Notification No.- 37/2023 – State Tax

S.O. No. 48, Dated 12th December, 2023--In exercise of the powers conferred by section 148 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017) (hereinafter referred to as the said Act), the Government of Jharkhand , on the recommendations of the Council, hereby notifies the electronic commerce operator who is required to collect tax at source under section 52 as the class of persons who shall follow the following special procedure in respect of supply of goods made through it by the persons exempted from obtaining registration (hereinafter referred to as the said person) in accordance with the notification issued under sub-section (2) of section 23 vide notification number 34/2023- State Tax, dated the 12th December, 2023, published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 46, dated the 12th December, 2023, namely: —

(i) the electronic commerce operator shall allow the supply of goods through it by the said person only if enrolment number has been allotted on the common portal to the said person;

(iv) the electronic commerce operator shall furnish the details of supplies of goods made through it by the said person in the statement in FORM GSTR-8 electronically on the common portal.

2. Where multiple electronic commerce operators are involved in a single supply of goods through electronic commerce operator platform, "the electronic commerce operator" shall mean the electronic commerce operator who finally releases the payment to the said person for the said supply made by the said person through him.

एस. ओ. सं. 48, (cid:465)दनांक 12 (cid:465)दस(cid:224)बर, 2023 --झारख(cid:214)ड सरकार, झारख(cid:214)ड माल और सेवा कर अ(cid:876)ध(cid:467)नयम, 2017 (2017 का 12) (िजसे इसम(cid:581) इसके प(cid:230)चात ् उ(cid:200)त अ(cid:876)ध(cid:467)नयम कहा गया है) क(cid:551) धारा 148 (cid:622)वारा (cid:292)द(cid:215)त शि(cid:200)तय(cid:585) का (cid:292)योग करते हु ए, प(cid:464)रषद क(cid:551) (cid:871)सफा(cid:464)रश(cid:585) पर, इलै(cid:200)(cid:282)ो(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक को अ(cid:876)धसू(cid:876)चत करती है िजससे ऐसे (cid:229)यि(cid:200)तय(cid:585) के वग(cid:91) के (cid:509)प म(cid:581) धारा 52 के अधीन (cid:304)ोत पर कर का सं(cid:274)हण (cid:873)कया जाना अपे(cid:879)(cid:162)त है जो झारख(cid:214)ड के राजप(cid:287), असाधारण, म(cid:581) एस. ओ. सं . 46, तार(cid:547)ख 12 (cid:465)दस(cid:224)बर 2023 म(cid:581) (cid:292)का(cid:871)शत अ(cid:876)धसूचना सं(cid:201)या 34/2023- रा(cid:207)य कर, तार(cid:547)ख 12 (cid:465)दस(cid:224)बर 2023 (cid:622)वारा धारा 23 क(cid:551) उपधारा (2) के अधीन जार(cid:547) अ(cid:876)धसूचना के अनुसरण म(cid:581) रिज(cid:232)(cid:282)(cid:547)करण (cid:292)ा(cid:220)त करने से छू ट (cid:292)ा(cid:220)त (cid:229)यि(cid:200)तय(cid:585) (िजसे इसम(cid:581) इसके प(cid:230)चात ् उ(cid:200)त (cid:229)यि(cid:200)त कहा गया है) (cid:622)वारा इसके मा(cid:218)यम से क(cid:551) गई माल क(cid:551) पू(cid:467)त(cid:91) के संबंध म(cid:581) (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत (cid:874)वशेष (cid:292)(cid:873)(cid:272)या का अनुसरण कर(cid:581)गे, अथा(cid:91)तः- (i) इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक, उ(cid:200)त (cid:229)यि(cid:200)त (cid:622)वारा इसके मा(cid:218)यम से क(cid:551) गई माल(cid:585) क(cid:551) पू(cid:467)त(cid:91) को के वल तभी अनु(cid:163)ात करेगा, य(cid:465)द उ(cid:200)त (cid:229)यि(cid:200)त को सामा(cid:219)य पोट(cid:91)ल पर नामाकं न सं(cid:201)या का आबंटन (cid:873)कया गया है;

(ii) इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक उ(cid:200)त (cid:229)यि(cid:200)त (cid:622)वारा इसके मा(cid:218)यम से क(cid:551) गई माल(cid:585) क(cid:551) (cid:873)कसी अंतर-राि(cid:207)यक पू(cid:467)त(cid:91) को अनु(cid:163)ात नह(cid:547)ं करेगा ;

(iii) इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक उ(cid:200)त (cid:229)यि(cid:200)त (cid:622)वारा इसके मा(cid:218)यम से क(cid:551) गई माल(cid:585) क(cid:551) पू(cid:467)त(cid:91) के संबंध म(cid:581) धारा 52 क(cid:551) उपधारा (1)के अधीन (cid:304)ोत पर कर का सं(cid:274)हण नह(cid:547)ं करेगा ; और (iv) इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक उ(cid:200)त (cid:229)यि(cid:200)त (cid:622)वारा इसके मा(cid:218)यम से क(cid:551) गई माल(cid:585) क(cid:551) पू(cid:467)त(cid:91) के (cid:222)यौरे सामा(cid:219)य पोट(cid:91)ल पर इलै(cid:200)(cid:282)ा(cid:467)नक (cid:509)प से (cid:292)(cid:509)प जीएसट(cid:547) आर-8 म(cid:581) (cid:874)ववरण के (cid:509)प म(cid:581) (cid:292)(cid:232)तुत करेगा ।

2. जहां इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक (cid:220)लेटफाम(cid:91) के मा(cid:218)यम से माल(cid:585) क(cid:551) एकल पू(cid:467)त(cid:91) म(cid:581) बहु इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक अंत(cid:91)व(cid:871)ल(cid:91)त है, "इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक" से ऐसा इलै(cid:200)(cid:282)ा(cid:467)नक वा(cid:872)ण(cid:207)य (cid:292)चालक अ(cid:871)भ(cid:292)ेत होगा जो अं(cid:467)तम (cid:509)प से उ(cid:200)त (cid:229)यि(cid:200)त को उसके मा(cid:218)यम से उ(cid:200)त (cid:229)यि(cid:200)त (cid:622)वारा क(cid:551) गई उ(cid:200)त पू(cid:467)त(cid:91) के (cid:871)लए संदाय जार(cid:547) करेगा ।
