Subject :—Participation of Teaching Staff and Other Government Officials in Census-2027 Roles, Responsibilities and Penal Provisions.

Circular No. : 13-JK (GAD) of 2026

Dated : 05.06.2026.

House Listing Operation (HLO) of Census-2027 is scheduled to be conducted from 01.06.2026 to 30.06.2026 across the Union Territory of J&K and a large number of Government employees, particularly teaching staff and other field-level officials, have been appointed as Enumerators and Supervisors under the provisions of the Census Act, 1948.

The duties assigned to Census functionaries are statutory in nature and must be performed within the prescribed timelines to ensure successful completion of this national exercise.

In terms of Census Circular No. 16 dated 17.03.2026, issued by O/o Registrar General & Census Commissioner of India, the responsibilities of Enumerators and Supervisors have been delineated in details, as also the relevant provisions of the Census Act, 1948, which pertain to penalties for refusal, neglect or failure to perform census duties.

The roles and responsibilities of Census functionaries, as envisaged under the Ibid. Act and various executive instructions, are reiterated here under :—

Core Duties of the Supervisor (Para-6) :

The Supervisor is responsible for technical configuration, operational guidance, field boundary authentication, and rigorous quality control across their assigned circle :

1. Technical Setup : Install the official Mobile App exclusively from authorized digital stores (Google Play/Apple App Store) and successfully register their device.

2. Training and Readiness : Ensure all attached Enumerators attend mandatory training sessions and receive their respective operational materials.

3. Boundary Verification : Accompany Enumerators directly to the field to physically visit all assigned House Listing Blocks (HLBS) and Enumeration Blocks (EBs) to finalize block boundaries.

4. Circle Mapping : Reference downloaded PDF maps from the HLO App to manually draw an integrated Layout Map of the Supervisory Circle, plotting landmarks, natural features, and specific black divisions.

5. Data Validation : Log into the Mobile App to audit all entries including synchronized Self-Enumeration (SE) records after data is uploaded by the Enumerators.

6. Field Coverage Monitoring : Verify complete coverage of all areas, buildings, households, and individuals within the circle without omissions or duplication. The Supervisor must independently survey boundary borders to ensure no intermediate areas are missed.

7. Houseless Population Operations : Provide direct, on-ground field assistance to Enumerators during the night timeNo. 15] The J&K Official Gazette, the 9th July, 2026/18th Asad., 1948. 59 enumeration of houseless populations on the final night of the Population Enumeration phase.

8. Paper-Mode Management : In cases where an Enumerator utilizes manual paper schedules due to unavoidable issues, ensure that all data is successfully entered onto the central web portal at the Charge Office within the prescribed schedule.

9. Record Collection & Dispatch : Secure all completed and blank forms, required statistical statements, and signed Certificates of complete coverage from field staff. Sign and forward these records to the Charge Officer within two days of concluding operations.

10. General Mandates : Maintain execution timelines and execute any other census-related tasks officially delegated by the Charge Officer.

Core Duties of the Enumerator (Para-7) :—

The Enumerator acts as the primary field agent responsible for executing block-level structural numbering, door-to-door data entry and local public interactions:

1. App Registration : Download and install the official Mobile App from authorized stores, delaying device registration until block allocations are successfully finalized on the CMMS Portal by the Charge Officer.

2. Block Layout Mapping : Download the required local maps (HLB maps via the HLO App or EB maps via the PE App) to draft a precise physical Layout Map of the assigned block boundaries.

3. Structural Numbering : Explicitly sketch and identify all buildings, plot the total number of distinct census houses within each structure, and document prominent local landmarks on the Layout Map.

4. Field Identification : Carry their official appointment letter and ID card visibly throughout all field operations.

5. Door-to-Door Data Entry: Conduct polite, probe-based data interviews and record information directly into the Mobile App during door-to-door visits according to guidelines.

