In exercise of the powers under Section 21 of the Jammu and Kashmir Civil Courts Act, 1977 and in supersession of the previous notifications on the subject, High Court is pleased to invest :–

i. All Civil Judges Senior Division) in the UTs of J&K and Ladakh with the powers, to hear civil suits, the value of which does not114 The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. [No. 11 exceed Rs. 20,00,000/- (Twenty Lakhs), to be exercised by them within the local limits of their jurisdiction; and

ii. All Civil Judges (Junior Division) in the UTs of J&K and Ladakh with the powers to hear civil suits, the value of which does not exceed Rs. 5,00,000/- (Five Lakhs), to be exercised by them within the local limits of their jurisdiction.

The notification shall be effective prospectively w.e.f. 01.06.2026, with the explicit condition that the pending suits etc. as on 31.05.2026, shall proceed in the respective Courts, irrespective of the above notification.

Whereas, it appears to the appropriate Government that a land quantum of 17 Marlas under Survey No. 134 in estate Sumbal Balla, Teshil Gund, District Ganderbal is required for public purposes namely "Acquisition of additional land measuring 17 Marlas under Survey No. 134 min involved in the improvement work at Masjid Mode Black2594 The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. Whereas, on the basis of indent placed by the requiring body vide No. 2003/SUMBAL/14/E2LA dated 18/05/2024 and after completing the SIA Study and consideration of report vide No. 68/LASTG/2024 dated 22/08/2024 & TG/OQ/2024/629-30 dated 04/11/2024 by the Appropriate Government, the Collector Land Acquisition, Kangan issued a Preliminary Notification vide no. No. SDM/KGN/LAS/26/57-66 dated 02/02/2026 under Section-11 of Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the land measuring 17 Marlas under survey No. 134 min in estate Sumbal Balla, Tehsil Gund for calling upon interested persons to file objections, if, any ; and

Whereas, as per the report furnished by the Collector Land Acquisition (Sub-Divisional Magistrate) Kangan no objection was received within the stipulated time and the land is required for the public purpose ; and

Whereas, the "Appropriate Government", the District Collector Ganderbal is satisfied after considering the report made by the Collector that the land particulars which are given below is required for public purposes :

Now, therefore, it is hereby declared under the provisions of Section 19 of the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the said land is required for public purposes i.e. "Acquisition of additional land measuring 17 Marlas under survey No. 134 min involved in the improvement work at Masjid Mode Black Spot, Srinagar Sonamarg Gumri road in estate Sumbal Balla, Tehsil Gund, District Ganderbal".

There is no involuntary displacement of persons due to the aforesaid acquisition, with no adverse impact and no rehabilitation is involved.

the Collector on any working day.

Whereas, Deputy Commissioners/District Collectors, vide SO.-17, dated 14/01/2022, were designated as 'Appropriate Government' within their respective jurisdictions for acquiring land for public purposes under "Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013" for an area not exceeding 400 Kanals ;

Whereas, Managing Director JKPTCL J&K (Requiring body) placed indent through Executive Engineer TLMD-VI Srinagar vide No. TLMD-VI/344-47, dated 17.02.2025 for insertion of tower D + 6 type of 220 KV D/C Zainkote Amargarh Transmission Line;

Whereas, Collector Land Acquisition/SDM Beerwah constituted a Committee vide Order No. COLL/SDM/BRW/LAS/2025/417-27, dated 22.07.2025 under rule 4(1) of "The Jammu and Kashmir Right to Fair Compensation & Transparency in Land Acquisition, Rehabilitation & Resettlement (Social Impact Assessment and Consent) Rules, 2023, issued vide SO.-440 dated 24.08.2023" ;

Whereas, the report submitted by the committee reveals that no displacement or rehabilitation is involved in the acquisition ; therefore, the Collector invoked Rule 8, and considered the report of the committee as Social Impact Assessment report ;

Whereas, it appears that a total of 12 Marla 136 Sft. of land under Survey No. 1919/1152 min at village Hardmulpora Tehsil Magam District Budgam is required for public purpose, namely insertion of tower D+6 type of 220 KV D/C Zainkote Amargarh Transmission Line ;

