सं(cid:201)या- 576/3/ईवीएम/2024/एसडीआर/ख(cid:214)ड-। :- यतः, लोक (cid:292)(cid:467)त(cid:467)न(cid:876)ध(cid:215)व अ(cid:876)ध(cid:467)नयम, 1951 क(cid:551) धारा 61क म(cid:581) यह उपबंध (cid:873)कया गया है (cid:873)क ऐसे (cid:467)नवा(cid:91)चन (cid:162)े(cid:287) या (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) म(cid:581) वो(cid:465)टंग मशीन(cid:585) (cid:622)वारा मतदान और मत(cid:585) के अ(cid:871)भलेखन का यथा(cid:874)व(cid:465)हत ऐसा तर(cid:547)का अपनाया जाए, जैसा (cid:873)क भारत (cid:467)नवा(cid:91)चन आयोग (cid:622)वारा (cid:292)(cid:215)येक मामले क(cid:551) प(cid:464)रि(cid:232)थ(cid:467)तय(cid:585) को (cid:218)यान म(cid:581) रखते हु ए, (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट (cid:873)कया जाए;

2. यतः, (cid:467)नवा(cid:91)चन(cid:585) का संचालन (cid:467)नयम, 1961 के (cid:467)नयम 49क के पर(cid:219)तुक के अनुसार भारत (cid:467)नवा(cid:91)चन आयोग (cid:622)वारा यथा-अनुमो(cid:465)दत ऐसे (cid:875)डजाइन वाला (cid:284)ॉप बॉ(cid:200)स यु(cid:200)त एक (cid:874)(cid:292)ंटर, ऐसे (cid:467)नवा(cid:91)चन (cid:162)े(cid:287) या (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) या उसके भाग(cid:585) म(cid:581) मत के पेपर (cid:282)ेल के मु(cid:289)ण के (cid:871)लए मतदान मशीन के साथ भी जोड़ा जाए जैसा (cid:873)क भारत (cid:467)नवा(cid:91)चन आयोग (cid:622)वारा (cid:467)नदेश (cid:465)दया जाए;

3. यतः, (cid:467)नवा(cid:91)चन आयोग ने अपने (cid:292)ेस नोट सं. ईसीआई/पीएन/23/2024 और ईसीआई/पीएन/24/2024 (cid:465)दनांक 16 माच(cid:91), 2024 के ज(cid:464)रए घो(cid:874)षत (cid:873)कए लोक सभा के सभी संसद(cid:547)य (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585), आं(cid:290) (cid:292)देश, अ(cid:509)णाचल (cid:292)देश, ओ(cid:875)डशा और (cid:871)सि(cid:200)कम क(cid:551) सभी (cid:874)वधान सभा (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) के वत(cid:91)मान साधारण (cid:467)नवा(cid:91)चन, 2024 और 13 रा(cid:207)य(cid:585) म(cid:581) 26 (cid:874)वधान सभा (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) (अनुल(cid:202)नक-1 के अनुसार) के वत(cid:91)मान उप-(cid:467)नवा(cid:91)चन(cid:585) म(cid:581) सभी प(cid:464)रि(cid:232)थ(cid:467)तय(cid:585) पर (cid:874)वचार (cid:873)कया है और इस बात का समाधान हो गया है (cid:873)क सभी संसद(cid:547)य (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) और आं(cid:290) (cid:292)देश, अ(cid:509)णाचल (cid:292)देश, ओ(cid:875)डशा और (cid:871)सि(cid:200)कम के सभी (cid:874)वधान सभा (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) और 13 रा(cid:207)य(cid:585) के 26 (cid:874)वधान सभा (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) (अनुल(cid:202)नक-1 के अनुसार) म(cid:581) मतदान कराने के (cid:871)लए पया(cid:91)(cid:220)त सं(cid:201)या म(cid:581) इले(cid:200)(cid:282)ॉ(cid:467)नक वो(cid:465)टंग मशीन (ईवीएम) और पेपर (cid:282)ेल [मतदाता स(cid:215)यापनीय पेपर ऑ(cid:875)डट (cid:282)ेल मशीन (वीवीपैट)] मु(cid:465)(cid:289)त करने के (cid:871)लए (cid:874)(cid:292)ंटर उपल(cid:222)ध ह(cid:583)। मतदान का(cid:871)म(cid:91)क ईवीएम और वीवीपैट (cid:874)(cid:292)ंटर(cid:585) को कु शलतापूव(cid:91)क संभालने म(cid:581) अ(cid:205)छ(cid:548) तरह से (cid:292)(cid:871)श(cid:879)(cid:162)त ह(cid:583) और मतदाता भी ईवीएम और वीवीपैट (cid:874)(cid:292)ंटर(cid:585) के (cid:292)चालन से पूण(cid:91) (cid:510)प से अवगत ह(cid:583)।