6. Self-Enumeration Verification : Retrieve Self-Enumeration (SE) IDs from residents who completed online tracking, carefully reviewing and confirming the pre-filled data with the respondent before accepting or editing the file.

7. Universal Coverage : Cover every single house and household within the assigned block bounds without omission or duplication. If a census house is locked, the Enumerator must make multiple return visits.

8. Revision Rounds : Execute mandatory revision rounds and update synchronized records directly through the moblie application.

9. Paper-Mode Backup : If forced to use paper schedules under unavoidable conditions, ensure all field data is manually uploaded onto the Charge Office web portal, and return all forms (filled, partially filled, or blank) to the Supervisor.

Penal Provisions :

Under Section 11 of the Census Act, 1948, any Census Officer (Enumerator or Supervisor) who refuses to perform census duty, neglects responsibilities, misconducts during fieldwork, or tampers with census records shall be liable to imprisonment up to three years and fine up to 1,000. In addition, disciplinary action may be initiated under the Jammu and Kashmir Government Employees (Conduct) Rules, including adverse entries in service records, deduction of salary, withholding of promotions/increments, departmental proceedings, suspension, or termination in cases of habitual dereliction of duty.

Accordingly, it is enjoined upon all Administrative Secretaries, Divisional Commissioners, Deputy Commissioners and Heads of Departments to provide full cooperation and administrative support to the officers /officials deployed for Census-2027 duties, and to ensure that no avoidable obstacles impede the conduct of census duties during the House Listing Operation. Controlling Officers shall, wherever feasible, suitably regulate the work schedules of deployed personnel to facilitate timely discharge of census responsibilities. All concerned shall accord priority to Census-2027-related matters and extend necessary cooperation to the Directorate of Census Operations, JAK, for the successful completion of the House Listing Operation,

Whereas, it appears to the appropriate Government that a total land 09 Marlas construction of Approach Road to Lift Irrigation Scheme Niklora Tehsil Shahoora Litter District Pulwama for public purpose for which the Chief Engineer Kashmir Irrigation and Flood Control3636 The J&K Official Gazette, the 9th July, 2026/18th Asad., 1948. [No. 15 Department Srinagar has placed formal indent vide No. CEO/Rev/9264- 66 dated 29-09-2025.

Whereas Social Impact Assessment study was carried out by

1. That the proposed acquisition of land serves public purpose.

2. That the extent of land proposed for acquisition is the absolute bare-minimum needed for the project.

3. That the acquisition of land at an alternate place has been considered and found not feasible.

4. That there is no unutilized land which has been previously acquired in the area.

5. That there is no unutilized acquired land that can be used for this public purpose.

On the basis of recommendations of the SIA Committee report submitted to the District Collector Pulwama vide this Office No. DCP/Coll/2025/433 dated 19-01-2026 for its acceptance and authorization for issuance of the Notification under Sec. 11 (1) of the said Act.

The District Collector has authorized to the undersigned for the issuance of the said notice vide his No. DCP/LA/2025/630-31 dated 28-01-2026.

Therefore, it is notified that a piece of land measuring 09 Marlas of standard measurement, whose detailed description is given here under needs to be acquired for public purpose i.e., for construction of Approach road to Lift Irrigation Scheme Niklora Tehsil Shahoora Litter.

The Notification is made under the provisions of Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013).

A plan of the land may be inspected in the office of Collector Land Acquisition Pulwama on any working day during the working hours. It is further notified under Section 11 (4) of the Act, that no person shall make any transaction or cause any transaction of land/structure i.e., sale/purchase, etc., or create any encumbrances on such land from the date of publication of such Notification without prior approval of the Collector. Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty) Days from the date of publication of this Notification as provided under Section 15 of the Act before Collector Land Acquisition (Assistant Commissioner Revenue) Pulwama and any objection filled beyond proper timeline shall not be entertained.