Whereas, the Collector Land Acquisition/SDM, Beerwah issued preliminary notifications under Section 11(1) of the Act for the said land vide No. COLL/SDM/BRW/LAS/2025/449-57,2596 The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. [No. 11 dated 28/08/2025 followed by a corrigendum dated 30.08.2025 for calling upon objections in respect of the land under acquisition from interested persons ;

Whereas, no objections were received within the stipulated time as communicated by Collector Land Acquisition/SDM, Beerwah vide No. COLL/SDM/BRW/LAS/2025/497, dated 19/11/2025 ;

Whereas, the Appropriate Government is satisfied after considering

the report made by the Collector/SDM, Beerwah vide letter No. COLL/SDM/BRW/LAS/2025/497, dated 19/11/2025 under Section 15(2) and rule 25(6) that the land particulars of which are given below is required for public purposes insertion of tower D + 6 type of 220 KV D/C Zainkote Amargarh Transmission Line :

Section 19 of the "Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013" that the said land is required for public purpose i.e. insertion of Tower D + 6 type of 220 KV D/C Zainkote Amargarh Transmission Line.

A plan of the land may be inspected in the office of the Collector

and Tehsildar concerned on any working day.

Whereas, it appears to the Government of UT of J&K that land

measuring 01 Kanals 11 Marlas is required for Defence purposes for

the area specified is required for the above purpose.

Defence Purposes for construction of Axial Road from BOP (Regal) to

measuring 01 Kanal (local) at Village Sunarian, Tehsil Pouni,

District Reasi to be acquired for "Construction of Veterinary

Dispensary at Ransoo".

Whereas, the Director, Sheep Husbandry Department, Jammu vide

No. DSHJ/F&F/2025-26/1503-1505 dated 25-04-2025 has placed a

formal indent for the acquisition of land for "Construction of Veterinary

Dispensary at Ransoo situated at Village Sunarian, Tehsil Pouni, District

Reasi ;

Whereas, on the identification of the indenting department, revenue

papers and map of land measuring 01 Kanal (local) situated at village

Sunarian, Tehsil Pouni, District Reasi were got prepared by the field staff

of revenue department through Tehsildar Pouni; and

Whereas, appropriate authority l.e. Deputy Commissioner Reasi

was pleased to accord exemption from undertaking SIA and consider the

preliminary report as SIA vide No. DCREAS-LAoLAAC/1/2024-06-DC

OFFICE REASI (OUTSIDE SECTT) (Computer No. 7548676) dated

02-08-2025; and

Whereas, notification under Sub-Section (1) of section 11 of the

Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 was issued by this

Collectorate vide No. DC/Rsi/LA(ACR)/25-26/73-85 (7548676) dated

10-09-2025 which was served upon the land owners, interested persons

and indenting department, who were asked to file their

objection/objections (if any) within 60 days from the date of

issuance/publication of this notification ; and

Whereas, no such objection(s) has/have been received in this

Collectorate in response to the above quoted notification ; and

Whereas, this Collectorate vide Letter No. DC/Rsi/LA(ACR)/25-

26/130-32 dated 7-01-2026 requested the appropriate authority2612 The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. [No. 11 i.e. Deputy Commissioner, Reasi to issue declaration under section 19 of the Act to the effect that land measuring 01 Kanal (local) at Village Sunarian, Tehsil Pouni, District Reasi is required for public purpose namely "Construction of Veterinary Dispensary at Ransoo" ; and

Whereas, vide Notification No. 01-DC(Rsi) of 2026 issued under endorsement No. DC/Rsi/SQ/25-26/5155-62 dated 21-02-2026, the appropriate authority i.e. Deputy Commissioner Reasi was pleased to issue declaration under section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for land measuring 01 Kanal (local) at Village Sunarian, Tehsil Pouni, District Reasi for public purpose namely "Construction of Veterinary Dispensary at Ransoo" and copy of the same was endorsed to this office with the directions to follow all the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, LB-10 of 1980 or any other law governing the subject matter while making apportionment of compensation in favour of the rightful claimants of the below said land.