4. अब, इस(cid:871)लए, भारत (cid:467)नवा(cid:91)चन आयोग, लोक (cid:292)(cid:467)त(cid:467)न(cid:876)ध(cid:215)व अ(cid:876)ध(cid:467)नयम, 1951 क(cid:551) उ(cid:200)त धारा 61क तथा (cid:467)नवा(cid:91)चन(cid:585) का संचालन (cid:467)नयम, 1961 के (cid:467)नयम 49क के तहत अपनी शि(cid:200)तय(cid:585) का (cid:292)योग करते हु ए, एत(cid:622)(cid:622)वारा, (cid:467)नवा(cid:91)चन आयोग (cid:622)वारा (cid:465)दनांक 16 माच(cid:91), 2024 को घो(cid:874)षत काय(cid:91)(cid:272)म के अनुसार, वत(cid:91)मान साधारण (cid:467)नवा(cid:91)चन, 2024 म(cid:581) लोक सभा के सभी संसद(cid:547)य (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585), आं(cid:290) (cid:292)देश, अ(cid:509)णाचल (cid:292)देश, ओ(cid:875)डशा और (cid:871)सि(cid:200)कम क(cid:551) (cid:874)वधान सभाओं के सभी (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) और वत(cid:91)मान उप-(cid:467)नवा(cid:91)चन म(cid:581) 13 रा(cid:207)य(cid:585) म(cid:581) 26 (cid:874)वधान सभा (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) (अनुल(cid:202)नक-1 के अनुसार) को ऐसे (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) के (cid:510)प म(cid:581) (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट करता है, िजनम(cid:581) (cid:467)नवा(cid:91)चन(cid:585) का संचालन (cid:467)नयम, 1961 और इस (cid:874)वषय पर (cid:467)नवा(cid:91)चन आयोग (cid:622)वारा समय-समय पर जार(cid:547) (cid:873)कए गए अनुपूरक अनुदेश(cid:585) के अंतग(cid:91)त (cid:874)व(cid:465)हत तर(cid:547)के से इले(cid:200)(cid:282)ॉ(cid:467)नक वो(cid:465)टंग मशीन(cid:585) तथा वीवीपैट (cid:874)(cid:292)ंटर(cid:585) के मा(cid:218)यम से मत डाले और अ(cid:871)भ(cid:871)ल(cid:872)खत (cid:873)कए जाएंगे।

5. (cid:467)नवा(cid:91)चन आयोग, एत(cid:622)(cid:622)वारा भारत इले(cid:200)(cid:282)ॉ(cid:467)न(cid:200)स (cid:871)ल(cid:871)मटेड, बंगलोर तथा इले(cid:200)(cid:282)ॉ(cid:467)न(cid:200)स काप(cid:574)रेशन ऑफ इि(cid:214)डया (cid:871)ल(cid:871)मटेड, हैदराबाद (cid:622)वारा यथा-(cid:874)वक(cid:871)सत इले(cid:200)(cid:282)ॉ(cid:467)नक वो(cid:465)टंग मशीन(cid:585) और वीवीपैट (cid:874)(cid:292)ंटर(cid:585), िज(cid:219)ह(cid:581) सभी (cid:467)नवा(cid:91)चन (cid:162)े(cid:287)(cid:585) म(cid:581) मत डालने और अ(cid:871)भ(cid:871)ल(cid:872)खत करने के (cid:871)लए उ(cid:200)त मशीन(cid:585) से जोड़ा जाएगा, के (cid:875)डजाइन को भी अनुमो(cid:465)दत करता है।

No.576/3/EVM/2024/SDR-Vol.-I :- Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify;

2. Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the Election Commission of India may direct;

3. Whereas, the Election Commission has considered the circumstances in all the Parliamentary Constituencies of Lok Sabha, all the Assembly Constituencies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim at the current general elections, 2024 and in 26 Assembly Constituencies (as per Annexure-1) in 13 States at the current bye-elections, announced vide the Election Commission's Press Notes No. ECI/PN/23/2024 & ECI/PN/24/2024 both dated 16th, March 2024, and is satisfied that sufficient number of Electronic Voting Machines (EVMs) and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the poll in all the Parliamentary Constituencies and all the Assembly Constituencies of Andhra Pradesh, Arunachal Pradesh, Odisha and Sikkim and in 26 Assembly Constituencies (as per Annexure-1) of 13 States. The polling personnel are well trained in efficient handling of EVMs and 'VVPAT Printers' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers;

Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961, hereby specifies all the Parliamentary Constituencies of the Lok Sabha, all the Assembly Constituencies of the legislative assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim at the current General Elections, 2024 and 26 Assembly Constituencies (as per Annexure-1) in 13 states at the current bye- election, as per the schedule announced by the Election Commission on 16th March, 2024, as the constituencies in which the votes, shall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed, under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Election Commission from time to time on the subject.

5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of votes in all the Constituencies.
