of processes of this court. Hence this court deems it appropriate now to proceed under Section 82 of CrPC by issuance of proclamation against the accused, which shall be published as per the mandate of law as follows :

(i) It shall be publicly read in some conspicuous place of the town or village in which the accused ordinarily resides;

(ii) It shall be affixed to some conspicuous part of the house or homestead in which the accused ordinarily resides or to some conspicuous part of such town or village; and

(iii) A copy thereof shall be affixed to some conspicuous part of the Court-house.

(iv) Further in the interests of justice let the said proclamation be also published in any local daily newspaper circulating in the place in which such person ordinarily resides, at the expense of the prosecution.

5. Let the said proclamation which shall be annexed with this court order be published in the manner aforesaid from points 1 to 3, by the SHO concerned of the area where the accused ordinarily resides who shall report the proof of said proclamation having been published in the manner aforesaid with specific date before this court by or before 30/05/2026

6. As far as publication in newspaper is concerned, the prosecution also shall ensure that same is done positively before 30/05/2026, and shall report compliance on the said date.

7. The accused shall accordingly appear before this court on the date mentioned in the proclamation order.

8. Copy of this order along with the proclamation order shall be provided to the SHO Charar-i-Sharief (Through SP Budgam), via. prosecution to before report compliance by or before 30-05-2026 positively who shall also be present the court to state that such publication has been duly done. A Copy of this order shall also go to SP Budgam for information and necessary action. List again on 30.05.2026 for reporting compliance.