Whereas, the land measuring 178 Kanals 15 Marlas (local) situated at village Chassana, Tehsil Chassana, District Reasi was required for public purpose namely in Construction of Budhal-Mahore-Gool GREF Road on NHDL Specification including land measuring 39 Kanals 03 Marlas bearing Khasra No.416/386 (17K-8M), 418/386 (5K-4M), 418/386 (4K-16M), 417/386 (1K-11M), 417/386 (01K-05M), 418/386 (01K-05M), 419/386 (03K-09M) & 425/386 (4K-5M) ; and3638 The J&K Official Gazette, the 9th July, 2026/18th Asad., 1948. [No. 15 Whereas, on the receipt of indent from indenting department i.e. Officer Commanding 100 RCC (GREF) C/O 56 APO and recommendation of Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. SDM/M/2022-23/42-45 dated 06.04.2022, sanction was accorded vide No. DC/Rsi/SQ/22-23/771-75 dated 12-05- 2022 to the exemption from undertaking Social Impact Assessment Study under section 9 by invoking urgency clause under section 40 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the subject land; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. CLA/SDM/M/2022-23/201-215 dated 16-07-2022 issued preliminary notification under section 11(1) of the (RFCTLARR) Act, 2013 for calling upon the objections, if any, from the interested persons/ land owners within stipulated time period from the date of issuance/publication of the said notice; and

Whereas, in response to the said notification, no objection was received within stipulated time period from the land owners/interested persons in the Collectorate of Sub Divisional Magistrate Mahore; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. CLA/SDM/M/2022-23/439-41 dated 20-12-2022 requested the appropriate Government i.e. Deputy Commissioner, Reasi to issue declaration under section 19(1) of RFCTLARR Act, 2013; and

Whereas, the appropriate Government i.e Deputy Commissioner Reasi was pleased to issue declaration under section 19 (1) of the ibid Act vide notification No. 05-DC (Rsi) of 2023 dated: 04-02-2023, issued under endorsement No. DC/Rsi/SQ/22-23/9146-52 dated 04-02-2023 for land measuring 178 Kanal 15 Marlas local situated at Village Chassana, Tehsil Chassana, District Reasi for public purpose namely "Construction/improvement of Budhal-Mahore-Gool GREF Road"; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore issued notification under section 21 of RFCTLAPRR Act, 2013 vide No. CLA/SDM/M/2023-24/53-67 dated 03-05-2023 asking all the stakeholders/land owners/interested persons to file their objections/attend his office either in person or through an authorized agent or advocate within 35 days from the date of publication of the notice, in which ten (10) number of objections/claims were received in response to the above quoted notification dated 03-05-2023. The matter was examined in lightNo. 15] The J&K Official Gazette, the 9th July, 2026/18th Asad., 1948. 3639 of the available record and necessary corrections were made in the issued notification under section 21; and

Whereas, the indenting Department vide letter No. 800/EPC/ PkgII/SAT/E2 dated 07-09-2024 requested Collector Land Acquisition (Sub Divisional Magistrate) Mahore for de-scoping of some land/area at PM 17+340 to 18+410 and in the intervening period the prescribed time period for the issuance of final award got expired. Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide letter No.CLA/SDM/M/2024-25/828-30 dated 06-03-2025 requested the appropriate Government to extend the time period for the issuance of Draft/Final Award in respect of village Chassana, Tehsil Chassana, District Reasi. In response appropriate Government vide letter No. DC/Rsi/SQ/2025-26/293-96 Dated 23-04-2025 extended the time period for six months w.e.f 01-04-2025. However, the final award could not be issued due to pending of de-scoping approval from the indenting Department and consequently the extended time period also expired; and