Therefore, all the owners/interested persons are hereby called upon to attend this office either in person or by an authorized agent or advocate within 30 days from the date of publication of this notice i.e. on or before 30-04-2026 during office hours at Collector Land Acquisition (Assistant Commissioner Revenue) Reasi to state their respective interests in the land, the amount, particulars of their claims to the compensation for such Interests and to the measurement of land, if any.

No claim will be entertained after the expiry of this period.

Whereas, the Director Tourism Kashmir has placed the indent vide Letter No. Estates/264/DTK/228 Dated, 13/08/2024 for acquisition of land measuring 01 Kanals, 13 Marlas & 03 Sirsai for public purpose2614 The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. [No. 11 namely Construction of Trekker's Hut at Chount Waliwar Tehsil Lar District Ganderbal.

Whereas, the revenue papers were prepared by the Tehsildar Lar and subsequently were forwarded to the Indenting Department for page- wise authentication to ensure their correctness and genuineness. The Indenting Department, vide letter No. Estate/264/DTK/429-30 dated 20/12/2024, returned the said revenue papers duly authenticated by the Director Tourism Kashmir.

Whereas, it appears to the Appropriate Government/Authority that a total of 01 Kanals, 13 Marlas & 03 Sirsai land under survey No. 376/8 & 291 min (details given below) is required in the village Chount Waliwar, Tehsil Lar, District Ganderbal for the public purpose, namely, construction of Trekker's Hut.

Whereas, in terms of sub rule (1) of Rule 4 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, a committee headed by Tehsildar Lar was constituted by the District Collector (Deputy Commissioner) Ganderbal vide order No. 53 of DCG(LAS) of 2025 dated 20/06/2025 issued under the endorsement No. DCG/LAS/Mix/25/F-499/302-12 dated 20/06/2025 for conducting preliminary enquiry.

Whereas, the Committee so constituted conducted a preliminary enquiry and submitted a detailed report through the Tehsildar Lar vide communication No. OQ/TL/25/7009, dated 03.12.2025, wherein, it has been reported that the committee conducted spot inspection and unanimously agreed upon the following points :

I. That, the Indenting Department was offered State/Govt. land at various locations for the proposed acquisition and have not found any suitable land and has agreed to the proposed land which serves the public purpose.

II. That, the extent of land proposed for acquisition is the absolute

bare-minimum needed for the purpose/project.

III. That, there is no sufficient/suitable unutilized land which has

been previously acquired in the area.

IV. That, there is no State/Government/Common land available which would serve the public purpose and there is only option to acquire the proposed patch of land.

Whereas, the Tehsildar Lar, head of the committee, vide his office Letter No. OQ/TL/25/8669 dated 11.02.2026, submitted a report to the Deputy Commissioner, Ganderbal stating that no involuntary displacement of persons shall occur due to the above said acquisition andNo. 11] The J&K Official Gazette, the 11th June, 2026/21st Jyai., 1948. 2615 that no rehabilitation is involved in the case in hand. Also, the consent of 70% of the interested persons has been obtained.

Whereas, as per rule 8 of J&K Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules 2022, where no involuntary displacement of persons due to acquisition of land with no adverse impact, and no rehabilitation is involved, the Collector shall obtain report of Committee as constituted under sub-rule (1) of Rule 4 along with the consent of the interested persons (atleast 70%) which shall be considered as Social Impact Assessment report.

In view of above, I, Collector Land Acquisition (Assistant Commissioner Revenue) Ganderbal in terms of powers vested in me under Section 11(1) of the Right to Fair Compensation Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, hereby, notify the land required for public purpose i.e. Construction of Trekker's Hut at Chount Waliwar Tehsil Lar District Ganderbal, the description of the land is as under :—

This notification is made under the provisions of Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No. 30/2013), to all whom it may concern.

A plan of the land may be inspected in the office of the Collector on any working day during the working hours. The Government authorizes Collector and his Revenue field staff to enter upon and the survey land, take levels of any land, dig or bore into the sub-soil & do all other acts required for the proper execution of their work as provided and specified in section 12 of the Act.

Under Sub Section (4) of Section 11 of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, etc., or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person(s) interested within 60 (sixty days) from the date of publication of this notification as provided under Section 15 of the Act, before Collector Land acquisition (Assistant Commissioner Revenue) Ganderbal.
