HIGH COURT OF JHARKHAND (ALLOTMENT OF QUARTERS) RULES, 2022

No. 05/Accts In exercise of the power conferred by Article 229 of the Constitution of India and of other enabling provisions, in supersession of any Rules, Regulations, Notifications, Orders or instructions issued in this behalf, and in addition to the relevant provisions contained in the Jharkhand Service Code, the Chief Justice, High Court of Jharkhand hereby makes the following Rules to govern the allotment of residential Quarters to the Officers and Staff of the High Court of Jharkhand:

1. Short Title, Commencement and Extent:

(i) These Rules may be called the "High Court of Jharkhand (Allotment of Quarters) Rules, 2022"

(ii) These Rules shall apply to the Officers and Staff of the High Court of Jharkhand who, under the terms and conditions of their service, are entitled to the Official residence.

(iii) These Rules shall come into force from the date of its notification.

2. Subject to the provisions contained in the Jharkhand Service Code, 2001, these Rules shall govern the allotment of Quarters to the Officers and Staff of the Court.

3. Definitions:

In these Rules, unless there is anything repugnant to the subject or context;

(i) "Code" means the Jharkhand Service Code, 2001.

(ii) "Court" means the High Court of Jharkhand at Ranchi.

subordinate Judicial service, for the time being posted in the High Court ondeputation.

(iv) "Officers" means and includes Officers appointed from amongst the members of the Staff of the Court and includes Officers on deputation and Officers in the Class I & II cadre of the service.

(v) "Staff" means and includes the employees of Class-III & IV Cadre, but it shall not include any person employed or engaged on contract or on daily wages.

(vi) "the Quarter" means a residential unit of any category or of any description available or earmarked for allotment to the officers and Staff of the High Court but shall not include the Staff Quarters/outhouses attached to the Official residence of the Chief Justice and of the other Judges of the Jharkhand High Court and of the officers in the Jharkhand, Superior or Subordinate Judicial Service posted in the High Court on deputation and the Quarters/outhouses attached to the High Court Guest House.

(vii) Registrar (Establishment) means the officer, for the time being appointed in the Jharkhand High Court as Registrar (Establishment).

(viii) "Registrar General" means the Officer, for the time being appointed in the Jharkhand High Court as Registrar General.

(ix) "Committee"means any Committee of Judges of the High Court as nominated by The Chief Justice.

4. (i) The Officers & Staff, entitled to an official residential Quarter, may apply to the Registrar (Establishment) for allotment of Quarter according to the entitlement in 'Form A'annexed to these rules.

(ii) Allotment of the Quarters amongst the Officers & Staff of the High Court shall be made by The Committee according to these Rules subject to the approval of The Chief Justice.

(iii) The letter of allotment will be issued in 'Form B' annexed to these Rules. 5. Categories and Divisions of Quarters:

(i) The different categories of Quarters shall be allotted amongst the officers and Staff as per 'Schedule I' attached to these Rules.

(ii) There shall be two sub-divisions namely:

a. General Applicant Quota- 90% of the accommodation in a particular class of

Quarter shall be allotted on the basis of Seniority to be determined on the basis of

length of service in that particular class. However if two applicants have the same

date of joining in that Class, then the seniority shall be decided as per the date of

joining in their preceding classes. In case two applicants have the same date of joining

in the basic post, then their seniority will be decided as per gradation list.

b. Discretionary Quota- 10% of the accommodation shall be reserved for

discretionary quota in each class at the discretion of The Chief Justice including the

allotment on the basis of emergent medical need.

Note: This Quota percentage in each Category as mentioned above shall be

applicable on existing vacancy of accommodations at the time of allotment.

(iii) The Quarter shall be allotted amongst the Judicial Officers of the Registry on Seniority basis as per the decision of the Committee subject to approval of The Chief Justice out of the quarters mentioned in'Schedule IA' of this Rule.

(iv) The allotment of Car Sheds/Garages, where available shall be done according to Seniority determined as per Rule 5 (ii) above.

6. Procedure for Allotment:

(i) After every three months, preferably by 7th day of March, June, September, December of each year, the list of vacant quarters shall be published by the Registrar (Establishment) on the notice board and thereafter the willing Officers and the Staff shall submit the application for allotment of quarters by 20th day of the concerned month. In case in any quarter (three months), there is no vacancy of any quarter, the same shall also be notified by the Registrar (Establishment).

(ii) As and when a Quarter is vacated, the Court Officer shall submit a report after physical inspection with the authorized Engineers of the Building Construction Department regarding the condition of the Quarter. If the Quarter is found not habitable,it shall not be included in the list of vacant Quarters to be notified.The Registrar (Establishment) shall take immediate steps for its repair to make it habitable preferably within a period of two months so that it may be included in the list of vacant Quarters to be notified in the next round of allotment.

Registrar (Establishment). The Registrar (Establishment) shall, within one week of the last date of submission of application, unless the application is withdrawn by the applicant concerned within this period, shall verify the correctness of the information entered and;

a. In case of incorrect information, the application shall be rejected;

b. In case of incomplete application, the applicant shall be communicated within three days of verification to complete the same within ten days;

c. If the incomplete application is not completed within ten days from the date of communication, the same shall be rejected.

(b) The verified and complete applications in relation to officers and Staff shall, on quarterly basis, be placed by the Registrar (Establishment) for consideration before The Committee constituted for this purpose by The Chief Justice.

(iv) No Quarter shall ordinarily be allotted to the Officers/Staff who owns a residential house within the radius of 10kilometres from the High Court.The Committee having regard to the hardship suffered by any member of the Officer/Staff or in the interest of the administration,may relax this rule in favour of such Officers/Staff with the approval of The Chief Justice.

