Notification No.- 03/2024 – State Tax(Rate)

S.O. No. 10, Dated 14th August, 2024 :-In exercise of the powers conferred by sub-section (1) of section 11 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the Government of Jharkhand, being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council, hereby makes the following further amendments in the notification of the Government of Jharkhand, Commercial Taxes Department, No. 2/2017-State Tax (Rate), dated the 29th June, 2017, published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 32, dated the 29th June, 2017, namely:-

In the said notification, after the Schedule, in the Explanation, in clause (ii), after the entries relating thereto, the following proviso shall be inserted, namely:-

"Provided that notwithstanding anything contained in the Legal Metrology Act, 2009 (1 of 2010) and the rules made thereunder, as amended from time to time, the supply of agricultural farm produce in package(s) of commodities containing quantity of more than 25 kilogram or 25 litre shall not be considered as a supply made within the scope of expression 'pre-packaged and labelled'.". 2. No. 32, dated the 29th June, 2017, and was last amended vide notification No. 18/2023- State Tax (Rate) dated the 5th March, 2024, published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 65, dated the 5th March, 2024.

एस. ओ. सं. 10, (cid:465)दनांक 14 अग(cid:232)त, 2024 --झारख(cid:214)ड माल और सेवा कर अ(cid:876)ध(cid:467)नयम, 2017 (2017 का 12) क(cid:551) धारा 11 क(cid:551) उप धारा (1) (cid:622)वारा (cid:292)द(cid:215)त शि(cid:200)तय(cid:585) का (cid:292)योग करते हु ए, झारख(cid:214)ड सरकार, इस बात से संतु(cid:231)ट होते हु ए (cid:873)क ऐसा करना जन(cid:465)हत म(cid:581) आव(cid:230)यक है, प(cid:464)रषद क(cid:551) (cid:871)सफा(cid:464)रश(cid:585) के आधार पर, एतद(cid:622)वारा, झारख(cid:214)ड सरकार, वा(cid:872)ण(cid:207)य-कर (cid:874)वभाग क(cid:551) अ(cid:876)धसूचना सं(cid:201)या 2/2017- रा(cid:207)य कर (दर), (cid:465)दनांक 29 जून, 2017, िजसे एस. ओ. सं. 32, (cid:465)दनांक 29 जून, 2017 के तहत झारख(cid:214)ड के राजप(cid:287), असाधारण, म(cid:581) (cid:292)का(cid:871)शत (cid:873)कया गया था, म(cid:581) और आगे भी (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत संशोधन करती है, यथा : -

उ(cid:200)त अ(cid:876)धसूचना म(cid:581), अनुसूची के प(cid:230)चात, (cid:232)प(cid:231)ट(cid:547)करण म(cid:581), खंड (ii) म(cid:581), उससे संबं(cid:876)धत (cid:292)(cid:874)वि(cid:231)टय(cid:585) के प(cid:230)चात, (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत परंतुक को अंत:(cid:232)था(cid:874)पत (cid:873)कया जाएगा, यथा :-

"बशत(cid:566) (cid:873)क (cid:874)व(cid:876)धक माप(cid:874)व(cid:163)ान अ(cid:876)ध(cid:467)नयम, 2009 (2010 का 1) और इसके अधीन बनाये गये (cid:467)नयम(cid:585), समय-समय पर यथासंशो(cid:876)धत, म(cid:581) (cid:873)कसी भी बात के बावजूद, 25 (cid:873)कलो(cid:274)ाम या 25 ल(cid:547)टर से अ(cid:876)धक मा(cid:287)ा वाले व(cid:232)तुओं के पैके ज (पैके ज(cid:585)) म(cid:581) कृ (cid:874)ष फाम(cid:91) उपज क(cid:551) आपू(cid:467)त(cid:91) को '(cid:292)ी- पेके (cid:207)ड और लेबल' वा(cid:200)यांश के भीतर क(cid:551) गई आपू(cid:467)त(cid:91) के (cid:510)प म(cid:581) नह(cid:547)ं माना जायेगा।" ।

2 यह अ(cid:876)धसूचना (cid:465)दनांक 15 जुलाई, 2024 से लागू मानी जाएगी ।
