| 28.1 | The Engineer shall extend the Intended Completion Date if a Variation is issued which makes it impossible for Completion to be achieved by the Intended Completion Date without the Contractor taking steps to accelerate the remaining work and which would cause the Contractor to incur additional cost | 28.1 The Engineer shall extend the Intended Completion Date if a Variation as explained in clause 28.1 (a) is issued which makes it impossible for completion to be achieved by the Intended Completion Date without the Contractor taking steps to accelerate the remaining work and which would cause the Contractor to incur additional cost. 28.1 (a) The Engineer shall also extend the intended completion date in any of the following events:- (i) The employer does not give access a part of the site by the site possession date stated in the contract data. (ii) Other contractors, public authorities, utilities or the Employer does not work within the dates. (iii) Other constraints such as Public protest, unapproachable working site, unforeseen circumstances and reasons which cause delay or extra cost to the contractor. (iv) Force majeure (eg.Natural Calamities) or conditions beyond control of the department. |