(v) No person shall ordinarily be allotted the type of Quarter to which he is not entitled.

(vi)If any member of the Officer/Staff does not accept the allotmentwithin fifteen days of allotment, the allotment made to such member shall stand cancelled.

(vii) The Officer/staff who is allotted Quarter shallhave to occupy the same within not more than fifteen days of the acceptance. After expiry of fifteen days, such person will be deemed to have occupied the Quarter and shall cease to receive House Rent Allowance and Quarter rent at the applicable rate shall be realised from him.

(viii) If the Officer/Staff who is allotted the Quarter fails to actually occupy the Quarter within one month from the date of the allotment, the allotment shall stand cancelled and the allottee shall be debarred from allotment of Quarters for a period of two years.

(ix) If the Officer/Staff in occupation of a Quarter is promoted to a higher post and by virtue of such higher post he is entitled to a higher category of Quarter, he may apply for that higher category of the Quarter. Such application shall be considered as a fresh application and shall be processed in accordance with these Rules. Until such Officer/Staff is allotted a Quarter in the higher category as per his entitlement he shall be allowed to continue to occupy the Quarter in his occupation.

(x) On fresh allotment of the higher category of Quarter to the applicant, the Rules of allotment under these Rules shall apply and the concerned Officers/Staff shall hand over the vacant possession of the Quarter in his possession to the Registrar (Establishment) within fifteen days of such allotment.

(xi) The Officers & Staff under occupation of allotted Quarter can apply for fresh allotment of any other Quarter in the same class after two years of initial allotment.

(xii) The Registrar (Establishment) shall notify all orders of allotment within three days from the date of the order.

(xiii) The Registrar (Establishment) shall maintain Register of allotment as per Schedule IIof this Rule.

7. General Conditions:-

The allottee of a Quarter shall:

(i) use the Quarter only for the residence and will be not use the Quarter or any part of it or the land appurtenant thereto for any purpose other than residence;

(ii) not sub-let the Quarter or any part of it or the land appurtenant thereto to any person;

(iii) not make permanent or temporary structural changes, alteration or make any additional construction in or around the Quarter or any part of it or on the land appurtenant thereto;

(iv) always maintain the Quarter in good habitable condition.

Any order of allotment may be cancelled by order of The Chief Justice on the ground of submission of false information in the application, misconduct, violation of Rules or on any other similar ground.

Pursuant to cancellation of allotment of the Staff Quarter under this Rule:

(a) The allottee/occupant shall vacate the Quarter within 30 days from the date of cancellation of the allotment.

(b) The allottee shall forfeit his right to allotment of the Quarter for a period of three years.

9. Provision for overstay:

(i) The member of the Officer/Staff who has been allotted the Official Quarter shall vacate the Quarter within one month of his retirement from the service or from the date he ceases to be the servant/employee of the High Court for any reason.

(ii) The Registrar (Establishment) may, with the permission of The Committee and The Chief Justice, permit such former Officer/staff to continue to occupy the Quarter allotted to him for not more than further two months, on payment of market rent.

(iii) In case of death, the dependants of a deceased employee may on such application being made be allowed to retain the Quarter for a period of three months.

(iv) In case such former Officer/staff or his dependents continues to occupy the Quarter after the expiry of the stipulated time, without permission of the Court, he will be liable to pay rent for such occupation at penal rate.

Note: The market rent or the penal rent for each category of the Quarter will be "Market Rent" or "Penal Rent" determined by the Government of Jharkhand from time to time.

10. Temporary Allotment:

An Officer/Staff may apply for temporary allotment of a vacant Quarter for purposes of marriage or a family function in his family. Such application shall be addressed to the Registrar (Establishment) and the purpose should be clearly mentioned.

The Registrar (Establishment) will place such application before The Chief Justice for consideration.

However, in case of temporary allotment, which shall be for a period not exceeding 15(Fifteen) Days, it is necessary that the allottee will ensure that the fittings of the Quarter are not damaged and proper cleanliness is ensured. The payment of Electric Charges for the period of temporary allotment as per meter reading (if any) shall be made by the allottee. The allottee will be liable for any damage due to negligence in this regard. Further the allottee shall pay daily rent of the Quarter at the rate of 20% of applicable monthly HRT (House Rent Tax)& MT (Municipal Tax) of that type of quarter prevalent at the relevant time.

11. Review:

The Chief Justice may, not withstanding the provisions contained in these rules, review any allotment order made under these rules either suo moto or at the instance of any aggrieved Officer or Staff.

12. Relaxation:

The Chief Justice may from time to time with respect to any individual case or for any class or group of cases, for sufficient reasons relax any condition or any requirement as is or may be prescribed in or under these rules.

The Court has been pleased to allot the Quarter No. _________________________________________________________________________ in favour of Sri/Smt./Ms. ____________________________________.

The aforesaid allotment will apply to the following terms and conditions: -

1. The allotment of Quarter will remain valid till further orders or till date the allottees remain in the service of the High Court.

2. The allottees are supposed to keep the Quarter in good condition including the fittings therein and cannot make any addition or alteration without prior permission of the Court.

3. The Quarter is allotted on payment of the rent and usual charges as admissible. 4. The allottees are not supposed to allow any other outsider to live in the Quarter. 5. The allottees are directed to submit the acceptance of Allotment in Writing within fifteen days and actually occupy the Quarter within fifteen days of acceptance.After expiry of the said period, the allottee shall be deemed to have occupied the Quarter and cease to receive House Rent Allowance and shall be charged rent at the rate applicable.

6. The allottees who are in occupation of quarters at present will submit his/her vacation report also with the occupation report within fifteen days.
