" After perusing the counter affidavit in question which is at page no. 982-973 in the correspondence side of the file, I also do not find any such reference of so called Section 27 of Santhal Pargana settlement regulation III of 1872, thus the stand taken by the delinquent officer appears to be genuine."
" In the present matter the facts appear to be totlally otherwise because the statement which is alleged in the charges to have been made in the relevant counter affidavit is itself not found in the concerned affidavit filed before the court. Making a misstatement about a court's record/counter affidavit or framing such extraneous charge while referring to and affidavit filed before the Hon'ble High Court is no doubt a very serious risk which the querist appears to be taking and in my view and opinon framing of chargess on the basic of letter dated 14.01.2004 and the alleged statement made in the counter affidavit does not appear to be proper and lawful."