Whereas, in order to avoid further loss to the State exchequer on account of interest, the Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide letter No. CLA/SDM/M/2025-26/406-408 Dated 10-12-2025 again requested the appropriate Government to extend the time period for the issuance of Draft/final Award in respect of village Chassana, Tehsil Chassana, District Reasi for another six months and in response the appropriate Government vide letter No. DC/Rsi/SQ/2025- 26/4715-18 Dated 28-01-2026 extended the time period for another six months w.e.f 28-01-2026 for the issuance of Final Award of BMG (GREF) road in respect of village Chassana, Tehsil Chassana; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide No. CLA/SDM/M/2025-26/546-48 Dated 09-03-2026 requested the appropriate Government for accord of approval for De- notification of land measuring 39 Kanal 03 Marlas as notified under section 11, section 19 and section 21 of the RFCTLARR Act 2013 ; and

Whereas, Section 93 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 provides that:

"Completion of acquisition not compulsory, but compensation

to be awarded when not completed.

I. The appropriate Government shall be at liberty to withdraw from the acquisition of any land of which possession has not been taken.

II. Whenever the appropriate Government withdraws from any such acquisition, the Collector shall determine the amount of compensation due for the damage suffered by the owner in consequence of the notice or of any proceedings thereunder, and shall pay such amount to the person interested, together with all costs reasonably incurred by him in the prosecution of the proceedings under this Act relating to the said land".

Whereas, Collector Land Acquisition (Sub Divisional Magistrate) Mahore vide letter No. CLA/SDM/M/2026-27/120-22 dated 15-04-2026 has requested for issuance of withdrawal notification/de-notification order in respect of Village Chassana, Tehsil Chassana for item No. 1, 2, 3, 4, 5, 6, 7 & 8 contained in notification No. 05-DC (Rsi) of 2023 dated 04-02-2023 issued under endorsement No. DC/Rsi/SQ/22- 23/9146-52 dated 04-02-2023 for land measuring 178 Kanals 15 Marlas local situated at village Chassana, Tehsil Chassana, District Reasi for public purpose namely "Construction/improvement of Budhal-Mahore- Gool GREF road";

Now, therefore, in terms of sub-section (1) of Section 93 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, land measuring 39 Kanals 03 Marlas bearing Khasra No. 416/386 (17K-08M), 418/386 (05K-04M), 418/386 (04K-16M), 417/386 (01K-11M), 417/386 (01K-05M), 418/386 (01K-05M), 419/386 (03K-09M) and 425/386 (04K-05M), situated in village Chassana, Tehsil Chassana, District Reasi, shall and shall always be deemed to have been de-notified fromNo. 15] The J&K Official Gazette, the 9th July, 2026/18th Asad., 1948. 3641 the acquisition proceedings issued by the Collector Land Acquisition (Sub Divisional Magistrate) Mahore, subject to the condition that :

a. The Collector Land Acquisition (Sub Divisional Magistrate) Mahore shall ensure that the possession of the said land has not been taken by the indenting department/agency and the land was/is still in the continued physical possession of the land owner(s).

b. The compensation of the said land has not been paid to the rightful claimants, and if any, compensation received by the land owner(s) in respect of the said land shall be recovered back before effecting necessary changes in the revenue records in pursuance of the proposed de-notification.

c. The Collector Land Acquisition (Sub Divisional Magistrate) Mahore shall ensure that the said land has not been proposed for any other acquisition/public purpose or is likely to be required.

d. The proposed de-notification shall be without prejudice to the outcome of the writ petition(s), if any, pending consideration before the Competent Court (s).

Whereas in the above titled case the accused person named above is absconding and the concerned IO has submitted that there is no immediate prospect of arresting him. Statement of the IO is part of the file. Perusal of the file and the statement of IO reveals that the accused has intentionally concealed himself and the arrest of said accused is impossible through usual mode, as such General Warrant of Arrest is hereby issued against him.

Through the medium of the instant general warrant of arrest all police personnel of the J&K Police are ordered and authorized to arrest the above named accused person, whenever and wherever found and produce him before this Court under proper custody. The General Warrant of arrest shall remain in force till its execution.
